Op 30 juni 2007 is te Brussel een wijziging van het onderhavige Verdrag tot stand gekomen. De tekst van deze wijziging luidt als volgt:

Le Conseil de coopération douanière,

Reconnaissant l’importance sans cesse croissante du rôle des Unions douanières ou économiques dans les affaires internationales et, notamment, dans les questions relatives aux échanges,

Constatant que certaines Unions douanières ou économiques participent activement aux travaux de l’Organisation,

Prenant acte du souhait légitime exprimé par une Union douanière ou économique de formaliser cette participation en devenant Membre de l’Organisation, et de la possibilité que d’autres Unions pourraient souhaiter en faire de même à l’avenir,

Tenant compte du fait que, pour qu’une Union douanière ou économique puisse devenir Membre, il convient de procéder à l’amendement de la Convention portant création d’un Conseil de coopération douanière,

Compte tenu également des dispositions de l’Article XX de la Convention portant création d’un Conseil de coopération douanière, relatives à la procédure d’amendement de ladite Convention,

Recommande à toutes les Parties contractantes à la Convention portant création d’un Conseil de coopération douanière, les amendements ci-après à apporter à ladite Convention:

Amender comme suit l’Article VII a) de la Convention:

Article VIII

• a) A l’exception des Unions douanières ou économiques Membres, pour lesquelles des dispositions spécifiques sont prises par le Conseil, chaque Membre du Conseil dispose d’une voix; toutefois, aucun Membre ne peut participer au vote sur les questions relatives à l’interprétation et à l’application des conventions en vigueur, visées à l’Article III d) ci-dessus, qui ne lui sont pas applicables, ni sur les amendements relatifs à ces conventions.

Insérer un nouvel alinéa d) dans l’Article XVIII de la Convention, libellé comme suit:

Article XVIII

• a) Le Gouvernement de tout Etat non signataire de la présente Convention pourra y adhérer à partir du 1^er avril 1951.

• b) Les instruments d’adhésion seront déposés auprès du Ministère des Affaires étrangères de Belgique qui notifiera ce dépôt à tous les Gouvernements signataires et adhérents, ainsi qu’au Secrétaire général.

• c) La présente Convention entrera en vigueur à l’égard de tout Gouvernement adhérent à la date du dépôt de son instrument d’adhésion mais pas avant son entrée en vigueur telle qu’elle est fixée à l’Article XVII a).

• d) Toute Union douanière ou économique peut, conformément aux dispositions des paragraphes a), b) et c) ci-dessus, devenir Partie contractante à la présente Convention. Toute demande de devenir Partie contractante émanant d’une Union douanière ou économique devra d’abord être soumise au Conseil pour approbation. Aux fins de la présente Convention, on entend par «Union douanière ou économique» une Union constituée et composée par des Etats ayant compétence pour adopter sa propre réglementation qui est obligatoire pour ces Etats dans les matières couvertes par la présente Convention et pour décider, selon ses procédures internes, d’adhérer à la présente Convention.

DEMANDE aux Parties contractantes à la Convention portant création d’un Conseil de coopération douanière qui acceptent la présente Recommandation de notifier par écrit leur acceptation au Ministère des Affaires étrangères de Belgique.

Recommendation of the Customs Co-operation Council¹⁾ concerning the amendment of the Convention establishing a Customs Co-operation Council

The Customs Co-operation Council,

Recognizing the increasingly significant role played by Customs or Economic Unions in world affairs, and particularly in matters pertaining to trade,

Noting that certain Customs or Economic Unions are active participants in the work of the Organization,

Acknowledging the legitimate desire of one Customs or Economic Union to place this participation on a formal footing by becoming a Member of the Organization, and the possibility that others may wish to do so in the future,

Bearing in mind that in order for a Customs or Economic Union to become a Member, an amendment must be made to the Convention establishing a Customs Co-operation Council,

Bearing in mind also the provisions of Article XX of the Convention establishing a Customs Co-operation Council, concerning the amendment of that Convention,

Recommends to all Contracting Parties to the Convention establishing a Customs Co-operation Council, the following amendments to that Convention:

Amend Article VIII(a) of the Convention to read as follows:

Article VIII

• a) With the exception of Customs or Economic Union Members, for which the Council shall make specific provisions, each Member of the Council shall have one vote except that a Member shall not have a vote on any question relating to the interpretation, application or amendment of any of the Conventions referred to in Article III(d) which is in force and which does not apply to that Member.

Insert a new sub-paragraph (d) in Article XVIII of the Convention, which will then read as follows:

Article XVIII

• a) The Government of any State which is not a signatory to the present Convention may accede thereto as from 1 April 1951.

• b) Instruments of accession shall be deposited with the Belgian Ministry of Foreign Affairs, which shall notify all signatory and acceding Governments and the Secretary General of each such deposit.

• c) The present Convention shall come into force for any acceding Government on the deposit of its instrument of accession, but not before it comes into force in accordance with paragraph (a) of Article XVII.

• d) Any Customs or Economic Union may become, in accordance with paragraphs (a), (b) and (c) above, a Contracting Party to this Convention. Any request from a Customs or Economic Union to become a Contracting Party shall first be submitted to the Council for approval. For the purposes of this Convention, “Customs or Economic Union” means a Union constituted by, and composed of, States which has competence to adopt its own regulations that are binding on those States in respect of matters governed by this Convention, and has competence to decide, in accordance with its internal procedures, to accede to this Convention.

REQUESTS Contracting Parties to the Convention establishing a Customs Co-operation Council which accept this Recommendation to notify the Belgian Ministry of Foreign Affairs, in writing, of their acceptance.

De Internationale Douaneraad,

Erkennende het toenemende belang van de rol die douane- of economische unies in internationale aangelegenheden vervullen, in het bijzonder op het gebied van met de handel verband houdende kwesties,

Gelet op het feit dat sommige douane- of economische unies actief aan de werkzaamheden van de Organisatie deelnemen,

Bevestigend de gerechtvaardigde wens van een douane- of economische unie deze deelname een officieel karakter te geven door Lid van de Organisatie te worden, alsmede de mogelijkheid dat andere unies dit in de toekomst eveneens wensen te doen,

Indachtig het feit dat voordat een douane- of economische unie Lid kan worden, het Verdrag houdende instelling van een Internationale Douaneraad moet worden gewijzigd,

Voorts indachtig de bepalingen van artikel XX van het Verdrag houdende instelling van een Internationale Douaneraad, inzake de wijziging van dat Verdrag,

Beveelt alle Partijen bij het Verdrag houdende instelling van een Internationale Douaneraad de volgende wijzigingen van dat Verdrag aan:

Wijzig artikel VIII, lid a, van het Verdrag als volgt:

Artikel VIII

• a. Met uitzondering van Leden die een douane- of economische unie zijn, waarvoor de Raad specifieke bepalingen vaststelt, heeft elk Lid van de Raad een stem; geen enkel Lid kan echter deelnemen aan een stemming over aangelegenheden welke betrekking hebben op de uitlegging, toepassing of wijziging van de verdragen bedoeld in artikel III, lid d, welke in werking zijn getreden doch op hem niet van toepassing zijn.

Voeg aan artikel XVIII van het Verdrag een nieuw lid d toe; het artikel luidt dan voortaan als volgt:

Artikel XVIII

• a. De Regering van iedere Staat, die dit Verdrag niet heeft ondertekend, kan tot dit Verdrag toetreden na 1 april 1951.

• b. De akten van toetreding zullen worden nedergelegd bij het Ministerie van Buitenlandse Zaken van België, dat van deze nederlegging zal kennis geven aan alle Regeringen, die dit Verdrag hebben ondertekend of tot dit Verdrag zijn toegetreden, alsmede aan de Secretaris-Generaal.

• c. Dit Verdrag treedt ten aanzien van elke toetredende Regering in werking op de dag van nederlegging van haar akte van toetreding, doch niet voordat het ingevolge artikel XVII, lid a, van kracht wordt.

• d. Elke douane- of economische unie kan, overeenkomstig de leden a, b en c van dit artikel, Partij bij dit Verdrag worden. Elk verzoek van een douane- of economische unie om Verdragsluitende Partij te worden, wordt eerst aan de Raad ter goedkeuring voorgelegd. Voor de toepassing van dit Verdrag wordt onder een „douane- of economische unie” verstaan een door Staten opgerichte en uit Staten bestaande unie die bevoegd is tot het vaststellen van haar eigen regelgeving die voor deze Staten bindend is ter zake van aangelegenheden waarop dit Verdrag van toepassing is en die bevoegd is om overeenkomstig haar interne procedures te besluiten tot dit Verdrag toe te treden.

VERZOEKT de Partijen bij het Verdrag houdende instelling van een Internationale Douaneraad die deze Aanbeveling aanvaarden, het Belgische Ministerie van Buitenlandse Zaken schriftelijk van hun aanvaarding kennis te geven.

De wijziging van 30 juni 2007 behoeft ingevolge artikel 91 van de Grondwet de goedkeuring van de Staten-Generaal, alvorens het Koninkrijk aan de wijziging kan worden gebonden.

De bepalingen van de wijzigingen van het Verdrag zullen ingevolge artikel XX, onderdeel c, van het Verdrag in werking treden drie maanden nadat de kennisgevingen van goedkeuring van alle Verdragsluitende Partijen door het Ministerie van Buitenlandse Zaken van België zijn ontvangen.
