In nota’s van 16 juni 2016 hebben het Koninkrijk der Nederlanden en de Zwitserse Bondsstaat een interpretatieve verklaring inzake artikel 1 van het Tractaat vastgelegd. De Engelse tekst van deze nota’s luidt als volgt:

The Embassy of the Kingdom of the Netherlands presents its compliments to the Federal Department of Foreign Affairs of the Swiss Confederation and has the honor to refer to the Treaty of friendship, establishment and commerce of 19 August 1875 between the Kingdom of the Netherlands and the Swiss Confederation and to communicate the following:

The Kingdom of the Netherlands interprets the provisions of Article I, paragraph 1 of this Treaty as being without prejudice to the relevant national legislation relating to foreigners with respect to the admission to stay on the territory, the right to work in any form of (self)employment including the requirement of work permits, and the establishment of businesses.

The Embassy of the Kingdom of the Netherlands kindly invites the Department to confirm whether the Swiss Confederation shares the above-mentioned interpretation and avails itself of this opportunity to renew to the Federal Department of Foreign Affairs the assurances of its highest consideration.

The Federal Department of Foreign Affairs presents its compliments to the Embassy of the Kingdom of the Netherlands and, referring to the Embassy’s note of 16 June 2016 regarding the Treaty of friendship, establishment and commerce of 19 August 1875 between the Swiss Confederation and the Kingdom of the Netherlands, has the honor to confirm herewith that the Swiss Confederation shares the interpretation of the Kingdom of the Netherlands, as stated in the said note, that fully corresponds with the constant practice and jurisprudence in Switzerland.

The Federal Department of Foreign Affairs avails itself of this opportunity to renew to the Embassy of the Kingdom of the Netherlands the assurances of its highest consideration.
