Protocol No. 15 amending the Convention for the Protection of Human Rights and Fundamental Freedoms

Preamble

The member States of the Council of Europe and the other High Contracting Parties to the Convention for the Protection of Human Rights and Fundamental Freedoms, signed at Rome on 4 November 1950 (hereinafter referred to as “the Convention”), signatory hereto,

Having regard to the declaration adopted at the High Level Conference on the Future of the European Court of Human Rights, held in Brighton on 19 and 20 April 2012, as well as the declarations adopted at the conferences held in Interlaken on 18 and 19 February 2010 and İzmir on 26 and 27 April 2011;

Having regard to Opinion No. 283 (2013) adopted by the Parliamentary Assembly of the Council of Europe on 26 April 2013;

Considering the need to ensure that the European Court of Human Rights (hereinafter referred to as “the Court”) can continue to play its pre-eminent role in protecting human rights in Europe,

Have agreed as follows:

Article 1

At the end of the preamble to the Convention, a new recital shall be added, which shall read as follows:

“Affirming that the High Contracting Parties, in accordance with the principle of subsidiarity, have the primary responsibility to secure the rights and freedoms defined in this Convention and the Protocols thereto, and that in doing so they enjoy a margin of appreciation, subject to the supervisory jurisdiction of the European Court of Human Rights established by this Convention,”

Article 2

1. In Article 21 of the Convention, a new paragraph 2 shall be inserted, which shall read as follows:

“Candidates shall be less than 65 years of age at the date by which the list of three candidates has been requested by the Parliamentary Assembly, further to Article 22.”

2. Paragraphs 2 and 3 of Article 21 of the Convention shall become paragraphs 3 and 4 of Article 21 respectively.

3. Paragraph 2 of Article 23 of the Convention shall be deleted. Paragraphs 3 and 4 of Article 23 shall become paragraphs 2 and 3 of Article 23 respectively.

Article 3

In Article 30 of the Convention, the words “unless one of the parties to the case objects” shall be deleted.

Article 4

In Article 35, paragraph 1 of the Convention, the words “within a period of six months” shall be replaced by the words “within a period of four months”.

Article 5

In Article 35, paragraph 3, sub-paragraph b of the Convention, the words “and provided that no case may be rejected on this ground which has not been duly considered by a domestic tribunal” shall be deleted.

FINAL AND TRANSITIONAL PROVISIONS

Article 6
  • 1. This Protocol shall be open for signature by the High Contracting Parties to the Convention, which may express their consent to be bound by:

    • a) signature without reservation as to ratification, acceptance or approval; or

    • b) signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval.

  • 2. The instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

Article 7

This Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date on which all High Contracting Parties to the Convention have expressed their consent to be bound by the Protocol, in accordance with the provisions of Article 6.

Article 8
  • 1. The amendments introduced by Article 2 of this Protocol shall apply only to candidates on lists submitted to the Parliamentary Assembly by the High Contracting Parties under Article 22 of the Convention after the entry into force of this Protocol.

  • 2. The amendment introduced by Article 3 of this Protocol shall not apply to any pending case in which one of the parties has objected, prior to the date of entry into force of this Protocol, to a proposal by a Chamber of the Court to relinquish jurisdiction in favour of the Grand Chamber.

  • 3. Article 4 of this Protocol shall enter into force following the expiration of a period of six months after the date of entry into force of this Protocol. Article 4 of this Protocol shall not apply to applications in respect of which the final decision within the meaning of Article 35, paragraph 1 of the Convention was taken prior to the date of entry into force of Article 4 of this Protocol.

  • 4. All other provisions of this Protocol shall apply from its date of entry into force, in accordance with the provisions of Article 7.

Article 9

The Secretary General of the Council of Europe shall notify the member States of the Council of Europe and the other High Contracting Parties to the Convention of:

  • a) any signature;

  • b) the deposit of any instrument of ratification, acceptance or approval;

  • c) the date of entry into force of this Protocol in accordance with Article 7; and

  • d) any other act, notification or communication relating to this Protocol.

IN WITNESS WHEREOF, the undersigned, being duly authorised thereto, have signed this Protocol.

DONE at Strasbourg, this 24th day of June 2013, in English and in French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each member State of the Council of Europe and to the other High Contracting Parties to the Convention.



Protocole n° 15 portant amendement à la Convention de sauvegarde des Droits de l’Homme et des Libertés fondamentales

Préambule

Les Etats membres du Conseil de l’Europe et les autres Hautes Parties contractantes à la Convention de sauvegarde des Droits de l’Homme et des Libertés fondamentales, signée à Rome le 4 novembre 1950 (ci-après dénommée « la Convention »), signataires du présent Protocole,

Vu la Déclaration adoptée lors de la Conférence de haut niveau sur l’avenir de la Cour européenne des Droits de l’Homme, tenue à Brighton les 19 et 20 avril 2012, ainsi que les Déclarations adoptées lors des Conférences tenues à Interlaken les 18 et 19 février 2010 et à İzmir les 26 et 27 avril 2011 ;

Vu l’Avis n° 283 (2013) adopté par l’Assemblée parlementaire du Conseil de l’Europe le 26 avril 2013 ;

Considérant qu’il est nécessaire de veiller à ce que la Cour européenne des Droits de l’Homme (ci-après dénommée « la Cour ») continue de jouer son rôle prééminent dans la protection des droits de l’homme en Europe,

Sont convenus de ce qui suit :

Article 1

A la fin du préambule de la Convention, un nouveau considérant est ajouté et se lit comme suit :

« Affirmant qu’il incombe au premier chef aux Hautes Parties contractantes, conformément au principe de subsidiarité, de garantir le respect des droits et libertés définis dans la présente Convention et ses protocoles, et que, ce faisant, elles jouissent d’une marge d’appréciation, sous le contrôle de la Cour européenne des Droits de l’Homme instituée par la présente Convention, »

Article 2

1. A l’article 21 de la Convention, un nouveau paragraphe 2 est inséré et se lit comme suit :

« Les candidats doivent être âgés de moins de 65 ans à la date à laquelle la liste de trois candidats est attendue par l’Assemblée parlementaire, en vertu de l’article 22. »

2. Les paragraphes 2 et 3 de l’article 21 de la Convention deviennent respectivement les paragraphes 3 et 4 de l’article 21.

3. Le paragraphe 2 de l’article 23 de la Convention est supprimé. Les paragraphes 3 et 4 de l’article 23 deviennent respectivement les paragraphes 2 et 3 de l’article 23.

Article 3

A l’article 30 de la Convention, les mots « à moins que l’une des parties ne s’y oppose » sont supprimés.

Article 4

A l’article 35, paragraphe 1, de la Convention, les mots « dans un délai de six mois » sont remplacés par les mots « dans un délai de quatre mois ».

Article 5

A l’article 35, paragraphe 3, alinéa b, de la Convention, les mots « et à condition de ne rejeter pour ce motif aucune affaire qui n’a pas été dûment examinée par un tribunal interne » sont supprimés.

DISPOSITIONS FINALES ET TRANSITOIRES

Article 6
  • 1. Le présent Protocole est ouvert à la signature des Hautes Parties contractantes à la Convention, qui peuvent exprimer leur consentement à être liées par :

    • a) la signature sans réserve de ratification, d’acceptation ou d’approbation ; ou

    • b) la signature sous réserve de ratification, d’acceptation ou d’approbation, suivie de ratification, d’acceptation ou d’approbation.

  • 2. Les instruments de ratification, d’acceptation ou d’approbation seront déposés près le Secrétaire Général du Conseil de l’Europe.

Article 7

Le présent Protocole entrera en vigueur le premier jour du mois qui suit l’expiration d’une période de trois mois après la date à laquelle toutes les Hautes Parties contractantes à la Convention auront exprimé leur consentement à être liées par le Protocole, conformément aux dispositions de l’article 6.

Article 8
  • 1. Les amendements introduits par l’article 2 du présent Protocole s’appliquent uniquement aux candidats figurant sur les listes soumises à l’Assemblée parlementaire par les Hautes Parties contractantes, en vertu de l’article 22 de la Convention, après l’entrée en vigueur du présent Protocole.

  • 2. L’amendement introduit par l’article 3 du présent Protocole ne s’applique pas aux affaires pendantes dans lesquelles l’une des parties s’est opposée, avant l’entrée en vigueur du présent Protocole, à une proposition d’une chambre de la Cour de se dessaisir au profit de la Grande Chambre.

  • 3. L’article 4 du présent Protocole entrera en vigueur à l’expiration d’une période de six mois après la date d’entrée en vigueur du présent Protocole. L’article 4 du présent Protocole ne s’applique pas aux requêtes au regard desquelles la décision définitive au sens de l’article 35, paragraphe 1, de la Convention a été prise avant la date d’entrée en vigueur de l’article 4 du présent Protocole.

  • 4. Toutes les autres dispositions du présent Protocole s’appliquent à la date de son entrée en vigueur, conformément aux dispositions de l’article 7.

Article 9

Le Secrétaire Général du Conseil de l’Europe notifiera aux Etats membres du Conseil de l’Europe et aux autres Hautes Parties contractantes à la Convention :

  • a) toute signature;

  • b) le dépôt de tout instrument de ratification, d’acceptation ou d’approbation;

  • c) la date d’entrée en vigueur du présent Protocole, conformément à l’article 7; et

  • d) tout autre acte, notification ou communication ayant trait au présent Protocole.

EN FOI DE QUOI, les soussignés, dûment autorisés à cet effet, ont signé le présent Protocole.

FAIT à Strasbourg, le 24 juin 2013, en français et en anglais, les deux textes faisant également foi, en un seul exemplaire qui sera déposé dans les archives du Conseil de l’Europe. Le Secrétaire Général du Conseil de l’Europe en communiquera copie certifiée conforme à chacun des Etats membres du Conseil de l’Europe et aux autres Hautes Parties contractantes à la Convention.


D. PARLEMENT

Het Protocol behoeft ingevolge artikel 91 van de Grondwet de goedkeuring van de Staten-Generaal, alvorens het Koninkrijk aan het Protocol kan worden gebonden.

E. PARTIJGEGEVENS

Ondertekening zonder of met voorbehoud van bekrachtiging, aanvaarding, of goedkeuring, bekrachtiging, aanvaarding en goedkeuring zijn voorzien in artikel 6 van het Protocol.

G. INWERKINGTREDING

De bepalingen van het Protocol zullen ingevolge artikel 7 in werking treden op de eerste dag van de maand volgend op het verstrijken van een periode van drie maanden na de datum waarop alle hoge verdragsluitende partijen bij het in rubriek J hieronder genoemde Verdrag van 4 november 1950 hun instemming tot uitdrukking hebben gebracht om door het Protocol te worden gebonden overeenkomstig artikel 6 van het Protocol.

Ingevolge artikel 8, derde lid, zal artikel 4 van het Protocol in werking treden na het verstrijken van een periode van zes maanden na de datum van inwerkingtreding van het Protocol.
