Verdrag inzake de Europese groep van luchtmachten van 6 juli 1998, zoals gewijzigd bij het Protocol bij genoemd Verdrag;

B. TEKST

De Engelse en de Franse tekst van het Verdrag, met Bijlagen en het Protocol van wijziging bij het Verdrag, zijn geplaatst in Trb. 2000, 105.

Voor correcties in de Engelse tekst zie Trb. 2001, 29.

Zie voor de geconsolideerde versie van de Engelse tekst van het Verdrag, met Bijlagen, zoals gewijzigd bij het Protocol, rubriek J van Trb. 2000, 105.

In dat Tractatenblad dienen in de geconsolideerde Engelse tekst de volgende correcties te worden aangebracht.

Op blz. 48, in de eerste overweging van de Preambule, derde regel, dient het woord „tot” te worden vervangen door „to”.

Op blz. 52, vijfde regel, dient het woord „recources” te worden vervangen door „resources”.

Op 12 december 2011 is te Londen het Tweede Protocol van wijziging bij het Verdrag, met Bijlagen, zoals gewijzigd bij het Protocol van 16 juni 1999, tot stand gekomen.

De Engelse en de Franse tekst van dit Protocol luiden als volgt:

Second Amending Protocol to the Agreement concerning the European Air Group

The Government of the Kingdom of Belgium, the Government of the French Republic, the Government of the Federal Republic of Germany, the Government of the Italian Republic, the Government of the Kingdom of the Netherlands, the Government of the Kingdom of Spain and the Government of the United Kingdom of Great Britain and Northern Ireland being Contracting Parties of the 6 July 1998 Agreement and Amending Protocol of 16th June 1999 concerning the European Air Group (hereinafter referred to as the “Agreement”),

Have agreed as follows:

Article 1

Article 4, final sentence shall be amended by replacing “Strike” with “Air”.

Article 2

Article 7, final sentence shall be amended by replacing “STC” with “Air Cmd”.

Article 3

Article 24 shall be replaced by the following in toto:

“Invoicing

RAF High Wycombe shall supply a quarterly invoice in accordance with the cost share items at Annex A through COS EAG for approval by the SRNOs. Following SRNO approval, the European Air Group shall pay the cost invoice from the EAG allocated common budget within 90 days of the date of the invoice in accordance with the cost sharing formula given in Annex B”.

Article 4

Article 26 shall be replaced by the following in toto:

“Funding the EAG Annual Budget

The Parties shall pay their share of the EAG approved budget in accordance with Article 22 at the start of the EAG’s financial year”.

Article 5

• 1. This amending Protocol shall be subject to ratification, acceptance or approval.

• 2. Instruments of ratification, acceptance or approval shall be deposited with the Government of the United Kingdom of Great Britain and Northern Ireland (“the depositary”). The depositary shall transmit certified copies to the Parties.

• 3. This amending Protocol shall enter into force on the first day of the second month following the date of notification by the depositary to the Parties of deposit of the last ratification, acceptance or approval instrument.

DONE in the English and French languages, both texts being equally authoritative.

Deuxième Protocole d’Amendement à l’Accord relatif au Groupe aerien Européen

Le Gouvernement de la République française, le Gouvernement du Royaume-Uni de Grande-Bretagne et d’Irlande du Nord, le Gouvernement de la République fédérale d’Allemagne, le Gouvernement du Royaume de Belgique, le Gouvernement de la République italienne, le Gouvernement du Royaume des Pays-Bas et le Gouvernement du Royaume d’Espagne signataires de l’Accord du 6 juillet 1998 et du Protocole du 16 Juin 1999 amendant l’Accord relatif au Groupe Aérien Européen (ci-après désigné «Accord»),

Sont convenus de ce qui suit:

Article 1

A l’article 4, dernière phrase, le mot «Strike» est remplacé par «Air».

Article 2

A l’article 7, dernière phrase, le mot «STC» est remplacé par «Air Cmd».

Article 3

L’article 24 est intégralement remplacé par les dispositions suivantes:

«Facturation

La base RAF de High Wycombe fournit chaque trimestre au Chef d’état-major du Groupe une facture en comformité avec les coûts partagés figurant à l’annexe A pour approbation des OSRN. Après approbation des OSRN, le Groupe Aérien Européen (GAE) paie la facture sur le budget commun qui lui est assigné dans les quatre-vingt-dix (90) jours qui suivent la date de la facture conformément à la formule de partage des coûts donnée en annexe B».

Article 4

L’article 26 est intégralement remplacé par les dispositions suivantes:

«Financement du budget annuel du GAE

Les Parties payent leur part du budget approuvé du GAE conformément à l’article 22 en début d’exercice budgétaire annuel du GAE».

Article 5

• 1. Le présent Protocole d’amendement est soumis à ratification, acceptation ou approbation.

• 2. Les instruments de ratification, d’acceptation ou d’approbation sons déposés auprès du Gouvernement du Royaume-Uni de Grande-Bretagne et d’Irlande du Nord (« le dépositaire»). Le dépositaire transmet les copies certifiées conformes aux parties.

• 3. Le présent Protocole d’amendement entre en vigueur le premier jour du deuxième mois suivant la date de notification aux Parties par le dépositaire du dépôt du dernier instrument de ratification, d’acceptation ou d’approbation.

FAIT en langues française et anglaise, les deux textes faisant également foi.

De vertaling van het op 12 december 2011 te Londen tot stand gekomen Tweede Protocol van wijziging luidt als volgt:

Tweede Protocol van Wijziging bij het Verdrag inzake de Europese Groep van Luchtmachten

De Regering van het Koninkrijk België, de Regering van de Franse Republiek, de Regering van de Bondsrepubliek Duitsland, de Regering van de Italiaanse Republiek, de Regering van het Koninkrijk der Nederlanden, de Regering van het Koninkrijk Spanje en de Regering van het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland, verdragsluitende partijen bij het Verdrag inzake de Europese groep van luchtmachten van 6 juli 1998 en het Protocol van wijziging daarbij van 16 juni 1999 (hierna te noemen „het Verdrag”),

Zijn het volgende overeengekomen:

Artikel 1

In artikel 4, laatste zin, wordt „Strike” vervangen door „Air”.

Artikel 2

In artikel 7, laatste zin, wordt „STC” vervangen door „Air Cmd”.

Artikel 3

Artikel 24 wordt volledig vervangen door de volgende tekst:

„Facturering

RAF High Wycombe verstrekt elk kwartaal via de stafchef van de EAG een factuur in overeenstemming met de in Bijlage A genoemde onderdelen voor kostenverdeling ter goedkeuring door de SRNO’s. Na goedkeuring door de SRNO’s betaalt de Europese groep van luchtmachten de factuur uit de gemeenschappelijke begroting van de EAG binnen 90 dagen te rekenen vanaf de factuurdatum, in overeenstemming met de in Bijlage B genoemde kostenverdeelsleutel.”

Artikel 4

Artikel 26 wordt volledig vervangen door de volgende tekst:

„Financiering van de jaarlijkse begroting van de EAG

De partijen betalen in overeenstemming met artikel 22 aan het begin van het boekjaar van de EAG hun aandeel van de goedgekeurde begroting van de EAG.”

Artikel 5

• 1. Dit Protocol van wijziging dient te worden bekrachtigd, aanvaard of goedgekeurd.

• 2. De akten van bekrachtiging, aanvaarding of goedkeuring worden nedergelegd bij de Regering van het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland („de depositaris”). De depositaris doet de partijen gewaarmerkte afschriften toekomen.

• 3. Dit Protocol van wijziging treedt in werking op de eerste dag van de tweede maand na de datum van kennisgeving door de depositaris aan de partijen van de nederlegging van de laatste akte van bekrachtiging, aanvaarding of goedkeuring.

GEDAAN in de Engelse en de Franse taal, zijnde beide teksten gelijkelijk authentiek.

Het Tweede Protocol van wijziging behoeft ingevolge artikel 91 van de Grondwet de goedkeuring van de Staten-Generaal, alvorens het Koninkrijk aan het Protocol kan worden gebonden.

Duitsland, 2 februari 2001

• a) On the understanding of the Government of the Federal Republic of Germany, the aforementioned agreement contains no obligation under international law to deploy armed forces or other provisions which, under German constitutional law, are subject to parliamentary reservation.

• b) In the event of discrepancies between the English and the French text of the Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of France on the European Air Group of 6 July 1998, as amended by the Protocol of 16 June 1999, the Federal Republic of Germany will regard the English version as prevailing.

G. INWERKINGTREDING

De bepalingen van het Tweede Protocol van wijziging van 12 december 2011 zullen ingevolge artikel 5, derde lid, in werking treden op de eerste dag van de tweede maand na de datum van kennisgeving door de depositaris aan de partijen van de nederlegging van de laatste akte van bekrachtiging, aanvaarding of goedkeuring.
