The Ministry of Foreign Affairs of the Kingdom of the Netherlands presents its compliments to the Embassy of the United States of America and has the honor to refer to the upcoming deployment of members of the United States Marine Corps (USMC) on board the Royal Netherlands Navy vessel Hr Ms Rotterdam in the framework of Operation Ocean Shield.

The Ministry has the honor to propose that:

  • 1. Members of the USMC deployed on board Hr Ms Rotterdam shall be accorded the immunities equivalent to those accorded to members of forces under the Agreement between the Parties to the North Atlantic Treaty regarding the status of their Forces of June 19, 1951.

  • 2. The Embassy of the United States shall, prior to the deployment of a member of the USMC on board Hr Ms Rotterdam, notify the Ministry by diplomatic note of the name and rank of such member.

  • 3. The Kingdom of the Netherlands recognizes the particular importance of disciplinary control by the United States Armed Forces authorities over United States personnel and, therefore, authorizes the United States to exercise disciplinary authority over a member of the USMC referred to in the preceding paragraph for the time of his deployment on board Hr Ms Rotterdam.

If this proposal is acceptable to the Embassy of the United States of America the Ministry proposes that this note and the affirmative note of the Embassy shall constitute an Agreement between the Kingdom of the Netherlands and the United States of America which shall enter into force on the date of the Embassy’s reply and which shall remain in force for the duration of the deployment of the members of the USMC on board Hr Ms Rotterdam and for such additional period as is necessary for its winding up, the total duration of this Agreement, however, not to exceed one year.

The Ministry of Foreign Affairs of the Kingdom of the Netherlands avails itself of this opportunity to renew to the Embassy of the United States of America the assurances of its highest consideration.

The Embassy of the United States of America presents its compliments to the Ministry of Foreign Affairs of the Kingdom of the Netherlands and has the honor to refer to the Embassy’s note No. MINBUZA-2012.16215 of July, 18 2012, which reads as follows:

The Embassy of the United States of America has further the honor to inform the Ministry that the proposals set forth in the Ministry’s note are acceptable to the United States of America and to confirm that the Ministry’s note and this note shall constitute an Agreement between the Kingdom of the Netherlands and the United States of America, which enters into force on the date of this reply and which shall remain in force for the duration of the deployment of the member of the USMC on board Hr Ms Rotterdam and for such additional period as is necessary for its winding up, the total duration of this Agreement, however, not to exceed one year.

The Embassy of the Unites States of America avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Kingdom of the Netherlands the assurances of its highest consideration.

D. PARLEMENT

Het in de nota’s vervatte verdrag behoeft ingevolge artikel 7, onderdeel c, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal.

G. INWERKINGTREDING

De bepalingen van het in de nota’s vervatte verdrag zijn ingevolge het gestelde in de op één na laatste alinea van nota Nr. I en nota Nr. II op 19 juli 2012 in werking getreden.

Het in de nota’s vervatte verdrag zal ingevolge dezelfde alinea niet langer dan één jaar van kracht zijn.

Wat betreft het Koninkrijk der Nederlanden, geldt het in de nota’s vervatte verdrag alleen voor Nederland (het Europese deel).

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat het in de nota’s vervatte verdrag zal zijn bekendgemaakt in Nederland (het Europese deel) op de dag na de datum van uitgifte van dit Tractatenblad.
