A. TITEL

Overeenkomst inzake het internationale vervoer van aan bederf onderhevige levensmiddelen en het gebruik van speciale vervoermiddelen bij dit vervoer (ATP) (met Bijlagen);

B. TEKST

Overeenkomstig artikel 18, eerste lid, van de Overeenkomst heeft de Werkgroep voor het vervoer van aan bederf onderhevige levensmiddelen op 27 oktober 2023 wijzigingen van de Overeenkomst en van enkele bepalingen van Bijlage 1 bij de Overeenkomst voorgesteld. Deze wijzigingen zijn ingevolge artikel 18, vijfde lid, aanvaard op 25 februari 2026. De Engelse1) tekst van deze wijzigingen luidt als volgt:


1. Throughout the text of the ATP

Replace multiplication symbols “*”, “.” and “.” by “×” in the existing equations.

2. Throughout the text of the ATP

Insert multiplication symbol “.” between the units.

3. Annex 1, Appendix 1, paragraph 3

Replace “confirm its identity” by “verify its conformity”

4. Annex 1, Appendix 2, paragraph 6.2.2. (i)

In the first sentence, after the word “stabilization” add a footnote (1) to read as follows:

  • “(1) Equipment can be pre-cooled before the test”

After the first sentence add the following new text:

“The internal temperature taken into consideration is the average temperature of the two sensors measured during the period selected for the test. The equipment is considered compliant if it meets the following conditions:

The average internal temperature is included in the ranges defined below:

the amplitude of the temperature variations around the class temperature is +/– 3 °C.”

5. Annex 1, Appendix 2, paragraph 6.2.3

Add a new heading before the existing paragraph to read as follows:

  • “6.2.3 Replacement of refrigerant fluid”

6. Annex 1, Appendix 2, paragraph 6.3

Amend the first sentence to read as follows:

“It shall be verified that the difference between the inside temperature of the empty equipment and the outside temperature which governs the class to which the equipment belongs as prescribed in this annex (a difference of 22 °C in the case of class A, 32 °C in the case of class B, 42 °C in the case of class C and 52 °C in the case of class D) can be achieved within a maximum period of 360 minutes.”

7. Annex 1, Appendix 2, paragraph 6.4 (ii)

Amend to read as follows:

  • “(ii) In the second stage, it shall be verified that the difference between the inside temperature of the empty equipment and the outside temperature which governs the class to which the equipment belongs as prescribed in this annex (a difference of 22 °C in the case of classes A, E and I, of 32 °C in the case of classes B, F and J, of 42 °C in the case of classes C, G and K, and of 52 °C in the case of classes D, H, and L), can be achieved within a maximum period of 360 minutes”

8. Annex 1, Appendix 2, paragraph 8, MODEL No. 1 A

Add the following list at the end:

10. Annex 1, Appendix 3, part A

Delete both transitional provisions after the title.


Overeenkomstig artikel 18, eerste lid, van de Overeenkomst heeft de Werkgroep voor het vervoer van aan bederf onderhevige levensmiddelen op 1 november 2024 wijzigingen van enkele bepalingen van Bijlagen 1 en 2 bij de Overeenkomst voorgesteld. Deze wijzigingen zijn ingevolge artikel 18, vijfde lid, aanvaard op 25 februari 2026. De Engelse1) tekst van deze wijzigingen luidt als volgt:


1. Annex 1, paragraph 7

Amend the definition of “Equipment” to read:

“Equipment means an assembly of parts forming an insulated body and its supportive structure needed for carriage on road and rail. If fitted, a thermal appliance forms part of the assembly.”

2. Annex 1, appendix 1, sub-paragraph 3 (b)

Amend the second sentence to read as follows:

“This certificate will be treated as a provisional certificate, if necessary, with a maximum validity of six months.”

3. Annex 1, appendix 1, sub-paragraph 3 (b)

In the last sentence, replace “Multi Temperature, Multi Compartment equipment” by “multi-temperature, multi-compartment equipment”.

4. Annex 1, appendix 1, sub-paragraph 3 (c)

In the last sentence, replace “Multi Temperature, Multi Compartment equipment” by “multi-temperature, multi-compartment equipment”.

5. Annex 1, appendix 2, paragraph 2.2.1

Replace “multiple-compartment tank” by “multi-compartment tank”.

6. Annex 1, appendix 2, paragraph 3.2.8

Replace the following sentence:

“The air volume flow may be modulated in part load operation after reaching the set point temperature and if the temperature of the class is reached, the air flow needs not be continuous.”

by:

“After reaching the set point, the air volume flow may be modulated in part load operation and the air flow need not be continuous.”

7. Annex 1, appendix 2, paragraph 5.1

Amend sub-paragraph (e) to read as follows:

“(e) the condition of the internal space (for single-compartment equipment) or the internal spaces (for multi-compartment equipment);”

8. Annex 1, appendix 2, paragraph 6.2

Amend the beginning of sub-paragraph (iii) to read as follows:

  • “(iii) Multi-compartment and multi-temperature equipment

    The test prescribed in (i) shall be conducted simultaneously for all compartments. During the tests, if the dividing walls are movable, they shall be positioned such that the volumes of the compartments correspond with the maximum refrigeration demand.

    Measurements shall be taken until the warmest temperature measured by one of the two sensors located inside each compartment matches the class temperature.

    For multi-temperature equipment whose compartment temperatures may be modified, a supplementary reversibility test shall then be conducted:…”. (Remainder unchanged)

9. Annex 1, appendix 2, paragraph 6.2.2

Amend the last paragraph in (ii) to read as follows:

“For equipment constructed prior than 6 January 2018, this provision need not be applied. In this case the equipment shall comply with the requirements of 6.2.1(i) or 6.2.1(ii) as applicable for the date of construction.”

10. Annex 1, appendix 2, paragraph 7

Amend the title of section 7 to read as follows:

“Procedure for measuring the capacity of mechanical multi-temperature refrigeration units and dimensioning multi-compartment multi-temperature equipment.”

11. Annex 1, appendix 2, paragraph 7.1

Amend the definition of multi-compartment equipment to read:

  • “(a) Multi-compartment equipment: Equipment with two or more insulated compartments divided by one or more dividing walls, as defined in annex 1, appendix 2, paragraph 7.3.7, making it possible to guarantee the geometrical separation of the compartments throughout transport and operation at different temperatures;”

12. Annex 1, appendix 2, paragraph 7.1

Add a new sub-paragraph (b) to read as follows:

  • “(b) Multi-temperature equipment: Multi-compartment equipment capable of maintaining a different temperature in each compartment;”

Renumber the remaining sub-paragraphs accordingly.

13. Annex 1, appendix 2, paragraph 7.3.4

In the last sentence, replace “insulated compartments” by “unconditioned compartments”.

14. Annex 1, appendix 2, paragraph 7.3.7

At the end, add the following definitions in alphabetical order:

“Definitions

  • (a) Dividing wall: Panel composed of insulating material making it possible to

    restrict the internal volume of the equipment by forming two adjacent compartments;

  • (b) Fixed dividing wall: A dividing wall with no degree of free movement;

  • (c) Movable dividing wall: A dividing wall composed of one or more panels that can be placed in different positions to increase or restrict the internal volume of a compartment;

  • (d) Longitudinal dividing wall: A dividing wall set along the length of the equipment;

  • (e) Transversal dividing wall: A dividing wall set along the width of the equipment.”

15. Annex 1, appendix 2, paragraph 8

In Models of test reports, Model 12, amend the last row of the table for “Heat exchangers” to read as follows:

In Models of test reports, Model 14, amend the title to read:

“Declaration of conformity for multi-temperature – multi-compartment equipment”

17. Annex 2, appendix 1

Amend to read as follows:

  • “1. The transport equipment shall be fitted with an instrument capable of measuring and recording air temperatures and storing the data obtained (hereinafter referred to as the instrument) to monitor the air temperatures to which quick-frozen foodstuffs intended for human consumption are subjected.

  • 2. Temperature recordings obtained in this manner for each transport operation shall be dated and stored by the operator for at least one year or longer, according to the nature of the food.

  • 3. The device shall comply with EN 12830:2018.

  • 4. The instrument shall be verified with at least two points of measurement in accordance with EN 13486:2023 and the documentation of the verification shall be made available to the ATP competent authorities.

    The inspections shall be carried out either by accredited bodies or by bodies approved by the competent authority, of the country in which the transport equipment is registered or recorded. To obtain the approval, the competent authority shall ensure that the staff of the inspection body is duly trained in accordance with the procedures laid down by the competent authority.

    The approved bodies shall use measuring equipment which has been calibrated in a laboratory accredited in accordance with standard EN 17025:2017.

  • 5. Transitional measures:

    • 5.1 Temperature recorders in service that comply with EN 12830:1999 may continue to be used.

    • 5.2 The measures referred to in paragraphs 2, 3 and 4 shall apply no later than 12 months after [date of entry into force DD/MM/YYYY].”


D. PARLEMENT

De wijzigingen van 27 oktober 2023 van de Overeenkomst en van Bijlage 1 bij de Overeenkomst en de wijzigingen van 1 november 2024 van Bijlagen 1 en 2 bij de Overeenkomst behoeven ingevolge artikel 7, aanhef en onderdeel f, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal.

G. INWERKINGTREDING

De wijzigingen van 27 oktober 2023 van de Overeenkomst en van Bijlage 1 bij de Overeenkomst zullen ingevolge artikel 18, zesde lid, van de Overeenkomst op 25 augustus 2026 voor alle partijen, waaronder het Koninkrijk der Nederlanden, in werking treden.

De wijzigingen van 1 november 2024 van Bijlagen 1 en 2 bij de Overeenkomst zullen ingevolge artikel 18, zesde lid, van de Overeenkomst op 25 augustus 2026 voor alle partijen, waaronder het Koninkrijk der Nederlanden, in werking treden.

Wat betreft het Koninkrijk der Nederlanden, zullen de wijzigingen van 27 oktober 2023 en 1 november 2024, evenals de Overeenkomst, alleen voor Nederland (het Europese deel) gelden.
