B. TEKST

Bij notawisseling tussen het Koninkrijk der Nederlanden en de Republiek Oezbekistan is op 11 november 2024 te Tashkent een Verdrag tot stand gekomen inzake de uitbreiding van het Verdrag van 11 februari 2000 tot het Caribische deel van Nederland (Bonaire, Sint Eustatius en Saba). De tekst van deze nota’s luidt als volgt:

The Embassy of the Kingdom of the Netherlands to Central Asia in Astana presents its compliments to the Ministry of Foreign Affairs of the Republic of Uzbekistan and has the honour to inform the Ministry as follows.

Following its Note No. MOS-515/10 dated 8 October 2010 concerning the modification of the Kingdom of the Netherlands, the Embassy of the Kingdom of the Netherlands in Moscow proposed in its Note No. MOS-175/12 dated 7 June 2012 to declare the Agreement on mutual administrative assistance in customs matters ('the Agreement'), done at The Hague on 11 February 2000, applicable to the Caribbean part of the Netherlands (the islands of Bonaire, Sint Eustatius, and Saba) from the date of that Note onwards.

In its Note No. 05/33934 dated 20 November 2012, the Ministry informed the Embassy of the Kingdom of the Netherlands in Moscow of the approval of the Republic of Uzbekistan to extend the territorial applicability of the Agreement to the Caribbean part of the Kingdom of the Netherlands, and proposed that the Ministry's Note and a Note in reply of the Embassy of the Kingdom of the Netherlands in Moscow would constitute an arrangement that would come into force on the date of receipt of the Embassy's Note.

Accordingly, in its Note No. MOS-454/13 dated 31 October 2013, the Embassy of the Kingdom of the Netherlands in Moscow confirmed the receipt of the Ministry's Note, yet incorrectly assumed that the extension was proposed by the Uzbek authorities. To correct this, the Embassy of the Kingdom of the Netherlands to Central Asia in Astana hereby kindly wishes to confirm that the extension was proposed by the Embassy of the Kingdom of the Netherlands in Moscow and that the Ministry's Note No. 05/33934 dated 20 November 2012 was sent in response to the Embassy's Note No. MOS-175/12 dated 7 June 2012.

Moreover, in order to finalise the extension of the Agreement to the Caribbean part of the Netherlands, the Embassy of the Kingdom of the Netherlands in Astana proposes that the present Note and a Note in reply from the Ministry shall constitute an arrangement as provided for in Article 20, paragraph 2, of the Agreement, which shall enter into force on the date of the Ministry's Note, and that, as a result of that entry into force, the Agreement shall become applicable to the Caribbean part of the Netherlands with retroactive effect from the date of the Embassy's Note of 2012, i.e. from 7 June 2012.

The Embassy of the Kingdom of the Netherlands to Central Asia looks forward to a reply and avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Uzbekistan the assurances of its highest consideration.

The Ministry of Foreign Affairs of the Republic of Uzbekistan presents its compliments to the Ministry of Foreign Affairs of the Kingdom of the Netherlands and in reference to the Note of the Embassy of the Kingdom of the Netherlands to Uzbekistan (with residence in Astana) No. AST-2023/331 dated 20 September 2023, has the honor to communicate the following.

The Government of the Republic of Uzbekistan confirms the acceptance of the proposal of the Netherlands side to extend the application of the Agreement between the Government of the Republic of Uzbekistan and the Government of the Kingdom of the Netherlands on Mutual Administrative Assistance in Customs Matters, signed at The Hague on 11 February 2000, to the Caribbean part of the Netherlands (the islands of Bonaire, Sint Eustatius, and Saba) with retroactive effect from the date of the Ministry's Note No. 05/33934 of 20 November 2012.

The Government of the Republic of Uzbekistan agrees to exchange Notes on the extension of the application of the Agreement between the Government of the Republic of Uzbekistan and the Government of the Kingdom of the Netherlands on Mutual Administrative Assistance in Customs Matters, signed at The Hague on 11 February 2000, to Aruba, Curacao, and Sint Maarten in accordance with the Article 20 of the above-mentioned Agreement.

Therefore, the Ministry kindly requests to send an official Note of the Ministry of Foreign Affairs of the Kingdom of the Netherlands with the proposal to extend the application of the Agreement of 2000 to Aruba, Curacao, and Sint Maarten.

The Ministry of Foreign Affairs of the Republic of Uzbekistan avails itself of the opportunity to renew to the Ministry of Foreign Affairs of the Kingdom of the Netherlands the assurances of its highest consideration.

G. INWERKINGTREDING

Het in de nota’s vervatte uitbreidingsverdrag is ingevolge het gestelde in de vijfde alinea van nota nr. I op 11 november 2024 in werking getreden.

Wat betreft het Koninkrijk der Nederlanden, geldt het in de nota’s vervatte uitbreidingsverdrag voor het Caribische deel van Nederland.

Ingevolge artikel 20, tweede lid, van het Verdrag en het in de nota’s vervatte uitbreidingsverdrag zijn de bepalingen van het Verdrag vanaf 20 november 2012 van toepassing voor het Caribische deel van Nederland.

Wat betreft het Koninkrijk der Nederlanden, geldt het Verdrag vanaf 20 november 2012 voor Nederland, het Europese en het Caribische deel.1)

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat het in de nota’s vervatte uitbreidingsverdrag zal zijn bekendgemaakt in Nederland, het Europese en het Caribische deel, op de dag na de datum van uitgifte van dit Tractatenblad.
