A. TITEL

Overeenkomst tussen het Koninkrijk der Nederlanden en de Volksrepubliek Bangladesh inzake technische samenwerking;

B. TEKST

Op 23 januari 2024 is een wijziging tot stand gekomen van het administratief akkoord inzake het project „Support to the Implementation of the Bangladesh Delta Plan 2100” (Trb. 2019, 96). De Engelse tekst van de wijziging van het administratief akkoord, luidt als volgt:

Second Amendment to the Administrative Arrangement and the Schedule of Operations between the Minister for Foreign Trade and Development Cooperation of the Netherlands and the Economic Relations Division of the Ministry of Finance of the People’s Republic of Bangladesh

Whereas, the Minister for Foreign Trade and Development Cooperation of the Netherlands (hereinafter referred to as “the Netherlands Party”) and the Economic Relations Division of the Ministry of Finance, Government of the People's Republic of Bangladesh (hereinafter referred to as “the Bangladesh Party”) had concluded on 13 May 2019 the Administrative Arrangement concerning the Project entitled “Support to the Implementation of the Bangladesh Delta Plan 2100” (hereafter referred to as the Project), activity number 4000001489;

Whereas both parties concluded on the same date a Schedule of Operations;

Whereas developments relating to the implementation of the Project justify a second amendment to the Administrative Arrangement mentioned;

Now therefore both Parties agree on the following amendment:

• Article I.3 of the Administrative Arrangement shall be replaced by the following text:

“The aforesaid co-operation between the two Parties is planned to last from 1 October 2018 to 31 December 2024 or shall expire on the date on which the Project has been completed in conformity with the provisions of the Administrative Arrangement and of the Project Document (TAPP), whichever date is the later”.

• Article II of the Administrative Arrangement shall be replaced by the following text:

“The Netherlands Party shall make an additional contribution of BDT 47,896,000 (top-up to accommodate the extension of the original Reimbursable Project Aid (RPA) on top of BDT 85,000,000 (the original RPA budget, as concluded on 13 May 2019) and an additional contribution of Euro 346,000 (top-up to accommodate the extension of the original TA budget, as concluded on 13 May 2019), Euro 5,420,326 in total (five million four hundred and twenty thousand three hundred and twenty six euros) in the form of a grant to the project in the following manner:

• A total of BDT 132,896,000 (one hundred thirty two million eight hundred and ninety six thousand BDT) of grant financing to be administered by the general Economics Division (GED);

• A total of € 4,304,000 (EUR four million three hundred and four thousand) for Technical Assistance, through direct contracting by the Netherlands party.

The Netherlands Party’s contribution will become available on the condition that:

• The Bangladeshi Partner shall have approved the Technical Assistance Project Proposal (TAPP) for the project as per agreed Project Extension Proposal;

• The general Economics Division (GED) has appointed a Project Director and established the Delta Wing.

• Article III of the Administrative Arrangement shall be replaced by the following text:

The Bangladeshi Party shall make a minimum amount of BDT 105,656,000 (hundred and five million six hundred and fifty-six thousand BDT) available to the project.

• Paragraph 1 of the Schedule of Operations shall be replaced by the following text:

1. “Contribution of either Party:

“The Netherlands Party shall make an additional contribution of BDT 47,896,000 (top-up to accommodate the extension of the original Reimbursable Project Aid (RPA) on top of BDT 85,000,000 (the original RPA budget, as concluded on 13 May 2019) and an additional contribution of Euro 346,000 (top-up to accommodate the extension of the original TA budget, as concluded on 13 May 2019), Euro 5,420,326 in total (five million four hundred and twenty thousand three hundred and twenty six euros) in the form of a grant to the project in the following manner:

• A total of BDT 132,896,000 (one hundred thirty two million eight hundred and ninety six thousand BDT) of grant financing to be administered by the general Economics Division (GED);

• A total of € 4,304,000 (EUR four million three hundred and four thousand) for Technical Assistance, through direct contracting by the Netherlands party.

The Bangladesh Party shall make a minimum amount of BDT 105,656,000 (hundred and five million six hundred and fifty-six thousand BDT) available to the project.

All other terms of the above mentioned Administrative Arrangement remain unchanged.

The amendment of the above mentioned Administrative Arrangement and its Schedule of Operations shall enter into force on the date of signature by both Parties with retrospective effect from 1 July 2023.

D. PARLEMENT

De wijziging van 23 januari 2024 van het administratief akkoord behoeft ingevolge artikel 7, onderdeel b, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal.

G. INWERKINGTREDING

De wijziging van 23 januari 2024 van het administratief akkoord is in werking getreden op 23 januari 2024, met terugwerkende kracht tot 1 juli 2023.

Wat betreft het Koninkrijk der Nederlanden, geldt de wijziging van het administratief akkoord voor Nederland (het Europese deel).

De bepalingen van het administratief akkoord zijn ingevolge de wijziging van 23 januari 2024 verlengd tot 31 december 2024, of tot de datum waarop het project wordt afgerond, naargelang welke datum het laatst valt.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat de wijziging van 23 januari 2024 van het administratief akkoord zal zijn bekendgemaakt in Nederland (het Europese deel) op de dag na de datum van uitgifte van dit Tractatenblad.
