A. TITEL

Overeenkomst inzake het internationale vervoer van aan bederf onderhevige levensmiddelen en het gebruik van speciale vervoermiddelen bij dit vervoer (ATP) (met Bijlagen);

B. TEKST

Overeenkomstig artikel 18, eerste lid, van de Overeenkomst heeft de Werkgroep voor het vervoer van aan bederf onderhevige levensmiddelen op 11 oktober 2019 wijzigingen van enkele bepalingen van Bijlagen 1 en 2 bij de Overeenkomst voorgesteld. Deze wijzigingen zijn ingevolge artikel 18, vijfde lid, aanvaard op 1 december 2021. De Engelse1) tekst van deze wijzigingen luidt als volgt:


1. Annex 1, appendix 2, section 6.5

Amend the two last paragraphs to read as follows:

„For measuring the outside temperature of the body (Te), at least 2 temperature measuring points shall be placed,

  • • One measuring point vertically within 20 cm around the middle height of the body, at a distance of 10 to 20 cm from the side wall, and

  • • Another measuring point 20 to 50 cm from the air inlet of the condenser unit.

The final reading shall be from the warmest measuring point inside the body at the end of the cool down test. The outside temperature used to determine the maximum cool down time, in case of equipment manufactured from 2 January 2012, is the average temperature of all readings from the outside measuring points until the class temperature has been reached.”

2. Annex 1, appendix 3

In line 6.1.2 in the certificate, replace „Not independent” by „dependent”.

3. Annex 1, appendix 4

In the first line, after the list of distinguishing marks, replace „non-independent” by „dependent”.

4. Annex 1, appendix 2, section 8, Model No. 12

In table concerning heat exchangers, replace the row „-type” by the following 2 rows:

In footnote 8 of the certificate, replace „mark” by „make”.

7. Annex 2, appendix 1

Replace paragraphs 2 and 3 by the following:

„The instrument shall be verified in accordance with EN 13486:2002 by an accredited body and the documentation shall be available for the approval of ATP competent authorities.

The instrument shall comply with standard EN 12830:2018.

Temperature recorders in service that comply with EN 12830:1999 may continue to be used.”

8. Annex 1, appendix 2, section 8, Model No. 12

Amend paragraph (c) line 3 to read as follows:

„Air flow volume leaving the evaporator:

value measured.........................m3/h

at a static:

  • • differential pressure measured between the air flows leaving and entering the evaporator of 0 Pa,

  • • absolute barometric air pressure of ...........................hPa.”

Overeenkomstig artikel 18, eerste lid, van de Overeenkomst heeft de Werkgroep voor het vervoer van aan bederf onderhevige levensmiddelen op 16 oktober 2020 wijzigingen van enkele bepalingen van Bijlage 1 bij de Overeenkomst voorgesteld. Deze wijzigingen zijn ingevolge artikel 18, vijfde lid, aanvaard op 1 december 2021. De Engelse1) tekst van deze wijzigingen luidt als volgt:


1. Annex 1, section 1. Insulated equipment

Replace degrees „K” by „°C” under INand IR (twice).

2. Annex 1, section 2. Refrigerated equipment

In the last paragraph, replace degrees „K” by „°C”.

3. Annex 1, section 3. Mechanically refrigerated equipment

Under Class F, replace degrees „K” by „°C”.

4. Annex 1, section 4. Heated equipment

In the last paragraph, replace degrees „K” by „°C”.

5. Annex 1, section 5. Mechanically refrigerated and heated equipment

6. Annex 1

Insert a new section 7 to read as follows:

„7. Definitions

Equipment means an assembly of parts forming an insulated body and its supportive structure needed for carriage on road and rail. Thermal appliances may be part of the assembly.

Heating appliance means a thermal appliance that generates thermal energy to increase(heat) the temperature inside.

Mechanically heated and refrigerated appliance means a mechanical refrigerating appliance that is able to decrease (cool) or increase (heat) the temperature inside the equipment that is tested to certify both the capacity to cool and to heat.

Mechanically refrigerating appliance means a thermal appliance that generates thermal energy to decrease (cool) the temperature inside the equipment by a mechanical drive system.

Refrigerating appliance means a thermal appliance that generates thermal energy to decrease (cool) the temperature inside the equipment by melting, evaporation or sublimation of for example natural ice, brine (eutectic) liquefied gas or dry ice.

Thermal appliance means a device to generate thermal energy, to decrease (cool) or increase (heat) the temperature inside the equipment.”.

7. Annex 1, appendix 1, paragraph 3(b)

Add a new last sentence to read as follows: „For Multi Temperature, Multi Compartment equipment also the declaration of conformity (see 7.3.6 of annex I, appendix 2) shall be provided.”.

8. Annex 1, appendix 1, paragraph 3(c)

Add a new last sentence to read as follows: „For Multi Temperature, Multi Compartment equipment also a calculation sheet (see 7.3.6 of annex I, appendix 2) based on the iterative method shall be provided.”.

D. PARLEMENT

De wijzigingen van 1 december 2021 van Bijlagen 1 en 2 bij de Overeenkomst behoeven ingevolge artikel 7, onderdeel f, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal.

G. INWERKINGTREDING

De wijzigingen van 1 december 2021 van Bijlagen 1 en 2 bij de Overeenkomst zullen ingevolge artikel 18, zesde lid, van de Overeenkomst op 1 juni 2022 voor alle partijen, waaronder het Koninkrijk der Nederlanden, in werking treden.

Wat betreft het Koninkrijk der Nederlanden, zullen de wijzigingen van 1 december 2021, evenals de Overeenkomst, alleen voor Nederland (het Europese deel) gelden.
