A. TITEL

Notawisseling houdende een Verdrag tussen het Koninkrijk der Nederlanden, ten behoeve van Sint Maarten, en de Franse Republiek inzake de rechtspositie van militairen en ander overheidspersoneel, aanwezig op elkaars grondgebied, in het kader van de COVID-19-crisis en humanitaire noodhulp bij orkanen;

D. PARLEMENT

Het in nota’s vervatte verlengingsverdrag, opgenomen in rubriek H hieronder, behoeft ingevolge artikel 7, onderdeel e, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal.

G. INWERKINGTREDING

Het in nota’s vervatte verlengingsverdrag, opgenomen in rubriek H hieronder, is ingevolge het gestelde in de voorlaatste alinea van nota Nr. I, op 22 december 2021 in werking getreden.

Het in nota’s vervatte verdrag van 6 augustus 2020, waarvan de geldigheid op 6 augustus 2021 zou aflopen, blijft ingevolge het gestelde in de voorlaatste alinea van nota Nr. I van het in nota’s vervatte verlengingsverdrag, opgenomen in rubriek H hieronder, van kracht voor een volgende periode van twee jaar, tot 6 augustus 2023, tenzij het op 25 juni 2021 te ’s-Gravenhage tot stand gekomen Verdrag tussen de Regering van het Koninkrijk der Nederlanden en de Regering van de Franse Republiek inzake samenwerking op defensiegebied en de status van hun strijdkrachten op de grondgebieden in de Caraïben en Zuid-Amerika van de Franse Republiek en het Koninkrijk der Nederlanden (Trb. 2021, 105) voor 6 augustus 2023 in werking treedt. In dat geval treedt het in nota’s vervatte verdrag van 6 augustus 2020 buiten werking op de datum van inwerkingtreding van het Verdrag van 25 juni 2021.

Wat betreft het Koninkrijk der Nederlanden, geldt het in nota’s vervatte verlengingsverdrag van 22 december 2021, evenals het in nota’s vervatte verdrag van 6 augustus 2020, alleen voor Sint Maarten.

H. VERLENGING

Bij notawisseling is op 22 december 2021 een verdrag tot stand gekomen tussen het Koninkrijk der Nederlanden en de Franse Republiek waarin het Verdrag van 6 augustus 2020, waarvan de geldigheid op 6 augustus 2021 zou aflopen, met een periode van twee jaar wordt verlengd. De tekst van dit in nota’s vervatte verlengingsverdrag luidt als volgt:

The Embassy of the Kingdom of the Netherlands presents its compliments to the Ministry for Europe and Foreign Affairs of the French Republic and has the honour to refer to the Exchange of Notes constituting an Agreement between the Government of the Kingdom of the Netherlands, for Sint Maarten, and the Government of the French Republic on the legal status of military and government personnel present in each other’s territory in Sint Maarten/Saint-Martin for activities related to the COVID-19 crisis and emergency humanitarian aid in case of hurricanes, done by Notes on 4 and 6 August 2020 (“the Agreement”), which expired on 6 August 2021.

Given the ongoing COVID-19 crisis, the recurrent hurricane season, and the fact that the Agreement between the Government of the Kingdom of the Netherlands and the Government of the French Republic relating to cooperation in matters of defense and the status of their forces in the Caribbean and South American territories of the Kingdom of the Netherlands and of the French Republic, signed in The Hague on 25 June 2021 (“the Caribbean SOFA”), has not yet entered into force, the Government of the Kingdom of the Netherlands, for Sint Maarten, wishes to temporarily continue the abovementioned Agreement.

The Embassy of the Kingdom of the Netherlands therefore has the honour to propose that the Agreement be extended until the entry into force of the Caribbean SOFA, at which date the Agreement shall be terminated, or until 6 August 2023, whichever date is earlier.

If the foregoing is acceptable to the Government of the French Republic, the Embassy of the Kingdom of the Netherlands further proposes that this Note together with an affirmative Note in reply from the Ministry shall constitute an Agreement (in the form of an exchange of Notes) between the Government of the Kingdom of the Netherlands, for Sint Maarten, and the Government of the French Republic on the extension of the Agreement of 2020. The Agreement shall enter into force on the date of the Ministry’s Note in reply, and which shall apply until 6 August 2023, or until the entry into force of the Caribbean SOFA, as provided for by Article 23 of the Caribbean SOFA, provided that this entry into force occurs before 6 August 2023.

The Embassy of the Kingdom of the Netherlands avails itself of this opportunity to renew to the Ministry for Europe and Foreign Affairs of the French Republic the assurances of its highest consideration.

The Ministry for Europe and Foreign Affairs of the French Republic presents its compliments to the Embassy of the Kingdom of the Netherlands and has the honour to acknowledge the receipt of the Embassy’s Note dated 8 December 2021, which reads as follows:

The Ministry for Europe and Foreign Affairs of the French Republic has further the honour to inform that the proposals set forth in the Embassy’s Note are acceptable to the French Republic and to confirm that the mentioned Note and this Note in reply shall constitute an Agreement (in the form of an exchange of Notes) between the Government of the French Republic and the Government of the Kingdom of the Netherlands, for Sint Maarten, on the extension of the Agreement between the Government of the French Republic and the Government of the Kingdom of the Netherlands on the legal status of military and government personnel present in each other’s territory in Sint Maarten/Saint-Martin for activities related to the COVID-19 crisis and emergency humanitarian aid in case of hurricanes, done by Notes on 4 and 6 August 2020, which shall enter into force on the date of this Note in reply, and which shall apply until 6 August 2023, or until the entry into force of the Agreement between the Government of the French Republic and the Government of the Kingdom of the Netherlands relating to cooperation in matters of defense and the status of their forces in the Caribbean and South American territories of the French Republic and of the Kingdom of the Netherlands, signed in The Hague on 25 June 2021, as provided for by Article 23 of that Agreement, provided that this entry into force occurs before 6 August 2023.

AMBASSADE DU ROYAUME DES PAYS-BAS

L’Ambassade du Royaume des Pays-Bas présente ses compliments au Ministère de l’Europe et des Affaires étrangères de la République française, et a l’honneur de porter à son attention l’Echange de Notes constituant un Accord entre le Gouvernement du Royaume des Pays-Bas, pour Sint Maarten, et le Gouvernement de la République française, sur le statut juridique des forces armées et d’autres organes gouvernementaux présents sur chaque territoire de Sint Maarten/Saint-Martin dans le cadre des activités liées à la crise de la COVID-19 et l’assistance humanitaire d’urgence en cas d’ouragans, conclu par Notes du 4 et 6 Aout 2020 (« l’Accord »), qui a expiré le 6 Aout 2021.

Compte tenu de la crise actuelle de la COVID-19, de la saison des ouragans récurrente et du fait que l’Accord entre le Gouvernement du Royaume des Pays-Bas et le Gouvernement de la République française relatif à la coopération en matière de défense et au statut de leurs forces sur les territoires Caribéens et Sud-Américain du Royaume des Pays-Bas et de la République française, signé à La Haye le 25 juin 2021 (ci-après le « SOFA Caraïbes »), n’est pas encore entré en vigueur, le Gouvernement du Royaume des Pays-Bas, pour Sint Maarten, souhaite prolonger temporairement l’accord susmentionné.

L’Ambassade du Royaume des Pays-Bas a donc l’honneur de proposer que l’Accord soit prorogé jusqu’à l’entrée en vigueur du SOFA Caraïbes, date à laquelle l’Accord prendra fin, ou jusqu’au 6 août 2023, selon la date la plus proche.

Si ce qui précède est acceptable pour le Gouvernement de la République française, l’Ambassade du Royaume des Pays-Bas propose en outre que la présente Note ainsi qu’une Note affirmative en réponse du Ministère constituent un Accord (sous forme d’échange de Notes) entre le Gouvernement du Royaume des Pays-Bas, pour Sint Maarten, et le Gouvernement de la République française sur la prorogation de l’Accord de 2020. L’Accord entrera en vigueur à la date de la Note du Ministère en réponse, et s’appliquera jusqu’au 6 août 2023, ou jusqu’à l’entrée en vigueur du SOFA Caraïbes, tel que prévu par l’article 23 du SOFA Caraïbes, à condition que cette entrée en vigueur intervienne avant le 6 août 2023.

L’Ambassade du Royaume des Pays-Bas saisit cette occasion pour renouveler au Ministère de l’Europe et des Affaires étrangères de la République française les assurances de sa très haute considération.

Le Ministère de l’Europe et des Affaires étrangères de la République française présente ses compliments à l’Ambassade du Royaume des Pays-Bas et a l’honneur d’accuser réception de la Note de l’Ambassade du Royaume des Pays-Bas datée du 8 décembre 2021, qui se lit comme suit :

Le Ministère de l’Europe et des Affaires étrangères de la République française a en outre l’honneur de faire connaître que les propositions énoncées dans la Note de l’Ambassade sont acceptables pour la République française et de confirmer que ladite Note et cette Note en réponse constituent un Accord (sous forme d’échange de notes) entre le Gouvernement de la République française et le Gouvernement du Royaume des Pays-Bas, pour Sint Maarten, relatif à la prorogation de l’Accord entre le Gouvernement de la République française et le Gouvernement du Royaume des Pays-Bas sur le statut juridique du personnel militaire et gouvernemental présent sur le territoire de l’autre à Sint Maarten/Saint-Martin pour les activités liées à la crise COVID-19 et à l’aide humanitaire d’urgence en cas d’ouragan, fait par Notes les 4 et 6 août 2020, qui entrera en vigueur à la date de la présente Note en réponse, et qui s’appliquera jusqu’au 6 août 2023, ou jusqu’à l’entrée en vigueur de l’Accord entre le Gouvernement de la République française et le Gouvernement du Royaume des Pays-Bas relatif à la coopération en matière de défense et au statut de leurs forces sur les territoires Caribéens et Sud-Américain de la République française et du Royaume des Pays-Bas, signé à La Haye le 25 juin 2021, comme le prévoit l’article 23 dudit accord, à condition que cette entrée en vigueur intervienne avant le 6 août 2023./.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat het in nota’s vervatte verlengingsverdrag van 22 december 2021 zal zijn bekendgemaakt in Sint Maarten op de dag na de datum van uitgifte van dit Tractatenblad.
