A. TITEL

Verdrag inzake de verlening van Europese octrooien (Europees Octrooiverdrag)

(met Uitvoeringsreglement en Protocollen);

München, 5 oktober 1973

B. TEKST

De Raad van Bestuur van de Europese Octrooiorganisatie heeft op 27 maart 2020 in overeenstemming met artikel 33, eerste lid, onderdeel c, van het Verdrag een Besluit (CA/D 2/20) aangenomen tot wijziging van het Uitvoeringsreglement bij het Verdrag en van artikel 2 van het Taksenreglement. De Engelse en de Franse tekst1) van het Besluit luiden als volgt:


Decision of the Administrative Council of 27 March 2020 amending Rule 142 of the Implementing Regulations to the European Patent Convention and Article 2 of the Rules relating to Fees (CA/D 2/20)

The Administrative Council of the European Patent Organisation,

Having regard to the European Patent Convention (hereinafter referred to as “EPC”) and in particular Article 33(1)(c) thereof,

On a proposal from the President of the European Patent Office,

Having regard to the opinion of the Committee on Patent Law,

Has decided as follows:

Article 1

Paragraph 2 of Rule 142 of the Implementing Regulations to the EPC will read as follows:

  • “(2) When, in the cases referred to in paragraph 1(a) or (b), the European Patent Office has been informed of the identity of the person authorised to continue the proceedings, it shall notify such person and, where applicable, any third party, that the proceedings will be resumed as from a specified date. If, three years after the publication of the date of interruption in the European Patent Bulletin, the European Patent Office has not been informed of the identity of the person authorised to continue the proceedings, it may set a date on which it intends to resume the proceedings of its own motion.”

Article 2

Article 2, paragraph 1, item 2, third indent, of the Rules relating to Fees will be reworded as follows:

  • “– an international search (Rule 16.1 PCT, Rule 40bis PCT in conjunction with Rule 20.5bis PCT, and Rule 158, paragraph 1)”

Article 3

This decision will enter into force on 1 July 2020.

Rule 142, paragraph 2, as amended by Article 1 of this decision will apply to all proceedings already interrupted on or after that date.

Décision du Conseil d'administration du 27 mars 2020 modifiant la règle 142 du règlement d'exécution de la Convention sur le brevet européen et l'article 2 du règlement relatif aux taxes (CA/D 2/20)

Le Conseil d'administration de l'organisation européenne des brevets,

vu la Convention sur le brevet européen (ci-après dénommée la «CBE»), et notamment son article 33, paragraphe 1, lettre c,

sur proposition du Président de l'Office européen des brevets,

vu l'avis du Comité «Droit des brevets»,

Décide :

Article premier

La règle 142, paragraphe 2 du règlement d'exécution de la CBE est remplacée par le texte suivant :

  • «(2) Si l'Office européen des brevets a connaissance de l'identité de la personne habilitée à poursuivre la procédure dans les cas visés au paragraphe 1 a) ou b), il notifie à cette personne et, le cas échéant, à toute autre partie que la procédure sera reprise à l'expiration du délai qu'il a imparti. Si, trois ans après que la date d'interruption a été publiée au Bulletin européen des brevets, l'identité de la personne habilitée à poursuivre la procédure n'a pas été portée à la connaissance de l'Office européen des brevets, celui-ci peut fixer la date à laquelle il envisage de reprendre la procédure d'office.»

Article 2

L'article 2, paragraphe 1, point 2, troisième tiret du règlement relatif aux taxes est remplacé par le texte suivant :

  • «– par recherche internationale (règle 16, paragraphe 1 PCT, règle 40bis PCT en liaison avec la règle 20.5bis PCT, et règle 158, paragraphe 1)»

Article 3

La présente décision entre en vigueur le 1er juillet 2020.

La règle 142, paragraphe 2, telle que modifiée par l'article premier de la présente décision, s'applique à toutes les procédures qui sont déjà interrompues à cette date ou qui seront interrompues à compter de cette date.

Besluit van de Raad van Bestuur van 27 maart 2020 tot wijziging van regel 142 van het Uitvoeringsreglement van het Europees Octrooiverdrag en artikel 2 van het Taksenreglement (CA/D 2/20)

De Raad van Bestuur van de Europese Octrooiorganisatie,

Gelet op het Europees Octrooiverdrag (hierna te noemen „EOV”) en in het bijzonder artikel 33, eerste lid, onderdeel c, daarvan,

Op voorstel van de President van het Europees Octrooibureau,

Gelet op het advies van de Commissie Octrooirecht,

Besluit het volgende:

Artikel 1

Regel 142, tweede lid, van het Uitvoeringsreglement van het Europees Octrooiverdrag wordt als volgt gewijzigd:

  • „2. Zodra bij het Europees Octrooibureau bekend is wie in de in het eerste lid, onderdeel a of b, bedoelde gevallen bevoegd is de procedure voort te zetten, deelt het deze persoon en, in voorkomend geval, alle overige partijen mede dat de procedure na afloop van een te stellen termijn zal worden hervat. Indien het Europees Octrooibureau binnen drie jaar na publicatie van de datum van de onderbreking in het Europees Octrooiblad geen bericht heeft ontvangen over de identiteit van de persoon die bevoegd is de procedure voort te zetten, kan het een datum vaststellen waarop het de procedure ambtshalve wil hervatten.”

Artikel 2

Artikel 2, eerste lid, punt 2, derde streepje, van het Taksenreglement wordt als volgt gewijzigd:

  • „– een internationaal nieuwheidsonderzoek (regel 16.1 van het Verdrag tot samenwerking inzake octrooien, regel 40bis van het Verdrag tot samenwerking inzake octrooien in combinatie met Regel 20.5bis van het Verdrag tot samenwerking inzake octrooien, en Regel 158, eerste lid)”

Artikel 3

Dit besluit treedt in werking op 1 juli 2020.

Regel 142, tweede lid, zoals gewijzigd bij artikel 1 van dit besluit is van toepassing op alle procedures die reeds zijn onderbroken op of na die datum.

G. INWERKINGTREDING

Regel 142, tweede lid, van het Uitvoeringsreglement bij het Verdrag en artikel 2, eerste lid, punt 2, derde streepje, van het Taksenreglement, zoals gewijzigd bij Besluit CA/D 2/20 van 27 maart 2020, zijn ingevolge artikel 3 van het Besluit op 1 juli 2020 in werking getreden.

Wat betreft het Koninkrijk der Nederlanden, zal de wijziging voor Nederland (het Europese deel en het Caribische deel), Curaçao en Sint Maarten gelden.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat de wijziging van het Uitvoeringsreglement bij het Verdrag zal zijn bekendgemaakt in Nederland (het Europese en het Caribische deel), Curaçao en Sint Maarten op de dag na de datum van uitgifte van dit Tractatenblad.
