A. TITEL

Notawisseling houdende een Verdrag tussen het Koninkrijk der Nederlanden, ten behoeve van Sint Maarten, en de Franse Republiek inzake de rechtspositie van militairen en ander overheidspersoneel, aanwezig op elkaars grondgebied, in het kader van de COVID-19-crisis en humanitaire noodhulp bij orkanen;

B. TEKST

Bij notawisseling tussen het Koninkrijk der Nederlanden, ten behoeve van Sint Maarten, en de Franse Republiek is op 6 augustus 2020 te ’s-Gravenhage een verdrag tot stand gekomen. De tekst van dit in nota’s vervatte verdrag luidt als volgt:

The Embassy of France in the Kingdom of the Netherlands presents its compliments to Ministry of Foreign Affairs of the Kingdom of the Netherlands and has the honour to refer to the Exchange of Notes constituting an Agreement between the Government of the French Republic, and the Government of the Kingdom of the Netherlands, for Sint Maarten, on the legal status of French armed forces and other French government bodies in the framework of the aftermath of hurricane Irma, done at The Hague, on 30 January 2018.

In case a hurricane hits Saint-Martin/Sint Maarten, and taking into consideration the serious sanitary crisis due to the COVID-19 which Saint-Martin/Sint Maarten and the surrounding islands are facing, and the need, for the French forces and the Dutch forces, to bring an emergency support and humanitarian assistance to the population of Saint-Martin/Sint Maarten, the Embassy of France in the Kingdom of the Netherlands has the honour to propose to the Government of the Kingdom of the Netherlands, for Sint Maarten, to conclude a short-term agreement whereby French forces and Dutch forces, in relation with the authorities of Saint-Martin/Sint Maarten, are granted permission to enter and be present in Saint-Martin/Sint Maarten in case it is necessary to provide an emergency support, notably sanitary, and humanitarian assistance to the population of Saint-Martin/Sint Maarten.

The Embassy of France in the Kingdom of the Netherlands proposes that this Agreement concerns the following:

For the French forces:

  • • the use of Philipsburg harbour as sea port of disembarkation (Sea Port of Disembarkation – SPOD);

  • • maritime operations, for French warships and other government ships operated for non-commercial purposes, in the territorial waters of Sint Maarten, and access of the Dutch forces on board these ships;

  • • air operations, for French aircrafts used in military, customs and police services, in the airspace of Sint Maarten, and access of the Dutch forces on board these aircrafts;

  • • the use of Princess Juliana international airport as airport of disembarkation (Airport Of Disembarkation – APOD);

  • • the transit of French armed forces or government forces with their weapons, ammunitions and equipment, including border-crossing, facilitated by escorts carried out by the Police Force of Sint Maarten, through the territory of Sint Maarten to the border-crossing point of Sint Maarten, or to any location where the emergency support or humanitarian assistance shall be required from the French forces by the Dutch authorities;

For the Dutch forces:

  • • the use of Marigot harbour as sea port of disembarkation (Sea Port of Disembarkation – SPOD);

  • • maritime operations, for Dutch warships and other government ships operated for non-commercial purposes, in the territorial waters of Saint-Martin and access of the French forces on board these ships;

  • • air operations, for Dutch aircrafts used in military, customs and police services, in the airspace of Saint-Martin, and access of the French forces on board these aircrafts;

  • • the use of Grand-Case international airport as airport of disembarkation (Airport Of Disembarkation – APOD);

  • • the transit of Dutch armed forces or government forces with their weapons, ammunitions and equipment, including border-crossing, facilitated by escorts carried out by the French national police or national gendarmerie, through the territory of Saint-Martin to the border-crossing point of Saint-Martin, or to any location where the emergency support or humanitarian assistance shall be required from the Dutch forces by the French authorities.

The forces of each of the parties shall respect the legislation in force in the territory in which they are located.

This note together with the affirmative note in reply do not have the effect of repealing the agreements and arrangements previously concluded in the field of defence and security between the Government of the French Republic and the Government of the Kingdom of the Netherlands or their competent authorities, and in particular the framework technical arrangement between the minister of Defence of the French Republic and the minister of Defence the Kingdom of the Netherlands on regional military cooperation activities in the Antilles and Guiana and in the Caribbean part of the Kingdom of the Netherlands, signed in Fort-de-France on 2 April 2019 and in Curaçao on 24 April 2019, the stipulations of which are applicable to operations carried out within the framework of this Agreement.

If the foregoing is acceptable to the Government of the Kingdom of the Netherlands, the Government of the French Republic proposes that this Note together with the affirmative Note in reply from the Government of the Kingdom of the Netherlands shall constitute an Agreement between the Government of the French Republic and the Government of the Kingdom of the Netherlands, for Sint Maarten, concluded in the French and English languages, both versions being equally authentic. The Agreement shall enter into force on the date of the Ministry of Foreign Affairs of the Kingdom of the Netherlands’s Note in reply and shall remain in force for a period of one year. The Government of the French Republic further proposes that the Agreement may be renewed by mutual written agreement of the Parties.

The Embassy of France in the Kingdom of the Netherlands avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Kingdom of the Netherlands the assurances of its highest consideration.

MINISTRY OF FOREIGN AFFAIRS OF THE KINGDOM OF THE NETHERLANDS

The Ministry of Foreign Affairs of the Kingdom of the Netherlands presents its compliments to the Embassy of France in the Kingdom of the Netherlands and has the honour to acknowledge receipt of the Embassy’s Note No. CE-2020-0286966 of 4 August 2020, which reads as follows:

The Ministry of Foreign Affairs of the Kingdom of the Netherlands has further the honour to inform that the proposals set forth in the Embassy’s Note No. CE-2020-0286966 of 4 August 2020 are acceptable to the Government of the Kingdom of the Netherlands and to confirm that the mentioned Note and this Note in reply shall constitute an Agreement between the Government of the Kingdom of the Netherlands, in respect of Sint Maarten, and the Government of the French Republic, concluded in the English and French languages, both versions being equally authentic. This Agreement shall enter into force on the date of this Note in reply and shall remain in force for a period of one year. The Ministry of Foreign Affairs of the Kingdom of the Netherlands also has the honour to confirm that the Agreement may be renewed by mutual written agreement of the Parties.

AMBASSADE DE FRANCE AUPRÈS DU ROYAUME DES PAYS-BAS

L’Ambassade de France auprès du Royaume des Pays-Bas présente ses compliments au Ministère des Affaires étrangères du Royaume des Pays-Bas, et a l’honneur de porter à son attention l’échange de notes constituant un Accord entre le Gouvernement de la République française et le Gouvernement du Royaume des Pays-Bas, pour Sint Maarten, sur le statut juridique des forces armées françaises et d’autres organes gouvernementaux français dans le cadre des opérations menées à la suite de l’ouragan Irma, conclu à La Haye le 30 janvier 2018.

Dans le cas où Saint-Martin/Sint Maarten serait touchée par un ouragan, et au vu de la grave crise sanitaire liée au COVID-19 à laquelle font face Saint-Martin/Sint Maarten et les îles environnantes, et du besoin pour les forces françaises et les forces néerlandaises d’apporter un soutien d’urgence et une assistance humanitaire à la population de Saint-Martin/Sint Maarten, l’Ambassade de France auprès du Royaume des Pays-Bas a l’honneur de proposer la conclusion d’un accord à court terme autorisant les forces françaises et les forces néerlandaises, en liaison avec les autorités de Saint-Martin/Sint Maarten, à entrer et à stationner à Saint-Martin/Sint Maarten, dans le cas où il serait nécessaire d'apporter un soutien d’urgence, notamment sanitaire, et une assistance humanitaire à la population de Saint-Martin/Sint Maarten.

L’Ambassade de France auprès du Royaume des Pays-Bas propose que cet accord porte sur les points suivants:

Pour les forces françaises :

  • • l’utilisation du port de Philipsburg comme port maritime de débarquement (Sea Port Of Disembarkation – SPOD) ;

  • • la conduite, par les navires de guerre et autres navires d’Etat français utilisés à des fins non commerciales, d’opérations maritimes dans les eaux territoriales de Sint Maarten, et l’accès des forces néerlandaises à bord de ces navires ;

  • • la conduite, par les aéronefs français utilisés dans des services militaires, de douane ou de police, d’opérations aériennes dans l’espace aérien de Sint Maarten, et l’accès des forces néerlandaises à bord de ces aéronefs ;

  • • l’utilisation de l’aéroport international Princess Juliana comme aéroport de débarquement (Airport Of Disembarkation – APOD) ;

  • • le transit des forces armées ou forces gouvernementales françaises, avec leurs armes, munitions et équipements, y compris le passage de la frontière, facilité par une escorte fournie par la police de Sint Maarten, à travers le territoire de Sint Maarten jusqu’au point de passage frontalier de Sint Maarten ou jusqu’à tout point vers lequel le soutien d’urgence ou l’assistance humanitaire est demandé aux forces françaises par les autorités néerlandaises ;

Pour les forces néerlandaises :

  • • l’utilisation du port de Marigot comme port maritime de débarquement (Sea Port Of Disembarkation – SPOD) ;

  • • la conduite, par les navires de guerre et autres navires d’Etat néerlandais utilisés à des fins non commerciales, d’opérations maritimes dans les eaux territoriales de Saint-Martin, et l’accès des forces françaises à bord de ces navires;

  • • la conduite, par les aéronefs néerlandais utilisés dans des services militaires, de douane ou de police, d’opérations aériennes dans l’espace aérien de Saint-Martin et l’accès des forces françaises à bord de ces aéronefs;

  • • l’utilisation de l’aéroport international de Grand-Case comme aéroport de débarquement (Airport Of Disembarkation – APOD);

  • • le transit des forces armées ou forces gouvernementales néerlandaises, avec leurs armes, munitions et équipements, y compris le passage de la frontière, facilité par une escorte fournie par les services de la police nationale ou de la gendarmerie nationale française, à travers le territoire de Saint-Martin jusqu’au point de passage frontalier de Saint-Martin ou jusqu’à tout point vers lequel le soutien d’urgence ou l’assistance humanitaire est demandé aux forces néerlandaises par les autorités françaises.

Les forces armées de chacune des Parties respectent la législation en vigueur sur le territoire sur lequel elles se trouvent.

La présente note et la note d’acceptation en réponse n’ont pas pour effet d’abroger les accords et arrangements conclus antérieurement dans les domaines de la défense et de la sécurité entre le Gouvernement de la République française et le Gouvernement du Royaume des Pays-Bas ou leurs autorités compétentes, et notamment l’arrangement technique cadre entre le ministre de la défense de la République française et le ministre de la défense du Royaume des Pays-Bas relatif aux activités de coopération militaire régionale aux Antilles et en Guyane françaises et dans la partie caribéenne du Royaume des Pays-Bas, signé à Fort de France le 2 avril 2019 et à Curaçao le 24 avril 2019, dont les stipulations sont applicables aux opérations menées dans le cadre du présent accord.

Si cette proposition est acceptable pour le Gouvernement du Royaume des Pays-Bas, le Gouvernement de la République française propose que la présente note ainsi que la note d’acceptation en réponse du Gouvernement du Royaume des Pays-Bas constituent un accord entre le Gouvernement de la République française et le Gouvernement du Royaume des Pays-Bas, pour Sint Maarten, conclu en langues française et anglaise, les deux versions faisant également foi. Cet accord entre en vigueur à la date de signature de la note du Ministère des Affaires étrangères du Royaume des Pays-Bas en réponse et reste en vigueur pour une durée d’un an. Le Gouvernement de la République française propose également que cet accord puisse être reconduit par consentement mutuel écrit des Parties.

L’Ambassade de France auprès du Royaume des Pays-Bas saisit cette occasion pour renouveler au Ministère des Affaires étrangères du Royaume des Pays Bas les assurances de sa plus haute considération.

LE MINISTÈRE DES AFFAIRES ÉTRANGÈRES DU ROYAUME DES PAYS-BAS

Le Ministère des Affaires étrangères du Royaume des Pays-Bas présente ses compliments à l’Ambassade de France auprès du Royaume des Pays-Bas et a l’honneur d’accuser réception de la note N° CE-2020-0286966 du 4 août 2020 de l’Ambassade, dont le texte se lit comme suit :

Le Ministère des Affaires étrangères du Royaume des Pays-Bas a l’honneur de faire savoir que les propositions présentées dans la note N° CE-2020-0286966 du 4 août 2020 de l’Ambassade de France auprès du Royaume des Pays-Bas sont acceptables pour le Gouvernement du Royaume des Pays-Bas, et de confirmer que la note susmentionnée, ainsi que la présente note en réponse constituent un accord entre le Gouvernement du Royaume des Pays-Bas, pour Sint Maarten, et le Gouvernement de la République française, conclu en langues anglaise et française, les deux versions faisant également foi. Cet accord entre en vigueur à la date de signature de la présente note en réponse et reste en vigueur pour une durée d’un an. Le Ministère des Affaires étrangères du Royaume des Pays-Bas a l’honneur de confirmer que cet accord peut être reconduit par consentement mutuel écrit des Parties.

D. PARLEMENT

Het in de nota’s vervatte verdrag behoeft ingevolge artikel 7, onderdeel c, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal.

G. INWERKINGTREDING

De bepalingen van het in de nota’s vervatte verdrag zijn ingevolge het gestelde in de voorlaatste alinea’s van nota’s Nr. I en II op 6 augustus 2020 in werking getreden en blijven ingevolge diezelfde alinea’s van kracht tot 6 augustus 2021.

Wat betreft het Koninkrijk der Nederlanden, geldt het in de nota’s vervatte verdrag alleen voor Sint Maarten.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat het in de nota’s vervatte verdrag zal zijn bekendgemaakt in Sint Maarten op de dag na de datum van uitgifte van dit Tractatenblad.
