A. TITEL

Protocol tot wijziging van de Veiligheidsbijlage bij de Overeenkomst tussen Staten die partij zijn bij het Noordatlantisch Verdrag, tot samenwerking inzake atoomgegevens;

B. TEKST


Protocol amending the Security Annex to the Agreement between the Parties to the North Atlantic Treaty for Co-operation regarding Atomic Information

Considering that developments in the security of Atomic information require the revision of the frequency of the comprehensive security inspection of all NATO military and civilian elements and member nations which have received information under the Agreement between the Parties to the North Atlantic Treaty for Co-operation regrading Atomic information,

the undersigned Parties have agreed as follows:

Article 1

The Security annex to the Agreement between the Parties to the North Atlantic Treaty for Co-operation regarding Atomic information done at Paris on June 18, 1964 is hereby amended as provided for in Article 2.

Article 2

The first sentence of section X, Security Inspections, paragraph A, of the Security Annex to the Agreement between the Parties to the North Atlantic Treaty for Cooperation regarding Atomic information shall be replaced by the following sentence:

  • “A. Comprehensive security inspection of all NATO military and civilian elements and member nations which have received Atomic information under the Agreement shall be made regularly, during a period to be determined by the North Atlantic Council on a recommendation by the NATO Security Committee, in accordance with the criteria set forth in Section I, Paragraph A of this Annex.”

Article 3

This Protocol shall enter into force upon receipt by the Government of the United States of America of notification from all states Parties to the Agreement between the Parties to the North Atlantic Treaty for Co-operation regarding Atomic information, that they are willing to be bound by the terms of this Protocol.

Article 4

The Government of the United States of America shall inform all parties and the North Atlantic Treaty Organization, of each notification and of the entry into force of this Protocol.

Article 5

This Protocol shall bear the date on which it is opened for signature and shall remain open for signature until it has been signed by all Parties to the Agreement between the Parties to the North Atlantic Treaty for Co-operation regarding Atomic information.

IN WITNESS WHEREOF, the undersigned representatives have signed the present Protocol.

DONE at Brussels, this 2nd day of June 1998, in the English and French languages, both texts being equally authoritative, in a single original which shall be deposited in the archives of the Government of the United States of America, who shall transmit certified copies thereof to all the signatory and acceding States.


Protocole modifiant l’Annexe de Sécurité à l’Accord entre les Etats parties au Traité de l’Atlantique Nord sur la coopération dans le domaine des renseignements atomiques

Considérant que l’évolution intervenue dans la sécurité des renseignements atomiques nécessite la révision de la fréquence des inspections générales de sécurité de tous les organismes militaires et civils de l’OTAN et des Etats membres ayant reçu des renseignements en vertu de l’Accord entre les Etats parties au Traité de l’Atlantique Nord sur la coopération dans le domaine des renseignements atomiques,

Les Parties soussignées sont convenues de ce qui suit:

Article 1

L’Annexe de sécurité à l’Accord entre les Etats parties au Traité de l’Atlantique Nord sur la coopération dans le domaine des renseignements atomiques, fait à Paris le 18 juin 1964, est modifiée par le présent Protocole, ainsi qu’il est stipulé à l’article 2.

Article 2

La première phrase du paragraphe A de la section X (Inspections de sécurité) de l’Annexe de sécurité à l’Accord entre les Etats parties au Traité de l’Atlantique Nord sur la coopération dans le domaine des renseignements atomiques est remplacée par la phrase suivante:

  • «A. Des inspections générales de sécurité de tous les organismes militaires et civils de l’OTAN et des Etats membres ayant reçu des renseignements atomiques en vertu de l’Accord seront effectuées régulièrement, au cours d’ une période devant être déterminée par le Conseil de l’Atlantique Nord sur recommandation du Comité de sécurité de l’OTAN, selon les dispositions prévues à la section I, paragraphe A. de la présente Annexe.»

Article 3

Le présent Protocole entrera en vigueur lorsque le gouvernement des Etats-Unis d’ Amérique aura reçu notification, de tous les Etats parties à l’Accord entre les Etats parties au Traité de l’Atlantique Nord sur la coopération dans le domaine des renseignements atomiques, de leur volonté d’être liés par les termes du présent Protocole.

Article 4

Le gouvernement des Etats-Unis d’ Amérique informera toutes les Parties et l’Organisation du Traité de l’Atlantique Nord de chaque notification, et de l’entrée en vigueur du présent Protocole.

Article 5

Le présent Protocole portera la date à laquelle il sera ouvert à la signature, et il restera ouvert à la signature jusqu’à ce qu’il ait été signé par toutes les Parties à l’Accord entre les Etats parties au Traité de l’Atlantique Nord sur la coopération dans le domaine des renseignements atomiques.

EN FOI DE QUOI, les représentants ci-dessous ont signé le présent Protocole.

FAIT à Bruxelles, le 2 juin 1998, en langues française et anglaise, chaque texte faisant également foi, en un seul exemplaire original qui sera versé aux archives du gouvernement des Etats-Unis d’Amérique, qui en transmettra des copies certifiées conformes à tous les Etats signataires et accédants.

D. PARLEMENT

Het Protocol behoeft ingevolge artikel 91 van de Grondwet, juncto artikel 11, eerste lid, van de Rijkswet goedkeuring en bekendmaking verdragen, alsnog de goedkeuring van de Staten-Generaal.

G. INWERKINGTREDING

De bepalingen van het Protocol zullen ingevolge artikel 3 van het Protocol in werking treden wanneer de Regering van de Verenigde Staten van Amerika van alle staten die partij zijn bij de Overeenkomst tussen Staten die partij zijn bij het Noordatlantisch Verdrag tot samenwerking inzake atoomgegevens een kennisgeving heeft ontvangen dat zij bereid zijn te worden gebonden door de bepalingen van dit Protocol.
