A. TITEL

Verdrag tussen het Koninkrijk der Nederlanden en de Republiek Moldavië inzake wederzijdse administratieve bijstand in douanezaken; (met Bijlage)

B. TEKST

Bij notawisseling tussen het Koninkrijk der Nederlanden en de Republiek Moldavië is op 29 augustus 2019 te Chisinau een verdrag tot stand gekomen, waarin het Verdrag tussen het Koninkrijk der Nederlanden en de Republiek Moldavië inzake wederzijdse administratieve bijstand in douanezaken, met Bijlage, wordt uitgebreid tot Aruba, Curaçao en Sint Maarten. De tekst van dit in nota’s vervatte verdrag luidt als volgt:

The Embassy Office of the Kingdom of the Netherlands in the Republic of Moldova presents its compliments to the Ministry of Foreign Affairs and European Integration of the Republic of Moldova and has the honour to refer to the Agreement between the Kingdom of the Netherlands and the Republic of Moldova on mutual administrative assistance in customs matters, signed at Chisinau on 19 June 2006 (hereinafter referred to as “the Agreement of 2006”).

The Government of the Kingdom of the Netherlands proposes that, in accordance with Article 21, paragraphs 2 and 3, of the Agreement of 2006, the application of the Agreement of 2006 shall be extended to Aruba, Curaçao and Sint Maarten, subject to the following:

  • 1. For the Kingdom of the Netherlands, the term “customs administration” in Article 1, under a), of the Agreement of 2006 shall mean, as regards Aruba, Curaçao and Sint Maarten, the respective central administration responsible for the implementation of customs laws.

  • 2. Article 2, paragraph 4, of the Agreement of 2006 shall apply only to Aruba, Curaçao and Sint Maarten, as the case may be, insofar as the agreements or arrangements referred to therein apply to those respective parts of the Kingdom of the Netherlands.

  • 3. As regards Aruba, Curaçao and Sint Maarten, the requirements of national law within the meaning of Article 17 of the Agreement of 2006 fall under the scope of the Ordinance on person registration or the Kingdom Act Administrative Assistance, as the case may be.

If the foregoing is acceptable to the Government of the Republic of Moldova, the Embassy Office of the Kingdom of the Netherlands in the Republic of Moldova has the further honour to propose that this Note and the Ministry’s Note in reply shall constitute an Agreement between the Kingdom of the Netherlands and the Republic of Moldova which shall enter into force on the first day of the second month following the date of receipt of the later notification in which one Contracting Party informs the other Contracting Party that the formalities required for the entry into force of this Agreement have been complied with.

The Embassy Office of the Kingdom of the Netherlands in the Republic of Moldova avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Moldova the assurance of its highest consideration.

Nr. II

THE MINISTRY OF FOREIGN AFFAIRS AND EUROPEAN INTEGRATION OF THE REPUBLIC OF MOLDOVA

The Ministry of Foreign Affairs and European Integration of the Republic of Moldova presents its compliments to the Embassy Office of the Kingdom of the Netherlands to the Republic of Moldova and has the honour to conform the receipt of the Verbal Note No. CHS/2019/050 dated from 6 August 2019, with the following content:

The Ministry confirms that the above proposal is acceptable to the Government of the Republic of Moldova and that the Embassy’s Office of the Kingdom of the Netherlands in the Republic of Moldova Note and this Note in reply shall constitute an Agreement between the Republic of Moldova and the Kingdom of the Netherlands which shall enter into force on the first day of the second month following the date of receipt of the later notification in which one Contracting Party informs the other Contracting Party that the formalities required for the entry into force of this Agreement have been complied with.

D. PARLEMENT

Het in de nota’s vervatte verdrag behoeft ingevolge artikel 91 van de Grondwet de goedkeuring van de Staten-Generaal, alvorens het Koninkrijk aan het in de nota’s vervatte verdrag kan worden gebonden.

G. INWERKINGTREDING

De bepalingen van het in de nota’s vervatte verdrag zullen ingevolge het gestelde in de op één na laatste alinea van respectievelijk nota’s Nr. I en II in werking treden op de eerste dag van de tweede maand volgend op de datum van ontvangst van de laatste kennisgeving waarin de ene partij aan de andere partij mededeelt dat aan alle noodzakelijke interne procedures voor de inwerkingtreding is voldaan.
