A. TITEL

Verdrag tussen het Koninkrijk der Nederlanden en Australië inzake de aanwezigheid van Australisch overheidspersoneel in Nederland ten behoeve van de reactie op het neerhalen van vlucht MH17 van Malaysia Airlines;

D. PARLEMENT

Het Vijfde Protocol van 29 juni 2018 tot verlenging van het Verdrag, opgenomen in rubriek H hieronder, behoeft ingevolge artikel 7, onderdeel e, van de Rijkswet goedkeuring en bekendmaking verdragen, niet de goedkeuring van de Staten-Generaal.

G. INWERKINGTREDING

Het Verdrag, waarvan de geldigheid op 30 juni 2018 zou aflopen, blijft ingevolge artikel 1 van het in rubriek H hieronder opgenomen Vijfde Protocol tot uiterlijk 30 juni 2019 van kracht.

Het Vijfde Protocol tot verlenging van het Verdrag, opgenomen in rubriek H hieronder, is ingevolge artikel 2 op 29 juni 2018 in werking getreden en zal ingevolge artikel 1 van het Protocol niet langer dan tot 30 juni 2019 van kracht zijn.

Wat betreft het Koninkrijk der Nederlanden, geldt het Vijfde Protocol, evenals het Verdrag, alleen voor Nederland (het Europese deel).

H. VERLENGING

Op 29 juni 2018 is een Vijfde Protocol tot stand gekomen tussen het Koninkrijk der Nederlanden en Australië waarmee het Verdrag van 1 augustus 2014, waarvan de geldigheid op 30 juni 2018 zou aflopen, in overeenstemming met artikel 22 van het Verdrag, tot uiterlijk 30 juni 2019 wordt verlengd.

De Engelse tekst van het Vijfde Protocol luidt als volgt:


Fifth Protocol Establishing the Prolongation of the Treaty between the Kingdom of the Netherlands and Australia on the Presence of Australian Personnel in the Netherlands for the Purpose of Responding to the Downing of Malaysia Airlines Flight MH17

The Kingdom of the Netherlands,

And

Australia

Referring to the Treaty between the Kingdom of the Netherlands and Australia on the Presence of Australian Personnel in the Netherlands for the Purpose of Responding to the Downing of Malaysia Airlines Flight MH17, concluded on 1 August 2014 (hereinafter “the Treaty”),

Referring also to the Fourth Protocol Establishing the Prolongation of the Treaty between the Kingdom of the Netherlands and Australia on the Presence of Australian Personnel in the Netherlands for the Purpose of Responding to the Downing of Malaysia Airlines Flight MH17 (hereinafter “the Fourth Protocol”),

Recalling the expiry of the Treaty as prolonged by the Fourth Protocol as per 30 June 2018,

Desiring to continue their good co-operation as reflected in the Treaty,

Have agreed on the following:

Article 1

The Treaty, the prolongation of which is due to expire on 30 June 2018, shall, on the entry into force of this Fifth Protocol, be prolonged until the completion of the Activity, as referred to in Article 1 and under the terms of Article 22 of the Treaty, but not later than 30 June 2019.

Article 2

This Fifth Protocol shall enter into force on the date of its last signature.

IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their respective Governments, have signed this Agreement.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat het Vijfde Protocol van 29 juni 2018 zal zijn bekendgemaakt in Nederland (het Europese deel) op de dag na de datum van uitgifte van dit Tractatenblad.
