A. TITEL

Notawisseling houdende een verdrag tussen het Koninkrijk der Nederlanden en de Republiek Uganda betreffende de status van personeel van het Ministerie van Defensie van het Koninkrijk der Nederlanden, dat aanwezig zal zijn op het grondgebied van de Republiek Uganda voor multilaterale trainings- en opleidingsactiviteiten;

D. PARLEMENT

Het in nota’s vervatte verlengingsverdrag, opgenomen in rubriek H hieronder, behoeft ingevolge artikel 7, onderdeel e, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal.

G. INWERKINGTREDING

Het in nota’s vervatte verlengingsverdrag, opgenomen in rubriek H hieronder, is op 23 oktober 2017, met terugwerkende kracht tot 18 september 2017, in werking getreden.

Het verdrag van 18 september 2012, waarvan de geldigheid op 18 september 2017 zou aflopen, blijft ingevolge het gestelde in de tweede alinea van respectievelijk de nota’s Nrs. II en III van kracht voor een volgende periode van een jaar, tot 18 september 2018.

Wat betreft het Koninkrijk der Nederlanden, geldt het in nota’s vervatte verlengingsverdrag van 23 oktober 2017, evenals het verdrag van 18 september 2012, voor Nederland (het Europese deel).

H. VERLENGING

Bij nota’s van respectievelijk 13 juli, 15 september en 23 oktober 2017 is een verdrag tot stand gekomen tussen het Koninkrijk der Nederlanden en de Republiek Uganda, waarin het Verdrag van 18 september 2012, waarvan de geldigheid op 18 september 2017 zou aflopen, met een periode van een jaar wordt verlengd tot 18 september 2018. De tekst van dit in nota’s vervatte verdrag luidt als volgt:

The Embassy of the Kingdom of the Netherlands presents its compliments to the Ministry of Foreign Affairs of the Republic of Uganda and has the honour to refer to the Agreement between the Kingdom of the Netherlands and the Republic of Uganda regarding the status of personnel of the Ministry of Defence of the Kingdom of the Netherlands who will be present in the territory of the Republic of Uganda for multilateral training and education activities, concluded on 18 September 2012 and to the Exchanges of Notes of 23 October 2013, 16 September 2014 and 2 June 2016 establishing the prolongation of the said Agreement until 18 September 2017.

The Embassy, on behalf of the Kingdom of the Netherlands, has the honor to propose that the Agreement between the Republic of Uganda and the Kingdom of the Netherlands referred to above shall be prolonged with one year. In this respect the Embassy would like to draw attention to the enclosed draft text for an Exchange of Notes regarding the prolongation of the said Agreement (see Annex 1).

If this proposal and the text of the Exchange of Notes are acceptable to Government of the Republic of Uganda, the Embassy proposes that this Exchange of Notes could be exchanged at a date to be determined at a later stage. The Exchange of Notes may only be exchanged after the necessary internal procedures in the Kingdom of the Netherlands have been fulfilled.

The Embassy of the Kingdom of the Netherlands avails itself of this opportunity to renew to the Ministry of the Republic of Uganda the assurances of its highest consideration.

[Annex I]

The Embassy of the Kingdom of the Netherlands presents its compliments to the Ministry of Foreign Affairs of the Republic of Uganda and has the honor to refer to the Agreement between the Kingdom of the Netherlands and the Republic of Uganda regarding the status of personnel of the Ministry of Defence of the Kingdom of the Netherlands who will be present in the territory of the Republic of Uganda for multilateral training and education activities, constituted by exchange of notes at Kampala on 18 September 2012 (the Agreement), which was extended twice for a period of one year and once for a period of two years, and which would have terminated, in accordance with its terms, on 18 September 2017.

Desiring to continue military cooperation between the military forces, and in view of multilateral training and education activities, the Kingdom of the Netherlands proposes that the Agreement shall be extended for an additional period of one year, so that the Agreement will remain in force until 18 September 2018.

Desiring to continue the protection of the military personnel of the Kingdom of the Netherlands, the Embassy proposes that the provisions of the Agreement shall remain applicable to the military present in the Republic of Uganda for activities related to the participation in the United Nations Mission in the Republic of South Sudan (UNMISS) and for activities related to the recuperation in connection with that participation in UNMISS.

If the foregoing is acceptable to the Government of the Republic of Uganda, the Embassy proposes that this Note, together with the Note in reply from the Ministry of Foreign Affairs, shall constitute an Agreement between the Kingdom of the Netherlands and the Republic of Uganda, which shall enter into force on the date of the Ministry’s Note, with retroactive effect to 18 September 2017.

The Embassy of the Kingdom of the Netherlands avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Uganda the assurances of its highest consideration.

THE MINISTRY OF FOREIGN AFFAIRS OF THE REPUBLIC OF UGANDA

The Ministry of Foreign Affairs of the Republic of Uganda presents its compliments to the Embassy of the Kingdom of the Netherlands and has the honor to refer to the agreement between the Kingdom of the Netherlands and the Republic of Uganda regarding the status of personnel of the Ministry of Defence of the Kingdom of the Netherlands who will be present in the territory of the Republic of Uganda for multilateral training and education activities constituted by exchange of notes at Kampala on 18^th September 2012.

The Ministry further has the honor to inform the Embassy that the proposals set forth in the Embassy’s Note are acceptable to the Government of the Republic of Uganda and to confirm that the Embassy’s Note and this Note shall constitute an agreement between the Kingdom of the Netherlands and the Republic of Uganda which shall enter into force on the date of this Note.

The Ministry of Foreign Affairs of the Republic of Uganda avails itself of this opportunity to renew to the Embassy of the kingdom of the Netherlands the assurances of its highest consideration.

EMBASSY OF THE KINGDOM OF THE NETHERLANDS

The Embassy of the Kingdom of the Netherlands presents its compliments to the Ministry of Foreign Affairs of the Republic of Uganda and has the honor to refer to the Agreement between the Kingdom of the Netherlands and the Republic of Uganda regarding the status of personnel of the Ministry of Defence of the Kingdom of the Netherlands who will be present in the territory of the Republic of Uganda for multilateral training and education activities, constituted by an exchange of Notes at Kampala on 18 September 2012 (“the Agreement”).

The Embassy acknowledges receipt of the Ministry’s Note Verbale No. MOT/367/369/01 of 15 September 2017 and confirms that the Agreement has been extended for an additional period of one year until 18 September 2018.

The Embassy of the Kingdom of the Netherlands avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Uganda the assurances of its highest consideration.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat het in nota’s vervatte verlengingsverdrag van 23 oktober 2017 zal zijn bekendgemaakt in Nederland (het Europese deel) op de dag na de datum van uitgifte van dit Tractatenblad.
