Protocol on Privileges and Immunities of the Unified Patent Court

The undersigning Contracting Member States of the Agreement on a Unified Patent Court,

Considering that the Unified Patent Court has been established by the Agreement on a Unified Patent Court of 19 February 2013 as an international organisation with legal personality in each Contracting Member State;

Recalling that the Agreement on a Unified Patent Court provides, in Article 37(1), that Contracting Member States hosting the central division of the Court of First Instance or one of its sections, a local or regional division of the Court of First Instance or the Court of Appeal of the Unified Patent Court shall provide facilities and, during the initial seven years, also administrative support staff;

Recalling that the Statute of the Unified Patent Court provides, in Article 8, that the Protocol on the privileges and immunities of the European Union shall apply to the judges of the Unified Patent Court;

Recalling that Article 8(4) of the Statute of the Unified Patent Court covers both the privileges and immunities of the judges of the Unified Patent Court and that the application of the Protocol on the privileges and immunities of the European Union to the judges of the Unified Patent Court has been foreseen because of the intrinsic link of the latter with the European patent with unitary effect and cannot create any precedent for the application of that Protocol to other international organizations with regard to the host nation policies of the Contracting Member States;

Recalling that the Administrative Committee has the competence to set up an internal tax and a social security scheme under the powers of administration which are conferred to it by the Unified Patent Court Agreement;

Recalling that the Agreement on a Unified Patent Court provides, in Article 4, that the Unified Patent Court shall enjoy the most extensive legal capacity accorded to legal persons under the national law of that State;

Recognizing that the Unified Patent Court needs to benefit from privileges and immunities which are necessary for the exercise of its functions;

Considering that a common approach on how to address issues of privileges and immunities is essential in view of the needs of the Unified Patent Court and of the Contracting Member States;

Recognizing that additional bilateral Headquarter Agreements may be concluded between the Unified Patent Court and Contracting Member States hosting the central division of the Court of First Instance or one of its sections, a local or regional division of the Court of First Instance or the Court of Appeal of the Unified Patent Court.

Have agreed as follows:

Article 1 Use of terms

For the purpose of this Protocol:

a) “Agreement”

means the Agreement on a Unified Patent Court of 19 February 2013;

b) “Statute”

means the Statute of the Unified Patent Court as set out in Annex I of the Agreement;

c) “State Party”

means a State party to this Protocol;

d) “Contracting Member State”

means a State party to the Agreement;

e) “Court”

means the Unified Patent Court created by the Agreement;

f) “Court of Appeal”

means the Court of Appeal of the Court;

g) “The official activities of the Court”

means the activities that are necessary for the fulfilment by the Court of the purposes and functions it has been entrusted with in accordance with the provisions of the Agreement;

h) “Premises of the Court”

means land and buildings made available to the Court by the Contracting Member State in accordance with Article 37 of the Agreement and used for the official activities of the Court;

i) “Judge”

means a Judge of the Court.

j) “Registrar”

means the Registrar and the Deputy-Registrar of the Court.

k) “Staff”

means all personnel employed by the Court as officials and other servants of the Court except the Judges and the Registrar.

l) “Family”

means, with respect to any person, the spouse and dependent members of the immediate family of such person forming part of such person’s household, as recognised by the hosting Contracting Member State;

m) “Representatives of the parties”

means the lawyers, European patent attorneys or patent attorneys authorised to practice or assist before the Court under Article 48 of the Agreement.

Article 2 General provisions on privileges and immunities of the Court

The Court shall enjoy in the territory of each State Party such privileges and immunities as are necessary for the exercise of its official activities.

Article 3 Inviolability of the premises of the Court

The premises of the Court shall be inviolable, subject to such conditions as may be agreed with the State Party concerned and subject to the responsibility of the State Party hosting the central division of the Court of First Instance or one of its sections, a local or regional division of the Court of First Instance or the Court of Appeal with respect to the facilities that are to be provided by such a State Party.

Article 4 Inviolability of archives and documents

The archives of the Court, and all papers and documents in whatever form belonging to it, held by it or addressed to it shall be inviolable at all times and wherever they may be located.

Article 5 Immunity of the Court, its property, assets and funds

  • 1. The Court shall enjoy immunity from legal process, except:

    • a. insofar as in any particular case it has expressly waived its immunity;

    • b. as in the event of civil proceedings against it with respect to contractual liability brought by persons others than the Judges, the Registrar or the Staff of the Court;

    • c. as in cases of civil proceedings against it with respect to non-contractual liability except where the claim is based on the performance of the Court’s jurisprudence or

    • d. in the case of a civil proceeding brought by a third party for damages resulting from an accident caused by a motor vehicle belonging to, or operated on behalf of, the Court, or in respect of a motor traffic offence involving such a vehicle.

  • 2. The Court shall enjoy immunity from legal process in respect of search, requisition, confiscation, seizure or expropriation of, or any other form of interference with, the property, assets and funds of the Court, wherever located, without the authorisation of the Court.

  • 3. To the extent necessary to exercise its official activities, the property, assets and funds of the Court shall be exempt from restrictions, regulations, controls and moratoria of any nature.

Article 6 Immunity of Representatives of a State Party

  • 1. Representatives of a State Party shall enjoy, while attending meetings of the Administrative Committee, the Budget Committee and the Advisory Committee immunities from legal process in respect of all acts performed by them in their official capacity, including their words spoken or written. This immunity shall continue to be accorded even after the termination of their mission.

  • 2. Their official papers and documents shall be inviolable.

  • 3. No State Party is obliged to extend the immunities referred to in paragraph 1 and 2 to its own nationals or any person who at the time of taking up his functions with the Court has his permanent residence in that State.

Article 7 Exemption from taxes

  • 1. The Court, its property and assets, shall be exempt from all direct taxes.

  • 2. The Court shall

    • a. be exempt from or accorded a refund of value added taxes paid on any substantial purchase of goods and services which are necessary and supplied for the official activities of the Court, subject to the limitations laid down by the host State Party;

    • b. however not be exempt from taxes and dues which amount to charges for public utility services.

  • 3. Goods purchased under such an exemption or reimbursement shall not be sold or otherwise disposed of in that State Party or in another Member State of the European Union, except in accordance with the conditions laid down by the State Party which granted the exemption or reimbursement.

  • 4. Without prejudice to the obligations arising for the State Parties under European Union law and the application of laws and regulations, the conditions and procedure shall be determined by the competent fiscal authorities of each State Party.

Article 8 Funds and freedom from currency restrictions

The State Parties shall accord the Court the freedom of currency restrictions which is necessary for the exercise of its official activities.

Article 9 Privileges and Immunities of the Judges and the Registrar

  • 1. The privileges and immunities of the Judges are governed by Article 8 of the Statute and by reference in Article 8 of the Statute by the Protocol on the privileges and immunities of the European Union.

  • 2. Article 8 of the Statute and the Protocol on the privileges and immunities of the European Union shall apply to the Registrar.

  • 3. When applied in accordance with paragraph 1 and 2, only Article 11(b-e) to 14 of the Protocol on the privileges and immunities of the European Union are to be applied in analogy adapted to the specific circumstances of the Court. This means in particular that the Judges and the Registrar shall:

    • a. be liable to an internal tax for the benefit of the Court on salaries, wages and emoluments paid to them by the Court;

    • b. from the date on which the internal tax under letter (a) is applied, be exempted from national taxation on the salaries, wages and emoluments, paid to them by the Court, but not on pensions and annuities, paid to them by the Court;

    • c. from the date on which the Judges and the Registrar are subject to a social

      security and health scheme established by the Court, with respect to services rendered for the Court, be exempted from all compulsory contributions to national social security and health schemes.

Article 10 Immunities and privileges of the Staff

  • 1. The Staff shall be immune from legal process in respect of all acts performed by them in their official capacity, including their words spoken or written. This immunity shall continue to be accorded even after the termination of their employment with the Court.

  • 2. The Staff shall,

    • a. be liable to an internal tax for the benefit of the Court on salaries, wages and emoluments paid to them by the Court;

    • b. from the date on which the internal tax under letter (a) is applied, be exempted from national taxation on the salaries, wages and emoluments, but not on pensions and annuities, paid to them by the Court; these salaries, wages and emoluments may be taken into account by the State Parties for the purpose of assessing the amount of taxation to be applied to income from other sources;

    • c. from the date on which the Staff is subject to a social security and health scheme established by the Court, with respect to services rendered for the Court, be exempted from all compulsory contributions to national social security and health schemes.

  • 3. No State Party is obliged to extend the privileges referred to in paragraph 2 to its own nationals or to a person who immediately prior to the employment by the Court was a resident of that State Party.

Article 11 Emblem and flag

The Court shall be entitled to display its emblem and flag at its premises subject to such conditions as may be agreed with the State Party concerned, on vehicles used for official purposes as well as on its website and documents.

Article 12 Cooperation with the authorities of State Parties

  • 1. Without prejudice to their privileges and immunities, it is the duty of all persons enjoying privileges and immunities under Article 6, 9 and 10 to respect the laws and regulations of the State Party in whose territory they may operate in their official capacity.

  • 2. The Court shall cooperate at all times with the appropriate authorities of State Parties to facilitate the enforcement of their laws and to prevent the occurrence of any abuse in connection with the privileges, immunities and facilities referred to in this Protocol.

Article 13 Purpose and waiver of privileges and immunities provided for in Article 6, 9 and 10

  • 1. The privileges and immunities provided for in this Protocol are not established for the personal benefit of those persons in whose favour they are granted. Their purpose is solely in the interest of the Court, especially to ensure, in all circumstances, the freedom of action of the Court and the complete independence of the persons concerned.

  • 2. The Presidium of the Court shall have not only the right but also the duty to waive the immunity of Judges, the Registrar and the Staff under Articles 9 and 10, when it considers that such immunity would hinder the normal course of justice, and that it is possible to waive such immunity without prejudicing the interests of the Court. A State Party has the same right regarding its representatives in the Administrative Committee and the Budget Committee (Article 6). The Administrative Committee shall have the same right and obligation regarding the members of the Advisory Committee.

Article 14 Access, residence and departure

Without prejudice to European Union law, the concerned State Party shall take all the necessary steps to facilitate;

  • a. the entry into, departure from and residence in its territory of all persons who are performing official duties for the Court, namely the Judges, the Registrar, Staff employed by the Court and staff provided by the State Parties as well as, where persons performing official duties for the Court are based in the State Party and are not nationals or permanent residents of that State Party, dependent members of their families, and

  • b. the entry into and departure from its territory of all persons who are called to or summoned by the Court in an official capacity, namely parties, Representatives of parties, interpreters, witnesses and experts before the Court.

Article 15 Notification

The Registrar shall communicate within one month of the entry into force of this Protocol to all State Parties the names of the Judges, the Registrar and the Staff to whom this Protocol applies. In addition to above, appointment/arrival of any Judge, Registrar or Staff to the Court and any change of circumstances shall be reported as soon as possible and at the latest within one month of the date of the relevant change of circumstance.

Article 16 Settlement of disputes

  • 1. The Court shall make provisions for appropriate modes of settlement of disputes involving any person referred to in this Protocol who by reason of his or her official position enjoys immunity or the Court in cases when it enjoys immunity under Article 5, if such immunity has not been waived.

  • 2. All disputes arising out of the interpretation or application of this Protocol shall be referred to an arbitral tribunal unless the parties have agreed to another mode of settlement. If a dispute arises between the Court and a State Party which is not settled by consultation, negotiation or other agreed mode of settlement within three months following a request by one of the parties to the dispute, it shall at the request of either party be referred for final decision to a panel of three arbitrators: one to be chosen by the Court, one to be chosen by the State Party and the third, who shall be Chairman of the panel, to be chosen by the first two arbitrators. If either party has failed to make its appointment of an arbitrator within two months of the appointment of an arbitrator by the other party, the President of the European Court of Justice shall make such appointment. Should the first two arbitrators fail to agree upon the appointment of the third arbitrator within three months following the appointment of the first two arbitrators the third arbitrator shall be chosen by the President of the European Court of Justice upon the request of the Court or the State Party.

Article 17 Signature, ratification, acceptance, approval or accession and deposition

  • 1. This Protocol shall be open for signature by all Contracting Member States from 29 June 2016 until 29 June 2017 at the Council of the European Union in Brussels.

  • 2. This Protocol is subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the General Secretariat of the Council of the European Union, hereinafter referred to as the depositary.

  • 3. After 29 June 2017 this Protocol shall remain open for accession by all Contracting Member States. The instruments of accession shall be deposited with the depositary.

Article 18 Entry into force

  • 1. This Protocol shall enter into force 30 days after the date on which the last of the four State Parties – France, Germany, Luxemburg and the United Kingdom – has deposited its instrument of ratification, acceptance, approval or accession.

  • 2. For each State Party, which deposits its instrument after the date referred to in paragraph 1, this Protocol shall enter into force 30 days after the date of deposit of its instrument of ratification, acceptance, approval or accession.

Article 19 Provisional application

A Contracting Member State may at any time notify the depositary that it will apply this Protocol provisionally.

IN WITNESS WHEREOF, the undersigned, being duly authorized thereto, have signed this Protocol.

DONE at Brussels this 29th of June 2016 in the English, French and German languages, all three texts being equally authentic, in a single copy, which shall be deposited with the depositary who shall transmit a certified true copy to all signatory and acceding States.



Protocole sur les privilèges et immunités de la juridiction unifiée du brevet

Les États soussignés, parties contractantes à l’Accord relatif à une juridiction unifiée du brevet,

Considérant que la juridiction unifiée du brevet a été établie par l'Accord du 19 février 2013 relatif à une juridiction unifiée du brevet en qualité d'organisation internationale dotée de la personnalité morale dans chacun des Etats membres contractants ;

Rappelant que l'Accord relatif à une juridiction unifiée du brevet prévoit, en son article 37, paragraphe 1, que les Etats membres contractants sur le territoire desquels est situé la division centrale du tribunal de première instance ou l'une de ses sections, une division locale ou régionale du tribunal de première instance ou la cour d'appel de la juridiction unifiée du brevet fournissent les infrastructures nécessaires ainsi que, pendant les sept premières années, le personnel d'appui administratif ;

Rappelant que les statuts de la juridiction unifiée du brevet prévoient, en leur article 8, que le Protocole sur les privilèges et immunités de l'Union européenne est applicable aux juges de la juridiction unifiée du brevet ;

Rappelant que l'article 8, paragraphe 4, des statuts de la juridiction unifiée du brevet couvrent à la fois les privilèges et les immunités des juges de la juridiction unifiée du brevet et que l'application du Protocole sur les privilèges et immunités de l'Union européenne aux juges de la juridiction unifiée du brevet a été prévue en raison du lien intrinsèque de cette dernière avec le brevet européen à effet unitaire et qu'elle ne peut créer de précédent pour l'application dudit Protocole à d'autres organisations internationales en ce qui concerne les politiques de siège des Etats membres contractants ;

Rappelant que le comité administratif est compétent pour instaurer un impôt interne et un régime de sécurité sociale, en vertu des pouvoirs d'administration qui lui sont conférés par l'Accord relatif à la juridiction unifiée du brevet ;

Rappelant que l'Accord relatif à la juridiction unifiée du brevet prévoit, en son article 4, que la juridiction unifiée du brevet possède la capacité juridique la plus large reconnue aux personnes morales par le droit national de l'Etat concerné ;

Reconnaissant que la juridiction unifiée du brevet a besoin de bénéficier des privilèges et immunités nécessaires à l’exercice de ses fonctions ;

Considérant qu'une approche commune des questions de privilèges et d'immunités est essentielle compte tenu des besoins de la juridiction unifiée du brevet et des Etats membres contractants ;

Reconnaissant que des accords de siège bilatéraux supplémentaires pourraient être conclus entre la juridiction unifiée du brevet et les Etats membres contractants accueillant la division centrale du tribunal de première instance ou l'une de ses sections, une division locale ou régionale du tribunal de première instance ou la Cour d'appel de la juridiction unifiée du brevet.

Sont convenus des dispositions suivantes :

Article 1er Définitions

Aux fins du présent protocole :

  • a) Le terme « Accord » du 19 février 2013 désigne l’Accord relatif à une juridiction unifiée du brevet ;

  • b) Le terme « statuts » désigne les statuts de la juridiction unifiée du brevet, figurant à l'annexe I à l’Accord ;

  • c) L'expression « Etat partie » désigne un Etat partie au présent Protocole ;

  • d) Le terme « Etat membre contractant » désigne un Etat partie à l'Accord ;

  • e) Le terme « Juridiction » désigne la juridiction unifiée du brevet établie par l'Accord ;

  • f) L'expression « cour d'appel » désigne la cour d'appel de la Juridiction ;

  • g) L'expression « les activités officielles de la Juridiction » désigne les activités nécessaires à l’accomplissement par la Juridiction de la mission et des fonctions qui lui ont été confiées, conformément aux dispositions de l'Accord ;

  • h) L'expression « locaux de la Juridiction » désigne les terrains et bâtiments mis à la disposition de la Juridiction par l'Etat membre contractant conformément à l’article 37 de l'Accord et employés pour les activités officielles de la Juridiction ;

  • i) Le terme « juge » désigne un juge de la Juridiction ;

  • j) Le terme « greffier » désigne le greffier et le greffier adjoint de la Juridiction ;

  • k) Le terme « personnel » désigne tous les membres du personnel employés par la Juridiction en qualité de fonctionnaires et les autres agents de la juridiction, hormis les juges et le greffier ;

  • l) Le terme « famille » désigne, en ce qui concerne toute personne, le conjoint et les membres à charge de la famille proche de cette personne faisant partie du ménage de cette dernière, tels que reconnus par l'Etat membre contractant hôte ;

  • m) L'expression « représentants des parties » désigne les avocats, les mandataires en brevets européens ou les avocats spécialistes en droit des brevets autorisés à exercer ou à apporter leur assistance devant la Juridiction, conformément à l'article 48 de l'Accord.

Article 2 Dispositions générales sur les privilèges et immunités de la Juridiction

La Juridiction jouit, sur le territoire de chaque Etat partie, des privilèges et immunités nécessaires à l’exercice de ses activités officielles.

Article 3 Inviolabilité des locaux de la Juridiction

Les locaux de la Juridiction sont inviolables, sous réserve des conditions pouvant être décidées avec l'Etat partie concerné et sous réserve de la responsabilité de l'Etat partie accueillant la division centrale du tribunal de première instance ou l'une de ses sections, une division locale ou régionale du tribunal de première instance ou la cour d'appel, en ce qui concerne les installations mises à disposition par cet Etat partie.

Article 4 Inviolabilité des archives et des documents

Les archives de la Juridiction et tous papiers et documents, quelle qu'en soit la forme, qui lui appartiennent, qu'elle détient ou qui lui sont adressés sont inviolables à tout moment et où qu'ils se trouvent.

Article 5 Immunité de la Juridiction et de ses avoirs, de ses biens et de ses fonds

  • 1. La Juridiction jouit de l'immunité de juridiction, sauf si :

    • a. la Juridiction a expressément renoncé à son immunité dans un cas particulier ;

    • b. des actions civiles relatives à la responsabilité contractuelle sont intentées à son encontre par des personnes autres que les juges, le greffier ou le personnel de la Juridiction ;

    • c. des actions civiles en matière de responsabilité extracontractuelle sont intentées à son encontre, sauf si la demande porte sur la jurisprudence de la Juridiction ou

    • d. une action civile est intentée par un tiers pour les dommages résultant d’un accident causé par un véhicule à moteur appartenant à la Juridiction ou utilisé pour son compte, ou d’une infraction au code de la route mettant en cause un tel véhicule ;

  • 2. La Juridiction jouit de l'immunité en matière de perquisition, de réquisition, de confiscation, de saisie, d'expropriation ou de toute autre forme d'ingérence touchant les avoirs, les biens et les fonds de la Juridiction, où qu'ils se trouvent, effectuée sans l'autorisation de la Juridiction.

  • 3. Dans la mesure nécessaire à l'exercice de ses activités officielles, les avoirs, les biens et les fonds de la Juridiction sont exempts de toute restriction, réglementation, ainsi que de tout contrôle et moratoire de quelque nature que ce soit.

Article 6 Immunité des représentants d'un Etat partie

  • 1. Les représentants d'un Etat partie jouissent, lors de leur participation aux réunions du comité administratif, du comité budgétaire et du comité consultatif, de l'immunité de juridiction pour tous les actes accomplis par eux dans l'exercice de leurs fonctions officielles, y compris leurs paroles et leurs écrits. Cette immunité continue de leur être accordée même après la fin de leur mission.

  • 2. Leurs papiers et documents officiels sont inviolables.

  • 3. Aucun Etat partie n'est tenu d'accorder les immunités mentionnées aux paragraphes 1 et 2 à ses propres ressortissants ou à toute personne qui, lors de son entrée en fonctions auprès de la Juridiction, a sa résidence permanente dans cet Etat.

Article 7 Exonérations fiscales

  • 1. La Juridiction, ses avoirs et ses biens sont exonérés de tous impôts directs.

  • 2. La Juridiction

    • a. est exonérée ou remboursée des taxes sur la valeur ajoutée perçues sur tout achat substantiel de biens et services nécessaires et fournis pour les activités officielles de la Juridiction, sous réserve des restrictions fixées par l'Etat partie hôte ;

    • b. n'est néanmoins pas exonérée des taxes et droits représentant la rémunération de services publics.

  • 3. Les biens ainsi achetés en franchise ou faisant l'objet de remboursement ne peuvent être vendus ou autrement cédés dans l'Etat partie en question ou dans un autre Etat membre de l'UE, si ce n'est aux conditions fixées par l'Etat partie ayant accordé l'exonération ou le remboursement.

  • 4. Sans préjudice des obligations des Etats parties qui découlent du droit européen et de l'application des lois et règlements, les conditions et la procédure sont déterminées par les autorités fiscales compétentes de chaque Etat partie.

Article 8 Fonds et absence de toutes restrictions en matière de change

Les Etats parties accordent à la Juridiction l'absence de toute restriction en matière de change, qui est nécessaire à l’exercice de ses activités officielles.

Article 9 Privilèges et immunités des juges et du greffier

  • 1. Les privilèges et immunités des juges sont régis par l'article 8 des statuts et, en raison du renvoi fait à l'article 8 des statuts, par le Protocole sur les privilèges et immunités de l'Union européenne.

  • 2. L’article 8 des statuts et le Protocole sur les privilèges et immunités de l'Union européenne s'appliquent au greffier.

  • 3. Lorsqu'il sont appliqués conformément aux paragraphes 1 et 2, seuls les articles 11, points b à e, à 14 du Protocole sur les privilèges et immunités de l'Union européenne doivent être appliqués par analogie, en les adaptant à la situation spécifique de la Juridiction. Cela signifie notamment que les juges et le greffier sont :

    • a. soumis à un impôt interne au profit de la Juridiction sur les traitements, salaires et émoluments qui leur sont versés par celle-ci ;

    • b. à partir de la date à laquelle l'impôt interne visé au point a) est appliqué, exonérés des impôts nationaux sur les traitements, salaires et émoluments qui leur sont versés par la Juridiction mais non des impôts nationaux sur les pensions et les rentes qui leur sont versées par la Juridiction ;

    • c. à partir de la date à laquelle les juges sont assujettis au régime d'assurance-maladie et de sécurité sociale établi par la Juridiction, pour les services rendus à celle-ci, exonérés de l'ensemble des cotisations obligatoires aux régimes d'assurance-maladie et de sécurité sociale nationaux.

Article 10 Immunités et privilèges du personnel

  • 1. Les membres du personnel bénéficient de l'immunité de juridiction pour tout acte accompli par eux dans l'exercice de leurs fonctions officielles, y compris leurs paroles et leurs écrits. Cette immunité continue de leur être accordée même après la fin de leur emploi auprès de la Juridiction.

  • 2. Les membres du personnel sont

    • a. soumis à un impôt interne perçu au profit de la Juridiction sur les traitements, salaires et émoluments qui leur sont versés par celle-ci ;

    • b. à partir de la date à laquelle l'impôt interne visé au point a) est appliqué, exonérés des impôts nationaux sur les traitements, salaires et émoluments qui leur sont versés par la Juridiction, mais non des impôts nationaux sur les pensions et les rentes qui leur sont versées par celle-ci ; ces traitements, salaires et émoluments pourront être pris en compte par les Etats parties pour le calcul du montant de l'impôt à percevoir sur les revenus provenant d'autres sources ;

    • c. à partir de la date à laquelle les membres du personnel sont assujettis à un régime d'assurance-maladie et de sécurité sociale établi par la Juridiction, pour les services rendus à celle-ci, exonérés de l'ensemble des cotisations obligatoires aux régimes d'assurance-maladie et de sécurité sociale nationaux.

  • 3. Aucun Etat partie n'est tenu d'accorder les privilèges mentionnés au paragraphe 2 à ses propres ressortissants ou à toute personne qui, juste avant son entrée en fonctions auprès de la Juridiction, résidait dans l'Etat en question.

Article 11 Emblème et drapeau

La Juridiction est autorisée, sous réserve des conditions pouvant être convenues avec l'Etat partie concerné, à arborer son emblème et son drapeau sur ses locaux et sur les véhicules affectés à son usage officiel, ainsi qu'à les faire figurer sur son site internet et sur ses documents.

Article 12 Coopération avec les autorités des Etats parties

  • 1. Sans préjudice de leurs privilèges et immunités, toutes les personnes jouissant des privilèges et immunités accordés en vertu des articles 6, 9 et 10 ont le devoir de respecter les lois et règlements de l'Etat partie sur le territoire duquel elles sont autorisées à exercer leurs fonctions officielles.

  • 2. La Juridiction coopère à tout moment avec les autorités compétentes des Etats parties pour faciliter l'application des lois de ces derniers et prévenir tout abus auquel pourrait donner lieu les privilèges, immunités et facilités mentionnés dans le présent Protocole.

Article 13 Objectif et levée des privilèges et immunités prévus aux articles 6, 9 et 10

  • 1. Les privilèges et immunités prévus par le présent Protocole ne sont pas établis en vue d'accorder aux personnes qui en bénéficient des avantages personnels. Ils visent uniquement à servir l'intérêt de la Juridiction et notamment à garantir, en toutes circonstances, la liberté d'action de la Juridiction et l'indépendance totale des personnes concernées.

  • 2. Le présidium de la Juridiction a non seulement le droit, mais aussi le devoir, de lever l'immunité des juges, du greffier et du personnel visée aux articles 9 et 10 lorsqu'il considère que cette immunité entraverait le cours normal de la justice et qu'elle peut être levée sans porter préjudice aux intérêts de la Juridiction. Un Etat partie a le même droit en ce qui concerne ses représentants au sein du comité administratif et du comité budgétaire (article 6). Le comité administratif a le même droit et la même obligation en ce qui concerne les membres du comité administratif.

Article 14 Accès, séjour et sortie

Sans préjudice du droit de l'Union européenne, l'Etat partie concerné prend toutes les mesures nécessaires pour faciliter :

  • a. l'entrée sur son territoire, la sortie de ce territoire et le séjour à toute personne exerçant des fonctions officielles auprès de la Juridiction, à savoir les juges, le greffier, le personnel employé par la Juridiction et le personnel mis à disposition par les Etats parties, ainsi que les membres à charge de leurs familles, dans le cas où les personnes exerçant des fonctions officielles auprès de la Juridiction ne sont ni des ressortissants ni des résidents permanents dudit Etat partie ; et

  • b. l'entrée sur son territoire et la sortie de celui-ci à toute personne convoquée ou citée à comparaître devant la Juridiction en qualité officielle, à savoir les parties, les représentants des parties, les interprètes, les témoins et les experts devant la Juridiction.

Article 15 Notification

Le greffier communique à tous les Etats parties, dans un délai d'un mois après l'entrée en vigueur du présent Protocole, les noms des juges, du greffier et du personnel auxquels s'applique le présent Protocole. Outre la communication susmentionnée, la nomination ou l'arrivée de tout juge, greffier ou membre du personnel à la Juridiction, ainsi que tout changement de situation, est notifié aussitôt que possible et au plus tard un mois après la date dudit changement de situation.

Article 16 Règlement des différends

  • 1. La Juridiction prévoit des moyens appropriés pour régler les différends mettant en cause toute personne mentionnée dans le présent Protocole qui en vertu de sa situation officielle jouit d’une immunité, ou la Juridiction dans les cas où elle jouit de l'immunité mentionnée à l'article 5, si cette immunité n'a pas été levée.

  • 2. Tout différend relatif à l’interprétation ou à l'application du présent Protocole est porté devant un tribunal arbitral, sauf si les parties ont convenu d'un autre mode de règlement. Si un différend survient entre la Juridiction et un Etat partie et qu'il ne peut être réglé par voie de consultation, de négociation ou par un autre mode de règlement convenu dans un délai de trois mois suivant la demande faite à cet effet par l'une des parties au différend, il est porté, à la demande de l'une ou l'autre partie, devant une formation de trois arbitres qui le tranchera définitivement : un arbitre désigné par la Juridiction, un autre désigné par l'Etat partie et le troisième, qui préside la formation, par les deux premiers arbitres. Si l'une ou l'autre des parties n'a pas désigné d'arbitre dans un délai de deux mois après la désignation d'un arbitre par l'autre partie, le président de la Cour de justice de l’Union européenne procède à cette désignation. A défaut d'accord entre les deux premiers arbitres sur le choix du troisième arbitre dans les trois mois qui suivent leur désignation, ce troisième arbitre est choisi par le président de la Cour de justice de l’Union européenne à la demande de la Juridiction ou de l'Etat partie.

Article 17 Signature, ratification, acceptation, approbation ou adhésion et dépôt

  • 1. Le présent Protocole est ouvert à la signature de tous les Etats membres contractants du 29 juin 2016 au 29 juin 2017 au Conseil de l’Union européenne à Bruxelles.

  • 2. Le présent Protocole est soumis à ratification, acceptation ou approbation. Les instruments de ratification, d’acceptation ou d’approbation sont déposés auprès du secrétariat général du Conseil de l’Union européenne, ci-après dénommé le dépositaire.

  • 3. Après le 29 juin 2017, le présent Protocole reste ouvert à l'adhésion de tous les Etats membres contractants. Les instruments d'adhésion sont déposés auprès du dépositaire.

Article 18 Entrée en vigueur

  • 1. Le présent Protocole entre en vigueur 30 jours après la date à laquelle le dernier des quatre Etats parties (l'Allemagne, la France, le Luxembourg et le Royaume-Uni) a déposé son instrument de ratification, d'acceptation, d'approbation ou d'adhésion.

  • 2. Pour chaque Etat partie déposant son instrument après la date mentionnée au paragraphe 1, le présent Protocole entre en vigueur 30 jours après la date de dépôt de son instrument de ratification, d'acceptation, d'approbation ou d'adhésion.

Article 19 Application provisoire

Un Etat membre contractant peut à tout moment notifier au dépositaire qu'il appliquera le présent Protocole à titre provisoire.

EN FOI DE QUOI les soussignés, dûment habilités à cet effet, ont signé le présent Protocole.

FAIT à Bruxelles, le 29 juin 2016 en langues française, allemande et anglaise, les trois textes faisant également foi, en un seul exemplaire, déposé auprès du dépositaire qui en transmet une copie certifiée conforme à chacun des États signataires et adhérents.


D. PARLEMENT

Het Protocol behoeft ingevolge artikel 91 van de Grondwet de goedkeuring van de Staten-Generaal, alvorens het Koninkrijk aan het Protocol kan worden gebonden.

E. PARTIJGEGEVENS

Ondertekening, bekrachtiging, aanvaarding, goedkeuring of toetreding en kennisgeving is voorzien in artikel 17.

F. VOORLOPIGE TOEPASSING

Voorlopige toepassing is voorzien in artikel 19 van het Protocol.

G. INWERKINGTREDING

De bepalingen van het Protocol van 29 juni 2016 zullen ingevolge artikel 18, eerste en tweede lid, van het Protocol in werking treden 30 dagen na de datum waarop de laatste van de vier staten die partij zijn Frankrijk, Duitsland, Luxemburg en het Verenigd Koninkrijk, hun akte van bekrachtiging, aanvaarding, goedkeuring of toetreding hebben nedergelegd. Voor elke staat die partij is die zijn akte na die datum nederlegt, treedt het Protocol in werking 30 dagen na de datum van nederlegging van zijn akte van bekrachtiging, aanvaarding, goedkeuring of toetreding.
