Bij notawisseling tussen het Koninkrijk der Nederlanden en de Republiek Turkije is op 1 april 2014 te Ankara een verdrag tot stand gekomen inzake de uitbreiding van het Verdrag tot Aruba, Curaçao en Sint Maarten. De Engelse tekst van de nota’s luidt als volgt:

The Embassy of the Kingdom of the Netherlands presents its compliments to the Ministry of Foreign Affairs of the Republic of Turkey and has the honour to refer to the Agreement between the Kingdom of the Netherlands and the Republic of Turkey on mutual administrative assistance for the proper application of customs law and for the prevention, investigation and combating of customs offences, signed at Ankara on 18 August 2005 (hereinafter referred to as “the Agreement of 2005”).

The Government of the Kingdom of the Netherlands proposes that, in accordance with Article 19, paragraphs 2 and 3, of the Agreement of 2005, the application of the Agreement of 2005 shall be extended to Aruba, Curaçao and Sint Maarten, subject to the following:

  • 1. For the Kingdom of the Netherlands, the term “customs administration” in Article 1, paragraph 1, of the Agreement of 2005 shall mean, as regards Aruba, Curaçao and Sint Maarten, the respective central administrations responsible for the implementation of customs laws.

  • 2. Article 2, paragraph 5, of the Agreement of 2005 shall apply only to Aruba, Curaçao and Sint Maarten, as the case may be, insofar as the agreements referred to therein apply to those respective parts of the Kingdom of the Netherlands.

  • 3. As regards Aruba and Curaçao and Sint Maarten, the requirements of national law within the meaning of Articles 14 and 15 of the Agreement of 2005 fall under the scope of the applicable laws of Aruba, Curacao and Sint Maarten respectively.

If the foregoing is acceptable to the Government of the Republic of Turkey, the Embassy has the further honour to propose that this Note and the Ministry’s Note in reply shall constitute an Agreement between the Kingdom of the Netherlands and the Republic of Turkey which shall enter into force on the first day of the second month following the date of receipt of the later notification in which one Party informs the other Party that the formalities required for the entry into force of this Agreement have been complied with.

The Embassy of the Kingdom of the Netherlands avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Turkey the assurance of its highest consideration.

MINISTRY OF FOREIGN AFFAIRS OF THE REPUBLIC OF TURKEY

The Ministry of Foreign Affairs of the Republic of Turkey presents its compliments to The Embassy of the Kingdom of the Netherlands and acknowledges receipt of the Latter’s Note No: ANK/PA/002/14, dated 16 January 2014 concerning the Agreement between the Republic of Turkey and the Kingdom of the Netherlands on Mutual Administrative Assistance for the Proper Application of Customs Law and for the Prevention, Investigation and Combating of Customs Offences, signed in Ankara on 18 August 2005.

The text of the aforesaid Note reads as follows:

The Ministry confirms that the above proposal is acceptable to the Government of the Republic of Turkey and that the Embassy’s Note and this Note in reply shall constitute an Agreement between the Republic of Turkey and the Kingdom of the Netherlands which shall enter into force on the first day of the second month following the date of receipt of the latter notification in which one Party informs the other Party that the formalities required for the entry into force of this Agreement have been complied with.

Het in de nota’s vervatte verdrag behoeft ingevolge artikel 91 van de Grondwet de goedkeuring van de Staten-Generaal, alvorens het Koninkrijk aan het verdrag kan worden gebonden.

G. INWERKINGTREDING

Zie Trb. 2011, 207 HERDRUK en Trb. 2012, 33.

De bepalingen van het in de nota's vervatte verdrag zullen ingevolge het gestelde in de op een na laatste alinea van de nota’s nr. I en II in werking treden op de eerste dag van de tweede maand volgend op de datum van ontvangst van de laatste kennisgeving, waarin de ene partij de andere partij ervan in kennis heeft gesteld dat de vereiste interne procedures voor de inwerkingtreding ervan zijn voltooid.
