Agreement between the Kingdom of the Netherlands and the Technical Centre for Agricultural and Rural Cooperation regarding the registration of interns

The Ministry of Foreign Affairs of the Kingdom of the Netherlands presents its compliments to the Technical Centre for Agricultural and Rural Cooperation (CTA) and, with reference to the Agreement between the Kingdom of the Netherlands and the Technical Centre for Agricultural and Rural Cooperation concerning the seat of the CTA of 7 August 1984 as well as to the consultations between the Ministry and CTA regarding the registration of interns who have been accepted by CTA into its internship programme in the Netherlands, has the honour to propose the following:

  • 1. For the purpose of this Agreement, the following definition of an intern shall apply: A graduate or postgraduate student who has been accepted by CTA into the internship programme of CTA and who, on that basis, performs certain tasks for CTA for which he or she will receive a monthly allowance. This allowance should cover his or her living expenses. An intern shall in no case fall under the definition of a staff member of CTA.

  • 2. Within eight (8) days after first arrival of an intern in the Netherlands, CTA shall request the Ministry of Foreign Affairs to register the intern in accordance with paragraph 3.

  • 3. The Ministry of Foreign Affairs shall register an intern for the purpose of his internship with CTA for a maximum period of six months, provided that CTA supplies the Ministry of Foreign Affairs with a declaration signed by the intern, accompanied by adequate proof, to the effect that:

    • a) the intern entered the Netherlands in accordance with the applicable immigration procedures;

    • b) the intern has sufficient financial means for living expenses and for repatriation, as well as sufficient medical insurance (including coverage of costs of hospitalization for at least the duration of the internship plus one month) and third party liability insurance, and will not be a charge on the public purse of the Netherlands;

    • c) the intern will not work in the Netherlands during his or her internship other than as an intern at CTA;

    • d) the intern will not bring any family members to reside with him or her in the Netherlands other than in accordance with the applicable immigration procedures;

    • e) the intern will leave the Netherlands within 14 days after the end of the internship unless he or she is otherwise entitled to stay in the Netherlands in accordance with the applicable immigration legislation.

  • 4. Upon registration of the intern in accordance with paragraph 3, the Ministry of Foreign Affairs shall issue an identity card bearing the code ZF to the intern.

  • 5. CTA shall not incur liability for damage resulting from non-fulfilment, by interns registered in accordance with paragraph 3, of the conditions of the declaration referred to in that paragraph.

  • 6. Interns shall not enjoy any privileges or immunities.

  • 7. In exceptional circumstances, the maximum period of six months mentioned in paragraph 3 may be extended once by a maximum period of six months.

  • 8. CTA shall notify the Ministry of Foreign Affairs of the final departure of the intern from the Netherlands within eight (8) days after such departure, and shall at the same time return the intern’s identity card.

If this proposal is acceptable to CTA, the Ministry suggests that this Note and the CTA’s affirmative reply to it shall together constitute an Agreement between the Kingdom of the Netherlands and CTA, of which the French and English texts are equally authentic. This Agreement shall be applied provisionally as from the date of such reply and shall enter into force on the day after both Parties have notified each other in writing that the legal requirements for entry into force have been complied with.

The Ministry of Foreign Affairs of the Kingdom of the Netherlands avails itself of this opportunity to renew to CTA the assurances of its highest consideration.

The Technical Centre for Agricultural and Rural Cooperation presents its compliments to the Ministry of Foreign Affairs of the Kingdom of the Netherlands and has the honour to acknowledge receipt of the Ministry’s Note DJZ/VE-235/08 of 9 April 2008, which reads as follows:

The Technical Centre for Agricultural and Rural Cooperation has the honour to inform the Ministry of Foreign Affairs that the proposal is acceptable to the Technical Centre for Agricultural and Rural Cooperation. The Technical Centre for Agricultural and Rural Cooperation accordingly agrees that the Ministry’s Note and this reply shall constitute an Agreement between the Technical Centre for Agricultural and Rural Cooperation and the Kingdom of the Netherlands. This Agreement shall be applied provisionally as from the date of this reply and shall enter into force on the day after both Parties have notified each other in writing that the legal requirements for entry into force have been complied with.

Accord entre le Royaume des Pays-Bas et le Centre technique de coopération agricole et rurale relatif à l’enregistrement des stagiaires

Le Ministère des Affaires étrangères du Royaume des Pays-Bas présente ses compliments au Centre technique de coopération agricole et rurale (CTA) et, se référant à l’accord du 7 août 1984 entre le Royaume des Pays-Bas et le CTA relatif au siège de celui-ci, ainsi qu’aux consultations entre le ministère et le CTA portant sur l’enregistrement des stagiaires admis par le CTA dans son programme de stage aux Pays-Bas, a l’honneur de lui soumettre les propositions suivantes:

  • 1. Aux fins du présent accord, on entend par «stagiaire» : un étudiant de deuxième ou de troisième cycle universitaire, admis par le CTA dans son programme de stage et accomplissant, sur cette base, pour le compte du CTA, des missions pour lesquelles il ou elle reçoit une allocation mensuelle devant couvrir ses frais de subsistance. Un stagiaire ne pourra en aucun cas être considéré comme un agent du CTA.

  • 2. Dans les huit jours suivant la première entrée du stagiaire aux Pays-Bas, le CTA demande au Ministère des Affaires étrangères d’enregistrer le stagiaire conformément aux conditions énoncées au paragraphe 3.

  • 3. Le Ministère des Affaires étrangères enregistre un stagiaire aux fins de son stage au CTA pour une durée maximale de six mois, sous réserve que le CTA fournisse au Ministère une déclaration, signée du stagiaire et accompagnée des justificatifs nécessaires, certifiant que:

    • a) le stagiaire est entré aux Pays-Bas en respectant les procédures d’immigration en vigueur;

    • b) le stagiaire dispose de ressources financières suffisantes pour assurer sa subsistance et son rapatriement, ainsi que d’une assurance maladie, couvrant les frais d’hospitalisation pour au moins la durée de son stage augmentée d’un mois, et d’une assurance responsabilité civile, et il ne sera pas à la charge de l’État néerlandais;

    • c) durant son stage, le stagiaire n’exercera pas d’activité rémunérée aux Pays-Bas autre que celles pour le CTA;

    • d) le stagiaire n’invitera aucun membre de sa famille à résider avec lui aux Pays-Bas autrement que dans les conditions prévues par les procédures d’immigration en vigueur;

    • e) le stagiaire quittera les Pays-Bas dans un délai de quatorze jours après la fin de son stage, sauf s’il est autorisé à y rester selon la législation applicable en matière d’immigration.

  • 4. Après l’enregistrement du stagiaire conformément aux dispositions du paragraphe 3, le Ministère des Affaires étrangères lui délivre une carte d’identité portant la mention ZF.

  • 5. Le CTA décline toute responsabilité pour les préjudices causés par le non-respect, par des stagiaires inscrits au Ministère conformément aux dispositions du paragraphe 3, des conditions de la déclaration visée dans ce paragraphe;

  • 6. Les stagiaires ne jouissent d’aucun privilège ni immunité.

  • 7. Dans des circonstances exceptionnelles, la période maximale de six mois mentionnée au paragraphe 3 peut être prolongée une seule fois de six mois au maximum.

  • 8. Le CTA notifie au Ministère des Affaires étrangères le départ définitif des Pays-Bas du stagiaire dans les huit jours suivant la date de son départ, et lui restitue par la même occasion la carte d’identité du stagiaire.

Si la présente proposition recueille l’agrément du CTA, le Ministère suggère que la présente note et la réponse du CTA confirmant son approbation constituent ensemble un accord entre le Royaume des Pays-Bas et le CTA, les versions française et anglaise faisant également foi. Cet accord sera appliqué à titre provisoire à compter de la date de cette réponse et entrera en vigueur le lendemain du jour où les deux parties se seront informées réciproquement de l’accomplissement des formalités juridiques requises pour son entrée en vigueur.

Le Ministère des Affaires étrangères du Royaume des Pays-Bas saisit cette occasion pour renouveler au CTA les assurances de sa très haute considération.

Le Centre technique de coopération agricole et rurale présente ses compliments au Ministère des Affaires étrangères du Royaume des Pays-Bas et a l’honneur d’accuser réception de la note du Ministère DJZ/VE-235/08 du 9 avril 2008, ainsi rédigée:

Le Centre technique de coopération agricole et rurale a l’honneur d’informer le Ministère des Affaires étrangères que la proposition ci-dessus recueille son agrément. En conséquence, le Centre technique de coopération agricole et rurale accepte que la note du Ministère et la présente réponse constituent un accord entre le Centre technique de coopération agricole et rurale et le Royaume des Pays-Bas. Cet accord sera appliqué à titre provisoire à compter de la date de la présente réponse et entrera en vigueur le lendemain du jour où les deux parties se seront informées réciproquement par écrit de l’accomplissement des formalités juridiques requises pour son entrée en vigueur.

Le Centre technique de coopération agricole et rurale saisit cette occasion pour renouveler au Ministère des Affaires étrangères du Royaume des Pays-Bas les assurances de sa très haute considération.

D. PARLEMENT

Het in de nota’s vervatte verdrag behoeft ingevolge artikel 91 van de Grondwet de goedkeuring van de Staten-Generaal, alvorens het Koninkrijk aan het verdrag kan worden gebonden.

F. VOORLOPIGE TOEPASSING

Het in de nota’s vervatte verdrag wordt ingevolge het gestelde in de één na laatste alinea van de nota’s Nr. I en Nr. II vanaf 15 april 2008 voorlopig toegepast door het Koninkrijk der Nederlanden.

Wat het Koninkrijk der Nederlanden betreft, geldt de voorlopige toepassing alleen voor Nederland.

G. INWERKINGTREDING

De bepalingen van het in de nota’s vervatte verdrag zullen ingevolge het in de één na laatste alinea van de nota’s Nr. I en Nr. II gestelde in werking treden op de dag nadat beide Partijen elkaar schriftelijk hebben medegedeeld dat de wettelijke vereisten voor inwerkingtreding zijn voltooid.
