Het in de nota’s vervatte verlengingsverdrag, opgenomen in rubriek H hieronder, behoeft ingevolge artikel 7, onderdeel e, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal.

F. VOORLOPIGE TOEPASSING

Het in de nota’s vervatte verlengingsverdrag wordt ingevolge de één na laatste alinea van de in rubriek H hieronder opgenomen nota Nr. II vanaf 20 december 2007 voorlopig toegepast.

De wijziging van artikel 19, vermeld in de tweede alinea van nota Nr. I, wordt eveneens vanaf 20 december 2007 voorlopig toegepast.

Wat het Koninkrijk der Nederlanden betreft, geldt de voorlopige toepassing alleen voor Nederland.

G. INWERKINGTREDING

Zie Trb. 2007, 19.

Het verdrag is per 21 december 2007, voorlopig (zie rubriek F hierboven), gewijzigd.

Het verdrag, waarvan de geldigheid op 21 december 2007 zou aflopen, wordt, ingevolge het gestelde in de één na laatste alinea van de in rubriek H hieronder opgenomen nota Nr. II voorlopig verlengd met een volgende periode van twaalf maanden tot 21 december 2008.

H. VERLENGING

Bij notawisseling van 20 december 2007 is een verdrag tot stand gekomen tussen het Koninkrijk der Nederlanden en de Republiek Cyprus waarin het verdrag van 21 december 2006, waarvan de geldigheid op 21 december 2007 zou aflopen, met een periode van een jaar voorlopig wordt verlengd. De tekst van deze nota’s luidt als volgt:

The Embassy of the Kingdom of the Netherlands presents its compliments to the Ministry of Foreign Affairs of the Republic of Cyprus, and with reference to the Agreement of 21 December 2006 regarding the right of presence of military and civilian Netherlands armed forces personnel and other employees of the Kingdom of the Netherlands in the sovereign territory of the Republic of Cyprus, the sailing of vessels in territorial waters, and the use of airspace and roads by aircraft and ground vehicles, in the framework of supporting the United Nations in the conduct of the United Nations Interim Force in Lebanon (UNIFIL) mission, (hereinafter referred to as “the Original Agreement”) has the honour to propose that the duration of the said Original Agreement referred to in Article 19 of the Original Agreement be extended for a further twelve (12) month period, so that the Original Agreement will remain in force until 21 December 2008. It is, therefore, proposed that Article 19 of the Original Agreement be amended, by substituting the first sentence thereof with the following new sentence:

“The Agreement shall remain into force until 21 December 2008.”

If this proposal is acceptable to the Republic of Cyprus, the Embassy proposes that this Note and the affirmative reply to it, shall together constitute an agreement between the Kingdom the The Netherlands and the Republic of Cyprus, which shall enter into force on the date of receipt of the answer of the Ministry.

The Embassy of the kingdom of the Netherlands avails itself of this opportunity to renew to the Ministry of Foreign affairs of the Republic of Cyprus the assurances of its highest consideration.

The Ministry of Foreign Affairs of the Republic of Cyprus presents its compliments to the Embassy of the Kingdom of the Netherlands in Nicosia and has the honour to acknowledge receipt of the latter’s Note No. 79 of 9 November 2007, which reads as follows:

The Ministry has the honour to inform the Embassy that the terms of the above proposal are acceptable to the Republic of Cyprus and to confirm that the Embassy’s Note and the Ministry’s reply shall together constitute an agreement between the Republic of Cyprus and the Kingdom of the Netherlands, provided that the relevant legislation will be enacted. Pending such enactment, the Government of the Republic of Cyprus undertakes to apply provisionally the provisions of Article 19 of the Original Agreement as amended and to exert every effort to ensure that the said enactment is effected as early as possible.

The Ministry of Foreign Affairs of the Republic of Cyprus avails itself of this opportunity to renew to Embassy of the Kingdom of the Netherlands the assurances of its highest consideration.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat het het in de nota’s vervatte verlengingsverdrag zal zijn bekendgemaakt in Nederland op de dag na de datum van uitgifte van dit Tractatenblad.
