In verband met het uiteenvallen van Servië en Montenegro zijn op
15 november 2006 en 18 januari 2007 nota’s gewisseld waarin
de regering van de Republiek Montenegro en de regering van het Koninkrijk
der Nederlanden tot overeenstemming komen over de voortgezette toepassing
van onder meer het onderhavige Verdrag tussen de Republiek Montenegro en het
Koninkrijk der Nederlanden. Zie voor de bedoelde notawisseling rubriek I hieronder.
I. VOORTGEZETTE TOEPASSING
Op 15 november 2006 en 18 januari 2007 zijn nota’s gewisseld tussen
de regering van het Koninkrijk der Nederlanden en de regering van de Republiek
Montenegro inzake de voortgezette toepassing van de geldigheid van onder meer
het onderhavige Verdrag. De tekst van deze nota’s luidt als volgt:

The Embassy of the Kingdom of the Netherlands presents its compliments
to the Ministry of Foreign Affairs of the Republic of Montenegro and has the
honour to propose that the following treaties concluded between the Kingdom
of the Netherlands and Serbia and Montenegro are in force between and represent
treaties concluded between the Kingdom of the Netherlands and the Republic
of Montenegro:
1. Agreement on the Extradition of Criminals, Belgrade 28 February/11
March 1896.
2. Convention on Trade and Navigation, Belgrade, 28 May 1930,
entered into force on 17 April 1932.
3. Agreement concerning regular air services, Belgrade, 13 March
1957, entered into force 3 March 1958, plus supplements of 16 August
1962 and 21 January 1964.
4. Cultural Agreement between the Kingdom of the Netherlands and
the Socialist Federal Republic of Yugoslavia, Belgrade, 11 August 1966,
entered into force 29 May 1967.
5. Agreement concerning the international roadtransport, Belgrade,
8 September 1966, entered into force 4 April 1967, and the Exchange
of Notes to supplement the Agreement concerning the international roastransport
with Article 7 bis, Belgrade 20 November 1972, entered into force 15 November
1973.
6. Convention between the Kingdom of the Netherlands and the Socialist
Federal Republic of Yugoslavia on social security, Belgrade, 11 May 1977,
entered into force 1 April 1979, and the Administrative arrangement concerning
the modalities of application of the Convention on Social Security, Belgrade,
16 May 1977, entered into force 1 April 1979.
7. Convention between the Kingdom of the Netherlands and the Socialist
Federal Republic of Yugoslavia for the avoidance of double taxation with respect
to taxes on income and on capital, Belgrade, 22 February 1982, entered
into force 6 February 1983.
8. Agreement on encouragement and reciprocal protection of investments
between the Kingdom of the Netherlands and the Federal Republic of Yugoslavia,
The Hague, 29 January 2002, entered into force 1 March 2004.
In case the Republic of Montenegro accepts the proposal contained herein,
the Embassy of the Kingdom of the Netherlands will consider the receipt of
the Note of the Republic of Montenegro confirming the acceptance of this proposal
as an agreement that the treaties referred to in this Note constitute treaties
between the Kingdom of the Netherlands and the Republic of Montenegro.
The Embassy avails itself of this opportunity to renew to the Ministry
of Foreign Affairs of the Republic of Montenegro the assurances of its highest
consideration.

its compliments to the Royal Netherlands Embassy in Belgrade, Republic of
Serbia, and with reference to the Embassy’s Note No. BEL/434-06, dated
15 November 2006, which reads as follows:

The Ministry has the honor to inform the Embassy that the Republic of
Montenegro agrees to the content of the above mentioned Note, and that the
Embassy’s Note and this Note express its agreement that the treaties
referred to in these notes constitute treaties between the Republic of Montenegro
and the Kingdom of the Netherlands.
The Ministry of Foreign Affairs of the Republic of Montenegro avails itself
of this opportunity to renew to the Royal Netherlands Embassy in Belgrade,
