B. TEKST

De Engelse en de Nederlandse tekst van het in brieven vervatte verdrag zijn geplaatst in Trb. 2004, 40.

Bij notawisseling van 18 december 2006 en 24 december 2006 is een wijziging tot stand gekomen, houdende verlenging van het Verdrag. De tekst van deze nota’s luidt als volgt:

The Embassy of the Kingdom of the Netherlands presents its compliments to the Ministry of Foreign Affairs of the State of Kuwait and has the honour to acknowledge receipt of the Ministry’s affirmative reply of 27 November 2006, to the Embassy’s Note no. Kwe-2006/274 of 30 August 2006 on the Status of Forces Agreement.

Referring to the proposed amendments to the Agreement, the Embassy has the honour to inform that the competent authorities in the Kingdom of the Netherlands agree to amend Article 11 of the said Agreement as follows:

‘‘This Agreement shall enter into force for a period of twelve months, to be renewed automatically, unless either Party notifies the other of its intention of terminating the Agreement before its expiration by a period of six months but not to affect paragraph 5 which shall be implemented on any matter which may occur from executing the Agreement.’’

The amended Agreement between the Kingdom of The Netherlands and the State of Kuwait will enter into force on the date of receipt of this Note by the Ministry of Foreign Affairs in Kuwait, with retroactive effect as of 13 July 2006. Therefore, the Embassy would highly appreciate if the Ministry could provide a notification of receipt of this note.

The Embassy of the Kingdom of the Netherlands avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the State of Kuwait the assurances of its highest consideration.

The Ministry of Foreign Affairs presents its compliments to the Embassy of the Kingdom of the Netherlands in Kuwait and refers to the Embassy’s note no. Kwe-2006/419 of 18/12/2006 on the approval of the competent authorities of the Kingdom of the Netherlands of the proposal of the competent bodies of the State of Kuwait on the amendment of article 11 of the Status of Forces Agreement reading as follows:

‘‘This Agreement shall enter into force for a period of twelve months, to be renewed automatically, unless either Party notifies the other of its intention of terminating the Agreement before its expiration by a period of six months but not to affect paragraph 5 which shall be implemented on any matter which may occur from executing the Agreement.’’

The Ministry would like to notify the receipt of the above mentioned Embassy’s note and would like to inform of the approval of its entry into force with retroactive effect as of 13/07/2006.

De in de nota’s van 18 december 2006 en 24 december 2006 vervatte wijziging van artikel 11 van het verdrag behoeft ingevolge artikel 7, onderdeel e, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal.

G. INWERKINGTREDING

Zie Trb. 2004, 40, rubriek J van Trb. 2004, 202 en rubriek G van Trb. 2006, 8.

Het bij notawisseling van 18 december 2006 en 24 december 2006 hierboven in rubriek B opgenomen wijzigingsverdrag, is ingevolge het in de op één na laatste alinea van nota Nr. I en Nr. II gestelde in werking getreden op 24 december 2006. Ingevolge de voorlaatste alinea van nota Nr. I en Nr. II heeft dit verdrag van 24 december 2006 terugwerkende kracht tot 13 juli 2006.

Het verdrag van 2003 is per 13 juli 2006 gewijzigd ingevolge de inwerkingtreding, met terugwerkende kracht tot 13 juli 2006, van het hierboven in rubriek B opgenomen in nota’s vervatte wijzigingsverdrag van 24 december 2006. Het verdrag van 2003, waarvan de geldigheid op 13 juli 2006 zou aflopen, is door de wijziging met onbepaalde tijd verlengd.

Wat het Koninkrijk der Nederlanden betreft, geldt het verlengingsverdrag, evenals het gewijzigde verdrag, alleen voor Nederland.

H. VERLENGING

Zie rubriek J van Trb. 2004, 202 en rubriek H van Trb. 2006, 8.  

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat het verdrag zal zijn bekendgemaakt in Nederland op de dag na de datum van uitgifte van dit Tractatenblad.
