Het in de nota’s vervatte verlengingsverdrag, opgenomen in rubriek H hieronder, behoeft ingevolge artikel 7, onderdeel e, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal.

F. VOORLOPIGE TOEPASSING

Ingevolge het gestelde in de voorlaatste alinea van nota Nr. I wordt het in rubriek H hieronder opgenomen verlengingsverdrag voorlopig toegepast vanaf 14 december 2005.

G. INWERKINGTREDING

Zie Trb. 2004, 40, en rubriek J van Trb. 2004, 202.

Het verlengingsverdrag van 19 juli 2004, dat vanaf 13 juli 2004 voorlopig werd toegepast, is op 20 november 2004 in werking getreden en op 13 juli 2005 buiten werking getreden, beide op grond van het gestelde in de één na laatste alinea van de betreffende nota’s.

Het verdrag, waarvan de geldigheid op 13 juli 2005 zou aflopen, blijft, ingevolge het gestelde in de eerste alinea van de in rubriek H hieronder opgenomen nota Nr. I, respectievelijk Nr. II, van kracht voor een volgende periode van twaalf maanden.

Het verlengingsverdrag, opgenomen in rubriek H hieronder, is ingevolge het in de op één na laatste alinea van nota Nr. I en Nr. II gestelde in werking getreden op 18 december 2005. Ingevolge de voorlaatste alinea van nota Nr. I en Nr. II heeft het in de nota’s vervatte verlengingsverdrag terugwerkende kracht tot 13 juli 2005.

Wat het Koninkrijk der Nederlanden betreft, geldt het verlengingsverdrag alleen voor Nederland.

Dit verlengingsverdrag van 14 december 2005 zal ingevolge het gestelde in de eerste alinea van nota Nr. I, respectievelijk Nr. II, buiten werking treden op 13 juli 2006.

Bij notawisseling van 11 juli 2005 en 14 december 2005 is een verlengingsverdrag tot stand gekomen tussen het Koninkrijk der Nederlanden en de Staat Koeweit waarin het verdrag van 13 juli 2003, waarvan de geldigheid op 13 juli 2005 zou aflopen, in overeenstemming met artikel 11 van het verdrag met een periode van twaalf maanden wordt verlengd. De tekst van deze nota’s luidt als volgt:

The Royal Netherlands Embassy presents its compliments to the Ministry of Foreign Affairs of the State of Kuwait and, with reference to the Status of Forces Agreement for military personnel and equipment for the forces between the Kingdom of the Netherlands and the State of Kuwait, which entered into force on 13 July 2003, the Embassy has the honour to propose that the duration of the said Agreement, laid down in Article 11, be extended with a twelve-month period so that the Agreement will expire on 13 July 2006.

If this proposal is acceptable to the State of Kuwait, the Embassy proposes that this Note and the affirmative reply to it shall together constitute an Agreement between the Kingdom of the Netherlands and the State of Kuwait, which will be applied provisionally pending Parliamentary approval in the Netherlands from the date of reply of the State of Kuwait. If this date is later than 13 July 2005 this agreement will have retroactive effect as from the latter date. This agreement shall enter into force on the date on which the Embassy has notified the State of Kuwait in writing that the legal requirements in the Netherlands for entry into force have been complied with.

The Royal Netherlands Embassy avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the State of Kuwait the assurances of its highest consideration.

The Ministry of Foreign Affairs in Kuwait presents its compliments to the Royal Netherlands Embassy and with reference to the Embassy’s note no. Kwe-2005/246 of 11/7/2005 on the proposal of extending the Agreement on the Status of the Netherlands Forces in the State of Kuwait (SOFA), the Ministry would like to inform that there is no objection to extend the mentioned Agreement so that it will expire on 13/07/2006.
