Subject: Request to the Government of the Kingdom of the Netherlands to Host an International Workshop of In-Service Inspection Qualification Bodies, 28–30 November 2006, Joint Research Centre, Petten, the Netherlands

Sir,

I have the honour to refer to earlier consultations, at the technical level, between the Secretariat of the International Atomic Energy Agency and the Joint Research Centre, concerning the organization of the aforementioned international workshop for the period 28–30 November 2006 within the framework of the IAEA technical cooperation project RER/4/027 Strengthening Capabilities for Nuclear Power Plant Performance and Service Life Including Engineering Aspects. Informal agreement about the IAEA’s and the EC’s respective contributions has already been reached with the EC (see attached agreement, as well as the workshop prospectus).

The purpose of the workshop is for IQB’s to revisit the field of inspection qualification and to exchange information and experience on the status of ongoing and planned IQ activities within national and international frames. It is also intended to identify further needs for cooperation among many countries which are in different development stages of IQ technology.

As the workshop will be held on the territory of the Netherlands, I hereby would like to request your Government’s consent for the EC and IAEA to hold this workshop in Petten. This consent will not imply any financial commitments for the Government of the Netherlands, but I would request you to confirm your Government’s agreement with the following arrangements which are customary for all the IAEA’s workshops:

1. The Government of the Netherlands will accord to the Agency, its property, funds and assets, and to the officials of the Agency and the participants officially designated to attend the workshop in their official capacities, and to members of the immediate families of such persons, the privileges and immunities contained in the Agreement on the Privileges and Immunities of the International Atomic Energy Agency which was accepted by the Government on 29 August 1963.

2. The Government will accord to officials and participants mentioned above every facility necessary for the performance of their function in connection with the workshop, including entering, remaining in and leaving the Netherlands. The Government will issue any necessary visas as expeditiously as possible and, where the legislation of the Netherlands permits, free of charge. The Government, however, reserves the right to deny, irrespective of nationality, visas to individual participants for national security reasons. Annex A contains the list of Member States to be invited to participate in the workshop.

The Agency will inform the Government promptly of all persons officially designated to attend the workshop. The Agency will also advise such persons to apply for visas, if necessary, in good time before the opening date of the workshop, and the Host Government is expected to issue such visas promptly so as to allow participants to attend the workshop.

3. The Government will facilitate customs formalities for those persons on entering and leaving the Netherlands.

4. The Government will exercise reasonable care to ensure security on the premises in which the workshop takes place and to ensure the safety of the officials of the Agency and participants while on the premises of the workshop. The Government will take whatever steps may be reasonable in the circumstances to ensure such security and safety, including such supervision of the premises as may be warranted.

I am sending a copy of this letter to Mr. Arne Sven Eriksson, European Commission Joint Research Centre, who has been designated a liaison person for this workshop.

I express to you the Agency’s deep appreciation for your Government’s cooperation.

I have the honour to refer to your letter reference RER/4/027 of 25 August 2006, relating to an agreement to be concluded between the Government of the Kingdom of the Netherlands and the International Atomic Energy Agency (IAEA) concerning the Joint IAEA/EC International Workshop of In-Service Inspection Qualification Bodies, which is scheduled to be held in Putten, the Netherlands, from 28 to 30 November 2006, which reads as follows:

I am authorized by the Government of the Kingdom of the Netherlands to state that it agrees to the proposals regarding the organization of the Workshop and to state that the Government of the Kingdom of the Netherlands considers your letter and my reply as together constituting an Agreement between the Government of the Kingdom of the Netherlands and the IAEA in respect of the International Workshop of In-Service Inspection Qualification Bodies, which shall enter into force on the date of this reply and shall remain in force for the duration of the Workshop and for such additional period as is necessary for its preparation and winding up, the total duration of this Agreement, however, not to exceed one year.

D. PARLEMENT

Het in de brieven vervatte verdrag behoeft ingevolge artikel 7, onderdeel c, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal.

G. INWERKINGTREDING

De bepalingen van het in de brieven vervatte verdrag zijn ingevolge het gestelde in de één na laatste alinea van brief Nr. II in werking getreden op 26 september 2006.

Het in de brieven vervatte verdrag zal ingevolge dezelfde alinea niet langer dan één jaar van kracht zijn.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat het in de brieven vervatte verdrag zal zijn bekendgemaakt in Nederland op de dag na de datum van uitgifte van dit Tractatenblad.
