Agreement between the Kingdom of the Netherlands and the European Space Agency in the light of the Government Policy Framework of the Netherlands on Attracting and Hosting International Organisations

The Ministry of Foreign Affairs of the Kingdom of the Netherlands presents its compliments to the European Space Agency and, with reference to the Agreement between the Kingdom of the Netherlands and the European Space Agency concerning the European Space Research Technology Centre (ESTEC) at Noordwijk of 10 February 1999 (the Seat Agreement), to the Privileges and Immunities of the European Space Agency in Annex I of the Convention for the establishment of a European Space Agency of 30 May 1975 and to the Cabinet Decision of 22 April 2005 on the Policy Framework on Attracting and Hosting International Organisations, has the honour to propose the following in respect of the privileges and immunities of the staff members of the European Space Agency.

1. Use of terms

For the purpose of this Agreement:

  • a) ‘‘the parties’’ means the European Space Agency and the host State;

  • b) ‘‘the Agency’’ means the European Space Agency;

  • c) ‘‘ESTEC’’ means the European Space Research Technology Centre of the European Space Agency;

  • d) ‘‘the host State’’ means the Kingdom of the Netherlands;

  • e) ‘‘staff members’’ means all members of the staff of the Agency in the Kingdom of the Netherlands who have been appointed under the provisions of Article XII of the Convention for the establishment of a European Space Agency opened for signature on 30 May 1975 and entered into force on 30 October 1980;

  • f) ‘‘the Vienna Convention’’ means the Vienna Convention on Diplomatic Relations of 18 April 1961.

2. Privileges and immunities

  • a) The Head of ESTEC, together with members of his family forming part of his household, shall enjoy the same privileges and immunities as the host State accords to heads of diplomatic missions accredited to the host State in accordance with the Vienna Convention.

  • b) The highest ranking staff members, together with members of their family forming part of their household, shall enjoy the same privileges and immunities as the host State accords to the diplomatic agents of diplomatic missions established in the host State in accordance with the Vienna Convention.

  • c) Other staff members, together with members of their family forming part of their household, shall enjoy the same privileges and immunities as the host State accords to administrative and technical staff of the diplomatic missions established in the host State in accordance with the Vienna Convention, provided that immunity from criminal jurisdiction and personal inviolability shall not extend to acts performed outside the course of their official duties.

  • d) Service staff members, together with members of their family forming part of their household, shall enjoy the same privileges and immunities as the host State accords to service staff of the diplomatic missions established in the host State in accordance with the Vienna Convention.

3. Determination of categories

The host State shall, in consultation with the Agency, determine which categories of personnel will be covered by each of the four groups as laid down in paragraph 2 of this Agreement.

4. Scope of the Agreement

  • a) This Agreement does not apply to persons who are nationals or permanent residents of the host State.

  • b) This Agreement shall not detract from any existing arrangements in the Seat Agreement or other bilateral or multilateral agreements.

  • c) This Agreement shall not extend to issues concerning admission and residence.

If this proposal is acceptable to the European Space Agency, the Ministry proposes that this Note and the European Space Agency’s affirmative reply to it shall together constitute an Agreement between the Kingdom of the Netherlands and the European Space Agency. This Agreement, the French and English texts of which are equally authentic, shall enter into force on the date of receipt of the European Space Agency’s reply by the Ministry.

The Ministry of Foreign Affairs of the Kingdom of the Netherlands avails itself of this opportunity to renew to the European Space Agency the assurances of its highest consideration.

The European Space Agency has the honour to inform the Ministry of Foreign Affairs that the proposal is acceptable to the European Space Agency. The European Space Agency accordingly agrees that the Ministry’s Note and this reply shall constitute an Agreement between the European Space Agency and the Kingdom of the Netherlands, which shall enter into force on the date of receipt of the European Space Agency’s reply by the Ministry.

The European Space Agency avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Kingdom of the Netherlands the assurances of its highest consideration.

Accord entre le Royaume des Pays-Bas et l’Agence spatiale européenne fondé sur le cadre stratégique du gouvernement néerlandais pour attirer et accueillir les organisations internationales

Le Ministère des Affaires étrangères du Royaume des Pays-Bas présente ses compliments à l’Agence spatiale européenne et, en se référant à l’accord entre le Royaume des Pays-Bas et l’Agence spatiale européenne concernant le Centre européen de Recherche et de Technologie spatiales (ESTEC) à Noordwijk du 10 février 1999 (l’Accord de siège), aux privilèges et immunités de l’Agence spatiale européenne en Annexe I de la Convention portant création d’une Agence spatiale européenne du 30 mai 1975 et à la décision du gouvernement du 22 avril 2005 concernant le cadre stratégique pour attirer et accueillir les organisations internationales, a l’honneur de lui soumettre la proposition suivante en ce qui concerne les privilèges et immunités des membres du personnel de l’Agence spatiale européenne.

1. Définitions

Aux fins du présent Accord:

  • a) les «Parties» désigneront l’Agence spatiale européenne et l’État d’accueil;

  • b) l’«Agence» désignera l’Agence spatiale européenne;

  • c) «ESTEC» désignera le Centre européen de Recherche et de Technologie spatiales de l’Agence spatiale européenne;

  • d) l’«État d’accueil» désignera le Royaume des Pays-Bas;

  • e) ‘membres du personnel’ désigneront l’ensemble des membres du personnel de l’Agence travaillant dans le Royaume des Pays-Bas, qui ont été nommés conformément aux dispositions de l’Article XII de la Convention portant création d’une Agence spatiale européenne, ouverte à la signature le 30 mai 1975 et entrée en vigueur le 30 octobre 1980;

  • f) la «Convention de Vienne» désignera la Convention de Vienne sur les relations diplomatiques conclue le 18 avril 1961.

2. Privilèges et immunités

  • a) Le chef de l’ESTEC et les membres de sa famille qui font partie de son ménage bénéficient des mêmes privilèges et immunités que l’État d’accueil accorde, en application de la Convention de Vienne, aux chefs des missions diplomatiques accrédités auprès de cet État.

  • b) Les membres du personnel de rang supérieur et les membres de leur famille qui font partie de leur ménage, bénéficient des mêmes privilèges et immunités que l’État d’accueil accorde, en application de la Convention de Vienne, aux agents diplomatiques des missions diplomatiques établis dans l’État d’accueil.

  • c) Les autres membres du personnel et les membres de leur famille qui font partie de leur ménage, bénéficient des mêmes privilèges et immunités que l’État d’accueil accorde, en application de la Convention de Vienne, aux membres du personnel administratif et technique des missions diplomatiques établis dans l’État d’accueil, étant entendu que l’immunité de la juridiction pénale et l’inviolabilité de la personne ne s’appliquent pas aux actes accomplis en dehors de leurs fonctions officielles.

  • d) Les membres du personnel de service et les membres de leur famille qui font partie de leur ménage, bénéficient des mêmes privilèges et immunités que l’État d’accueil accorde, en application de la Convention de Vienne, aux membres du personnel de service des missions diplomatiques établis dans l’État d’accueil.

3. Détermination des catégories

L’État d’accueil, en consultation avec l’Agence, détermine quelles catégories de personnel relèveront respectivement de chacun des quatre groupes visés à l’article 2 du présent Accord.

4. Champ d’application

  • a) Le présent Accord ne s’applique pas aux personnes ressortissantes de l’État d’accueil ou qui y ont leur résidence permanente.

  • b) Le présent Accord ne porte pas atteinte aux dispositions existantes des Accords de siège ou de tout autre accord bilatéral ou multilatéral.

  • c) Le présent Accord ne s’étend pas aux questions d’admission et de résidence.

Si le présent projet d’accord recueille l’assentiment de l’Agence spatiale européenne, le Ministère propose que la présente note et la réponse affirmative de l’Agence spatiale européenne constituent ensemble un Accord entre le Royaume des Pays-Bas et l’Agence spatiale européenne. Le présent Accord, dont les textes anglais et français font également foi, entrera en vigueur à la date de réception de la réponse de l’Agence spatiale européenne par le Ministère.

Le Ministère des Affaires étrangères du Royaume des Pays-Bas saisit cette occasion pour renouveler à l’Agence spatiale européenne les assurances de sa très haute considération.

L’Agence spatiale européenne a l’honneur d’informer le Ministère des Affaires étrangères que la proposition recueille son assentiment et qu’en conséquence la note du Ministère et la présente réponse constitueront un Accord entre l’Agence spatiale européenne et le Royaume des Pays-Bas, lequel entrera en vigueur à la date de réception de la réponse de l’Agence spatiale européenne par le Ministère.

L’Agence spatiale européenne saisit cette occasion pour renouveler au Ministère des Affaires étrangères les assurances de sa très haute considération.

Het in de nota’s vervatte verdrag behoeft ingevolge artikel 7, onderdeel a, van de Rijkswet goedkeuring en bekendmaking verdragen juncto artikel 3 van de Wet van 24 december 1947 (Stb. H 452) niet de goedkeuring van de Staten-Generaal.

G. INWERKINGTREDING

De bepalingen van het in de nota’s vervatte verdrag zijn ingevolge het gestelde in de één na laatste alinea van beide nota’s in werking getreden op 29 september 2006.

Wat betreft het Koninkrijk der Nederlanden, geldt het in de nota’s vervatte verdrag alleen voor Nederland.
