Op 14 oktober 2005 is een Protocol tot wijziging van het onderhavige Protocol tot stand gekomen. De Engelse en de Franse tekst1 van het wijzigingsprotocol luiden als volgt:

Protocol of 2005 to the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms located on the Continental Shelf

The States Parties to this Protocol,

Being Parties to the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf done at Rome on 10 March 1988,

Recognizing that the reasons for which the Protocol of 2005 to the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation was elaborated also apply to fixed platforms located on the continental shelf,

Taking account of the provisions of those Protocols,

Have Agreed as follows:

ARTICLE 1

For the purposes of this Protocol:

1. ‘‘1988 Protocol’’ means the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf, done at Rome on 10 March 1988.

2. ‘‘Organization’’ means the International Maritime Organization.

3. ‘‘Secretary-General’’ means the Secretary-General of the Organization.

ARTICLE 2

Article 1, paragraph 1, of the 1988 Protocol is replaced by the following text:

1. The provisions of article 1, paragraphs 1(c), (d), (e), (f), (g), (h), and 2(a), of articles 2bis, 5, 5bis and 7, and of articles 10 to 16, including articles 11bis, 11ter and 12bis, of the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation, as amended by the Protocl of 2005 to the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation, shall also apply mutatis mutandis to the offences set forth in articles 2, 2bis and 2ter of this Protocol where such offences are committed on board or against fixed platforms located on the continental shelf.

ARTICLE 3

1. Article 2, paragraph 1(d) of the 1988 Protocol is replaced by the following text:

  • d) places or causes to be placed on a fixed platform, by any means whatsoever, a device or substance which is likely to destroy that fixed platform or likely to endanger its safety.

2. Article 2, paragraph 1(e) of the 1988 Protocol is deleted.

3. Article 2, paragraph 2 of the 1988 Protocol is replaced by the following text:

2. Any person also commits an offence if that person threatens, with or without a condition, as is provided for under national law, aimed at compelling a physical or juridicial person to do or refrain from doing any act, to commit any of the offences set forth in paragraphs 1b) and c), if that threat is likely to endanger the safety of the fixed platform.

ARTICLE 4

1. The following text is inserted as article 2bis:

Article 2bis

Any person commits an offence within the meaning of this Protocol if that person unlawfully and intentionally, when the purpose of the act, by its nature or context, is to intimidate a population, or to compel a government or an international organization to do or to obstain from doing any act:

  • a) uses against or on a fixed platform or discharges from a fixed platform any explosive, radioactive material or BCN weapon in a manner that causes or is likely to cause death or serious injury or damage; or

  • b) discharges, from a fixed platform, oil, liquefied natural gas, or other hazardous or noxious substance, which is not covered by subparagraph a), in such quantity or concentration that causes or is likely to cause death or serious injury or damage; or

  • c) threatens, with or without a condition, as is provided for under national law, to commit an offence set forth in subparagraph a) or b).

2. The following text is inserted as Article 2ter:

Article 2ter

Any person also commits an offence within the meaning of this Protocol if that person:

  • a) unlawfully and intentionally injures or killes any person in connection with the commission of any of the offences set forth in article 2, paragraph 1, or article 2bis; or

  • b) attempts to commit an offence set forth in article 2, paragraph 1, article 2bis, subparagraph a) or b), or subparagraph a) of this article; or

  • c) participates as an accomplice in an offence set forth in article 2, article 2bis or subparagraph a) or b) of this article; or

  • d) organizes or directs others to commit an offence set forth in article 2, article 2bis or subparagraph a) or b) of this article; or

  • e) contributes to the commission of one or more offences set forth in article 2, article 2bis or subparagraph a) or b) of this article, by a group of persons acting with a common purpose, intentionally and either:

    • i) with the aim of furthering the criminal activity or criminal purpose of the group, where such activity or purpose involves the commission of an offence set forth in article 2 or 2bis; or

    • ii) in the knowledge of the intention of the group to commit an offence set forth in article 2 or 2bis.

ARTICLE 5

1. Article 3, paragraph 1 of the 1988 Protocol is replaced by the following text:

1. Each State Party shall take such measures as may be necessary to establish its jurisdiction over the offences set forth in articles 2, 2bis and 2ter when the offence is committed:

  • a) against or on board a fixed platform while it is located on the continental shelf of that State; or

  • b) by a national of that State.

2. Article 3, paragraph 3 of the 1988 Protocol is replaced by the following text:

3. Any State Party which has established jurisdiction mentioned in paragraph 2 shall notify the Secretary-General. If such State Party subsequently rescinds that jurisdiction, it shall notify the Secretary-General.

3. Article 3, paragraph 4 of the 1988 Protocol is replaced by the following text:

4. Each State Party shall take such measures as may be necessary to establish its jurisdiction over the offences set forth in articles 2, 2bis and 2ter in cases where the alleged offender is present in its territory and it does not extradite the alleged offender to any of the States Parties which have established their jurisdiction in accordance with paragraphs 1 and 2.

ARTICLE 6

Interpretation and application

1. The 1988 Protocol and this Protocol shall, as between the Parties to this Protocol, be read and interpreted together as one single instrument.

2. Articles 1 to 4 of the 1988 Protocol, as revised by this Protocol, together with articles 8 to 13 of this Protocol shall constitute and be called the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf, 2005 (2005 SUA Fixed Platforms Protocol).

ARTICLE 7

The following text is added as article 4bis of the Protcol:

Final clauses of the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf, 2005

The final clauses of the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf, shall be articles 8 to 13 of the Protocol of 2005 to the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf. References in this Protocol to States Parties shall be taken to mean references to States Parties to the 2005 Protocol.

FINAL CLAUSES

ARTICLE 8

Signature, ratifications, acceptance, approval and accession

1. This Protocol shall be open for signature at the Headquarters of the Organization from 14 February 2006 to 13 February 2007 and shall thereafter remain open for accession.

2. States may express their consent to be bound by this Protocol by:

  • a) signature without reservation as to ratification, acceptance or approval; or

  • b) signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval; or

  • c) accession.

3. Ratification, acceptance, approval or accession shall be effected by the deposit of an instrument to that effect with the Secretary-General.

4. Only a State which has signed the 1988 Protocol without reservation as to ratification, acceptance or approval, or has ratified, accepted, approved or acceded to the 1988 Protocol may become a Party to this Protocol.

ARTICLE 9

Entry into force

1. This Protocol shall enter into force ninety days following the date on which three States have either signed it without reservation as to ratification, acceptance or approval, or have deposited an instrument of ratifiation, acceptance, approval or accession with the Secretary-General. However, this Protocol shall not enter into force before the Protocol of 2005 to the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation has entered into force.

2. For a State which deposits an instrument of ratification, acceptance, approval or accession in respect of this Protocol after the conditions in paragraph 1 for entry into force thereof have been met, the ratification, acceptance, approval or accession shall take effect ninety days after the date of such deposit.

ARTICLE 10

Denunciation

1. This Protocol may be denounced by any State Party at any time after the date on which this Protocol enters into force for that State.

2. Denunciation shall be effected by the deposit of an instrument of denunciation with the Secretary-General.

3. A denunciation shall take effect one year, or such longer period as may be specified in the instrument of denunciation, after the deposit of the instrument with the Secretary-General.

ARTICLE 11

Revision and amendment

1. A conference for the purpose of revising or amending this Protocol may be convened by the Organization.

2. The Secretary-General shall convene a conference of States Parties to this Protocol for revising or amending the Protocol, at the request of one third of the States Parties, or five States Parties, whichever is the higher figure.

3. Any instrument of ratification, acceptance, approval or accession deposited after the date of entry into force of an amendment to this Protocol shall be deemed to apply to the Protocol as amended.

ARTICLE 12

Depositary

1. This Protocol and any amendments adopted under article 11 shall be deposited with the Secretary-General.

2. The Secretary-General shall:

  • a) inform all States which have signed this Protocol or acceded to this Protocol of:

    • (i) each new signature or deposit of an instrument of ratification, acceptance, approval or accession together with the date thereof;

    • (ii) the date of the entry into force of this Protocol;

    • (iii) the deposit of any instrument of denunciation of this Protocol together with the date on which it is received and the date on which the denunciation takes effect;

    • (iv) any communication called for by any article of this Protocol; and

  • b) transmit certified true copies of this Protocol to all States which have signed or acceded to this Protocol.

3. As soon as this Protocol enters into force, a certified true copy of the text shall be transmitted by the Secretary-General to the Secretary-General of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.

ARTICLE 13

Languages

This Protocol is established in a single original in the Arabic, Chinese, English, French, Russian and Spanish languages, each text being equally authentic.

DONE AT LONDON this fourteenth day of October two thousand and five.

IN WITNESS WHEREOF the undersigned, being duly authorized by their respective Governments for that purpose, have signed this Protocol.


Protocole de 2005 relatif au Protocole pour la répression d’actes illicites contre la sécurité des plates-formes fixes situées sur le plateau continental

Les États parties au présent Protocole,

Étant parties au Protocole pour la répression d’actes illicites contre la sécurité des plates-formes fixes situées sur le plateau continental, conclu à Rome le 10 mars 1988,

Reconnaissant que les raisons pour lesquelles le Protocole de 2005 à la Convention pour la répression d’actes illicites contre la sécurité de la navigation maritime a été élaboré s’appliquent également aux plates-formes fixes situées sur le plateau continental,

Tenant compte des dispositions desdits Protocoles,

Sont convenus de ce qui suit:

ARTICLE PREMIER

Aux fins du présent Protocole:

1. «Protocole de 1988» s’entend du Protocole pour la répression d’actes illicites contre la sécurité des plates-formes fixes situées sur le plateau continental, conclu à Rome le 10 mars 1988.

2. «Organisation» s’entend de l’Organisation maritime internationale.

3. «Secrétaire général» s’entend du Secrétaire général de l’Organisation.

ARTICLE 2

Remplacer le paragraphe 1 de l’article premier du Protocole de 1988 par le texte suivant:

1. Les dispositions des paragraphes 1 c), d), e), f), g), h) et 2 a) de l’article premier, celles des articles 2bis, 5, 5bis et 7 et celles des articles 10 à 16, y compris les articles 11bis, 11ter et 12bis, de la Convention pour la répression d’actes illicites contre la sécurité de la navigation maritime, telle que modifiée par le Protocole de 2005 relatif à la Convention pour la répression d’actes illicites contre la sécurité de la navigation maritime, s’appliquent également mutatis mutandis aux infractions visées aux articles 2, 2bis et 2ter du présent Protocole lorsque ces infractions sont commises à bord ou à l’encontre de plates-formes fixes situées sur le plateau continental.

ARTICLE 3

1. Remplacer le paragraphe 1 d) de l’article 2 du Protocole de 1988 par le texte suivant:

  • d) place ou fait placer sur une plate-forme fixe, par quelque moyen que ce soit, un dispositif ou une substance propre à détruire la plate-forme fixe ou de nature à compromettre sa sécurité.

2. Supprimer le paragraphe 1 e) de l’article 2 du Protocole de 1988.

3. Remplacer le paragraphe 2 de l’article 2 du Protocole de 1988 par le texte suivant:

2. Commet également une infraction toute personne qui menace de commettre l’une quelconque des infractions visées aux paragraphes 1 b) et c), si cette menace étant assortie ou non, en vertu du droit interne, d’une condition, afin de contraindre une personne physique ou morale à accomplir ou à s’abstenir d’accomplir un acte quelconque.

ARTICLE 4

1. Insérer le texte ci-après en tant qu’article 2bis:

Article 2bis

Commet une infraction au sens du présent Protocole toute personne qui illicitement et délibérément, lorsque cet acte, par sa nature ou son contexte, vise à intimider une population ou à s’abstenir d’accomplir un acte quelconque:

  • a) utilise contre ou à bord d’une plate-forme fixe, ou déverse à partir d’une plate-forme fixe, des explosifs, des matières radioactives ou des armes BCN, d’une manière qui provoque ou risque de provoquer la mort ou des dommages corporels ou matériels graves; ou

  • b) déverse, à partir d’une plate-forme fixe, des hydrocarbures, du gaz naturel liquéfié, ou d’autres substances nocives ou potentiellement dangereuses, qui ne sont pas visés à l’alinéa a), en quantités ou concentrations qui provoquent ou risquent de provoquer la mort ou des dommages corporels ou matériels graves; ou

  • c) menace de commettre l’une quelconque des infractions visées à l’alinéa a) ou b), ladite menace étant ou non assortie, en vertu du droit interne, d’une condition.

2. Insérer le texte ci-après en tant qu’article 2ter:

Article 2ter

Commet également une infraction au sens du présent Protocole toute personne qui:

  • a) illicitement et délibérément blesse ou tue toute personne, lorsque ces faits présentent un lien de connexité avec la commission de l’une des infractions visées au paragraphe 1 de l’article 2 ou à l’article 2bis; ou

  • b) tente de commettre une infraction visée au paragraphe 1 de l’article 2, à l’alinéa a) ou b) de l’article 2bis ou à l’alinéa a) du présent article; ou

  • c) se rend complice d’une infraction visée à l’article 2 ou 2bis ou à l’alinéa a) ou b) du présent article; ou

  • d) organise la commission d’une infraction visée à l’article 2 ou 2bis ou à l’alinéa a) ou b) du présent article ou donne l’ordre à d’autres personnes de la commettre; ou

  • e) contribue à la commission de l’une ou plusieurs des infractions visées à l’article 2 ou 2bis ou à l’alinéa a) ou b) du présent article, par un groupe de personnes agissant de concert, cette contribution étant délibérée et faite soit:

    • i) pour faciliter l’activité criminelle du groupe ou en servir le but, lorsque cette activité ou ce but suppose la commission d’une infraction visée à l’article 2 ou 2bis; soit

    • ii) en sachant que le groupe a l’intention de commettre une infraction visée à l’article 2 ou 2bis.

ARTICLE 5

1. Remplacer le paragraphe 1 de l’article 3 du Protocole de 1988 par le texte suivant:

1. Chaque État Partie prend les mesures nécessaires pour établir sa compétence aux fins de connaître des infractions visées aux articles 2, 2bis et 2ter quand l’infraction est commise:

  • a) à l’encontre ou à bord d’une plate-forme fixe alors qu’elle se trouve sur le plateau continental de cet État; ou

  • b) par un ressortissant de cet État.

2. Remplacer le paragraphe 3 de l’article 3 du Protocole de 1988 par le texte suivant:

3. Tout État Partie qui a établi sa compétence pour les cas visés au paragraphe 2 en informe le Secrétaire général. Si ledit État Partie annule ensuite cette compétence, il en informe le Secrétaire général.

3. Remplacer le paragraphe 4 de l’article 3 du Protocole de 1988 par le texte suivant:

4. Chaque État Partie prend les mesures nécessaires pour établir sa compétence aux fins de connaître des infractions visées aux articles 2, 2bis et 2ter dans le cas où l’auteur présumé de l’infraction se trouve sur son territoire et où il ne l’extrade pas vers l’un quelconque des États Parties qui ont établi leur compétence conformément aux paragraphes 1 et 2.

ARTICLE 6

Interprétation et application

1. Le Protocole de 1988 et le présent Protocole sont considérés et interprétés, entre les Parties au présent Protocole, comme un seul et même instrument.

2. Les articles 1 à 4 du Protocole de 1988, tel que révisé par le présent Protocole, ainsi que les articles 8 à 13 du présent Protocole constituent et sont appelés le Protocole de 2005 pour la répression d’actes illicites contre la sécurité des plates-formes fixes situées sur le plateau continental (Protocole SUA de 2005 sur les plates-formes fixes).

ARTICLE 7

Ajouter le texte ci-après en tant qu’article 4bis du Protocole:

Les clauses finales du Protocole de 2005 pour la répression d’actes illicites contre la sécurité des plates-formes fixes situées sur le plateau continental sont les articles 8 à 13 du Protocole de 2005 relatif au Protocole pour la répression d’actes illicites contre la sécurité des plates-formes fixes situées sur le plateau continental. Dans le présent Protocole, les références aux États Parties sont considérées comme des références aux États Parties au Protocole de 2005.

CLAUSES FINALES

ARTICLE 8

Signature, ratification, acceptation, approbation et adhésion

1. Le présent Protocole est ouvert à la signature du 14 février 2006 au 13 février 2007 au Siège de l’Organisation maritime internationale. Il reste ensuite ouvert à l’adhésion.

2. Les États peuvent exprimer leur consentement à être liés par le présent Protocole par:

  • a) signature sans réserve quant à la ratification, l’acceptation ou l’approbation; ou

  • b) signature sous réserve de ratification, d’acceptation ou d’approbation, suivie de ratification, d’acceptation ou d’approbation; ou

  • c) adhésion.

3. La ratification, l’acceptation, l’approbation ou l’adhésion s’effectuent par le dépôt d’un instrument à cet effet auprès du Secrétaire général.

4. Seul un État qui a signé le Protocole de 1988 sans réserve quant à la ratification, l’acceptation ou l’approbation, ou a ratifié, accepté, approuvé le Protocole de 1988 ou y a adhéré peut devenir Partie au présent Protocole.

ARTICLE 9

Entrée en vigueur

1. Le Présent Protocole entre en vigueur quatre-vingt-dix jours après la date à laquelle trois États l’ont signé sans réserve quant à la ratification, l’acceptation ou l’approbation, ou ont déposé auprès du Secrétaire général un instrument de ratification, d’acceptation, d’approbation ou d’adhésion. Toutefois, le présent Protocole n’entre pas en vigueur avant que le Protocole de 2005 relatif à la Convention pour la répression d’actes illicites contre la sécurité de la navigation maritime ne soit entré en vigueur.

2. Pour un État qui dépose un instrument de ratification, d’acceptation ou d’approbation du présent Protocole ou d’adhésion à celui-ci après que les conditions régissant son entrée en vigueur énoncées au paragraphe 1 ont été remplies, la ratification, l’acceptation, l’approbation ou l’adhésion prend effet quatre-vingt-dix jours après la date du dépôt.

ARTICLE 10

Dénonciation

1. Le présent Protocole peut être dénoncé par l’un quelconque des États Parties à tout moment après la date à laquelle le présent Protocole entre en vigueur à l’égard de cet État.

2. La dénonciation s’effectue au moyen du dépôt d’un instrument de dénonciation auprès du Secrétaire général.

3. La dénonciation prend effet un an après le dépôt de l’instrument de dénonciation auprès du Secrétaire général ou à l’expiration de tout délai plus long énoncé dans cet instrument.

ARTICLE 11

Révision et modification

1. Une conférence peut être convoquée par l’Organisation en vue de réviser ou de modifier le présent Protocole.

2. Le Secrétaire général convoque une conférence des États Parties au présent Protocole pour réviser ou modifier le Protocole à la demande d’un tiers des États Parties ou de cinq États Parties, si ce dernier chiffre est plus élevé.

3. Tout instrument de ratification, d’acceptation, d’approbation ou d’adhésion déposé après la date d’entrée en vigueur d’un instrument au présent Protocole est réputé s’appliquer au Protocole tel que modifié.

ARTICLE 12

Dépositaire

1. Le présent Protocole, ainsi que tout amendement adopté conformément à l’article 11, est déposé auprès du Secrétaire général.

2. Le Secrétaire général:

  • a) informe tous les États qui ont signé le présent Protocole ou y ont adhéré:

    • i) de toute nouvelle signature ou de tout dépôt d’un nouvel instrument de ratification, d’acceptation, d’approbation ou d’adhésion, ainsi que de leur date;

    • ii) de la date d’entrée en vigueur du présent Protocole;

    • iii) du dépôt de tout instrument de dénonciation du présent Protocole ainsi que de la date à laquelle il a été reçu et de la date à laquelle la dénonciatin prend effet;

    • iv) de toute communication faite en application de tout article du présent Protocole; et

  • b) transmet des copies certifiées conformes du présent Protocole à tous les États qui l’ont signé ou qui y ont adhéré.

3. Dès l’entrée en vigueur du présent Protocole, le Secrétaire général en transmet une copie certifiée conforme au Secrétaire générale de l’Organisation des Nations Unies en vue de son enregistrement et de sa publication conformément à l’article 102 de la Charte des Nations Unies.

ARTICLE 13

Langues

Le présent Protocole est établi en un seul exemplaire original en lan-gues anglaise, arabe, chinoise, espagnole, française et russe, chaque texte faisant également foi.

FAIT À LONDRES, ce quatorze octobre deux mille cinq.

EN FOI DE QUOI, les soussignés, dûment autorisés à cet effet par leur gouvernement respectif, ont signé le présent Protocole.

De Staten-Partijen bij dit Protocol,

Als partijen bij het Protocol tot bestrijding van wederrechtelijke gedragingen gericht tegen de veiligheid van vaste platforms op het continentale plat, gedaan te Rome op 10 maart 1988,

Erkennend dat de redenen waarom het Protocol van 2005 bij het Verdrag tot bestrijding van wederrechtelijke gedragingen gericht tegen de veiligheid van de zeevaart werd opgesteld ook gelden voor vaste platforms op het continentale plat,

Rekening houdend met de bepalingen van die Protocollen,

Zijn het volgende overeengekomen:

ARTIKEL 1

Voor de toepassing van dit Protocol:

1. wordt verstaan onder „Protocol van 1988’’, het Protocol tot bestrijding van wederrechtelijke gedragingen gericht tegen de veiligheid van vaste platforms op het continentale plat, gedaan te Rome op 10 maart 1988;

2. wordt verstaan onder „Organisatie’’, de Internationale Maritieme Organisatie;

3. wordt verstaan onder „Secretaris-Generaal’’, de Secretaris-Generaal van de Organisatie.

ARTIKEL 2

Artikel 1, eerste lid, van het Protocol van 1988 wordt vervangen door de volgende tekst:

1. De bepalingen van artikel 1, eerste lid, sub c, d, e, f, g, h, en tweede lid, sub a, en van de artikelen 2bis, 5, 5bis en 7, en van de artikelen 10 tot en met 16, met inbegrip van de artikelen 11bis, 11ter en 12bis van het Verdrag tot bestrijding van wederrechtelijke gedragingen gericht tegen de veiligheid van de zeevaart, zoals gewijzigd bij het Protocol van 2005 bij het Verdrag tot bestrijding van wederrechtelijke gedragingen gericht tegen de veiligheid van de zeevaart zijn van overeenkomstige toepassing op de strafbare feiten omschreven in de artikelen 2, 2bis en 2ter van dit Protocol, indien deze strafbare feiten worden gepleegd aan boord van of tegen vaste platforms op het continentale plat.

ARTIKEL 3

1. Artikel 2, eerste lid, sub d, van het Protocol van 1988 wordt vervangen door de volgende tekst:

  • d. op een vast platform, op welke wijze dan ook, een voorwerp of substantie plaatst of doet plaatsen waarmee het vaste platform kan worden vernield of de veiligheid ervan in gevaar kan worden gebracht.

2. Artikel 2, eerste lid, sub e, van het Protocol van 1988 wordt geschrapt.

3. Artikel 2, tweede lid, van het Protocol van 1988 wordt vervangen door de volgende tekst:

2. Aan een strafbaar feit maakt zich eveneens schuldig hij die dreigt, al dan niet gepaard gaand met een voorwaarde zoals voorzien in de nationale wetgeving, teneinde een natuurlijke persoon of een rechtspersoon te dwingen tot het verrichten of zich onthouden van een handeling, een van de in het eerste lid, sub b en c omschreven strafbare feiten te plegen, indien door deze dreiging de veiligheid van het vaste platform in gevaar kan worden gebracht.

ARTIKEL 4

1. De volgende tekst wordt ingevoegd als artikel 2bis:

Artikel 2bis

Aan een strafbaar feit in de zin van dit Protocol maakt zich schuldig hij die wederrechtelijk en opzettelijk, indien het doel van de gedraging door haar aard of context is een bevolking te intimideren of een regering of internationale organisatie te dwingen tot het verrichten of zich onthouden van enige handeling:

  • a. tegen, op of vanaf een vast platform een explosief, radioactief materiaal of een biologisch, chemisch of nucleair wapen doet vrijkomen op een wijze die leidt of kan leiden tot de dood of ernstig letsel of ernstige schade; of

  • b. van een vast platform olie, vloeibaar gemaakt aardgas of een andere schadelijke of gevaarlijke stof doet vrijkomen waarop sub a niet van toepassing is en wel in een zodanige hoeveelheid of concentratie dat dit leidt of kan leiden tot de dood of ernstig letsel of ernstige schade; of

  • c. al dan niet gepaard gaand met een voorwaarde zoals voorzien in de nationale wetgeving dreigt met het plegen van een strafbaar feit zoals voorzien in sub a of b.

2. De volgende tekst wordt ingevoegd als artikel 2ter:

Artikel 2ter

Aan een strafbaar feit in de zin van dit Protocol maakt zich tevens schuldig hij die:

  • a. wederrechtelijk en opzettelijk een ander verwondt of doodt in verband met het plegen van een van de strafbare feiten omschreven in artikel 2, eerste lid, of in artikel 2bis; of

  • b. poogt een strafbaar feit te plegen omschreven in artikel 2, eerste lid, artikel 2bis, sub a of b, of sub a van dit artikel; of

  • c. als medeplichtige deelneemt aan een strafbaar feit omschreven in artikel 2, artikel 2bis of sub a of b van dit artikel; of

  • d. het plegen van een strafbaar feit omschreven in artikel 2, artikel 2bis of sub a of b van dit artikel organiseert of anderen opdracht geeft een van deze strafbare feiten te plegen; of

  • e. bijdraagt tot het plegen van een of meer van de strafbare feiten omschreven in artikel 2, artikel 2bis of sub a of b van dit artikel, door een groep personen die opzettelijk, met een gemeenschappelijk doel handelt en:

    • i. hetzij met het oog op de bevordering van de criminele activiteit of het criminele doel van de groep, wanneer een dergelijke activiteit of het doel het plegen van een strafbaar feit inhoudt zoals omschreven in artikel 2 of 2bis;

    • ii. hetzij met de wetenschap van het doel van de groep een strafbaar feit te plegen zoals omschreven in artikel 2 of 2bis.

ARTIKEL 5

1. Artikel 3, eerste lid, van het Protocol van 1988 wordt vervangen door de volgende tekst:

1. Elke Staat-Partij neemt de maatregelen die nodig zijn om zijn rechtsmacht te vestigen met betrekking tot de in artikelen 2, 2bis en 2ter omschreven strafbare feiten, wanneer het strafbare feit wordt gepleegd:

  • a. tegen of aan boord van een vast platform dat is gelegen op het continentale plat van die Staat; of

  • b. door een onderdaan van die Staat.

2. Artikel 3, derde lid, van het Protocol van 1988 wordt vervangen door de volgende tekst:

3. Elke Staat-Partij die zijn rechtsmacht bedoeld in het tweede lid heeft gevestigd, stelt de Secretaris-Generaal daarvan in kennis. Indien een Staat-Partij daarna zijn rechtsmacht ter zake intrekt, stelt hij de Secretaris-Generaal daarvan in kennis.

3. Artikel 3, vierde lid, van het Protocol van 1988 wordt vervangen door de volgende tekst:

4. Elke Staat-Partij neemt de maatregelen die nodig zijn om zijn rechtsmacht te vestigen met betrekking tot de in artikel 2, 2bis en 2ter omschreven strafbare feiten in gevallen waarin de vermoedelijke dader zich op zijn grondgebied bevindt en hij deze persoon niet uitlevert aan een Staat-Partij die zijn rechtsmacht heeft gevestigd in overeenstemming met het eerste en tweede lid.

ARTIKEL 6

Uitlegging en toepassing

1. Het Protocol van 1988 en dit Protocol dienen, tussen de Partijen bij dit Protocol, tezamen te worden gelezen en geïnterpreteerd als een enkel instrument.

2. De artikelen 1 tot en met 4 van het Protocol van 1988, zoals gewijzigd bij dit Protocol, vormen, tezamen met de artikelen 8 tot en met 13 van dit Protocol, het Protocol tot bestrijding van wederrechtelijke gedragingen gericht tegen de veiligheid van vaste platforms op het continentale plat van 2005 en worden als zodanig aangeduid.

ARTIKEL 7

De volgende tekst wordt toegevoegd als artikel 4bis van het Protocol:

Slotbepalingen van het Protocol tot bestrijding van wederrechtelijke gedragingen gericht tegen de veiligheid van vaste platforms op het continentale plat van 2005

De slotbepalingen van het Protocol tot bestrijding van wederrechtelijke gedragingen gericht tegen de veiligheid van vaste platforms op het continentale plat van 2005 zijn de artikelen 8 tot en met 13 van het Protocol van 2005 bij het Protocol tot bestrijding van wederrechtelijke gedragingen gericht tegen de veiligheid van vaste platforms op het continentale plat. Verwijzingen in dit Protocol naar Staten-Partijen verwijzen naar Staten die Partij zijn bij het Protocol van 2005.

SLOTBEPALINGEN

ARTIKEL 8

Ondertekening, bekrachtiging, aanvaarding, goedkeuring en toetreding

1. Dit Protocol staat van 14 februari 2006 tot en met 13 februari 2007 open voor ondertekening op het hoofdkwartier van de Organisatie en blijft daarna open voor toetreding.

2. Staten kunnen hun instemming door dit Protocol te worden gebonden tot uitdrukking brengen door:

  • a. ondertekening zonder voorbehoud van bekrachtiging, aanvaarding of goedkeuring; of

  • b. ondertekening onder voorbehoud van bekrachtiging, aanvaarding of goedkeuring, gevolgd door bekrachtiging, aanvaarding of goedkeuring; of

  • c. toetreding.

3. Bekrachtiging, aanvaarding, goedkeuring of toetreding geschiedt door nederlegging van een daartoe strekkende akte bij de Secretaris-Generaal.

4. Uitsluitend een Staat die het Protocol van 1988 zonder voorbehoud van bekrachtiging, aanvaarding of goedkeuring heeft ondertekend danwel het Protocol van 1988 heeft bekrachtigd, aanvaard of goedgekeurd of ertoe is toegetreden kan Partij worden bij dit Protocol.

ARTIKEL 9

Inwerkingtreding

1. Dit Protocol treedt in werking negentig dagen na de datum waarop drie Staten het hebben ondertekend zonder voorbehoud van bekrachtiging, aanvaarding of goedkeuring of een akte van bekrachtiging, aanvaarding, goedkeuring of toetreding hebben nedergelegd bij de Secretaris-Generaal. Dit Protocol treedt evenwel niet in werking voordat het Protocol van 2005 bij het Verdrag tot bestrijding van wederrechtelijke gedragingen gericht tegen de veiligheid van de zeevaart in werking is getreden.

2. Voor een Staat die een akte van bekrachtiging, aanvaarding, goedkeuring of toetreding met betrekking tot dit Protocol heeft nedergelegd nadat aan de voorwaarden van het eerste lid voor inwerkingtreding is voldaan, wordt de bekrachtiging, aanvaarding, goedkeuring of toetreding van kracht negentig dagen na de datum van nederlegging.

ARTIKEL 10

Opzegging

1. Dit Protocol kan door elke Staat-Partij te allen tijde na de datum waarop dit Protocol voor die Staat in werking is getreden worden opgezegd.

2. Opzegging geschiedt door nederlegging van een akte van opzegging bij de Secretaris-Generaal.

3. Een opzegging wordt van kracht een jaar, of zoveel later als aangegeven in de akte van opzegging, na de nederlegging van de akte van opzegging bij de Secretaris-Generaal.

ARTIKEL 11

Herziening en wijziging

1. Door de Organisatie kan een conferentie tot herziening of wijziging van dit Protocol worden belegd.

2. Op verzoek van een derde van de Staten-Partijen of van vijf Staten-Partijen, naargelang van welk aantal het grootst is, belegt de Secretaris-Generaal een conferentie van de Staten-Partijen tot herziening of wijziging van het Protocol.

3. Een akte van bekrachtiging, aanvaarding, goedkeuring of toetreding die is nedergelegd na de datum van inwerkingtreding van een wijziging van dit Protocol wordt geacht van toepassing te zijn op het gewijzigde Protocol.

ARTIKEL 12

Depositaris

1. Dit Protocol en alle ingevolge artikel 11 aanvaarde wijzigingen worden nedergelegd bij de Secretaris-Generaal.

2. De Secretaris-Generaal:

  • a. stelt alle Staten die dit Protocol hebben ondertekend of ertoe zijn toegetreden in kennis van:

    • i. iedere nieuwe ondertekening of nederlegging van een akte van bekrachtiging, aanvaarding, goedkeuring of toetreding, alsmede de datum ervan;

    • ii. de datum van inwerkingtreding van dit Protocol;

    • iii. de nederlegging van elke akte van opzegging van dit Protocol, alsmede de datum van ontvangst ervan en de datum waarop de opzegging van kracht wordt;

    • iv. alle mededelingen die ingevolge een artikel van dit Protocol vereist zijn; en

  • b. doet alle Staten die dit Protocol hebben ondertekend of ertoe zijn toegetreden voor eensluidend gewaarmerkte afschriften van dit Protocol toekomen.

3. Terstond na inwerkingtreding van dit Protocol zendt de Secretaris-Generaal een voor eensluidend gewaarmerkt afschrift van de tekst aan de Secretaris-Generaal van de Verenigde Naties ter registratie en publicatie overeenkomstig artikel 102 van het Handvest van de Verenigde Naties.

ARTIKEL 13

Talen

Dit Protocol is opgesteld in één oorspronkelijk exemplaar in de Arabische, de Chinese, de Engelse, de Franse, de Russische en de Spaanse taal, zijnde alle teksten gelijkelijk authentiek.

GEDAAN TE LONDEN de veertiende oktober tweeduizend vijf.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe naar behoren gemachtigd door hun onderscheiden Regeringen, dit Protocol hebben ondertekend.

Het Protocol van 2005 behoeft ingevolge artikel 91 van de Grondwet de goedkeuring van de Staten-Generaal, alvorens het Koninkrijk aan het Protocol kan worden gebonden.

Ondertekening van het Protocol van 2005 zonder voorbehoud van bekrachtiging, aanvaarding of goedkeuring is voorzien in artikel 8, tweede lid, onderdeel a, van dat Protocol, terwijl bekrachtiging, aanvaarding of goedkeuring is voorzien in artikel 8, tweede lid, onderdeel b. Toetreding is voorzien in artikel 8, tweede lid, onderdeel c.

De bepalingen van het Protocol zijn voor Aruba in werking getreden op 17 januari 2006.

Het Protocol geldt niet voor de Nederlandse Antillen.


De bepalingen van het Protocol van 2005 zullen ingevolge zijn artikel 9, eerste lid, in werking treden negentig dagen nadat 3 staten het Protocol hetzij hebben ondertekend zonder voorbehoud van bekrachtiging, aanvaarding of goedkeuring, hetzij hebben bekrachtigd, aanvaard of goedgekeurd of ertoe zijn toegetreden. Het Protocol treedt echter niet in werking voordat het Protocol van 2005 tot wijziging van het hieronder in rubriek J genoemde Verdrag van 10 maart 1988 in werking is getreden.
