Verlenging van de Verklaring

Aanvaarding is voorzien in artikel II van de hieronder in rubriek H opgenomen verlenging.

De bepalingen van de verlenging van de Verklaring zullen, ingevolge artikel II van de verlenging juncto artikel IV, tweede lid, onderdeel a en c, van de Verklaring van 7 juni 2001, in werking treden zodra twee derde van de staten, die deelnemen aan de Verklaring van 7 juni 2001, de Directeur-Generaal van het Europees Ruimte-Agentschap schriftelijk van de aanvaarding in kennis heeft gesteld.

H. VERLENGING

Op 5 december 2005 is, in overeenstemming met artikel VI, tweede lid, onderdeel c, een verlenging van de Verklaring totstandgekomen, waarin de verklaring van 7 juni 2001, waarvan de geldigheid op 1 januari 2007 zou aflopen, wordt verlengd vanaf 1 januari 2007 tot eind 2008. De Engelse tekst van die verlenging luidt als volgt:

The governments of the Republic of Austria, the Kingdom of Belgium, the Kingdom of Denmark, the Republic of Finland, the French Republic, the Federal Republic of Germany, Ireland, the Italian Republic, the Kingdom of the Netherlands, the Kingdom of Norway, the Portuguese Republic, the Kingdom of Spain, the Kingdom of Sweden, the Swiss Confederation, the United Kingdom of Great Britain and Northern Ireland,

parties to the Declaration by certain European governments on the Ariane launcher production phase which entered into force on 14 April 1980 and was renewed on 21 May 1992 and 20 December 2001 (hereafter referred to as the Ariane Production Declaration’’), and

Member States of the European Space Agency (‘‘the Agency’’)

I. REAFFIRM their resolve to ensure continuity of the scheme set up, for the production, marketing and launch of the Ariane launchers on the basis of the production master files stemming from the Agency’s development programmes, and their support for continuation by the Arianespace company of the production and commercialisation activities for the Ariane launchers.

II. AGREE, pursuant to the terms of section IV.2. a) and c) of the Ariane Production Declaration to extend the latter, as from 1st January 2007 until the end of 2008. If need be, its provisions shall remain in force beyond that date in order to allow, where appropriate, for the execution of launch contracts concluded up to the end of 2008.

III. NOTE the provisions of the Resolution on the restructuring of the Ariane launcher sector adopted by Council meeting at ministerial level on 27 May 2003 and the Resolution on the Agency’s mandate for the current Ariane launcher production phase and the evolution towards an overall coherent strategy in the European launcher sector adopted by Council on 4 February 2004.

IV. INVITE the Council of the Agency to authorise the Director General of the Agency to continue to exercise the duties of depositary of the extended Ariane Production Declaration, together with those described in section IV.2 thereof.

V. INVITE the Governments of the Member States of the Agency that are parties to the Declaration to convey as soon as possible to the Director General of the Agency notification of their acceptance in writing of the extension of the Ariane Production Declaration.

VI. INVITE the respective Governments of the Republic of Greece and of the Grand Duchy of Luxemburg to notify the Director General of the Agency of their accession to the extended Declaration within three months of the date on which it takes effect, in accordance with the provisions of section IV.2 thereof.
