Sir,

I have the honour to inform you that the International Atomic Energy Agency (hereinafter referred to as the IAEA) is planning to organize a Regional Training Course on the Security of Nuclear Research Reactors in June 2006.

From informal discussions held between the Office of Nuclear Security (NSNS), Department of Nuclear Safety and Security, the Ministry of Housing, Spatial Planning and the Environment (VROM), the Reactor Institute, Delft and the Permanent Mission of the Kingdom of the Netherlands to the IAEA, we understand that the Government of the Kingdom of the Netherlands would be willing to host the training course and that suitable premises and facilities could be made available in the Kingdom of the Netherlands for the course.

I have the honour to enquire whether your Government would agree to make the following arrangements:

1. The Government will accord to the IAEA, its property, funds and assets, and to the officials of the IAEA, lecturers, and participants officially designated to attend the training course in their official capacities, and to observers, the privileges and immunities contained in the Agreement on the Privileges and Immunities of the IAEA which was accepted by the Government on 29 Augus 1963.

2. The Government will accord to the officials of the IAEA, lecturers, the participants mentioned above and to the observers every facility necessary for the performance of their functions in connection with the training course, including entering, remaining in and leaving the Kingdom of the Netherlands. The Government will issue any necessary visas as expeditiously as possible and, where the legislation of the Kingdom of the Netherlands permits, free of charge. The Government, however, reserves the right to deny, irrespective of nationality, visas to individual participants for national security reasons. The IAEA will inform the Government promptly of all persons officially designated to attend the training course. The IAEA will also advise such persons to apply for visas, if required, in good time before the opening date of the training course, and the Government is expected to issue such visas promptly so as to allow participants to attend the training course.

3. The Government will facilitate customs formalities for those persons on entering and leaving the Kingdom of the Netherlands.

4. The Government will make available to the IAEA without charge, and for the entire duration of the training course, adequate premises and facilities.

5. The Government will exercise reasonable care to ensure security on the premises in which the training course takes place and to ensure the safety of the officials of the IAEA and participants while on the premises where the course will take place. The Government will take whatever steps may be reasonable in the circumstances to ensure such security and safety, including such supervision of the premises as may be warranted.

I enclose for your information a list of Member States of the IAEA to be invited to nominate participants for the training course as Annex A and a list of administrative and technical requirements as Annex B.

Should your Government agree to host the training course in question, I would be grateful if your Government would designate a representative to facilitate liaison between the IAEA and the Government in connection with the course. The course location and date will be decided through discussion with the designated host organization. Mr. D. Ek, (NSNS), has been appointed Scientific Secretary of the training course. Ms. Julie Zellinger, Divison of Conference and Document Services will provide the administrative organization.

I would be grateful to receive, in writing, your Government’s agreement on the above enumerated points by mid April 2006 so as to enable the Secretariat to proceed with timely arrangements.

Regional Training Course on the Security of Nuclear Research Reactors Delft, the Kingdom of the Netherlands 26 June to 7 July 2006

I. To be provided by the Host Government free of charge

(1) Premises

This shall be at the exlusive disposal of the IAEA from the day before the training course until the last day of the course inclusive:

Main training room (to accommodate up to 35 participants with classroom style seating) Administrative support room

Five rooms, each one large enough to accommodate seven participants

(2) Equipment

Personal computers with printer and Internet/e-mail connections; (number to be confirmed)

Photocopying machine (rapid and easy to operate)

Microphones for lecturers (type and number to be confirmed)

Overhead projector

Large screen

Laser pointer

Flip charts

(3) Personnel

  • a) Host Country Organizer – Mr. Rik Linssen – appointed by Reactor Institute, Delft, will be responsible for the local administrative coordination, which includes arranging

    • (i) suitable accommodation for officials of the IAEA, lecturers, IAEA selected participants and observers;

    • (ii) local transportation, as required;

    • (iii) lunches during the course;

    • (iv) two hospitality events for the course participants and all courselecturers. The cost of one hospitality event will be born by the IAEA and the other one borne by the Host Government;

  • b) Lecturers from the Host Government/National Institute, as appropriate, to talk about the physical protection infrastructure in the Kingdom of the Netherlands.

  • c) Administrative and auxiliary staff, as required, for the proper conduct of the course, including the maintenance and operation of the equipment at the training premises.

(4) Course Material

To be provided by the IAEA and printed by the Host Government.

All lecturers will be selected by the IAEA and the Host Government in joint consultation. The IAEA will invite the non local lecturers and the Host Government will invite the local ones. The lecturers will deliver on specific items of the course and will participate in relevant panel discussions.

II Observers

Up to four observers may be invited to participate in the training course at their own cost. They may be selected by the IAEA or the Host Government, in joint consultation.

III IAEA Responsibilities

1. Providing the services of an IAEA Course Director and Corse Organizer;

2. Inviting Member States to nominate participants in the course following established IAEA practices;

3. Selection of participants from the nominations received;

4. Assuming the following costs of conducting the course, in accordance with IAEA Financial Rules and Regulations) including:

  • a) Travel costs and subsistence allowance of IAEA invited guest lecturers/technical experts;

  • b) Daily subsistence allowance and travel arrangements for all IAEA invited participants, the IAEA Course Director and Course Organizer;

  • c) Funding one hospitality event for the course participants and all course lecturers

5. Distribution of pre-course material and other information to the selected participants;

6. Consulting on the above with the designated representative from the Host Government, as appropriate.

PERMANENTE VERTEGENWOORDIGING VAN HET KONINKRIJK DER NEDERLANDEN

I have the honour to refer to your letter reference NSF05247 of 18 April 2006, relating to an agreement to be concluded between the Government of the Kingdom of the Netherlands and the International Atomic Energy Agency (IAEA) concerning the Regional Training Course on the Security of Nucleair Research Reactors, which is scheduled to be held in Delft from 26 June to 7 July 2006, which reads as follows:

I am authorized by the Government of the Kingdom of the Netherlands to state that it agrees to the proposals regarding the organization of the Training Course and to state that the Government of the Kingdom of the Netherlands considers your letter and my reply as together constituting an Agreement between the Government of the Kingdom of the Netherlands and the IAEA in respect of the Regional Training Course on the Security of Nuclear Research Reactor 2006, which shall enter into force on the date of this reply and shall remain in force for the duration of the Training Course and for such additional period as is necessary for its preparation and winding up, the total duration of this Agreement, however, not to exceed one year.

The liaison officer for the Netherlands in connection with the Training Course will be Mr. A.H. Dal of the Netherlands Ministry of Housing, Spatial Planning and the Environment, Nuclear-Physics Service.

D. PARLEMENT

Het in de brieven vervatte verdrag behoeft ingevolge artikel 7, onderdeel c, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal.

G. INWERKINGTREDING

De bepalingen van het in de brieven vervatte verdrag zijn ingevolge het gestelde in de één na laatste alinea van brief Nr. II in werking getreden op 30 mei 2006.

Het in de brieven vervatte verdrag zal ingevolge dezelfde alinea niet langer dan één jaar van kracht zijn.
