De Engelse en de Franse tekst van het Statuut zijn geplaatst in Trb. 1990, 75.

Voor wijzigingen van paragraaf 13 en paragraaf 14 van het Statuut zie rubriek J van Trb. 1993, 22.

In overeenstemming met paragraaf 21 van het Statuut heeft de Internationale Studiegroep voor Koper bij Besluit van 17 maart 2005 paragraaf 15 (a) van het Statuut gewijzigd.

De Engelse en de Franse tekst1 van de wijziging luiden als volgt:

1. Decide by concensus to amend paragraph 15(a) of the Terms of Reference as follows:

Paragraph 15 (a) is deleted and replaced by the following provision:

‘‘15(a) Each member shall contribute to an annual budget wich shall be approved by the Group in accordance with the provisions of the Rules of Procedure. For the purpose of assessing the contributions of members, 50 percent of the budget shall be apportioned equally among them; 25 percent shall be apportioned among member States in proportion to their shares in the total exports and imports of member States of copper ores and concentrates, measured in copper metal content, and unrefined and refined copper; and the remaining 25 percent shall be apportioned among member States in proportion to their shares in a total which shall consist of the mine production or refined consumption of copper of each member State, whichever is the higher. The calculation of these shares shall be based on the latest three calendar years for which statistics are available. The maximum amount payable by an individual member shall be capped at 10% of total budgeted assessments with the balance redistributed equally across remaining members.’’

2. Decide also that this amendment shall enter into force for all parties immediately and apply to member assessments for 2006 and future years;

3. Decide further that any State or intergovernmental organization that accepts the Terms of Reference after the entry into force of the amendment shall be deemed to have accepted the Terms of Reference as amended;

4. Request the depositary to circulate the amendment to the States, international organizations concerned and the Secretary General of the International Copper Study Group;

5. Request also the depositary to establish and circulate certified true copies of the Terms of Reference of the International Copper Study Group as amended to the States, the international organizations concerned and the Secretary General of the International Copper Study Group.

1. Décident par consensus d’amender l’alinéa a) du paragraphe 15 des statuts comme suit:

Le texte de l’alinéa a) du paragraphe 15 est supprimé et remplacé par le texte suivant:

«15.a) Chaque membre contribue à un budget annuel qui est approuvé par le Groupe conformément aux dispositions du règlement intérieur. Aux fins du calcul des contributions des membres, 50% du budget sont répartis entre eux à parts égales; 25% le sont entre les États membres à proportion de la part te chacun dans leurs exportations et leurs importations totales de minerais et concentrés de cuivre, mesurées d’après la teneur en cuivre métallique, et de cuivre on affiné et affiné; et les 25% restant, à proportion de la part de chaque État membre dans un total constitué par les quantités de cuivre extraites ou les quantités de cuivre affiné consommées par chaque État membre, le chiffre retenu étant le plus élevé des deux en chaque cas. Ces parts sont calculées sur les trois dernières années civiles pour lesquelles des statistiques sont disponibles. Le montant maximal exigible d’un membre individuel est plafonnée à 10% du total des contributions prévues au budget, le solde étant redistribué à parts égales entre les membres restants;»

2. Décident également que le présent amendement entrera immédiatement en vigueur pour toutes les parties et s’appliquera aux quotes-parts versées par les membres pour 2006 et les années suivantes;

3. Décident en outre que tout État ou organisme intergouvernemental qui accepte les status après l’entrée en vigueur de l’amendement est réputé avoir accepté les statuts tels que modifiés;

4. Prient le dépositaire de communiquer le présent amendement aux États, aux organisations internationals concernées et au Secrétaire général du Groupe d’étude international du cuivre;

5. Prient également le dépositaire d’établir et de communiquer aux États, aux organisations internationales concernées et au Secrétaire général du Groupe d’étude international du cuivre des exemplaires certifiés conformes des statuts du Groupe d’étude international du cuivre tels que modifiés.

G. INWERKINGTREDING

In overeenstemming met punt 2 van het Besluit van 17 maart 2005 is de wijziging van paragraaf 15 (a) van het statuut op diezelfde datum in werking getreden.

Wat betreft het Koninkrijk der Nederlanden, geldt de wijziging alleen voor Nederland.
