Resolutie LEG.2(82) van 18 oktober 2000

Tijdens haar tweeëntachtigste zitting heeft de Juridische Commissie, bij Resolutie LEG.2(82), op 18 oktober 2000 in overeenstemming met artikel 33, vierde lid, van het Protocol, wijzigingen aangenomen.

Amendments of the Limits of Compensation in the Protocol of 1992 to amend the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage, 1971

The Legal Committee at its eighty-second session:

Recalling Article 33(b) of the Convention on the International Maritime Organization (hereinafter referred to as the ‘‘IMO Convention’’) concerning the functions of the Committee,

Mindful of Article 36 of the IMO Convention concerning rules governing the procedures to be followed when exercising the functions conferred on it by or under any international convention or instrument,

Recalling further article 33 of the Protocol of 1992 to amend the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage, 1971 (hereinafter referred to as the ‘‘1992 Fund Protocol’’) concerning the procedures for amending the limits of the amounts of compensation set out in article 6(3) of the 1992 Fund Protocol,

Having considered amendments to the limits of the amounts of compensation proposed and circulated in accordance with the provisions of article 33(1) and (2) of the 1992 Fund Protocol,

1. Adopts, in accordance with article 33(4) of the 1992 Fund Protocol, amendments to the limits of the amounts of compensation set out in article 6(3) of the 1992 Fund Protocol, as set out in the Annex to this resolution;

2. Determines, in accordance with article 33(7) of the 1992 Fund Protocol, that these amendments shall be deemed to have been accepted on 1 May 2002 unless, prior to that date, not less than one quarter of the States that were Contracting States on the date of the adoption of these amendments (being 18 October 2000) have communicated to the Organization that they do not accept these amendments;

3. Further determines that, in accordance with article 33(8) of the 1992 Fund Protocol, these amendments, deemed to have been accepted in accordance with paragraph 2 above, shall enter into force on 1 November 2003;

4. Requests the Secretary-General, in accordance with articles 33(7) and 38(2)(vi) of the 1992 Fund Protocol, to transmit certified copies of the present resolution and the amendments contained in the Annex thereto to all States which have signed or acceded to the 1992 Fund Protocol; and

5. Further requests the Secretary-General to transmit copies of the present resolution and its Annex to the Members of the Organization which have not signed or acceded to the 1992 Fund Protocol.

Annex

Amendments of the Limits of Compensation in the Protocol of 1992 to amend the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage, 1971

Article 6(3) of the 1992 Fund Protocol is amended as follows:

the reference in paragraph 4(a) to ‘‘135 million units of account’’ shall read ‘‘203,000,000 units of account’’;

the reference in paragraph 4(b) to ‘‘135 million units of account’’ shall read ‘‘203,000,000 units of account’’; and

the reference in paragraph 4(c) to ‘‘200 million units of account’’ shall read ‘‘300,740,000 units of account’’.

Wijzigingen van de vergoedingsgrenzen in het protocol van 1992 tot wijziging van het Internationaal Verdrag betreffende de instelling van een Internationaal Fonds voor vergoeding van schade door verontreiniging door olie, 1971

De juridische commissie tijdens haar tweeëntachtigste zitting:

Herinnerend aan artikel 33(b) van het Verdrag nopens de Internationale Maritieme Organisatie (hierna te noemen het „IMO-verdrag’’) betreffende de taken van de Commissie,

Indachtig artikel 36 van het IMO-verdrag inzake regels betreffende de procedures die dienen te worden gevolgd bij de uitoefening van de taken die haar bij of krachtens een internationaal verdrag of instrument zijn opgelegd,

Voorts in herinnering brengend artikel 33 van het Protocol van 1992 tot wijziging van het Internationaal Verdrag betreffende de instelling van een Internationaal Fonds voor vergoeding van schade door verontreiniging door olie, 1971, (hierna te noemen het „Fondsprotocol, 1992’’), betreffende de procedures voor wijziging van de vergoedingsgrenzen als vervat in artikel 6, derde lid, van het Fondsprotocol, 1992,

Na bestudering van de wijzigingen van de vergoedingsgrenzen, voorgesteld en verspreid in overeenstemming met de bepalingen van artikel 33, eerste en tweede lid van het Fondsprotocol, 1992,

1. Neemt, in overeenstemming met artikel 33, vierde lid, van het Fondsprotocol, 1992, de wijzigingen van de vergoedingsgrenzen als vervat in artikel 6, derde lid, van het Fondsprotocol, 1992, aan, waarvan de tekst is vervat in de Bijlage bij deze resolutie;

2. Bepaalt, in overeenstemming met artikel 33, zevende lid, van het Fondsprotocol, 1992, dat deze wijzigingen worden geacht te zijn aanvaard op 1 mei 2002, tenzij voor deze datum niet minder dan eenvierde van de Staten die Verdragsluitende Staten waren op de datum van aanneming van deze wijzigingen (zijnde 18 oktober 2000) de Organisatie hebben medegedeeld dat zij de wijzigingen niet aanvaarden;

3. Bepaalt voorts, in overeenstemming met artikel 33, achtste lid, van het Fondsprotocol, 1992, dat deze wijzigingen, die geacht worden te zijn aanvaard overeenkomstig het bovenstaande punt 2, in werking zullen treden op 1 november 2003;

4. Verzoekt de Secretaris-Generaal, in overeenstemming met de artikelen 33, zevende lid, en 38, tweede lid, onderdeel vi, van het Fondsprotocol, 1992, voor eensluidend gewaarmerkte afschriften van deze resolutie en van de in de Bijlage vervatte wijzigingen te doen toekomen aan alle Staten die het Fondsprotocol, 1992, hebben ondertekend of ertoe zijn toegetreden; en

5. Verzoekt de Secretaris-Generaal voorts afschriften van deze resolutie en de Bijlage daarbij te doen toekomen aan Leden van de Organisatie die het Fondsprotocol, 1992, niet hebben ondertekend of er niet toe zijn toegetreden.

Wijzigingen van de vergoedingsgrenzen in het Protocol van 1992 tot wijziging van het Internationaal Verdrag betreffende de instelling van een Internationaal Fonds voor vergoeding van schade door verontreiniging door olie, 1971

Artikel 6, derde lid, van het Fondsprotocol, 1992, wordt bij dezen als volgt gewijzigd:

de verwijzing in het vierde lid, onderdeel a, naar „135 miljoen rekeneenheden’’ wordt gewijzigd in „203.000.000 rekeneenheden’’;

de verwijzing in het vierde lid, onderdeel b, naar „135 miljoen rekeneenheden’’ wordt gewijzigd in „203.000.000 rekeneenheden’’; en

de verwijzing in het vierde lid, onderdeel c, naar „200 miljoen rekeneenheden’’ wordt gewijzigd in „300.740.000 rekeneenheden’’.

... The Argentine Republic rejects the statement made by the United Kingdom of Great Britain and Northern Ireland on acceding to the Protocol of 1992 to amend the International Convention on Civil Liability for Oil Pollution Damage, 1969 and the Protocol of 1992 to amend the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage, 1971. In that statement, accession was declared to be effective in respect of the Malvinas Islands, South Georgia and South Sandwich Islands. The Argentine Republic reaffirms its sovereignty over these islands and their surrounding maritime spaces, which constitute and integral part of its national territory. The Argentine Republic recalls the adoption, by the General Assembly of the United Nations, of resolutions 2065(XX), 3160(VVVII), 31/49, 37/9, 38/12, 39/6, 40/21, 41/40, 42/19 and 43/25, acknowledging the existence of a dispute concerning sovereignty and urging the Government of the Argentine Republic and the United Kingdom of Great Britain and Northern Ireland to enter into negotiations with a view to identifying means of pacific and final settlement of the outstanding problems between the two countries, including all matters concerning the future of the Malvinas Islands, in accordance with the Charter of the United Nations.

Canada, 29 mei 1998

By virtue of Article 14 of the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage, 1992, the Government of Canada assumes reponsibility for the payment of the obligations contained in Article 10, paragraph 1.

Duitsland, 29 september 1994

The Federal Republic of Germany hereby declares that, having deposited the instruments of ratification of the protocols of 27 November 1992 amending the International Convention on Civil Liability for Oil Pollution Damage of 1969 and amending the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage of 1971, it regards its ratification of the Protocols of 25 May 1984, as documented on 18 October 1988 by deposit of its instruments of ratification, as null and void as from the entry into force of the Protocols of 27 November 1992.

Ierland, 15 mei 1997

Declare that this instrument of accession shall not take effect until the end of the six-month period in article 31 of the 1992 Protocol to amend the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage of 1971.

Mauritius, 6 december 1999

Rejects as unfounded the claim by the United Kingdom of Great Britain and Northern Ireland of any sovereignty or sovereign rights over the so-called British Indian Ocean Territory (Chagos Archipelago) and reaffirms it sovereignty and sovereign rights over the Chagos Archipelago which forms an integral part of the national territory of the Republic of Mauritius, and over their surrounding maritime zones.

In accordance with the provisions of article 30, paragraph 4 of the above-mentioned Protocol, Spain declares that the deposit of its instrument of accession shall not take effect for the purpose of this article until the end of the six-month period stipulated in article 31 of the said Protocol.

Turkije, 17 augustus 2001

In relation to Article 3/a (ii) of the Convention, the Republic of Turkey considers that this Article is not in conformity with international law and it defines those maritime areas as high seas whereby no country has jurisdiction and sovereign rights according to international law. The Republic of Turkey, however, taking into consideration the objectives of this Convention, reserves its rights deriving from the Convention. Within this context, the Republic of Turkey hereby declares that in maritime areas where there has been no delimitation agreement between opposite or adjacent coastal States, the exercise of authority or any claim thereof under this Convention by any coastal State Party to the Convention, creates no rights or obligations with regard to delimitation of maritime areas, nor does it create a precedent for the future agreements between those States concerning the delimitation of maritime areas under national jurisdiction.

Bezwaar door Cyprus, 30 April 2002

The Government of the Republic of Cyprus hereby declares that it does not accept the declaration of the Republic of Turkey, contained in its instrument of accession to the Protocol of 1992 to amend the International Convention on the Establishment of an International Fund for Compenstaion for Oil Pollution Daaamage, 1971, as it considers that Article 3(a)(ii) of the 1992 Fund Convention (as defined in Article 27(2) of the Protocol), to which the declaration refers, is not contrary to international law.

Bezwaar door Griekenland, 8 April 2002

The Government of the Hellenic Republic hereby declares that it does not accept such Declaration, as it considers that Article 3a(ii) of the amended 1971 Convention, to which the Declaration refers, is not contrary to International Law.

Zuid-Korea, 7 maart 1997 (vertaling)

... that this instrument of accession shall not take effect until the end of the six-month period in article 31 of the mentioned Protocol and denouncing the 1971 Fund Convention and the 1969 Liability Convention with effect twelve months after the expiry of the above-mentioned six-month period.

Ingevolge punt 2 en 3 van de Resolutie zijn de wijzigingen van 18 oktober 2000 op 1 november 2003 in werking getreden.
