De Internationale Douaneraad heeft tijdens zijn 103de en 104de zitting op 26 juni 2004 overeenkomstig de procedure van artikel 16 van het Verdrag een Aanbeveling aangenomen strekkende tot het aanbrengen van bepaalde wijzigingen in de douane-nomenclatuur zoals vervat in de Bijlage bij het Verdrag. Ingevolge de procedure van artikel 16, derde lid, van het Verdrag is deze aanbeveling door alle verdragspartijen aanvaard op 14 jnuari 2005. De tekst van de wijziging luidt als volgt:

«5. - A) On entend par machines automatiques de traitement de l’information au sens du n° 84.71 les machines aptes à:

    • 1°) enregistrer le ou les programmes de traitement et au moins les données immédiatement nécessaires pour l’exécution de ce ou de ces programmes;

    • Toutefois, les claviers, les dispositifs d’entrée à coordonnées x, y et les unités de mémoires à disques, qui remplissent les conditions énoncées aux paragraphes C) 2°) et C) 3° ) ci-dessus sont toujours à classer en tant qu’unités dans le n° 84.71.

  • D) Le n° 84.71 ne couvre pas les appareils ci-après lorsqu’ils sont présentés séparément, même s’ils remplissent toutes les conditions énoncées à la Note 5 C):

    • 1°) les imprimantes, les copieurs, les télécopieurs , même combinés entre eux;

    • 2°) les appareils pour la transmission ou la réception de la voix, d’images ou d’autres données, y compris les appareils pour la communication dans un réseau filaire ou sans fil (tel qu’un réseau local ou étendu);

    • (iv) Executing, without human intervention, a processing program which requires them to modify their execution, by logical decision during the processing run.

  • (B) Automatic data processing machines may be in the form of systems consisting of a variable number of separate units.

  • (C) Subject to paragraphs (D) and (E) below, a unit is to be regarded as being part of an automatic data processing system if it meets all of the following conditions:

    • (i) It is of a kind solely or principally used in an automatic data processing system;

De bepalingen van de wijziging van de Bijlage van 26 juni 2004 zullen ingevolge artikel 16, vierde lid, onderdeel b, van het Verdrag op 1 januari 2007 in werking treden.
