Verklaringen, voorbehouden en bezwaren

België, 22 februari 1991

– accession is based on Resolution ESA/C/XCII/Res.1 (Final) of 18 October 1990 on renewal of the Ariane launcher production phase, which authorises the European Space Agency to carry out Ariane operational activities on the basis of Article V.2 of the ESA Convention;

– as regards application of section I.6(c), the Belgian Government will comply with the obligations listed, subject to domestic legislation in force;

– the Belgian Government accepts no liability arising out of any decision on use of the Ariane launcher by a State that is not a Member of the European Space Agency;

– accession is subject to the condition that it does not entail any new financial commitment on the part of the Belgian Government.

Duitsland, 5 april 1991 (vertaling)

1. With reference to paragraph 1.4 b of the Declaration relating to the ARIANE Launcher Production Phase, the German Government confirms that with regard to the procurement for ARIANE launchers by German users the preference for ARIANE launchers will be exercised in the spirit that the German Government will do its best, subject to its legal possibilities.

2. With regard to the application of the third sub-paragraph of paragraph 1.6 c of the Declaration relating to the ARIANE Launcher Production Phase, the German Government proceeds on the understanding that it will fulfil the obligations listed thereunder subject to the national legislation currently in force.

3. The German Government understands that paragraph 1.10 of the Declaration relating to the ARIANE Launcher Production Phase does not include any financial obligations with regard to the promotion of exports by means of special arrangements. It points out that export guarantees can be granted only within the framework of the export credits insurance available in Germany in accordance with the customary criteria and that other export financing aids are not available.

Noorwegen, 14 augustus 1992

We are of the understanding – like other parties to the declaration who are directly concerned with the selection of launchers for international satellite organizations – that paragraph 1.4 (c) of the declaration does not commit national entities to prefer Ariane launchers in all circumstances.

Verenigd Koninkrijk, het, 9 oktober 1991

Zweden, 17 juni 1991

... to confirm our previous reserve that it is the understanding of my Government that a decision on the use of the Ariane launcher by another state member of the European Space Agency cannot be interpreted as engaging the responsibility of the Swedish Government.
