Op 31 december 1985 heeft het Koninkrijk der Nederlanden een eenzijdige verklaring afgelegd per diplomatieke nota. De tekst van de diplomatieke nota1 luidt als volgt:

The Royal Netherlands Embassy presents its compliments to the Department of State and has the honor to request the Department's attention for the following.

The island of Aruba, which is at present still part of the Netherlands Antilles, will obtain internal autonomy as a country within the Kingdom of the Netherlands as of 1 January 1986. Consequently the Kingdom will from then on no longer consist of two countries, namely The Netherlands (the Kingdom in Europe) and the Netherlands Antilles (situated in the Caribbean region), but will consist of three countries, namely the said two countries and the country of Aruba.

As the changes being made on 1 Januari 1986 concern a shift only in the internal consititutional relations within the Kingdom of the Netherlands, and as the Kingdom as such will remain the subject under international law regarding to treaties concluded by the Kingdom which already apply to the Netherlands Antilles, including Arbua, these treaties will remain in force for Aruba in its new capacity of country within the Kingdom. Therefore these treaties will as of 1 January 1986, as concerns the Kingdom of the Netherlands, apply tot the Netherlands Antilles (without Aruba) and Aruba.

Consequently the treaties referred to in the annex, which are in force at the moment between the Kingdom and the United States of America, and which apply to the Netherlands Antilles, will as of 1 January 1986, as concerns the Kingdom of The Netherlands, apply to the Netherlands Antilles and Aruba. The Embassy would appreciate receiving confirmation from the Department of State indicating that the Government of the United States of America has taken note of the above information.

Finally, it will be remembered that the question of the status of Aruba as of 1 January 1986 was raised earlier this year in the Embassy's Notes, dated August 22, 1985 no. 9968, October 2 1985, no. NA-11706 and December 4, 1985, no. NA-14573, in connection with the applicability to Aruba of the tax treaty between the United States of America and the Kingdom of The Netherlands, dated April 29, 1948 and of the subsequent protocol and exchange of Notes, including the Department's Note of December 17, 1985 regarding this matter.

The Royal Netherlands Embassy avails itself of this opportunity to renew to the Department of State the assurance of its highest consideration.

Ingevolge de in rubriek 3 hierboven opgenomen verklaring geldt het onderhavige Verdrag vanaf 1 januari 1986 voor Aruba als land met een status aparte in plaats van als onderdeel van de Nederlandse Antillen.
