De onderhavige overeenkomst is in overeenstemming met artikel 102 van het Handvest van de Verenigde Naties op 16 oktober 1974 geregistreerd bij het secretariaat van de Verenigde Naties onder nr. 13582.

Beëindiging

De onderhavige in brieven vervatte overeenkomst is beëindigd op grond van een notawisseling, waarvan de tekst als volgt luidt:

The Embassy of the United States of America presents its compliments to the Ministry of Foreign Affairs of the Kingdom of the Netherlands and has the honor to refer to the Agreement between the United States of America and the Kingdom of the Netherlands relating to the reciprocal acceptance of airworthiness certifications effected by exchange of notes at The Hague on January 16, 1974 (``the 1974 Agreement").

The Embassy refers also to the Agreement between the Government of the United States of America and the Government of the Kingdom of the Netherlands for Promotion of Aviation Safety, which was signed at The Hague on September 13, 1995 (``the 1995 Agreement") and in particular to Article VIII thereof, which provides that the 1974 Agreement shall remain in force until terminated by an exchange of notes following completion of technical assessments and implementation procedures concerning airworthiness certification by civil aviation authorities of our respective governments as described in Article III of the 1995 Agreement.

Considering that the civil aviation authorities of our respective governments completed technical assessments and signed, on June 3, 2002, the Implementation Procedures for Design Approval, Production Activities, Export Airworthiness Approval, Post Design Approval Activities, and Technical Assistance between the Authorities, the Government of the United States of America proposes that the 1974 Agreement be terminated.

Accordingly, if the Ministry of Foreign Affairs of the Kingdom of the Netherlands concurs, the Embassy further proposes that termination of the 1974 Agreement become effective on the date of the Ministry's affirmative note in reply.

The Embassy of the United States of America takes this opportunityto renew to the Ministry of Foreign Affairs the assurances of its highest consideration.

The Ministry of Foreign Affairs presents its compliments to the Embassy of the United States of America and has the honour to acknowledge receipt of the Embassy's Note No. 14/04 dated 21 April 2004 which reads as follows:

The Ministry of Foreign Affairs has the honour to inform the Embassy that the Government of the Kingdom of the Netherlands agrees that the Agreement between the Government of the Kingdom of the Netherlands and the Government of the United States of America for relating to the reciprocal acceptance of airworthiness certifications effected by exchange of notes at The Hague on 16 January 1974 be terminated and that the termination of this Agreement become effective on the date of this Note in reply.

The Ministry of Foreign Affairs avails itself of this opportunity to renew to the Embassy of the United States the assurances of its highest consideration.
