Het in brieven vervatte verdrag, waarvan de geldigheid op 13 juli 2004 zou aflopen, blijft, ingevolge het gestelde in de voorlaatste alinea van de in rubriek J hieronder opgenomen nota Nr. 1, respectievelijk Nr. II, van kracht voor een volgende periode van twaalf maanden.

Verlenging

Op 10 en 19 juli 2004 zijn nota's gewisseld tussen de Regering van het Koninkrijk der Nederlanden en de Regering van de Staat Koeweit, waarvan de tekst1 als volgt luidt:

The Royal Netherlands Embassy presents its compliments to the Ministry of Foreign Affairs of the State of Kuwait and, with reference to the Status of Forces Agreement for military personnel and equipment for the forces between the Kingdom of the Netherlands and the State of Kuwait, which entered into force on 13 July 2003, the Embassy has the honour to propose that the duration of the said Agreement, laid down in its article 11, be extended with a twelve-month period so that the Agreement will expire on 13 July 2005.

If this proposal is acceptable to the State of Kuwait, the Embassy proposes that this Note and the affirmative reply to it shall together constitute an Agreement between the Kingdom of the Netherlands and the State of Kuwait, which will be applied provisionally pending Parliamentary approval in the Netherlands from the date of reply of the State of Kuwait. If this date is later than 13 July 2004 this agreement will have retroactive effect as from the latter date. This agreement shall enter into force on the date on which the Embassy has notified the State of Kuwait in writing that the legal requirements in the Netherlands for entry into force have been complied with.

The Royal Netherlands Embassy avails itself of this opportunity to renew to the State of Kuwait the assurances of its highest consideration.

The Ministry of Foreign Affairs in Kuwait presents its compliments to the Royal Netherlands Embassy.

And with reference to the Embassy's note no. Kwe-2004/208 of 10/7/2004, in which the Embassy proposes extending the Agreement on the Status of the Netherlands Forces in the State of Kuwait (SOFA) which entered into force on 13/7/2003, for one year.

The Ministry would like to inform that there is no objection to extend the mentioned agreement for one year so that it will expire on 13/7/2005 according to article (11) of the aforementioned agreement.

Ministry of Foreign Affairs avails itself of this opportunity to renew to the Royal Netherlands Embassy the assurances of its highest consideration.

Het in de nota's vervatte verlengingsverdrag behoeft ingevolge artikel 7, onderdeel c, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal.

De bepalingen van het in de nota's vervatte verlengingsverdrag zullen ingevolge het gestelde in de voorlaatste alinea van Nota Nr. I in werking treden op de datum waarop de ambassade de Staat Koeweit er schriftelijk van in kennis heeft gesteld dat aan de wettelijke vereisten voor inwerkingtreding is voldaan.

Ingevolge de voorlaatste alinea van Nota Nr. I wordt het in de nota's vervatte verlengingsverdrag vanaf 19 juli 2004 met terugwerkende kracht vanaf 13 juli 2004 voorlopig toegepast.

Wat het Koninkrijk der Nederlanden betreft, geldt de verlenging alleen voor Nederland.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van BuitenlandseZaken bepaald dat het verlengingsverdrag zal zijn bekendgemaakt in Nederland op de dag na de datum van uitgifte van dit Tractatenblad.
