De wijziging is ingevolge artikel VII, vierde lid, van de Overeenkomst op 8 januari 2000 in werking getreden.

Voor het Koninkrijk der Nederlanden is de wijziging op dezelfde datum in werking getreden.

Wat het Koninkrijk der Nederlanden betreft, geldt de wijziging alleen voor Nederland.

Wijziging zoals in de Derde Vergadering van de Verdragsluitende Partijen van 24 tot 26 juli 2000 te Bristol overeengekomen

Op de van 24 tot 26 juli 2000 gehouden Derde zitting van de Vergadering van de Verdragsluitende Partijen is in overeenstemming met artikel VII, vierde lid, van de Overeenkomst een resolutie tot wijziging van de onderhavige Overeenkomst aangenomen. De Engelse en de Franse tekst1 van de resolutie luiden als volgt:

Resolution 3.7

Amendment of the Agreement

The Meeting of the Parties to the Agreement on the Conservation of Bats in Europe (hereafter ``the Agreement"),

Recognizing the need for conservation measures to protect all populations of Chiroptera species in Europe and in their non-European Range States;

Guided by a common will to further strengthen the Agreement and its scope;

Agrees:

1. To change the title of the Agreement to:

``The Agreement on the Conservation of Populations of European Bats";

2. To extend the last paragraph of the preamble with the words: ``and in their non-European Range States";

3. To replace Article I (b) with:

(b) ``Bats" means populations of CHIROPTERA species as listed in Annex 1 to this Agreement occurring in Europe and in their non-European Range States".

4. To add a new paragraph 5 to Article II to read as follows:

``5. The Annexes to this Agreement form an integral part thereof. Any

reference to the Agreement includes a reference to its Annexes."

5. To replace Article VII (4) with:

``4. An Amendment to the Agreement other than an Amendment to its Annexes shall be adopted by a two-thirds majority of the Parties present and voting and shall enter into force for those Parties which have accepted it 60 days after the deposit of the fifth instrument of acceptance of the Amendment with the Depositary. Thereafter, it shall enter into force for a Party 30 days after the date of deposit of its instrument of acceptance of the Amendment with the Depositary."

6. To add new paragraphs 5 to 7 to Article VII which read as follows:

``5. Any additional Annexes and any Amendment to an Annex shall be adopted by a two-thirds majority of the Parties present and voting and shall enter into force for all Parties on the sixtieth day after the date of its adoption by the Meeting of the Parties, except for Parties which have entered a reservation in accordance with paragraph 6 of this Article.

6. During the period of 60 days provided for in paragraph 5 of this Article, any Party may by written notification to the Depositary enter a reservation with respect to an additional Annex or an Amendment to an Annex.

Such reservation may be withdrawn at any time by written notification to the Depositary, and there upon the additional Annex or the Amendment shall enter into force for that Party on the sixtieth day after the date of withdrawal of the reservation.

7. Any State which becomes a Party to the Agreement after the entry into force of an Amendment shall, failing an expression of a different intention by that State:

  • a) be considered as a Party to the Agreement as amended; and

  • b) be considered as a Party to the unamended Agreement in relation to any Party not bound by the Amendment."

Résolution 3.7

Amendement de l'Accord

La Réunion des Parties contractantes à l'Accord relatif à la Conservation des Chauves-souris en Europe (par la suite «l'Accord»),

Reconnaissant la nécessité de mesures de conservation pour protéger toutes les populations de Chiroptères en Europe et dans les Etats non européens de leur aire de répartition,

Guidée par la volonté commune de fortifier l'Accord et sa portée,

a convenu:

1. De modifier le titre de l'Accord comme suit:

«Accord relatif à la Conservation des Populations de Chauves-souris d'Europe»;

2. De compléter le dernier paragraphe du préambule par: «et dans les Etats non européens de leur aire de répartition»;

3. De remplacer l'Article 1 (b) par:

«(b) Le terme «Chauves-souris» désigne les populations européennes de CHIROPTERA mentionnées dans l'Annexe 1 de cet Accord se trouvant en Europe ou dans des Etats non européens de leur aire de répartition»;

4. D'ajouter un nouveau paragraphe 5 à l'Article II:

«5. Les Annexes au présent Accord font partie intégrante de cet Accord. Toute référence à l'Accord constitue aussi une référence à ses Annexes»;

5. De remplacer l'Article VII (4) comme suit:

«4. Tout amendement au présent Accord, autre qu'un amendement à ses Annexes, est adopté à la majorité des deux-tiers des Parties présentes et votantes et entre en vigueur pour les Parties qui l'ont accepté 60 jours apres le dépôt du cinquième instrument d'approbation de l'amendement auprès du Dépositaire. Par la suite, il entre en vigueur pour une Partie 30 jours après la date de dépôt de son instrument d'approbation de l'amendement auprès du Dépositaire.»;

6. D'ajouter de nouveaux paragraphes (5 à 7) à l'Article VII:

«5. Toute nouvelle Annexe, ainsi que tout amendement à une Annexe, sont adoptés á la majorité des deux-tiers des Parties présentes et votantes, et entrent en vigueur à l'égard de toutes les Parties le soixantième jour après son adoption par la Réunion des Parties, sauf pour les Parties qui auront émis une réserve conformément au paragraphe 6 du présent Article.

6. Au cours du délai de 60 jours prévu au paragraphe 5 du présent Article, toute Partie peut, par notification écrite au Dépositaire, faire une réserve à l'égard d'une nouvelle Annexe ou d'un amendement à une Annexe.

Une telle réserve peut être retirée à tout moment par notification écrite au dépositaire; la nouvelle Annexe ou l'amendement entre alors en vigueur pour ladite Partie le soixantième jour après la date du retrait de la réserve.

7. Tout Etat qui devient Partie à l'Accord après l'entrée en vigueur d'un amendement est, faute d'avoir exprimé une intention différente, considéré comme étant:

  • a) Partie à l'Accord tel qu'il est amendé, et

  • b) Partie à l'Accord non amendé au regard de toute Partie à l'Accord qui n'est pas liée par l'accord portant l'amendement.»;

7. D'ajouter l'Annexe 1 suivante à l'Accord:

Wat het Koninkrijk der Nederlanden betreft, geldt deze wijziging alleen voor Nederland.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat de onderhavige wijziging in Nederland zal zijn bekendgemaakt op de dag na de datum van uitgifte van dit Tractatenblad.
