Het Verdrag, het Protocol en de Bijlagen zullen op grond van artikel IX van het Verdrag op 31 oktober 2004 buiten werking treden tussen de Tsjechische Republiek enerzijds en het Koninkrijk der Nederlanden anderzijds.

I. OPZEGGING

De Regering van de Tsjechische Republiek heeft bij nota van 30 oktober 2003 (waarvan de tekst – voor zover van belang – in rubriek J hieronder is opgenomen) het Verdrag opgezegd.

Bij Beschikking van 15 november 2001, 2001/855/EG (waarvan de tekst is geplaatst in Pb. EG L320 van 5 december 2001, blz. 13 e.v.), heeft de Raad van de Europese Unie de lidstaten van de Europese Unie gemachtigd bepalingen betreffende aangelegenheden die vallen onder de gemeenschappelijke handelspolitiek en die vervat zijn in de in de bijlage vermelde tussen de lidstaten en derde landen gesloten vriendschaps-, handels- en scheepvaartverdragen en handelsovereenkomsten stilzwijgend te verlengen dan wel te handhaven tot en met 30 april 2005. Het onderhavige Verdrag is opgenomen in de bij die Beschikking behorende bijlage.

Op 30 oktober 2003 heeft de Regering van de Tsjechische Republiek de Regering van het Koninkrijk der Nederlanden de volgende nota doen toekomen, waarvan de tekst – voor zover van belang – als volgt luidt:

The Embassy of the Czech Republic in The Hague presents its compliments to the Ministry of Foreign Affairs of the Netherlands and has the honour to convey the following information:

With regard to its upcoming accession to the European Union in 2004, the Czech Republic is obliged to adjust its treaty basis to comply with the principles and legal standards of the European Union. In the interest of effective participation in the European Union's activities, it will also be bound by the entire system of EU law. However, the Czech Republic's bilateral treaty basis includes certain international treaties, which are not fully compatible with the aforementioned standards of the European Union.

Under these circumstances, with regard to the time limits and technical concerns, the Czech Republic regrettably finds it necessary to hereby denounce the following agreements:

1. Convention de Commerce entre la République Tchécoslovaque et le Royaume des Pays-Bas/Hague, 20.01.1923; in accordance with its Article IX, the treaty will terminate on 31. 10. 2004;

Despite the above fact, the Czech side remains committed to continuing and developing the traditional friendly relations and cooperation between our two countries.

The Embassy of the Czech Republic avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Netherlands the assurances of its highest consideration.
