Briefwisseling houdende een verdrag tussen het Koninkrijk der Nederlanden en het Milieu Programma van de Verenigde Naties (UNEP) met betrekking tot de ``Second Meeting of the Scientific and Technical Advisory Committee to the Protocol Concerning Specially Protected Areas and Wildlife";

Excellency,
I have the honour to refer to the Second Meeting of the Scientific and Technical Advisory Committee (STAC) to the Protocol Concerning Specially Protected Areas and Wildlife, which is scheduled to be held in Curacao, the Netherlands Antilles, from 3 to 6 June 2003.
It is my intention to invite the representatives of all the Contracting Parties to the above-mentioned Protocol, as follows:
BARBADOS, COLOMBIA, CUBA, DOMINICAN REPUBLIC, FRANCE, the KINGDOM OF THE NETHERLANDS, PANAMA, ST. LUCIA, ST. VINCENT AND THE GRENADINES, TRINIDAD AND TOBAGO, UNITED STATES OF AMERICA AND VENEZUELA, as well as other member countries of the Caribbean Environment Programme and International non-governmental and intergovernmental organizations as observers.
In order to ensure the smooth functioning of the Meeting, I should appreciate it if your Government would undertake to apply the following provisions:
1. a) Provide the necessary premises, including conference rooms, office space, working areas and other related facilities (beginning one day prior to the meeting and continuing 24 hours a day until the meeting ends), and supplies as specified in Annex I. The Government of the Netherlands Antilles shall, at its expense, furnish, equip and maintain in good repair all these premises and facilities in a manner that the United Nations Environment Programme (UNEP)-CAR/RCU considers adequate for the effective conduct of the Meeting;
b) Provide, if possible within the conference area, or nearby: bank, post office, telephone, Internet and fax, a travel agency and a secretarial service centre, equipped in consultation with UNEP, for the use of delegations to the Meeting on a commercial basis;
c) Arrange for the delegates to receive and send e-mail free of charge;
d) Bear the cost of all necessary utility services, including local telephone communications of the Secretariat of the Meeting and its communications by fax, e-mail or telephone with UNEP offices, when such communications are authorized by or on behalf of the Conference Officer of the Meeting or the Head of the Secretariat;
e) Provide two (2) coffee breaks per day for participants for the duration of the Meeting and host two receptions for the delegates;
f) Ensure that adequate accommodation in hotels or residences is available at reasonable group discount rates (no greater than US$ 83 a night, inclusive of tax and breakfast for the person participating in or attending the Meeting);
g) Provide for medical services (nurse) for first aid in case of emergencies at the conference area, and for serious emergencies, ensure immediate transportation and admission to a hospital;
h) Provide transport between the airport, the conference area and main hotels for members of the UNEP Secretariat servicing the Meeting upon their arrival and departure (about 8 persons);
i) Provide availability of transport for all persons participating in and servicing the Meeting between the airport, the main hotels and the conference area: UNEP-CAR/RCU will provide information on time of arrival and flight numbers;
j) Provide a vehicle with driver, as necessary, for official use by the principal officers and Secretariat of the Meeting, as well as such other local transportation as may be required by the Secretariat in connection with the Meeting;
k) Appoint a liaison officer who will be responsible, in consultation with UNEP-CAR/RCU, for making and carrying out the administrative and personnel arrangements for the Meeting as required under this Agreement, and as listed in Annex I;
l) Provide adequate police protection to ensure the effective functioning of the Meeting in an atmosphere of security and tranquility free from interference of any kind.
2. The Convention of 13 February 1946 on the Privileges and Immunities of the United Nations shall apply. The Government of the Netherlands Antilles will ensure that no impediments to transit to and from the Meeting are imposed on any persons whose presence at the Meeting is authorized by UNEP-CAR/RCU.
3. The Government of the Netherlands Antilles shall be responsible for dealing with any action, claim or other demand against the United Nations Environment Programme or its officials and arising out of:
a) Injury to persons or damage to or loss of property in the premises referred to in paragraph 1 a) that are provided by or are under the control of the Government of the Netherlands Antilles;
b) Injury to persons or damage to or loss of property caused by, or incurred in using, the transport services referred to in paragraphs 1 (g) and 1 (i) that are provided by or are under the control of the Government of the Netherlands Antilles;
c) The employment for the Meeting of the personnel provided by the Government of the Netherlands Antilles in paragraphs 1 (j), 1 (k) and 1 (l).
4. The Government of the Netherlands Antilles shall refrain from any action, which may adversely affect UNEP-CAR/RCU or the United Nations and shall fulfil its commitments with fullest regard for the interest of the United Nations.
5. Any dispute between the Parties to this Agreement (UNEP and the Government of the Kingdom of the Netherlands) concerning the interpretation or application of this Agreement that is not settled by negotiation or other agreed mode of settlement shall be referred at the request of either party for final decision to a tribunal of three arbitrators, one to be named by the Secretary-General of the United Nations, one to be named by the Government of the Kingdom of the Netherlands and the third, who shall be the Chairperson, to be chosen by the first two. If either party fails to appoint an arbitrator within sixty (60) days of the appointment by the other party, or if these two arbitrators should fail to agree on the third arbitrator within sixty (60) days of their appointment, the President of the International Court of Justice may make any necessary appointments at the request of either party.
I should appreciate receiving your Government's acceptance by letter or by telefax on the above responsibilities by 28 July 2003, so that invitations and documents may be prepared and issued in good time.
This letter and your reply will constitute the Agreement covering the Meeting.

I have the honour to refer to your letter of 26 May 2003, relating to an agreement to be concluded between the Government of the Kingdom of the Netherlands and the United Nations Environment Programme (UNEP) concerning the Second Meeting of the Scientific and Technical Advisory Committee (STAC) to the Protocol Concerning Specially Protected Areas and Wildlife, which is scheduled to be held in Curacao, the Netherlands Antilles, from 3 to 6 June 2003, which reads as follows:
The Government of the Kingdom of the Netherlands agrees to the proposals regarding the organization of the Meeting and I consider your letter and my reply as together constituting an Agreement between the Government of the Kingdom of the Netherlands and the United Nations Environment Programme in respect of the Second Meeting of the Scientific and Technical Advisory Committee (STAC) to the Protocol Concerning Specially Protected Areas and Wildlife, which shall enter into force on the date of this reply and shall remain in force for the duration of the Meeting and for such additional period as is necessary for its preparation and winding up, the total duration of this Agreement, however, not to exceed one year. I avail myself of this opportunity to renew to Your Excellency the assurances of my highest consideration.

Personnel, Equipment, Rooms and Supplies to be provided by the Government of the Netherlands Antilles
– 1 Liaison Officer responsible for organizational matters before and for the duration of the Meeting
– 2 Conference Room Assistants (English speaking)
– 2 Photocopy Technicians responsible for ensuring machines are in working order, and for doing all photocopying work (to be available 24 hours/day)
– 1 Computer Technician responsible for maintenance of computers and printers (to be available 24 hours/day)
– 3 Secretaries (1 English, 1 Spanish, 1 French) – must have wordprocessing skills, (Microsoft Word), (to be prepared to work during nights and early mornings).
– To contribute to the payment of the translation an interpretation services up to a maximum of $ 6,500
– 1 Conference Room for plenary meetings (50–60 people), plus additional space necessary for interpretation booths, equipment and technicians in the conference room
– Head table for 6 persons
– Tables for delegations with seating capacity for 50–60 people, ``U" shaped set up
– 1 Table with seating capacity for 4 people for conference room personnel
– Overhead projector, multi-media projector, video and screens
– 3 Tables for document display
– 3 Interpreters' booths (English, Spanish, French)
– 1 booth or table for sound control and recording equipment

– Photocopying room (3 large tables for collation and dustbins or recycling containers for waste paper)
– Ten (10) IBM-compatible Personal Computers loaded with Microsoft Office 97 and the Word package set for spelling facilities in English, Spanish and French

– Two (2) photocopy machines – one (1) of them medium volume 70 pages per minute with collating and stapling capability.
– Lunch for the Delegates and members of the Secretariat for the 4- days duration of the Meeting.

N.B. All unused or partially used supplies and equipment, provided by the Government of the Netherlands Antilles will be returned to the Government of the Netherlands Antilles at the end of the Conference.
Het in de brieven vervatte verdrag behoeft ingevolge artikel 7, onderdeel a, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal, alvorens in werking te kunnen treden.
De bepalingen van het in de brieven vervatte verdrag zijn ingevolge het gestelde in de voorlaatste alinea van de tweede brief op 28 mei 2003 in werking getreden.
Wat het Koninkrijk der Nederlanden betreft, geldt het in de brieven vervatte verdrag alleen voor de Nederlandse Antillen.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat het in de notawisseling vervatte verdrag zal zijn bekendgemaakt in Nederland op de dag na de datum van uitgifte van dit Tractatenblad.
