Agreement concerning the establishing of global technical regulations for wheeled vehicles, equipment and parts which can be fitted and/or be used on wheeled vehicles

Preamble

The Contracting Parties,

Having decided to adopt an Agreement to establish a process for promoting the development of global technical regulations ensuring high levels of safety, environmental protection, energy efficiency and anti-theft performance of Wheeled Vehicles, Equipment and Parts which can be fitted and/or be used on Wheeled Vehicles;

Having decided that such process shall also promote the harmonization of existing technical regulations, recognizing the right of subnational, national and regional authorities to adopt and maintain technical regulations in the areas of health, safety, environmental protection, energy efficiency and anti-theft performance that are more stringent than those established at the global level;

Having authorization to enter into such an Agreement under paragraph 1a) of the Terms of Reference of the UN/ECE and Chapter XIII of the Rules of Procedure of the UN/ECE, Rule 50;

Recognizing that this Agreement does not prejudice the rights and obligations of a Contracting Party under existing international agreements on health, safety and environmental protection;

Recognizing that this Agreement does not prejudice the rights and obligations of a Contracting Party under the agreements under the World Trade Organization (WTO), including the Agreement on Technical Barriers to Trade (TBT), and intending to establish global technical regulations under this agreement, as a basis for their technical regulations in a manner consistent with these agreements;

Intending that Contracting Parties to this Agreement use the global technical regulations established under this Agreement as a basis for their technical regulations;

Recognizing the importance to public health, safety and welfare of continuously improving and seeking high levels of safety, environmental protection, energy efficiency and anti-theft performance of wheeled vehicles, equipment and parts which can be fitted and/or be used on wheeled vehicles, and the potential value to international trade, consumer choice and product affordability of increasing convergences in existing and future technical regulations and their related standards;

Recognizing that governments have the right to seek and implement improvements in the level of health, safety and environmental protection, and to determine whether the global technical regulations established under this Agreement are suitable for their needs;

Recognizing the important harmonization work already carried out under the 1958 Agreement;

Recognizing the interest and expertise in different geographic regions regarding safety, environmental, energy and anti-theft problems and methods of solving those problems, and the value of that interest and expertise in developing global technical regulations to aid in achieving those improvements and in minimizing divergences;

Desiring to promote the adoption of established global technical regulations in developing countries, taking into account the special issues and circumstances for those countries, and in particular the least developed of them;

Desiring that the technical regulations applied by the Contracting Parties be given due consideration through transparent procedures in developing global technical regulations, and that such consideration include comparative analyses of benefits and cost effectiveness;

Recognizing that establishing global technical regulations providing high levels of protection will encourage individual countries to conclude that those Regulations will provide the protection and performance needed within their jurisdiction;

Recognizing the impact of the quality of vehicle fuels on the performance of vehicle environmental controls, human health, and fuel efficiency; and

Recognizing that the use of transparent procedures is of particular importance in developing global technical regulations under this Agreement and that this development process must be compatible with the regulatory development processes of the Contracting Parties to this Agreement;

Have agreed as follows:

Article 1 Purpose

1.1. The purpose of this Agreement is:

1.1.1. To establish a global process by which Contracting Parties from all regions of the world can jointly develop global technical regulations regarding the safety, environmental protection, energy efficiency, and anti-theft performance of wheeled vehicles, equipment and parts which can be fitted and/or be used on wheeled vehicles;

1.1.2. To ensure that, in developing global technical regulations, due and objective consideration is given to the existing technical regulations of Contracting Parties, and to the UN/ECE Regulations;

1.1.3. To ensure that objective consideration is given to the analysis of best available technology, relative benefits and cost effectiveness as appropriate in developing global technical regulations;

1.1.4. To ensure that the procedures used in developing global technical regulations are transparent;

1.1.5. To achieve high levels of safety, environmental protection, energy efficiency, and anti-theft performance within the global community, and to ensure that actions under this Agreement do not promote, or result in, a lowering of these levels within the jurisdiction of Contracting Parties, including the subnational level;

1.1.6. To reduce technical barriers to international trade through harmonizing existing technical regulations of Contracting Parties, and UN/ECE Regulations, and developing new global technical regulations governing safety, environmental protection, energy efficiency and anti-theft performance of wheeled vehicles, equipment and parts which can be fitted and/or be used on wheeled vehicles, consistent with the achievement of high levels of safety and environment protection and the other above-stated purposes; and

1.1.7. To ensure that, where alternative levels of stringency are needed to facilitate the regulatory activities of certain countries, in particular developing countries, such needs are taken into consideration in developing and establishing global technical regulations.

1.2. This Agreement is to operate in parallel with the 1958 Agreement, without affecting the institutional autonomy of either Agreement.

Article 2 Contracting Parties and consultative status

2.1. Countries that are members of the Economic Commission for Europe (UN/ECE), regional economic integration organizations that are set up by ECE member countries and countries that are admitted to the ECE in a consultative capacity in accordance with paragraph 8 of the ECE's Terms of Reference, may become Contracting Parties to this Agreement.

2.2. Countries that are members of the United Nations and that participate in certain activities of the ECE in accordance with paragraph 11 of the ECE's Terms of Reference, and regional economic integration organizations set up by such countries, may become Contracting Parties to this Agreement.

2.3. Any specialized agency and any organization, including intergovernmental organizations and non-governmental organizations, that have been granted consultative status by the Economic and Social Council of the United Nations, may participate in that capacity in the deliberations of any Working Party during consideration of any matter of particular concern to that agency or organization.

Article 3 Executive committee

3.1. The representatives of the Contracting Parties shall constitute the Executive Committee of this Agreement and shall meet at least annually in that capacity.

3.2. The Rules of Procedure of the Executive Committee are set forth in Annex B to this Agreement.

3.3. The Executive Committee shall:

3.3.1. be responsible for the implementation of this Agreement, including the setting of priorities for activity under this Agreement;

3.3.2. consider all recommendations and reports by Working Parties regarding the establishment of global technical regulations under this Agreement; and

3.3.3. fulfil such other functions as may be appropriate under this Agreement.

3.4. The Executive Committee shall have the final authority to decide whether to list regulations in the Compendium of Candidate global technical regulations and to establish global technical regulations under this Agreement.

3.5. The Executive Committee shall, in discharging its functions, use information from all relevant sources when the Committee deems it appropriate to do so.

Article 4 Criteria for technical regulations

4.1. To be listed under Article 5 or established under Article 6, a technical regulation shall meet the following criteria:

4.1.1. provide a clear description of the wheeled vehicles, equipment and/or parts which can be fitted and/or be used on wheeled vehicles and which are subject to the regulation.

4.1.2. contain requirements that:

4.1.2.1. provide for high levels of safety, environmental protection, energy efficiency or anti-theft performance; and

4.1.2.2. wherever appropriate, are expressed in terms of performance instead of design characteristics.

4.1.3. include:

4.1.3.1. the test method by which compliance with the regulation is to be demonstrated;

4.1.3.2. for regulations to be listed under Article 5, where appropriate, a clear description of approval or certification markings and/or labels requisite for type approval and conformity of production or for manufacturer self-certification requirements; and

4.1.3.3. if applicable, a recommended minimum period of lead time, based upon considerations of reasonableness and practicability, that a Contracting Party should provide before requiring compliance.

4.2. A global technical regulation may specify alternative non-global levels of stringency or performance, and appropriate test procedures, where needed to facilitate the regulatory activities of certain countries, in particular developing countries.

Article 5 Compendium of candidate global technical regulations

5.1. A compendium of technical regulations of the Contracting Parties other than UN/ECE Regulations that are candidates for harmonization or adoption as global technical regulations (to be known as the Compendium of Candidates) shall be created and maintained.

5.2. Listing technical regulations in the Compendium of Candidates

Any Contracting Party may submit a request to the Executive Committee for the listing in the Compendium of Candidates of any technical regulation that such Contracting Party has applied, is applying or has adopted for future application.

5.2.1. The request specified in paragraph 5.2. shall contain:

5.2.1.1. a copy of such regulation;

5.2.1.2. any available technical documentation supporting such regulation, including documentation concerning best available technology, relative benefits, and cost effectiveness; and

5.2.1.3. the identification of any known existing or imminent relevant international voluntary standards.

5.2.2. The Executive Committee shall consider all requests that satisfy the requirements of Article 4 and paragraph 5.2.1. of this Article. The technical regulation shall be listed in the Compendium of Candidates if supported by an affirmative vote in accordance with paragraph 7.1. of Article 7 of Annex B. The documentation submitted with the request for that regulation shall be appended to the listed technical regulation.

5.2.3. The requested regulation shall be considered to be listed by the Secretary-General on the date on which it is supported by an affirmative vote under paragraph 5.2.2. of this Article.

5.3. Removing listed technical regulations from the Compendium of Candidates

A listed technical regulation shall be removed from the Compendium of Candidates either:

5.3.1. upon the establishment in the Global Registry of a global technical regulation embodying product requirements addressing the same elements of performance or design characteristics as the listed technical regulation;

5.3.2. at the end of the 5-year period following the regulation's listing under this Article, and at the end of each subsequent 5-year period, unless the Executive Committee reaffirms, by an affirmative vote in accordance with paragraph 7.1. of Article 7 of Annex B, the listing of the technical regulation in the Compendium of Candidates; or

5.3.3. in response to a written request from the Contracting Party at whose request the technical regulation was originally listed. Such request shall include the bases for the removal of the regulation.

5.4. Availability of documents

All documents considered by the Executive Committee under this Article shall be publicly available.

Article 6 Registry of global technical regulations

6.1. A registry shall be created and maintained for the global technical regulations developed and established under this Article. The registry shall be known as the Global Registry.

6.2. Establishing global technical regulations in the Global Registry through harmonization of existing regulations

A Contracting Party may submit a proposal to develop a harmonized global technical regulation concerning elements of performance or design characteristics addressed either by technical regulations listed in the Compendium of Candidates, or by any UN/ECE Regulations, or both.

6.2.1. The proposal specified in paragraph 6.2. shall contain:

6.2.1.1. an explanation of the objective of the proposed global technical regulation;

6.2.1.2. a narrative description or, if available, the draft text of the proposed global technical regulation;

6.2.1.3. available documentation that may facilitate the analysis of the issues to be addressed in the report required by paragraph 6.2.4.2.1. of this Article;

6.2.1.4. a list of all technical regulations in the Compendium of Candidates, and any UN/ECE Regulations, that address the same elements of performance or design characteristics to be addressed by the proposed global technical regulation; and

6.2.1.5. the identification of any known existing relevant international voluntary standards.

6.2.2. Each proposal specified in paragraph 6.2.1. of this Article shall be submitted to the Executive Committee.

6.2.3. The Executive Committee shall not refer to any Working Party any proposal that it determines does not satisfy the requirements of Article 4 and paragraph 6.2.1. of this Article. It may refer all other proposals to an appropriate Working Party.

6.2.4. In response to a proposal referred to it for developing a global technical regulation through harmonization, the Working Party shall use transparent procedures to:

6.2.4.1. develop recommendations regarding a global technical regulation by:

6.2.4.1.1. giving consideration to the objective of the proposed global technical regulation and the need for establishing alternative levels of stringency or performance;

6.2.4.1.2. reviewing all technical regulations that are listed in the Compendium of Candidates, and any UN/ECE Regulations, that address the same elements of performance;

6.2.4.1.3. reviewing any documentation that is appended to the regulations specified in paragraph 6.2.4.1.2. of this Article;

6.2.4.1.4. reviewing any available assessments of functional equivalence relevant to the consideration of the proposed global technical regulation, including assessments of related standards;

6.2.4.1.5. verifying whether the global technical regulation under development satisfies the stated objective of the regulation and the criteria in Article 4; and

6.2.4.1.6. giving due consideration to the possibility of the technical regulation being established under the 1958 Agreement.

6.2.4.2. submit to the Executive Committee:

6.2.4.2.1. a written report that presents its recommendation regarding the global technical regulation, includes all technical data and information that were considered in the development of its recommendation, describes its consideration of the information specified in paragraph 6.2.4.1. of this Article, and sets forth the rationale for its recommendations, including an explanation for rejecting any alternative regulatory requirements and approaches considered; and

6.2.4.2.2. the text of any recommended global technical regulation.

6.2.5. The Executive Committee shall, using transparent procedures:

6.2.5.1. determine whether the recommendations regarding the global technical regulation, and the report are based upon a sufficient and thorough performance of the activities specified in paragraph 6.2.4.1. of this Article. If the Executive Committee determines that the recommendations, report and/or the text of the recommended global technical regulation, if any, are inadequate, it shall return the regulation and report to the Working Party for revision or additional work.

6.2.5.2. consider the establishment of a recommended global technical regulation in accordance with the procedures set forth in paragraph 7.2. of Article 7 of Annex B. A consensus vote by the Executive Committee in favour of the regulation shall establish the Regulation in the Global Registry.

6.2.6. The global technical regulation shall be considered to be established in the Global Registry on the date of the consensus vote by the Executive Committee in favour of the regulation.

6.2.7. The Secretariat shall, upon the establishment of a global technical regulation by the Executive Committee, append copies of all relevant documentation, including the proposal submitted pursuant to paragraph 6.2.1. of this Article and the recommendations and report required by paragraph 6.2.4.2.1. of this Article, to that regulation.

6.3. Establishing new global technical regulations in the Global Registry

A Contracting Party may submit a proposal to develop a new global technical regulation concerning elements of performance or design characteristics not addressed by technical regulations in the Compendium of Candidates or UN/ECE Regulations.

6.3.1. The proposal specified in paragraph 6.3. shall contain:

6.3.1.1. an explanation of the objective of the proposed new global technical regulation, based on objective data to the extent possible;

6.3.1.2. a narrative description or, if available, the draft text of the proposed new global technical regulation;

6.3.1.3. any available documentation that may facilitate the analysis of the issues to be addressed in the report required by paragraph 6.3.4.2.1. of this Article; and

6.3.1.4. the identification of any known existing relevant international voluntary standards.

6.3.2. Each proposal specified in paragraph 6.3.1. of this Article shall be submitted to the Executive Committee.

6.3.3. The Executive Committee shall not refer to any Working Party any proposal that it determines does not satisfy the requirements of Article 4 and paragraph 6.3.1. of this Article. It may refer all other proposals to an appropriate Working Party.

6.3.4. In response to a proposal referred to it for developing a new global technical regulation, the Working Party shall use transparent procedures to:

6.3.4.1. develop recommendations regarding a new global technical regulation by:

6.3.4.1.1. giving consideration to the objective of the proposed new global technical regulation and the need for establishing alternative levels of stringency or performance;

6.3.4.1.2. considering technical feasibility;

6.3.4.1.3. considering economic feasibility;

6.3.4.1.4. examining benefits, including those of any alternative regulatory requirements and approaches considered;

6.3.4.1.5. comparing potential cost effectiveness of the recommended regulation to that of the alternative regulatory requirements and approaches considered;

6.3.4.1.6. verifying whether the new global technical regulation under development satisfies the stated objective of the Regulation and the criteria in Article 4; and

6.3.4.1.7. giving due consideration to the possibility of the technical regulation being established under the 1958 Agreement.

6.3.4.2. submit to the Executive Committee:

6.3.4.2.1. a written report that presents its recommendation regarding the new global technical regulation, includes all technical data and information that were considered in the development of its recommendation, describes its consideration of the information specified in paragraph 6.3.4.1. of this Article, and sets forth the rationale for its recommendations, including an explanation for rejecting any alternative regulatory requirements and approaches considered; and

6.3.4.2.2. the text of any recommended new global technical regulation.

6.3.5. The Executive Committee shall, using transparent procedures:

6.3.5.1. determine whether the recommendations regarding the new global technical regulation and the report are based upon a sufficient and thorough performance of the activities specified in paragraph 6.3.4.1. of this Article. If the Executive Committee determines that the recommendations, report and/or the text of the recommended new global technical regulation, if any, are inadequate, it shall return the regulation and report to the Working Party for revision or additional work.

6.3.5.2. consider the establishment of a recommended new global technical regulation in accordance with the procedures set forth in paragraph 7.2. of Article 7 of Annex B. A consensus vote by the Executive Committee in favour of the regulation shall establish the Regulation in the Global Registry.

6.3.6. The global technical regulation shall be considered to be established in the Global Registry on the date of the consensus vote by the Executive Committee in favour of the regulation.

6.3.7. The Secretariat shall, upon the establishment of a new global technical regulation by the Executive Committee, append copies of all relevant documentation, including the proposal submitted pursuant to paragraph 6.3.1. of this Article and the recommendations and report required by paragraph 6.3.4.2.1. of this Article, to that Regulation.

6.4. Amending established global technical regulations

The process for amending any global technical regulation established in the Global Registry under this Article shall be the procedures specified in paragraph 6.3. of this Article for establishing a new global technical regulation in the Global Registry.

6.5. Availability of documents

All documents considered or generated by the Working Party in recommending global technical regulations under this Article shall be publicly available.

Article 7 Adoption, and notification of application, of established global technical regulations

7.1. A Contracting Party that votes in favour of establishing a global technical regulation under Article 6 of this Agreement shall be obligated to submit the technical Regulation to the process used by that Contracting Party to adopt such a technical Regulation into its own laws or regulations and shall seek to make a final decision expeditiously.

7.2. A Contracting Party that adopts an established global technical regulation into its own laws or regulations shall notify the Secretary-General in writing of the date on which it will begin applying that Regulation. The notification shall be provided within 60 days after its decision to adopt the Regulation. If the established global technical regulation contains more than one level of stringency or performance, the notification shall specify which of those levels of stringency or performance is selected by the Contracting Party.

7.3. A Contracting Party that is specified in paragraph 7.1. of this Article and that decides not to adopt the established global technical regulation into its own laws or regulations, shall notify the Secretary-General in writing of its decision and the basis for its decision. The notification shall be provided within sixty (60) days after its decision.

7.4. A Contracting Party that is specified in paragraph 7.1. of this Article and that has not, by the end of the one-year period after the date of the establishment of the Regulation in the Global Registry, either adopted that technical regulation or decided not to adopt the Regulation into its own laws or regulations, shall provide a report on the status of the Regulation in its domestic process. A status report shall be submitted for each subsequent one-year period if neither of those actions has been taken by the end of that period. Each report required by this paragraph shall:

7.4.1. include a description of the steps taken during the past year to submit the Regulation and make a final decision and an indication of the anticipated date of such a decision; and

7.4.2. be submitted to the Secretary-General not later than 60 days after the end of the one-year period for which the report is submitted.

7.5. A Contracting Party that accepts products that comply with an established global technical regulation without adopting that Regulation into its own laws or regulations shall notify the Secretary-General in writing of the date on which it began to accept such products. The Contracting Party shall provide the notification within sixty (60) days after the beginning of such acceptance. If the established global technical regulation contains more than one level of stringency or performance, the notification shall specify which of those levels of stringency or performance is selected by the Contracting Party.

7.6. A Contracting Party that has adopted into its own laws or regulations an established global technical regulation may decide to rescind or amend the adopted Regulation. Prior to making that decision, the Contracting Party shall notify the Secretary-General in writing of its intent and the reasons for considering that action. This notice provision shall also apply to a Contracting Party that has accepted products under paragraph 7.5. and that intends to cease accepting such products. The Contracting Party shall notify the Secretary-General of its decision to adopt any amended or new regulation within 60 days after that decision. Upon request, the Contracting Party shall promptly provide copies of such amended or new regulation to other Contracting Parties.

Article 8 Issue resolution

8.1. Questions concerning the provisions of an established global technical regulation shall be referred to the Executive Committee for resolution.

8.2. Issues between two or more Contracting Parties concerning the interpretation or application of this Agreement shall, so far as possible, be resolved through consultation or negotiation between or among them. Where this process fails to resolve the issues, the Contracting Parties concerned may agree to request the Executive Committee to resolve the issue as provided in paragraph 7.3. of Article 7 of Annex B.

Article 9 Becoming a contracting party

9.1. Countries and regional economic integration organizations specified in Article 2 may become Contracting Parties to this Agreement by either:

9.1.1. signature without reservation as to ratification, acceptance or approval;

9.1.2. signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval;

9.1.3. acceptance; or

9.1.4. accession.

9.2. The instrument of ratification, acceptance, approval or accession shall be deposited with the Secretary-General.

9.3. Upon becoming a Contracting Party:

9.3.1. after this Agreement has entered into force, each country or regional integration organization shall give notification in accordance with Article 7 as to which, if any, global technical regulation(s) established pursuant to Article 6 it will adopt, and as to any decision to accept products that comply with any of those global technical regulations, without adopting those Regulations into its own laws or regulations. If the established global technical regulation contains more than one level of stringency or performance, the notification shall specify which of those levels of stringency or performance is adopted or accepted by the Contracting Party.

9.3.2. each regional economic integration organization shall declare in matters within its competence that its Member States have transferred powers in fields covered by this Agreement, including the power to make binding decisions on their Member States.

9.4. Regional economic integration organizations that are Contracting Parties shall cease being Contracting Parties when they lose the powers declared in accordance with paragraph 9.3.2. of this Article and shall inform the Secretary-General thereof.

Article 10 Signature

10.1. This Agreement shall be open for signature beginning 25 June 1998.

10.2. This Agreement shall remain open for signature until its entry into force.

Article 11 Entry into force

11.1. This Agreement and its Annexes, which constitute integral parts of the Agreement, shall enter into force on the thirtieth (30) day following the date on which a minimum of five (5) countries and/or regional economic integration organizations have become Contracting Parties pursuant to Article 9. This minimum of five (5) must include the European Community, Japan, and the United States of America.

11.2. If, however, paragraph 11.1 of this Article is not satisfied fifteen (15) months after the date specified in paragraph 10.1., then this Agreement and its Annexes, which constitute integral parts of the Agreement, shall enter into force on the thirtieth (30) day following the date on which a minimum of eight (8) countries and/or regional economic integration organizations have become Contracting Parties pursuant to Article 9. Such date of entry into force shall not be earlier than sixteen (16) months after the date specified in paragraph 10.1. At least one (1) of these eight (8) must be either the European Community, Japan or the United States of America.

11.3. For any country or regional economic integration organization that becomes a Contracting Party to the Agreement after its entry into force, this Agreement shall enter into force sixty (60) days after the date that such country or regional economic integration organization deposits its instrument of ratification, acceptance, approval or accession.

Article 12 Withdrawal from Agreement

12.1. A Contracting Party may withdraw from this Agreement by notifying the Secretary-General in writing.

12.2. Withdrawal from this Agreement by any Contracting Party shall take effect one year after the date on which the Secretary-General receives notification pursuant to paragraph 12.1. of this Article.

Article 13 Amendment of Agreement

13.1. A Contracting Party may propose amendments to this Agreement and the Annexes to this Agreement. Proposed amendments shall be submitted to the Secretary-General, who shall transmit them to all Contracting Parties.

13.2. A proposed amendment transmitted in accordance with paragraph 13.1. of this Article shall be considered by the Executive Committee at its next scheduled meeting.

13.3. If there is a consensus vote in favour of the amendment by the Contracting Parties present and voting, it shall be communicated by the Executive Committee to the Secretary-General who shall then circulate the amendment to all Contracting Parties.

13.4. An amendment circulated under paragraph 13.3. of this Article shall be deemed to be accepted by all Contracting Parties if no Contracting Party expresses an objection within a period of six (6) months after the date of such circulation. If no such objection has been expressed, the amendment shall enter into force for all Contracting Parties three (3) months after the expiry of the period of the six (6) months referred in this paragraph.

13.5. The Secretary-General shall, as soon as possible, notify all Contracting Parties whether an objection to the proposed amendment has been expressed. If such objection has been expressed, the amendment shall be deemed not to have been accepted, and shall be of no effect whatever.

Article 14 Depositary

The Depositary of this Agreement shall be the Secretary-General of the United Nations. In addition to other depositary functions, the Secretary-General shall, as soon as possible, notify the Contracting Parties of:

14.1. the listing or removing of technical regulations under Article 5.

14.2. the establishing or amending of global technical regulations under Article 6.

14.3. notifications received in accordance with Article 7.

14.4. signatures, acceptances, and accessions in accordance with Articles 9 and 10.

14.5. notifications received in accordance with Article 9.

14.6. the dates on which this Agreement shall enter into force for Contracting Parties in accordance with Article 11.

14.7. notifications of withdrawal from this Agreement received in accordance with Article 12.

14.8. the date of entry into force of any amendment to this Agreement in accordance with Article 13.

14.9. notifications received in accordance with Article 15 regarding territories.

Article 15 Extension of agreement to territories

15.1. This Agreement shall extend to any territory or territories of a Contracting Party for whose international relations such Contracting Party is responsible, unless the Contracting Party otherwise specifies, prior to entry into force of the agreement for that Contracting Party.

15.2. Any Contracting Party may denounce this Agreement separately for any such territory or territories in accordance with Article 12.

Article 16 Secretariat

The Secretariat of this Agreement shall be the Executive Secretary of the UN/ECE. The Executive Secretary shall carry out the following secretariat functions:

16.1. prepare the meetings of the Executive Committee and the Working Parties;

16.2. transmit to the Contracting Parties reports and other information received in accordance with the provisions of this Agreement; and

16.3. discharge the functions assigned by the Executive Committee.

Annex A

Definitions

For the purposes of this Agreement, the following definitions shall apply:

1. With regard to the global technical regulations developed under this Agreement, the term ``accept" means the action by a Contracting Party of allowing the entry of products that comply with a global technical regulation into its market without having adopted that global technical regulation into its respective laws and regulations.

2. With regard to the global technical regulations developed under this Agreement, the term ``adopt" means the promulgation of a global technical regulation into the laws and regulations of a Contracting Party.

3. With regard to the global technical regulations developed under this Agreement, the term ``apply" means the action of requiring compliance with a global technical regulation by a Contracting Party as of a certain date; in other words, the effective date of the regulation within a Contracting Party's jurisdiction.

4. The term ``Article" means an article of this Agreement.

5. The term ``consensus vote" means a vote on a matter in which no Contracting Party present and voting objects to the matter in accordance with paragraph 7.2. of Article 7 of Annex B.

6. The term ``Contracting Party" means any country, or regional economic integration organization, that is a Contracting Party to this Agreement.

7. The term ``equipment and parts which can be fitted and/or be used on wheeled vehicles" means equipment or parts whose characteristics have a bearing on safety, environmental protection, energy efficiency, or anti-theft performance. Such equipment and parts include, but are not limited to, exhaust systems, tyres, engines, acoustic shields, anti-theft alarms, warning devices, and child restraint systems.

8. The term ``established global technical regulation" means a global technical regulation that has been placed on the Global Registry in accordance with this Agreement.

9. The term ``listed technical regulation" means a national or regional technical regulation that has been placed on the Compendium of Candidates in accordance with this Agreement.

10. The term ``manufacturer self-certification" means a Contracting Party's legal requirement that a manufacturer of wheeled vehicles, equipment and/or parts which can be fitted and/or be used on wheeled vehicles must certify that each vehicle, item of equipment or part that the manufacturer introduces into commerce satisfies specific technical requirements.

11. The term ``regional economic integration organization" means an organization which is constituted by, and composed of, sovereign countries, and which has competence in respect of matters covered by this Agreement, including the authority to make decisions binding on all of its Member Countries in respect of those matters.

12. The term ``Secretary-General" means the Secretary-General of the United Nations.

13. The term ``transparent procedures" means procedures designed to promote the public awareness of and participation in the regulatory development process under this Agreement. They shall include the publication of:

    • 1. notices of meetings of the Working Parties and of the Executive Committee; and

    • 2. working and final documents.

    • They shall also include the opportunity to have views and arguments represented at:

    • 1. meetings of Working Parties through organizations granted consultative status; and

    • 2. meetings of Working Parties and of the Executive Committee through pre-meeting consulting with representatives of Contracting Parties.

14. The term ``type approval" means written approval of a Contracting Party (or competent authority designated by a Contracting Party) that a vehicle and/or any item of equipment and/or part that can be fitted and/or be used on a vehicle, satisfies specific technical requirements, and is used as a precondition to the introduction of the vehicle, equipment or part into commerce.

15. The term ``UN/ECE Regulations" means United Nations/Economic Commission for Europe Regulations adopted under the 1958 Agreement.

16. The term ``Working Party" means a specialized technical subsidiary body under the ECE whose function is to develop recommendations regarding the establishment of harmonized or new global technical regulations for inclusion in the Global Registry and to consider amendments to the global technical regulations established in the Global Registry.

17. The term ``1958 Agreement" means the Agreement concerning the Adoption of Uniform Technical Prescriptions for Wheeled Vehicles, Equipment and Parts which can be fitted and/or be used on Wheeled Vehicles and the Conditions for Reciprocal Recognition of Approvals Granted on the Basis of these Prescriptions.


Annex B

Composition and Rules of procedure of the Executive Committee

Article 1

Membership in the Executive Committee shall be limited to Contracting Parties.

Article 2

All Contracting Parties shall be members of the Executive Committee.

Article 3

3.1. Except as provided in paragraph 3.2. of this Article, each Contracting Party shall have one vote.

3.2. If a regional economic integration organization and one or more of its Member States are Contracting Parties to this Agreement, the regional economic integration organization shall, in matters within its competence, exercise its right to vote with a number of votes equal to the number of its Member States that are Contracting Parties to this Agreement. Such an organization shall not exercise its right to vote if any of its Member States exercises its right, and vice versa.

Article 4

In order to cast its own vote, a Contracting Party shall be present. A Contracting Party need not be present for the casting of a vote by its regional economic integration organization.

Article 5

5.1. A quorum consisting of not less than half of all the Contracting Parties shall be present for the taking of a vote.

5.2. For purposes of determining a quorum under this Article, and determining the number of Contracting Parties needed to constitute one-third of the Contracting Parties present and voting under paragraph 7.1. of Article 7 of this Annex, a regional economic integration organization and its Member States shall be counted as one Contracting Party.

Article 6

6.1. The Executive Committee shall, at its first session each calendar year, elect a Chairman and Vice-Chairman from its membership. The Chairman and Vice-Chairman shall be elected by a two-thirds affirmative vote of all Contracting Parties present and voting.

6.2. Neither the Chairman, nor the Vice-Chairman, shall come from the same Contracting Party more than two years in succession. In any year, the Chairman and Vice-Chairman shall not come from the same Contracting Party.

Article 7

7.1. A national or regional regulation shall be listed in the Compendium of Candidates by an affirmative vote of either at least one-third of the Contracting Parties present and voting (as defined in Article 5.2. of this Annex), or one-third of the total number of votes cast, whichever is more favourable to achieving an affirmative vote. In either case, the one-third shall include the vote of either the European Community, Japan or the United States, if any of them are Contracting Parties.

7.2. Establishing a global technical regulation in the Global Registry, amending an established global technical regulation and amending this Agreement shall be by a consensus vote of the Contracting Parties present and voting. A present and voting Contracting Party that objects to a matter for which a consensus vote is necessary for adoption shall provide a written explanation of its objection to the Secretary-General within sixty (60) days from the date of the vote. If such Contracting Party fails to provide such explanation during that period, it shall be considered as having voted in favour of the matter on which the vote was taken. If all Contracting Parties that objected to the matter so fail, the vote on the matter shall be considered to have been a consensus vote in favour of the matter by all persons present and voting. In that event, the date of the vote shall be considered to be the first day after that 60-day period.

7.3. All other matters requiring resolution may, at the discretion of the Executive Committee, be resolved by the voting process set forth in paragraph 7.2. of this Article.

Article 8

Contracting Parties that abstain from voting are considered as not voting.

Article 9

The Executive Secretary shall convene the Executive Committee whenever a vote is required to be taken under Article 5, 6 or 13 of this Agreement or whenever necessary to conduct activities under this Agreement.


Accord concernant l'établissement de règlements techniques mondiaux applicables aux véhicules à roues, ainsi qu'aux équipements et pièces qui peuvent être montés et/ou utilisés sur les véhicules à roues

Préambule

Les Parties contractantes,

Ayant décidé d'adopter un Accord visant à établir, à l'échelle de la planète, un processus propre à favoriser l'élaboration de règlements techniques mondiaux garantissant un degré élevé de sécurité, de protection de l'environnement, de rendement énergétique et de protection contre le vol aux véhicules à roues ainsi qu'aux équipements et pièces qui peuvent être montés et/ou utilisés sur les véhicules à roues;

Ayant décidé que ce processus devrait aussi favoriser l'harmonisation des règlements techniques existants, en reconnaissant le droit des autorités locales, nationales et régionales d'adopter et de faire appliquer des règlements techniques, dans les domaines de la santé, de la sécurité, de la protection de l'environnement, du rendement énergétique et de la protection contre le vol, qui soient plus stricts que ceux établis au niveau mondial;

Etant autorisées à conclure un tel Accord en vertu de l'alinéa a) du premier paragraphe du mandat de la Commission économique pour l'Europe (CEE/ONU) et de l'article 50 du chapitre XIII de son règlement intérieur;

Reconnaissant que le présent Accord ne porte pas atteinte aux droits et obligations des Parties contractantes aux termes des accords internationaux relatifs à la santé, à la sécurité et à la protection de l'environnement;

Reconnaissant que le présent Accord ne porte pas atteinte aux droits et obligations des Parties contractantes aux termes des accords relevant de l'Organisation mondiale du commerce (OMC), y compris l'Accord sur les obstacles techniques au commerce et se proposant d'établir des règlements techniques mondiaux, au titre du présent Accord, en tant que base de leurs règlements techniques, d'une manière qui soit conforme à ces accords;

Se proposant de faire en sorte que les Parties contractantes au présent Accord fondent leurs règlements techniques sur les règlements techniques mondiaux établis en vertu du présent Accord;

Reconnaissant l'importance pour la santé publique, la sécurité et le bien-être d'une amélioration continue de la sécurité, de la protection de l'environnement, du rendement énergétique et de la protection contre le vol des véhicules à roues ainsi que des équipements et pièces qui peuvent être montés et/ou utilisés sur ces véhicules, et les avantages potentiels pour le commerce international, le choix des consommateurs et le prix des produits d'un rapprochement croissant entre les règlements techniques actuels et futurs et les normes connexes;

Reconnaissant que les gouvernements ont le droit de rechercher et d'apporter des améliorations au niveau de la santé, de la sécurité et de la protection de l'environnement et de déterminer quels règlements techniques mondiaux établis au titre du présent Accord répondent à leurs besoins;

Reconnaissant l'important travail d'harmonisation déjà effectué en vertu de l'Accord de 1958;

Reconnaissant que dans plusieurs régions géographiques existent un intérêt et des connaissances spécialisées en ce qui concerne les problèmes de sécurité, d'environnement, d'énergie et de lutte contre le vol, ainsi que les méthodes propres à résoudre lesdits problèmes, et reconnaissant la valeur de cet intérêt et de ces connaissances spécialisées pour la mise au point de règlements techniques mondiaux susceptibles de faciliter ces améliorations et de réduire les divergences;

Desireuses de promouvoir l'adoption de règlements techniques mondiaux dans les pays en développement, compte tenu des questions et des conditions propres à ces pays et, en particulier, aux moins développés d'entre eux;

Desireuses que les règlements techniques appliqués par les Parties contractantes soient dûment examinés et de façon transparente dans l'élaboration des règlements techniques mondiaux, et que cet examen comporte des analyses comparatives des coûts et des avantages;

Reconnaissant que l'établissement de règlements techniques mondiaux assurant un degré élevé de protection encouragera certains pays à conclure que lesdits règlements leur assureront la protection et l'efficacité dont ils ont besoin sur leur territoire;

Reconnaissant l'incidence de la qualité des carburants des véhicules sur l'efficacité des contrôles des véhicules, aux fins de protection de l'environnement sur la santé humaine et sur le rendement énergétique; et

Reconnaissant que l'utilisation de procédures transparentes revêt une importance particulière dans l'établissement de règlements techniques mondiaux en vertu du présent Accord, et que ces procédures doivent être compatibles avec les procédures d'établissement de règlements par les Parties contractantes au présent Accord;

Sont convenues de ce qui suit:

Article Premier Objet

1.1. Le présent Accord a pour objet:

1.1.1. D'établir une procédure mondiale par laquelle les Parties contractantes de toutes les régions du monde puissent élaborer conjointement des règlements techniques mondiaux concernant la sécurité, la protection de l'environnement, le rendement énergétique et la protection contre le vol des véhicules à roues, ainsi que des équipements et pièces qui peuvent être montés et/ou utilisés sur ces véhicules;

1.1.2. De faire en sorte que, lors de l'élaboration des règlements techniques mondiaux, on tienne dûment et objectivement compte des règlements techniques existants des Parties contractantes mais aussi des Règlements de la CEE/ONU;

1.1.3. De faire en sorte que soit objectivement prise en considération l'analyse des meilleures techniques disponibles, des avantages relatifs et du rapport coût/efficacité, selon les cas, dans l'élaboration des règlements techniques mondiaux;

1.1.4. Veiller à la transparence des procédures servant à l'élaboration des règlements techniques mondiaux;

1.1.5. D'atteindre des niveaux élevés de sécurité, de protection de l'environnement, de rendement énergétique et de protection contre le vol dans la communauté mondiale, et de garantir que les mesures prises au titre du présent Accord ne favorisent ni n'entraînent un abaissement de ces niveaux sur le territoire des Parties contractantes, y compris au niveau local;

1.1.6. De réduire les obstacles techniques au commerce international en harmonisant les règlements techniques existants des Parties contractantes et les Règlements CEE/ONU, et en élaborant de nouveaux règlements techniques mondiaux concernant la sécurité, la protection de l'environnement, le rendement énergétique et la protection contre le vol des véhicules à roues, ainsi que des équipements et pièces qui peuvent être montés et/ou utilisés sur ces véhicules, conformément à la recherche de niveaux élevés de sécurité et de protection de l'environnement et aux autres objectifs définis ci-dessus; et

1.1.7. De faire en sorte que, lorsque différents niveaux de sécurité sont requis pour faciliter les activités de certains pays en matière de réglementation, notamment des pays en développement, il en soit tenu compte dans l'élaboration et l'établissement de règlements techniques mondiaux.

1.2. Le présent Accord doit fonctionner en parallèle avec l'Accord de 1958, sans que l'autonomie institutionnelle d'aucun des deux n'en souffre.

Article 2 Parties Contractantes et statut consultatif

2.1. Peuvent devenir Parties contractantes au présent Accord les pays membres de la Commission économique pour l'Europe (CEE/ONU), les organisations d'intégration économique régionale constituées de pays membres de la CEE et les pays admis à la Commission à titre consultatif en application du paragraphe 8 du mandat de la CEE.

2.2. Peuvent devenir Parties contractantes au présent Accord, les Etats Membres de l'Organisation des Nations Unies qui participent à certaines activités de la CEE en vertu du paragraphe 11 du mandat de la Commission et les organisations d'intégration économique régionale constituées de ces pays.

2.3. Toute institution spécialisée et toute organisation, y compris les organisations intergouvernementales et les organisations non gouvernementales dotées du statut consultatif auprès du Conseil économique et social de l'Organisation des Nations Unies, peut participer en cette qualité à toutes les réunions de tous les groupes de travail lors de l'examen de toute question présentant un intérêt particulier pour cette institution ou cette organisation.

Article 3 Comité exécutif

3.1. Les représentants des Parties contractantes constituent le Comité exécutif du présent Accord et se réunissent au moins une fois par an en cette qualité.

3.2. Le règlement intérieur du Comité exécutif est énoncé à l'annexe B du présent Accord.

3.3. Le Comité exécutif:

3.3.1. est responsable de l'application du présent Accord, y compris de la définition des activités prioritaires au titre du présent Accord;

3.3.2. examine toutes les recommandations et tous les rapports émanant des groupes de travail en ce qui concerne l'établissement de règlements techniques mondiaux en vertu du présent Accord; et

3.3.3. s'acquitte des autres fonctions que lui assigne le présent Accord.

3.4. Le Comité exécutif décide en dernier lieu s'il convient d'inscrire des règlements au Recueil des règlements techniques mondiaux admissibles et d'établir des règlements techniques mondiaux en vertu du présent Accord.

3.5. Le Comité exécutif peut, dans l'exercice de ses fonctions, tirer parti de renseignements provenant de toutes les sources pertinentes, lorsqu'il le juge utile.

Article 4 Critères applicables aux règlements techniques

4.1. Pour qu'un règlement technique soit inscrit en vertu de l'article 5 ou établi en application de l'article 6, il doit répondre aux critères suivants:

4.1.1. donner une description précise des véhicules à roues ainsi que des équipements et/ou pièces qui peuvent être montés et/ou utilisés sur ces véhicules, qui relèvent du règlement.

4.1.2. contenir des prescriptions qui:

4.1.2.1. garantissent des degrés élevés de sécurité, de protection de l'environnement, de rendement énergétique et de protection contre le vol; et

4.1.2.2. dans la mesure du possible, soient fondées sur des considérations d'efficacité plutôt que de conception.

4.1.3. indiquer:

4.1.3.1. la méthode d'essai à utiliser pour démontrer la conformité du règlement;

4.1.3.2. pour les règlements à inscrire en vertu de l'article 5, le cas échéant, une description précise des marques d'homologation ou d'agrément et/ou des étiquettes requises pour l'homologation de type et la conformité de la production ou pour les conditions d'autocertification du constructeur; et

4.1.3.3. le cas échéant, le délai minimum recommandé, à la fois raisonnable et fondé sur des considérations pratiques, qu'une Partie contractante devrait accorder avant d'exiger que le règlement soit respecté.

4.2. Un règlement technique mondial peut prévoir des degrés de sévérité ou d'efficacité variables et des procédures d'essai appropriées, le cas échéant, pour faciliter les activités de réglementation de certains pays, notamment des pays en développement.

Article 5 Recueil des règlements techniques mondiaux admissibles

5.1. Un Recueil des règlements techniques des Parties contractantes autres que les Règlements CEE/ONU qui sont admissibles aux fins d'harmonisation ou d'adoption en tant que règlements techniques mondiaux (dénommé Recueil des règlements admissibles) est établi et tenu à jour.

5.2. Inscription de règlements techniques au Recueil des règlements admissibles

Toute Partie contractante peut présenter au Comité exécutif une demande d'inscription au Recueil des règlements admissibles, de tout règlement technique que ladite Partie a appliqué, applique ou a adopté en vue d'une application future.

5.2.1. La demande visée au paragraphe 5.2. doit être accompagnée:

5.2.1.1. d'un exemplaire dudit règlement;

5.2.1.2. de tous les documents techniques existants se rapportant à ce règlement, y compris ceux relatifs aux meilleures techniques disponibles, aux avantages relatifs et au rapport coût/efficacité; et

5.2.1.3. de l'indication de toutes les normes volontaires internationales pertinentes, déjà en vigueur ou dont l'application est imminente.

5.2.2. Le Comité exécutif examine toutes les demandes qui satisfont aux dispositions de l'article 4 et du paragraphe 5.2.1. du présent article. Le règlement technique est inscrit au Recueil des règlements admissibles s'il fait l'objet d'un vote favorable conformément aux dispositions du paragraphe 7.1. de l'article 7 de l'annexe B. La documentation jointe à la demande relative à ce règlement est annexée au règlement technique inscrit.

5.2.3. Le Secrétaire général considère le règlement ayant fait l'objet d'une demande comme étant inscrit à la date à laquelle il a fait l'objet d'un vote favorable conformément au paragraphe 5.2.2. du présent article.

5.3. Retrait de règlements techniques inscrits au Recueil des règlements admissibles

Un règlement technique inscrit au Recueil des règlements admissibles en est retiré:

5.3.1. dès qu'un autre règlement technique mondial contenant des prescriptions de produits fondées sur les mêmes critères d'efficacité ou de conception est inscrit au Registre mondial;

5.3.2. au terme des cinq années qui suivent l'inscription du règlement en vertu du présent article, et à la fin de chaque période ultérieure de cinq ans, sauf si le Comité exécutif confirme, par un vote favorable défini au paragraphe 7.1. de l'article 7 de l'annexe B, le maintien du règlement technique dans le Recueil des règlements admissibles; ou

5.3.3. si la Partie contractante à l'origine de l'inscription du règlement technique en fait la demande par écrit. Cette demande doit être motivée.

5.4. Accessibilité des documents

Tous les documents examinés par le Comité exécutif en vertu du présent article doivent être accessibles au public.

Article 6 Registre des règlements techniques mondiaux

6.1. Un Registre des règlements techniques mondiaux (dénommé Registre mondial) élaborés et établis conformément aux dispositions du présent article, est ouvert et tenu à jour.

6.2. Inscription de règlements techniques mondiaux au Registre mondial, par harmonisation des règlements existants

Une Partie contractante peut soumettre une proposition visant à établir un règlement technique mondial harmonisé concernant des critères d'efficacité ou de conception, visé soit par les règlements techniques inscrits au Recueil des règlements admissibles, soit par les Règlements CEE/ONU, soit par les deux types de Règlement.

6.2.1. La proposition visée au paragraphe 6.2. doit contenir:

6.2.1.1. la présentation de l'objectif du règlement technique mondial proposé;

6.2.1.2. le descriptif ou, s'il est disponible, le projet de texte du règlement technique mondial proposé;

6.2.1.3. les documents disponibles susceptibles de faciliter l'analyse des questions à traiter dans le rapport visé au paragraphe 6.2.4.2.1. du présent article;

6.2.1.4. la liste de tous les règlements techniques inscrits au Recueil des règlements admissibles et de tous les Règlements CEE/ONU qui portent sur les mêmes critères d'efficacité ou de conception que ceux visés dans le règlement technique mondial proposé; et

6.2.1.5. une indication de toutes les normes volontaires internationales pertinentes connues en vigueur.

6.2.2. Toute proposition définie au paragraphe 6.2.1. du présent article doit être soumise au Comité exécutif.

6.2.3. Le Comité exécutif ne doit soumettre à aucun groupe de travail de propositions qui selon lui ne sont ni conformes aux dispositions de l'article 4 ni à celles du paragraphe 6.2.1. du présent article. Il peut présenter toutes les autres propositions à un groupe de travail approprié.

6.2.4. Lorsqu'il est saisi d'une proposition d'élaboration d'un règlement technique mondial harmonisé, le Groupe de travail doit, dans la transparence:

6.2.4.1. élaborer des recommandations relatives à un règlement technique mondial:

6.2.4.1.1. en étudiant l'objectif du règlement technique mondial proposé et la nécessité d'établir d'autres degrés de sévérité ou d'efficacité;

6.2.4.1.2. en examinant tous les règlements techniques inscrits au Recueil des règlements admissibles et tous les Règlements CEE/ONU, portant sur les mêmes critères d'efficacité;

6.2.4.1.3. en étudiant toute la documentation qui est jointe aux règlements définis au paragraphe 6.2.4.1.2. du présent article;

6.2.4.1.4. en examinant toutes les évaluations disponibles de l'équivalence fonctionnelle relative à l'examen du règlement technique mondial proposé, y compris les évaluations des normes connexes;

6.2.4.1.5. en s'assurant que le règlement technique mondial en cours d'élaboration est conforme à ses objectifs déclarés et aux critères de l'article 4; et

6.2.4.1.6. en accordant toute l'attention voulue à la possibilité d'élaborer ce règlement technique en vertu de l'Accord de 1958.

6.2.4.2. Soumettre au Comité exécutif:

6.2.4.2.1. un rapport écrit qui expose ses recommandations relatives au règlement technique mondial, contienne toutes les données et tous les renseignements techniques examinés lors de l'élaboration de ces recommandations, décrive l'examen des renseignements définis au paragraphe 6.2.4.1. du présent article et qui justifie le bien-fondé de ses recommandations ainsi que le refus de toutes les autres prescriptions et approches réglementaires examinées; et

6.2.4.2.2. le texte de tout règlement technique mondial recommandé.

6.2.5. Le Comité exécutif doit, dans la transparence:

6.2.5.1. déterminer si les recommandations concernant le règlement technique mondial et le rapport se fondent sur la bonne exécution des activités définies au paragraphe 6.2.4.1. du présent article. Si le Comité exécutif estime que les recommandations, le rapport et/ou le texte du règlement technique mondial recommandé, s'il existe, sont insuffisants, il renvoie le règlement et le rapport au Groupe de travail pour qu'il le révise ou le complète.

6.2.5.2. envisager l'élaboration d'un règlement technique mondial recommandé, conformément aux procédures définies au paragraphe 7.2. de l'article 7 de l'annexe B. Le Comité exécutif peut décider, à l'issue d'un vote par consensus, d'inscrire le règlement au Registre mondial.

6.2.6. Le règlement technique mondial est considéré comme inscrit au Registre mondial dès que le Comité exécutif l'adopte par consensus.

6.2.7. Dès qu'un règlement technique mondial est inscrit au Registre mondial par le Comité exécutif, le secrétariat doit y joindre le texte de toute la documentation pertinente, y compris la proposition présentée conformément au paragraphe 6.2.1. du présent article, ainsi que les recommandations et le rapport prescrits par le paragraphe 6.2.4.2.1. du présent article.

6.3. Inscription de nouveaux règlements techniques mondiaux au Registre mondial

Une Partie contractante peut présenter une proposition d'élaboration d'un nouveau règlement technique mondial concernant des critères d'efficacité ou de conception non visés par les règlements techniques inscrits au Recueil des règlements admissibles ni par les Règlements CEE/ONU.

6.3.1. La proposition visée au paragraphe 6.3. doit contenir:

6.3.1.1. une explication de l'objectif du nouveau règlement technique mondial proposé, fondée dans toute la mesure possible sur des données objectives;

6.3.1.2. le descriptif technique ou, s'il est disponible, le projet de texte du nouveau règlement technique mondial proposé;

6.3.1.3. toute documentation disponible susceptible de faciliter l'analyse des questions traitées dans le rapport prescrit au paragraphe 6.3.4.2.1. du présent article; et

6.3.1.4. une indication de toutes les normes volontaires internationales pertinentes connues en vigueur.

6.3.2. Chaque proposition définie au paragraphe 6.3.1. du présent article doit être soumise au Comité exécutif.

6.3.3. Le Comité exécutif ne doit soumettre à aucun groupe de travail de propositions qui selon lui ne sont ni conformes aux dispositions de l'article 4 ni à celles du paragraphe 6.3.1. du présent article. Il peut soumettre toutes les autres propositions à un groupe de travail approprié.

6.3.4. Lorsqu'il est saisi d'une proposition d'élaboration d'un nouveau règlement technique mondial, le Groupe d'experts doit dans la transparence:

6.3.4.1. formuler des recommandations concernant un nouveau règlement technique mondial:

6.3.4.1.1. en examinant l'objectif du nouveau règlement technique mondial proposé et la nécessité d'établir d'autres niveaux de sévérité ou d'efficacité;

6.3.4.1.2. en procédant à l'évaluation de sa faisabilité technique;

6.3.4.1.3. en procédant à l'évaluation de sa faisabilité économique;

6.3.4.1.4. en examinant ses avantages ainsi que ceux de toute autre prescription ou approche réglementaire considérée;

6.3.4.1.5. en examinant le rapport coût/efficacité potentiel du règlement recommandé par rapport aux autres prescriptions et approches réglementaires envisagées;

6.3.4.1.6. en s'assurant que le règlement technique mondial en cours d'élaboration est conforme à ses objectifs déclarés et aux critères de l'article 4; et

6.3.4.1.7. en accordant toute l'attention voulue à la possibilité d'élaborer ce règlement technique en vertu de l'Accord de 1958.

6.3.4.2. soumettre au Comité exécutif:

6.3.4.2.1. un rapport écrit qui expose ses recommandations relatives au nouveau règlement technique mondial, contienne toutes les données et tous les renseignements techniques examinés lors de l'élaboration de ses recommandations, décrive l'examen des renseignements définis au paragraphe 6.3.4.1. du présent article et qui justifie le bien-fondé de ses recommandations ainsi que le refus de toutes les autres prescriptions et approches réglementaires examinées; et

6.3.4.2.2. le texte de tout nouveau règlement technique mondial recommandé.

6.3.5. Le Comité exécutif doit, dans la transparence:

6.3.5.1. déterminer si les recommandations concernant le nouveau règlement technique mondial et le rapport sont fondées sur la bonne exécution des activités définies au paragraphe 6.3.4.1. du présent article. Si le Comité exécutif estime que les recommandations, le rapport et/ou le texte du nouveau règlement technique mondial recommandé, s'il existe, sont insuffisants, il renvoie le règlement et le rapport au Groupe de travail pour qu'il le révise ou le complète;

6.3.5.2. envisager l'élaboration d'un nouveau règlement technique mondial recommandé conformément aux procédures définies au paragraphe 7.2. de l'article 7 de l'annexe B. Le Comité exécutif peut décider, à l'issue d'un vote par consensus, d'inscrire le règlement au Registre mondial.

6.3.6. Le règlement technique mondial est considéré comme inscrit au Registre mondial dès que le Comité exécutif l'adopte par consensus.

6.3.7. Dès qu'un nouveau règlement technique mondial est établi par le Comité exécutif, le secrétariat doit y joindre le texte de toute la documentation pertinente, y compris la proposition présentée conformément au paragraphe 6.3.1. du présent article, ainsi que les recommandations et le rapport prescrits par le paragraphe 6.3.4.2.1. du présent article.

6.4. Amendement des règlements techniques mondiaux établis

La procédure d'amendement de tout règlement technique mondial inscrit au Registre mondial en vertu du présent article doit être conforme aux prescriptions du paragraphe 6.3. du présent article, c'est-à-dire à la procédure d'inscription au Registre mondial de tout nouveau règlement technique mondial.

6.5. Accessibilité des documents

Tous les documents examinés ou établis par le Groupe de travail pour recommander des règlements techniques mondiaux en vertu du présent article doivent être accessibles au public.

Article 7 Adoption et notification d'application de règlements techniques mondiaux établis

7.1. Toute Partie contractante qui vote en faveur de l'établissement d'un règlement technique mondial en vertu de l'article 6 du présent Accord est tenue de soumettre ledit règlement à la procédure qu'elle utilise pour donner force de loi aux règlements techniques, et doit s'efforcer de prendre sa décision rapidement.

7.2. La Partie contractante qui donne force de loi à un règlement technique mondial établi doit notifier au Secrétaire général par écrit la date à laquelle elle commencera à appliquer ledit règlement. Cette notification doit intervenir dans les 60 jours suivant la date d'adoption du règlement. Si le règlement technique mondial établi prévoit plus d'un degré de sévérité ou d'efficacité, la notification doit préciser quel est le degré retenu par la Partie contractante.

7.3. La Partie contractante définie au paragraphe 7.1. du présent article qui décide de ne pas donner force de loi au règlement technique mondial établi notifie sa décision au Secrétaire général par écrit et lui en expose les motifs. Cette notification doit intervenir dans les soixante (60) jours suivant sa décision.

7.4. La Partie contractante définie au paragraphe 7.1. du présent article qui, à l'issue d'une période d'un an à compter de la date de l'inscription du règlement au Registre mondial, n'a ni adopté le règlement technique ni décidé de lui donner force de loi, remet un rapport sur le statut dudit règlement au regard de son droit national. Ce rapport doit être remis chaque année aussi longtemps que cette situation se prolonge. Chaque rapport prescrit par le présent paragraphe doit:

7.4.1. comprendre une description des mesures prises au cours de l'année précédente pour soumettre le règlement et prendre une décision finale, ainsi qu'une indication de la date prévue pour cette décision; et

7.4.2. être soumis au Secrétaire général au plus tard 60 jours après la fin de la période d'un an couverte par le rapport.

7.5. La Partie contractante qui admet des produits conformes à un règlement technique mondial établi, sans pour autant donner force de loi à ce règlement, notifie le Secrétaire général par écrit de la date à laquelle elle a commencé à admettre ces produits. La Partie contractante doit remettre la notification dans les soixante (60) jours suivant le début de cette acceptation. Si le règlement technique mondial établi contient plus d'un degré de sévérité ou d'efficacité, la notification doit préciser quel est le degré retenu par la Partie contractante.

7.6. La Partie contractante qui a donné force de loi à un règlement technique mondial établi peut décider d'abroger ou de modifier le règlement adopté. Au préalable, la Partie contractante doit notifier le Secrétaire général par écrit de son intention et de ses raisons. Cette obligation de notification vaut aussi pour la Partie contractante qui admet des produits visés par le paragraphe 7.5. et qui a l'intention de ne plus le faire. La Partie contractante doit notifier au Secrétaire général sa décision d'adopter ledit règlement dans les 60 jours suivant sa décision. Sur demande, la Partie contractante doit rapidement fournir le texte du règlement modifié ou du nouveau règlement, selon le cas, aux autres Parties contractantes.

Article 8 Règlement des différends

8.1. Les différends relatifs aux dispositions d'un règlement technique mondial établi sont portés à l'attention du Comité exécutif pour être réglés.

8.2. Les différends entre deux Parties contractantes ou plus concernant l'interprétation ou l'application du présent Accord sont dans la mesure du possible réglés par concertation ou négociation entre lesdites Parties. Lorsque cette procédure ne débouche pas sur un règlement des différends, les Parties contractantes en question peuvent décider de demander au Comité exécutif de les régler en application du paragraphe 7.3. de l'article 7 de l'annexe B.

Article 9 Comment devenir partie contractante

9.1. Les pays et les organisations d'intégration économique régionale définis dans l'article 2 peuvent devenir Parties contractantes au présent Accord:

9.1.1. en le ratifiant, l'acceptant ou l'adoptant après l'avoir signé sous réserve de ratification, d'acceptation ou d'adoption;

9.1.2. en l'acceptant; ou

9.1.3. en le signant, sans réserve de ratification, d'acceptation ou d'adoption;

9.1.4. en y adhérant.

9.2. L'instrument de ratification, d'acceptation, d'adoption ou d'adhésion doit être déposé auprès du Secrétaire général.

9.3. En devenant Partie contractante:

9.3.1. chaque pays ou chaque organisation d'intégration économique régionale, lorsque l'Accord est entré en vigueur, indique conformément à l'article 7, le cas échéant, quel(s) règlement(s) technique(s) mondial(mondiaux) établi(s) conformément à l'article 6 il ou elle va adopter, et s'il a pris la décision d'admettre des produits conformes à l'un quelconque de ces règlements techniques mondiaux, sans pour autant leur donner force de loi. Si le règlement technique mondial établi contient plus d'un degré de sévérité ou d'efficacité, la notification doit préciser quel degré est adopté ou accepté par la Partie contractante.

9.3.2. chaque organisation d'intégration économique régionale doit indiquer, pour les domaines relevant de sa competence, si ses Etats membres ont délégué des pouvoirs dans les domaines visés par le présent Accord, y compris celui de prendre des décisions contraignantes à leur égard.

9.4. Les organisations d'intégration économique régionale qui sont Parties contractantes cessent de l'être lorsqu'elles perdent les pouvoirs qui leur ont été délégués conformément au paragraphe 9.3.2. du présent article et en informent le Secrétaire général.

Article 10 Signature

10.1. Le présent Accord sera ouvert à la signature à compter du 25 juin 1998.

10.2. Le présent Accord restera ouvert à la signature jusqu'à son entrée en vigueur.

Article 11 Entrée en vigueur

11.1. Le présent Accord, ainsi que ses annexes qui en font partie intégrante, entrera en vigueur le trentième (30) jour suivant la date à laquelle un minimum de cinq (5) pays ou organisations d'intégration économique régionale seront devenus Parties contractantes en vertu de l'article 9, dont la Communauté européenne, le Japon et les Etats-Unis d'Amérique.

11.2. Toutefois, si les conditions énoncées au paragraphe 11.1. du présent article ne sont pas satisfaites quinze (15) mois après la date définie au paragraphe 10.1, le présent Accord, ainsi que ses annexes qui en font partie intégrante, entreront en vigueur le trentième (30) jour suivant la date à laquelle un minimum de huit (8) pays et/ou organisations d'intégration économique régionale seront devenus Parties contractantes en vertu de l'article 9. Cette date d'entrée en vigueur ne doit pas intervenir moins de seize (16) mois après la date définie au paragraphe 10.1. Au moins une (1) de ces huit (8) Parties contractantes doit être soit la Communauté européenne, soit le Japon, soit les Etats-Unis d'Amérique.

11.3. Pour tout pays ou toute organisation d'intégration économique régionale qui devient Partie contractante à l'Accord après son entrée en vigueur, le présent Accord a force de loi soixante (60) jours après la date qu'il ou elle a déposé dans son instrument de ratification, d'acceptation, d'adoption ou d'adhésion.

Article 12 Retrait de l'accord

12.1. Toute Partie contractante peut se retirer du présent Accord à condition de le notifier par écrit au Secrétaire général.

12.2. Le retrait de toute Partie contractante du présent Accord prend effet un an après la date à laquelle le Secrétaire général en a reçu notification conformément au paragraphe 12.1. du présent article.

Article 13 Amendement de l'accord

13.1. Une Partie contractante peut proposer des amendements au présent Accord ainsi qu'à ses annexes. Les amendements proposés sont soumis au Secrétaire général, qui les transmet à toutes les Parties contractantes.

13.2. Tout amendement transmis conformément au paragraphe 13.1. du présent article est examiné par le Comité exécutif à sa réunion suivante.

13.3. Si l'amendement est adopté à l'issue d'un vote par consensus par les Parties contractantes présentes et votantes, le Comité exécutif le communique au Secrétaire général qui à son tour le distribue à toutes les Parties contractantes.

13.4. Tout amendement distribué conformément au paragraphe 13.3. du présent article est considéré comme accepté par toutes les Parties contractantes si aucune d'entre elles n'élève d'objection dans un délai de six (6) mois à compter de la date de cette diffusion. Si aucune objection n'a été formulée, l'amendement entre en vigueur pour toutes les Parties contractantes trois (3) mois après l'expiration du délai de six (6) mois dont il est question dans le présent paragraphe.

13.5. Le Secrétaire général adresse le plus tôt possible à toutes les Parties contractantes une notification pour leur faire savoir si une objection a été formulée contre le projet d'amendement. Si une telle objection a été formulée, l'amendement est considéré comme n'ayant pas été accepté et reste sans aucun effet.

Article 14 Dépositaire

Le Secrétaire général de l'Organisation des Nations Unies est le dépositaire du présent Accord. Outre ses autres fonctions de dépositaire, le Secrétaire général notifie le plus tôt possible aux Parties contractantes:

14.1. L'inscription ou le retrait de règlements techniques conformément à l'article 5.

14.2. L'établissement ou l'amendement de règlements techniques mondiaux conformément à l'article 6.

14.3. Les notifications reçues conformément à l'article 7.

14.4. Les signatures, les acceptations et les adhésions, conformément aux article 9 et 10.

14.5. Les notifications reçues conformément à l'article 9.

14.6. Les dates auxquelles le présent Accord entre en vigueur, pour les Parties contractantes conformément à l'article 11.

14.7. Les notifications de retrait du présent Accord reçues conformément à l'article 12.

14.8. La date d'entrée en vigueur de tout amendement au présent Accord, conformément à l'article 13.

14.9. Les notifications reçues conformément à l'article 15 concernant l'extension territoriale.

Article 15 Extension territoriale de l'accord

15.1. Le présent Accord a force de loi sur tout territoire ou tous territoires d'une Partie contractante qui est responsable des relations extérieures de ce ou ces territoires, à moins qu'elle n'en ait disposé autrement, avant son entrée en vigueur pour ladite Partie contractante.

15.2. Toute Partie contractante peut dénoncer le présent Accord séparément pour ce ou ces territoires, conformément à l'article 12.

Article 16 Secrétariat

Le secrétariat du présent Accord est assuré par le Secrétaire exécutif de la Commission économique pour l'Europe, qui s'acquitte des fonctions ci-après:

16.1. préparer les réunions du Comité exécutif et des groupes de travail;

16.2. communiquer aux Parties contractantes les rapports et les autres renseignements reçus en application des dispositions du présent Accord; et

16.3. exécuter les tâches que lui confie le Comité exécutif.

Annexe A

Définitions

Aux fins du présent Accord, on entend par:

1. En ce qui concerne les règlements techniques mondiaux élaborés au titre du présent Accord, le terme «admet» désigne le fait qu'une Partie contractante autorise l'entrée sur son marché de produits conformes au règlement technique mondial sans pour autant avoir adopté ce règlement technique mondial dans ses lois et sa réglementation correspondantes.

2. En ce qui concerne les règlements techniques mondiaux élaborés au titre du présent Accord, le terme «adopte» désigne l'incorporation d'un règlement technique mondial dans les lois et la réglementation d'une Partie contractante.

3. En ce qui concerne les règlements techniques mondiaux élaborés au titre du présent Accord, le terme «applique» désigne le fait qu'une Partie contractante exige la conformité avec un règlement technique mondial à compter d'une certaine date; autrement dit la date effective d'application du règlement dans la juridiction d'une Partie contractante.

4. Le terme «article», désigne un article du présent Accord.

5. Le terme «vote par consensus», désigne un vote sur une question à propos de laquelle aucune Partie contractante présente et votante ne soulève d'objection, conformément au paragraphe 7.2. de l'article 7 de l'annexe B.

6. «Partie contractante», tout pays ou toute organisation d'intégration économique régionale qui est Partie contractante au présent Accord.

7. «équipements et pièces qui peuvent être montés et/ou utilisés sur des véhicules à roues», les équipements ou les parties dont les caractéristiques ont une incidence sur la sécurité, la protection de l'environnement, le rendement énergétique ou la protection contre le vol. Ces équipements et pièces comprennent entre autres les systèmes d'échappement, les pneumatiques, les moteurs, les équipements antibruit, les alarmes antivol, les dispositifs d'avertissement et les systèmes de retenue pour enfants.

8. «règlement technique mondial établi», un règlement technique mondial inscrit au Registre mondial conformément au présent Accord.

9. «règlement technique inscrit», un règlement technique national ou régional inscrit au Recueil des règlements admissibles conformément au présent Accord.

10. «autocertification du constructeur», l'obligation juridique imposée par une Partie contractante selon laquelle un constructeur de véhicules à roues ainsi que d'équipements et pièces qui peuvent être montés et/ou utilisés sur ces véhicules doit certifier que chaque véhicule, chaque équipement et chaque pièce qu'il met sur le marché satisfait à des prescriptions techniques précises.

11. «organisation d'intégration économique régionale», une organisation constituée par des Etats souverains et composée d'Etats souverains, qui a compétence pour les questions relevant du présent Accord, y compris le pouvoir de prendre des décisions ayant force obligatoire pour tous ses Etats membres en ce qui concerne ces questions.

12. «Secrétaire général», le Secrétaire général de l'Organisation des Nations Unies.

13. «transparence», des procédures conçues pour favoriser l'information et la participation du public au processus d'élaboration de la réglementation en vertu du présent Accord. Cette transparence suppose la publication:

    • 1. d'avis annonçant les réunions des groupes de travail et du Comité exécutif; et

    • 2. des documents de travail et des documents finals.

    • Elle permet aussi de porter des points de vue et des arguments à l'attention:

    • 1. des réunions des groupes de travail par l'intermédiaire d'organisations dotées du statut consultatif; et

    • 2. des réunions des groupes de travail et du Comité exécutif par l'intermédiaire de consultations préalables avec des représentants des Parties contractantes.

14. «homologation de type», l'homologation écrite d'une Partie contractante (ou d'une autorité compétente désignée par elle) selon laquelle un véhicule et/ou tout équipement et/ou pièce qui peut être monté et/ou utilisé sur un véhicule satisfait à des prescriptions techniques précises, condition préalable à la mise sur le marché de cet équipement ou de cette pièce.

15. «Règlement CEE/ONU», un Règlement de la Commission économique pour l'Europe de l'Organisation des Nations Unies adopté en vertu de l'Accord de 1958.

16. «Groupe de travail», un organe subsidiaire technique spécialisé relevant de la CEE, chargé de formuler des recommandations relatives à l'élaboration de règlements techniques mondiaux harmonisés ou nouveaux, en vue de leur inclusion dans le Registre mondial, et d'examiner les amendements à apporter aux règlements techniques mondiaux inscrits dans le Registre mondial.

17. «Accord de 1958», l'Accord concernant l'adoption de prescriptions techniques uniformes applicables aux véhicules à roues, aux équipements et aux pièces susceptibles d'être montés ou utilisés sur un véhicule à roues et les conditions de reconnaissance réciproque des homologations délivrées conformément à ces prescriptions.


Annexe B

Composition et règlement interieur du Comité executif

Article 1

Seules les Parties contractantes peuvent faire partie du Comité exécutif.

Article 2

Toutes les Parties contractantes sont membres du Comité exécutif.

Article 3

3.1. Sous réserve des dispositions du paragraphe 3.2. du présent article, chaque Partie contractante dispose d'une voix.

3.2. Si une organisation d'intégration économique régionale et un ou plusieurs de ses Etats membres sont Parties contractantes au présent Accord, elle peut, dans les domaines relevant de sa compétence, exercer son droit de vote en disposant d'un nombre de voix égal au nombre de ses Etats membres qui sont Parties contractantes au présent Accord. Elle ne peut exercer son droit de vote si l'un quelconque de ses Etats membres exerce le sien, et réciproquement.

Article 4

Pour pouvoir voter, une Partie contractante doit être présente, sauf si son droit de vote est exercé par une organisation d'intégration économique régionale.

Article 5

5.1. Un quorum d'au moins la moitié des Parties contractantes doit être réuni pour pouvoir procéder à un vote.

5.2. Dans le calcul du quorum en vertu du présent article, et pour définir le nombre des Parties contractantes représentant un tiers des Parties contractantes présentes et votantes en vertu du paragraphe 7.1. de l'article 7 de la présente annexe, une organisation d'intégration économique régionale et ses Etats membres sont comptés comme une seule Partie contractante.

Article 6

6.1. Lors de sa première session de chaque année civile, le Comité exécutif élit un président et un vice-président parmi ses membres. Le Président et le Vice-Président sont élus à la majorité des deux tiers des Parties contractantes présentes et votantes.

6.2. Ni le Président, ni le Vice-Président ne doit être originaire de la même Partie contractante plus de deux années de suite. Le Président et le Vice-Président ne doivent jamais être originaires de la même Partie contractante.

Article 7

7.1. Un règlement national ou régional peut être inscrit au Recueil des règlements admissibles avec un vote favorable d'au moins un tiers des Parties contractantes présentes et votantes (voir définition à l'article 5.2 de la présente annexe) ou d'un tiers du nombre total de suffrages exprimés, si ce décompte est plus avantageux. Dans les deux cas, le tiers doit comprendre la voix de la Communauté européenne, du Japon ou des Etats-Unis, s'ils sont Parties contractantes.

7.2. L'inscription d'un règlement technique mondial au Registre mondial, l'amendement d'un règlement technique mondial établi et l'amendement du présent Accord doivent être adoptés par consensus des Parties contractantes présentes et votantes. Si une Partie contractante présente et votante est en désaccord sur une question devant faire l'objet d'un vote par consensus, elle doit en communiquer les raisons par écrit au Secrétaire général, dans les soixante (60) jours à compter de la date du scrutin. Passé ce délai, la Partie contractante est considérée comme ayant émis un vote favorable. Si toutes les Parties contractantes en désaccord se trouvent dans le même cas, on considère que la question a été votée par consensus par la totalité des personnes présentes et votantes. Dans cette éventualité, la date du scrutin est considérée comme étant le premier jour suivant a période de 60 jours.

7.3. Toutes les autres questions en suspens peuvent, à la discrétion du Comité exécutif, être résolues au moyen de la procédure de vote définie au paragraphe 7.2. du présent article.

Article 8

Les Parties contractantes qui s'abstiennent sont considérées comme non votantes.

Article 9

Le Secrétaire exécutif convoque le Comité exécutif chaque fois qu'un vote doit avoir lieu en vertu des articles 5, 6 ou 13 du présent Accord ou chaque fois que des activités doivent être menées en application du présent Accord.


C. VERTALING

Overeenkomst betreffende de vaststelling van mondiale technische reglementen voor wielvoertuigen, uitrustingsstukken en onderdelen die kunnen worden aangebracht en/of gebruikt op wielvoertuigen

Preambule

De Overeenkomstsluitende Partijen,

Besloten hebbende een Overeenkomst goed te keuren tot instelling van een proces ter bevordering van de ontwikkeling van mondiale technische reglementen die hoge niveaus van veiligheid, milieubescherming, energie-efficiëntie en diefstalbeveiliging verzekeren voor wielvoertuigen, uitrustingsstukken en onderdelen die kunnen worden aangebracht en/of gebruikt op wielvoertuigen;

Besloten hebbende dat dit proces ook de harmonisatie van bestaande technische voorschriften dient te bevorderen en erkennende het recht van subnationale, nationale en regionale autoriteiten tot aanname en handhaving van technische voorschriften op het gebied van gezondheid, veiligheid, milieubescherming, energie-efficiëntie en diefstalbeveiliging die strenger zijn dan de op mondiaal niveau vastgestelde voorschriften;

Zijnde gemachtigd krachtens lid 1 onder a) van het mandaat van de VN/ECE en hoofdstuk XIII van het huishoudelijk reglement van de VN/ECE, regel 50, om tot deze Overeenkomst toe te treden;

Erkennende dat deze Overeenkomst geen afbreuk doet aan de rechten en plichten die een Overeenkomstsluitende Partij heeft krachtens bestaande internationale Overeenkomsten op het gebied van gezondheidszorg, veiligheid en milieubescherming;

Erkennende dat deze Overeenkomst geen afbreuk doet aan de rechten en plichten die een Overeenkomstsluitende Partij heeft op grond van de Overeenkomsten in het kader van de Wereldhandelsorganisatie (WTO), de Overeenkomst inzake technische belemmeringen in het handelsverkeer inbegrepen, en met de bedoeling krachtens deze Overeenkomst op een met genoemde overeenkomsten strokende wijze mondiale technische reglementen vast te stellen als grondslag voor hun technische voorschriften;

Met de bedoeling dat de Overeenkomstsluitende Partijen de krachtens deze Overeenkomst vastgestelde technische reglementen gebruiken als grondslag voor hun technische voorschriften;

Erkennende het belang voor volksgezondheid, veiligheid en welzijn van het continu verbeteren van en streven naar hoge niveaus van veiligheid, milieubescherming, energie-efficiëntie en diefstalbeveiliging van wielvoertuigen, uitrustingsstukken en onderdelen die kunnen worden aangebracht en/of gebruikt op wielvoertuigen, alsmede de potentiële waarde voor de internationale handel, de keuzemogelijkheden van de consument en de betaalbaarheid van producten van groeiende convergentie op het gebied van bestaande en toekomstige voorschriften en bijbehorende normen;

Erkennende dat regeringen het recht hebben om verbeteringen na te streven en door te voeren op het gebied van volksgezondheid, veiligheid en milieubescherming, alsmede te bepalen of de krachtens deze Overeenkomst vastgestelde mondiale technische reglementen aan hun behoeften beantwoorden;

Erkennende dat er reeds belangrijk werk op het gebied van harmonisatie is gedaan krachtens de Overeenkomst van 1958;

Erkennende de in de verschillende geografische gebieden bestaande belangstelling voor en deskundigheid op het gebied van veiligheid, milieu, energie en diefstalbeveiligingsproblemen en methoden om die op te lossen, alsmede de waarde van die belangstelling en deskundigheid voor de ontwikkeling van mondiale technische reglementen als bijdrage tot de realisering van die verbeteringen en het tot een minimum beperken van de verschillen;

Geleid door de wens om de aanname van vastgestelde mondiale technische reglementen in ontwikkelingslanden te bevorderen, rekening houdende met de speciale problemen en omstandigheden in die landen, met name in de minst ontwikkelde landen;

Geleid door de wens dat bij de ontwikkeling van mondiale technische reglementen door middel van doorzichtige procedures naar behoren rekening dient te worden gehouden met de door de Overeenkomstsluitende Partijen toegepaste technische voorschriften, en dat dit ook vergelijkende kosten-batenanalyses met zich meebrengt;

Erkennende dat de vaststelling van hoge beschermingsniveaus beogende mondiale technische reglementen de afzonderlijke landen ertoe zal brengen te concluderen dat die reglementen in hun rechtsgebied voor de nodige bescherming en beveiliging zullen zorgen;

Erkennende het effect van de kwaliteit van motorbrandstoffen op de prestaties van milieubeschermende inrichtingen in auto's, de menselijke gezondheid en het brandstofrendement; en

Erkennende dat het bijzonder belangrijk is dat er bij de ontwikkeling van mondiale technische reglementen in het kader van deze Overeenkomst doorzichtige procedures worden toegepast, en dat het ontwikkelingsproces verenigbaar moet zijn met de regelgevingsprocessen bij de Overeenkomstsluitende Partijen;

Zijn als volgt overeengekomen:

Artikel 1 Doel

1.1. Het doel van deze Overeenkomst is:

1.1.1. een wereldomvattend proces in te stellen, waarbij de Overeenkomstsluitende Partijen uit alle delen van de wereld gezamenlijk mondiale technische reglementen kunnen ontwikkelen met betrekking tot de veiligheid, milieubescherming, energie-efficiëntie en diefstalbeveiliging van wielvoertuigen, uitrustingsstukken en onderdelen die kunnen worden aangebracht en/of gebruikt op wielvoertuigen;

1.1.2. ervoor te zorgen dat bij de ontwikkeling van mondiale technische reglementen er naar behoren objectief rekening wordt gehouden met de bestaande technische voorschriften van de Overeenkomstsluitende Partijen en met de VN/ECE-reglementen;

1.1.3. ervoor te zorgen dat er bij de ontwikkeling van mondiale technische reglementen objectief rekening gehouden wordt met de analyse van de beste beschikbare technologie, de relatieve voordelen en de kosteneffectiviteit naar gelang van toepassing;

1.1.4. ervoor te zorgen dat de bij de ontwikkeling van mondiale technische reglementen toegepaste procedures doorzichtig zijn;

1.1.5. hoge niveaus van veiligheid, milieubescherming, energie-efficiëntie en diefstalbeveiliging in de wereldgemeenschap te bereiken, en ervoor te zorgen dat de acties in het kader van deze Overeenkomst niet een daling van deze niveaus binnen het rechtsgebied van de Overeenkomstsluitende Partijen, de subnationale niveaus inbegrepen, bevorderen of daartoe leiden;

1.1.6. de technische belemmeringen voor de internationale handel af te bouwen door harmonisatie van bestaande technische voorschriften van Overeenkomstsluitende Partijen en VN/ECE-reglementen en door ontwikkeling van nieuwe mondiale technische reglementen op het gebied van veiligheid, milieubescherming, energie-efficiëntie en diefstalbeveiliging van wielvoertuigen, uitrustingsstukken en onderdelen die kunnen worden aangebracht en/of gebruikt op wielvoertuigen, welke verenigbaar zijn met de realisering van hoge niveaus van veiligheid en milieubescherming en de overige hierboven genoemde doeleinden; en

1.1.7. ervoor te zorgen dat, indien er alternatieve niveaus van striktheid nodig zijn om de regelgeving in bepaalde landen, met name ontwikkelingslanden, te bevorderen, hiermee bij de ontwikkeling en vaststelling van mondiale technische reglementen rekening moet worden gehouden.

1.2. De uitvoering van deze Overeenkomst moet parallel met die van de Overeenkomst van 1958 verlopen, zonder dat er afbreuk wordt gedaan aan de institutionele autonomie van de Overeenkomsten.

Artikel 2 Overeenkomstsluitende partijen en raadgevende status

2.1. Landen die lid zijn van de Economische Commissie voor Europa (VN/ECE), organisaties voor regionale economische integratie die zijn opgericht door lidstaten van de ECE en landen die overeenkomstig paragraaf 8 van het mandaat van deze Commissie in een raadgevende hoedanigheid tot de ECE zijn toegelaten, kunnen Partij bij deze Overeenkomst worden.

2.2. Landen die lid zijn van de Verenigde Naties en die aan bepaalde activiteiten van de ECE deelnemen overeenkomstig paragraaf 11 van het Mandaat van de ECE, en door deze landen opgerichte organisaties voor regionale economische integratie kunnen Partij bij deze Overeenkomst worden.

2.3. Gespecialiseerde bureaus en alle organisaties, intergouvernementele en niet-gouvernementele organisaties inbegrepen, aan welke door de Economische en Sociale Raad van de Verenigde Naties een raadgevende status is verleend, kunnen in die hoedanigheid deelnemen aan de beraadslagingen van werkgroepen, wanneer er zaken behandeld worden die voor die bureaus of organisaties van bijzonder belang is.

Artikel 3 Uitvoerend Comité

3.1. De vertegenwoordigers van de Overeenkomstsluitende Partijen richten het Uitvoerend Comité van deze Overeenkomst op en komen minstens éénmaal per jaar als zodanig bijeen.

3.2. Het Huishoudelijk Reglement van het Uitvoerend Comité is opgenomen in bijlage B bij deze Overeenkomst.

3.3. Het Uitvoerend Comité:

3.3.1. is verantwoordelijk voor de implementatie van deze Overeenkomst, die onder meer de bepaling van prioriteiten voor de activiteiten in het kader van deze Overeenkomst omvat;

3.3.2. bestudeert alle aanbevelingen en rapporten van werkgroepen met betrekking tot de vastlegging van mondiale technische reglementen krachtens deze Overeenkomst; en

3.3.3. vervult eventuele andere passende functies in het kader van deze Overeenkomst.

3.4. Het Uitvoerend Comité beslist in laatste instantie over de opname van voorschriften in het Compendium van mogelijke mondiale technische reglementen en over de vastlegging van mondiale technische reglementen krachtens deze Overeenkomst.

3.5. Het Uitvoerend Comité gebruikt bij de uitoefening van zijn functies informatie uit alle van belang zijnde bronnen, wanneer het Comité dit passend acht.

Artikel 4 Criteria voor technische voorschriften

4.1. Om krachtens artikel 5 te kunnen worden opgenomen of krachtens artikel 6 te worden vastgelegd moet een technisch voorschrift aan de volgende criteria voldoen:

4.1.1. het moet een duidelijke beschrijving geven van de wielvoertuigen, uitrustingsstukken en/of onderdelen die kunnen worden aangebracht en/of gebruikt op wielvoertuigen en waarop het voorschrift van toepassing is;

4.1.2. het moet eisen bevatten die:

4.1.2.1. hoge niveaus van veiligheid, milieubescherming, energie-efficiëntie of diefstalbeveiliging beogen; en

4.1.2.2. indien van toepassing, worden uitgedrukt in termen van prestaties en niet van ontwerp-eigenschappen;

4.1.3. het moet omvatten:

4.1.3.1. de beproevingsmethode waarmee overeenstemming met het voorschrift moet worden aangetoond;

4.1.3.2. voor de krachtens artikel 5 op te nemen voorschriften, indien van toepassing, een duidelijke beschrijving van de goedkeurings- of certificatiemerken en/of labels die vereist zijn bij typegoedkeuring en conformiteit van de productie of bij de fabrikantenverklaring; en

4.1.3.3. indien van toepassing, een op overwegingen van redelijkheid en uitvoerbaarheid gebaseerde aanbevolen minimum aanloopperiode, die een Overeenkomstsluitende Partij moet bieden, alvorens overeenstemming te eisen.

4.2. In een mondiaal technisch reglement kunnen alternatieve niet-mondiale striktheids- of prestatieniveaus en passende beproevingsprocedures worden opgenomen, indien dit nodig is om de regelgevingsactiviteiten in bepaalde landen, met name in ontwikkelingslanden, te verge- makkelijken.

Artikel 5 Compendium van mogelijke mondiale technische voorschriften

5.1. Er wordt een Compendium van geen VN/ECE-reglementen zijnde technische voorschriften van Overeenkomstsluitende Partijen, die in aanmerking komen voor harmonisatie of goedkeuring als mondiale technische reglementen (het zogeheten Compendium of Candidates) gecreëerd en bijgehouden.

5.2. Opname van technische voorschriften in het Compendium of Candidates

Een Overeenkomstsluitende Partij kan bij het Uitvoerend Comité een verzoek indienen tot opname in het Compendium of Candidates van ieder technisch voorschrift dat zij heeft toegepast, nog toepast of heeft aangenomen voor toepassing in de toekomst.

5.2.1. Het in paragraaf 5.2 genoemde verzoek omvat:

5.2.1.1. een exemplaar van het voorschrift;

5.2.1.2. alle beschikbare het voorschrift ondersteunende technische documentatie, waaronder documenten over de best beschikbare technologie, de daaraan verbonden voordelen en de kosteneffectiviteit; en

5.2.1.3. vermelding van alle bekende bestaande of op komst zijnde relevante internationale facultatieve normen.

5.2.2. Het Uitvoerend Comité onderzoekt alle verzoeken die aan de eisen van artikel 4 en paragraaf 5.2.1 van dit artikel voldoen. Het technisch voorschrift wordt opgenomen in het Compendium of Candidates, indien een positief stemmingsresultaat overeenkomstig paragraaf 7.1 van artikel 7 van bijlage B wordt verkregen. De tegelijk met het verzoek tot opname ingediende documentatie wordt aan het opgenomen technisch voorschrift gehecht.

5.2.3. Het voorschrift waarvoor een verzoek tot opname is ingediend, wordt geacht door de Secretaris-Generaal te zijn opgenomen op de datum waarop het positief stemmingsresultaat krachtens paragraaf 5.2.2 van dit artikel is verkregen.

5.3. Verwijdering van technische voorschriften uit het Compendium of Candidates

Een in het Compendium opgenomen technisch voorschrift wordt daaruit verwijderd:

5.3.1. na vastlegging in het Wereldregister van een mondiaal technisch reglement dat producteisen bevat die op dezelfde prestatie-onderdelen of ontwerp-eigenschappen betrekking hebben als het opgenomen technisch voorschrift;

5.3.2. aan het einde van de periode van vijf jaar die volgt op de opname van het voorschrift krachtens dit artikel, en aan het einde van iedere daaropvolgende periode van vijf jaar, tenzij het Uitvoerend Comité met een positief stemmingsresultaat overeenkomstig paragraaf 7.1 van artikel 7 van bijlage B de opname van het technisch voorschrift in het Compendium of Candidates herbevestigt; of

5.3.3. ingevolge een schriftelijk verzoek van de Overeenkomstsluitende Partij op wier verzoek het technisch voorschrift oorspronkelijk was opgenomen. In dit verzoek worden de redenen voor verwijdering van het voorschrift vermeld.

5.4. Beschikbaarheid van documenten

Alle door het Uitvoerend Comité krachtens dit artikel onderzochte documenten zijn algemeen beschikbaar.

Artikel 6 Register van mondiale technische reglementen

6.1. Er wordt een register gecreëerd en onderhouden voor de krach-tens dit artikel ontwikkelde en vastgelegde mondiale technische reglementen. Dit register wordt het Wereldregister genoemd.

6.2. De vastlegging van mondiale technische reglementen in het Wereldregister door middel van harmonisatie van bestaande voorschriften

Een Overeenkomstsluitende Partij kan een voorstel indienen voor de ontwikkeling van een geharmoniseerd mondiaal technisch reglement betreffende prestatie-onderdelen of ontwerp-eigenschappen die in de in het Compendium of Candidates opgenomen technische voorschriften of in VN/ECE-reglementen, of in beiden, worden behandeld.

6.2.1. Het in paragraaf 6.2 genoemde voorstel omvat:

6.2.1.1. een uiteenzetting van het doel van het voorgestelde mondiaal technisch reglement;

6.2.1.2. een uitgebreide beschrijving of, indien beschikbaar, de ontwerp-tekst van het voorgestelde mondiaal technisch reglement;

6.2.1.3. beschikbare documentatie die de bestudering kan vergemakkelijken van de punten die behandeld moeten worden in het krachtens paragraaf 6.2.4.2.1 van dit artikel vereiste rapport;

6.2.1.4. een lijst van alle technische voorschriften in het Compendium of Candidates en alle VN/ECE-reglementen die prestatie-onderdelen of ontwerp-eigenschappen behandelen waarop het voorgestelde mondiaal technisch reglement betrekking moet hebben; en

6.2.1.5. vermelding van alle bekende bestaande relevante internationale facultatieve normen.

6.2.2. Elk voorstel als bedoeld in paragraaf 6.2.1 van dit artikel wordt aan het Uitvoerend Comité voorgelegd.

6.2.3. Voorstellen die volgens het Uitvoerend Comité niet aan de eisen van artikel 4 en paragraaf 6.2.1 van dit artikel voldoen worden niet naar een werkgroep verwezen. Alle andere voorstellen kan het Uitvoerend Comité naar een geschikte werkgroep verwijzen.

6.2.4. Wanneer er een voorstel voor ontwikkeling van een mondiaal technisch reglement door middel van harmonisatie naar haar wordt verwezen, past de werkgroep doorzichtige procedures toe:

6.2.4.1. bij de opstelling van aanbevelingen betreffende een mondiaal technisch reglement:

6.2.4.1.1. zij houdt rekening met de doelstelling van het voorgestelde mondiaal technisch reglement en met de noodzaak om alternatieve striktheids- of prestatieniveaus op te stellen;

6.2.4.1.2. zij bekijkt alle in het Compendium of Candidates opge- nomen technische voorschriften en alle VN/ECE-reglementen die op dezelfde prestatie-onderdelen betrekking hebben;

6.2.4.1.3. zij bestudeert alle documentatie die aan de in paragraaf 6.2.4.1.2 van dit artikel bedoelde voorschriften is gehecht;

6.2.4.1.4. zij bestudeert alle beschikbare beoordelingen van de functionele gelijkwaardigheid die van belang zijn bij de beschouwing van het voorgestelde mondiaal technisch reglement, met inbegrip van beoordelingen van aanverwante normen;

6.2.4.1.5. zij controleert of het in ontwikkeling zijnde mondiaal technisch reglement aan zijn doelstelling en aan de criteria van artikel 4 beantwoordt; en

6.2.4.1.6. zij houdt naar behoren rekening met de mogelijkheid om het technisch voorschrift krachtens de Overeenkomst van 1958 te doen vastleggen.

6.2.4.2. zij legt aan het Uitvoerend Comité voor:

6.2.4.2.1. een geschreven rapport met daarin haar aanbeveling betreffende het mondiaal technisch reglement, alle technische gegevens en informatie waarmee bij de opstelling van de aanbeveling rekening is gehouden, een beschrijving van haar onderzoek van de in paragraaf 6.2.4.1 van dit artikel bedoelde informatie, en een uiteenzetting van de rationale van haar aanbevelingen, met inbegrip van een verklaring voor het afwijzen van eventuele door haar bestudeerde alternatieve regelgeving en benaderingen; en

6.2.4.2.2. de tekst van het aanbevolen mondiaal technisch reglement.

6.2.5. Door het Uitvoerend Comité wordt volgens doorzichtige procedures:

6.2.5.1. bepaald of aan de aanbevelingen betreffende het mondiaal technisch reglement en het rapport een voldoende en grondige uitvoering van de werkzaamheden als bedoeld in paragraaf 6.2.4.1 van dit artikel ten grondslag ligt. Indien het Uitvoerend Comité aanbevelingen, een rapport en/of de tekst van een aanbevolen mondiaal technisch reglement onvoldoende acht, stuurt zij het reglement en het rapport voor herziening of verdere aanvulling terug naar de werkgroep;

6.2.5.2. beraadslaagd over de vastlegging van een aanbevolen mondiaal technisch reglement overeenkomstig de procedures van paragraaf 7.2 van artikel 7 van bijlage B. Wanneer het Uitvoerend Comité met eenparigheid van stemmen voor het reglement stemt, wordt dit in het Wereldregister vastgelegd.

6.2.6. Het mondiaal technisch reglement wordt geacht in het Wereldregister te zijn vastgelegd op de datum dat het Uitvoerend Comité met eenparigheid van stemmen voor het reglement heeft gestemd.

6.2.7. Het secretariaat zal na de vaststelling van een mondiaal technisch reglement door het Uitvoerend Comité exemplaren van alle relevante documenten, met inbegrip van het overeenkomstig paragraaf 6.2.1 van dit artikel ingediende voorstel, de aanbevelingen en het rapport, die op grond van paragraaf 6.2.4.2.1 van dit artikel vereist zijn, aan dat reglement aanhechten.

6.3. Vastlegging van nieuwe mondiale technische reglementen in het Wereldregister

Een Overeenkomstsluitende Partij kan een voorstel indienen voor ontwikkeling van een nieuw mondiaal technisch reglement met prestatie-onderdelen of ontwerp-eigenschappen die niet in de technische reglementen van het Compendium of Candidates of de VN/ECE-reglementen worden behandeld.

6.3.1. Het in paragraaf 6.3 bedoelde voorstel omvat:

6.3.1.1. een uiteenzetting van het doel van het voorgestelde nieuwe mondiaal technisch reglement die op zoveel mogelijk objectieve gegevens gebaseerd is;

6.3.1.2. een beschrijving of, indien beschikbaar, de ontwerp-tekst van het voorgestelde nieuwe mondiaal technisch reglement;

6.3.1.3. alle beschikbare documentatie die het onderzoek van de onderwerpen, die in het op grond van paragraaf 6.3.4.2.1 van dit artikel vereiste rapport moeten worden behandeld, kan vergemakkelijken; en

6.3.1.4. vermelding van alle bekende bestaande relevante internationale facultatieve normen.

6.3.2. Ieder voorstel als bedoeld in paragraaf 6.3.1 van dit artikel wordt voorgelegd aan het Uitvoerend Comité.

6.3.3. Het Uitvoerend Comité verwijst voorstellen die volgens hem niet aan de eisen van artikel 4 en paragraaf 6.3.1 van dit artikel voldoen, niet naar een werkgroep. Alle andere voorstellen kan zij wel naar een geschikte werkgroep verwijzen.

6.3.4. Wanneer er een voorstel voor ontwikkeling van een nieuw mondiaal technisch reglement naar de werkgroep verwezen wordt, past zij doorzichtige procedures toe bij:

6.3.4.1. de opstelling van aanbevelingen met betrekking tot een nieuw mondiaal technisch reglement:

6.3.4.1.1. zij houdt rekening met de doelstelling van het voorgestelde nieuwe mondiaal technisch reglement en de noodzaak om alternatieve striktheids- of prestatieniveaus op te stellen;

6.3.4.1.2. zij bekijkt of het technisch haalbaar is;

6.3.4.1.3. zij bekijkt of het economisch haalbaar is;

6.3.4.1.4. zij bestudeert de voordelen, waarbij zij ook kijkt naar de voordelen van eventuele alternatieve regelgeving en benaderingen;

6.3.4.1.5. zij vergelijkt de potentiële kosteneffectiviteit van het aanbevolen reglement met die van de onderzochte alternatieve regelgeving en benaderingen;

6.3.4.1.6. zij controleert of het in ontwikkeling zijnde mondiaal technisch reglement aan zijn doelstelling en aan de criteria van artikel 4 beantwoordt; en

6.3.4.1.7. zij houdt naar behoren rekening met de mogelijkheid om het technisch reglement krachtens de Overeenkomst van 1958 te doen vastleggen.

6.3.4.2. zij legt aan het Uitvoerend Comité voor:

6.3.4.2.1. een geschreven rapport met daarin haar aanbeveling betreffende het nieuwe mondiaal technisch reglement, alle technische gegevens en informatie waarmee bij de opstelling van de aanbeveling rekening is gehouden, een beschrijving van haar onderzoek van de in paragraaf 6.3.4.1 van dit artikel bedoelde informatie, en een uiteenzetting van de rationale van haar aanbevelingen, met inbegrip van een verklaring voor het afwijzen van eventuele door haar bestudeerde alternatieve regelgeving en benaderingen; en

6.3.4.2.2. de tekst van het aanbevolen nieuwe mondiaal technisch reglement.

6.3.5. Door het Uitvoerend Comité wordt volgens doorzichtige procedures:

6.3.5.1. bepaald of aan de aanbevelingen betreffende het nieuwe mondiaal technisch reglement en het rapport een voldoende en grondige uitvoering van de werkzaamheden als bedoeld in paragraaf 6.3.4.1 van dit artikel ten grondslag ligt. Indien het Uitvoerend Comité aanbevelingen, een rapport en/of de tekst van een aanbevolen nieuw mondiaal technisch reglement onvoldoende acht, stuurt hij het reglement en het rapport voor herziening of verdere aanvulling terug naar de werkgroep;

6.3.5.2. beraadslaagd over de vastlegging van een aanbevolen nieuw mondiaal technisch reglement volgens de procedures van paragraaf 7.2 van artikel 7 van bijlage B. Wanneer het Uitvoerend Comité met eenparigheid van stemmen voor het reglement stemt, wordt dit in het Wereldregister vastgelegd.

6.3.6. Het mondiaal technisch reglement wordt geacht in het Wereldregister te zijn vastgelegd op de datum dat het Uitvoerend Comité met eenparigheid van stemmen voor het reglement heeft gestemd.

6.3.7. Het secretariaat zal, na de vastlegging van een nieuw mondiaal technisch reglement door het Uitvoerend Comité, aan dit reglement exemplaren hechten van alle relevante documentatie, met inbegrip van het overeenkomstig paragraaf 6.3.1 van dit artikel ingediende voorstel, de aanbevelingen en het krachtens paragraaf 6.3.4.2.1 van dit artikel vereiste rapport.

6.4. Wijziging van een vastgelegd mondiaal technisch reglement

Bij wijziging van een krachtens dit artikel in het Wereldregister vastgelegd mondiaal technisch reglement worden de in paragraaf 6.3 van ditartikel vermelde procedures voor vastlegging van een nieuw mondiaal technisch reglement in het Wereldregister gevolgd.

6.5. Beschikbaarheid van documenten

Alle documenten die door de werkgroep bij het krachtens dit artikel aanbevelen van mondiale technische reglementen zijn geraadpleegd of geproduceerd zijn algemeen beschikbaar.

Artikel 7 Aanname en kennisgeving van toepassing van vastgelegde mondiale technische reglementen

7.1. Een Overeenkomstsluitende Partij die stemt voor de vastlegging van een mondiaal technisch reglement krachtens artikel 6 van deze Overeenkomst is verplicht om dit technisch reglement te onderwerpen aan de procedure die door genoemde Overeenkomstsluitende Partij wordt toegepast bij opname van zo'n technisch reglement in de eigen wetgeving of regelgeving, en tracht spoedig tot een definitief besluit te komen.

7.2. Een Overeenkomstsluitende Partij die een vastgelegd mondiaal technisch reglement invoert in haar eigen wetgeving of regelgeving, stelt de Secretaris-Generaal schriftelijk in kennis van de datum waarop zij dat reglement begint toe te passen. De kennisgeving volgt binnen 60 dagen na haar besluit om het reglement aan te nemen. Indien het vastgelegde mondiaal technisch reglement meer dan één striktheids- of prestatieniveau bevat, moet in de kennisgeving worden vermeld voor welk striktheids- of prestatieniveau door de Overeenkomstsluitende Partij is gekozen.

7.3. Een Overeenkomstsluitende Partij als bedoeld in paragraaf 7.1 van dit artikel, die besluit om het vastgestelde mondiaal technisch reglement niet in haar eigen wet- of regelgeving op te nemen, stelt de Secretaris-Generaal schriftelijk in kennis van haar besluit en de grond voor dat besluit. De kennisgeving moet binnen 60 dagen na het besluit worden gedaan.

7.4. Een Overeenkomstsluitende Partij als bedoeld in paragraaf 7.1 van dit artikel, die één jaar na de datum van vastlegging van het reglement in het Wereldregister het technisch reglement nog niet heeft aangenomen, of besloten heeft het reglement niet in haar eigen wet- of regelgeving op te nemen, vermeldt in een rapport in welk stadium van het nationale wetgevingsproces het reglement verkeert. Voor iedere daaropvolgende periode van een jaar wordt een statusrapport ingediend, indien tegen het einde van die periode geen van genoemde maatregelen genomen is. Ieder door deze paragraaf voorgeschreven rapport:

7.4.1. bevat een beschrijving van de stappen die het afgelopen jaar genomen zijn om tot indiening van het reglement en tot een definitief besluit te komen, alsmede de vermelding dat de datum waarop dit besluit wordt verwacht; en

7.4.2. wordt uiterlijk 60 dagen na het einde van het jaar waarop het rapport betrekking heeft bij de Secretaris-Generaal ingediend.

7.5. Een Overeenkomstsluitende Partij die producten aanvaardt die in overeenstemming zijn met een vastgelegd mondiaal technisch reglement, zonder dat dit reglement in de eigen wet- of regelgeving is opgenomen, stelt de Secretaris-Generaal schriftelijk in kennis van de datum waarop zij begonnen is deze producten te aanvaarden. De Overeenkomstsluitende Partij doet de mededeling binnen 60 dagen na het begin van deze aanvaarding. Indien het vastgestelde mondiaal technisch reglement meer dan één striktheids- of prestatieniveau bevat, wordt in de mededeling vermeld voor welk striktheids- of prestatieniveau de Overeenkomstsluitende Partij heeft gekozen.

7.6. Een Overeenkomstsluitende Partij die een vastgelegd mondiaal technisch reglement in haar eigen wet- of regelgeving heeft opgenomen, kan ertoe besluiten dit reglement af te schaffen of te wijzigen. Alvorens dat besluit te nemen, stelt de Overeenkomstsluitende Partij de Secretaris-Generaal schriftelijk in kennis van haar voornemen en van de redenen van de voorgenomen maatregel. Deze mededelingsplicht geldt ook voor een Overeenkomstsluitende Partij die krachtens paragraaf 7.5 producten heeft aanvaard, en die voornemens is de aanvaarding van deze producten te staken. De Overeenkomstsluitende Partij stelt de Secretaris-Generaal in kennis van haar besluit om een gewijzigd of nieuw reglement op te nemen binnen 60 dagen na dat besluit. De Overeen- komssluitende Partij verschaft desgevraagd exemplaren van dit gewijzigd of nieuw reglement aan andere Overeenkomstsluitende Partijen.

Artikel 8 Regeling van geschillen

8.1. Vragen betreffende de bepalingen van een vastgelegd mondiaal technisch reglement worden voor een oplossing verwezen naar het Uitvoerend Comité.

8.2. Geschillen tussen twee of meer Overeenkomstsluitende Partijen betreffende de uitlegging of toepassing van deze Overeenkomst worden, voorzover mogelijk, opgelost door middel van overleg of onderhandelingen. Indien het niet lukt om op deze wijze de geschillen te regelen, kunnen de betrokken Overeenkomstsluitende Partijen overeenkomen het Uitvoerend Comité te verzoeken het geschil overeenkomstig de bepalingen van paragraaf 7.3 van artikel 7 van bijlage B te regelen.

Artikel 9 Overeenkomstsluitende Partijen worden

9.1. Landen en organisaties voor regionale economische integratie als bedoeld in artikel 2 kunnen Overeenkomstsluitende Partijen worden door:

9.1.1. ondertekening zonder voorbehoud van bekrachtiging, aanvaarding of goedkeuring; of

9.1.2. ondertekening met voorbehoud van bekrachtiging, aanvaarding of goedkeuring, gevolgd door bekrachtiging, aanvaarding of goedkeuring;

9.1.3. aanvaarding; of

9.1.4. toetreding.

9.2. De akte van bekrachtiging, aanvaarding, goedkeuring of toetreding wordt neergelegd bij de Secretaris-Generaal.

9.3. Na Overeenkomstsluitende Partij te zijn geworden:

9.3.1. na de inwerkingtreding van deze Overeenkomst deelt ieder land of iedere organisatie voor regionale integratie overeenkomstig artikel 7 welk, indien enig, overeenkomstig artikel 6 vastgelegd(e) mondiaal (mondiale) technisch(e) reglement(en) zij aanneemt, en meldt ieder besluit om producten die met één van die mondiale technische reglementen in overeenstemming zijn te aanvaarden, zonder die reglementen in de eigen wet- of regelgeving op te nemen. Indien het vastgelegde mondiaal technisch reglement meer dan één striktheids- of prestatieniveau bevat, wordt in de mededeling vermeld welk striktheids- of prestatieniveau door de Overeenkomstsluitende Partij wordt aangenomen of aanvaard.

9.3.2. iedere organisatie voor regionale economische integratie verklaart in onder haar bevoegdheid vallende maatregelen dat haar lidstaten op door deze Overeenkomst bestreden gebieden bevoegdheden hebben overgedragen, met inbegrip van de bevoegdheid om beslissingen te nemen die bindend zijn voor haar lidstaten.

9.4. Regionale organisaties voor economische integratie die Overeenkomstsluitende Partij zijn, houden op Overeenkomstsluitende Partij te zijn, wanneer zij de bevoegdheden verliezen, waarover zij overeenkomstig paragraaf 9.3.2 van dit artikel hebben verklaard te beschikken, en delen dit aan de Secretaris-Generaal mede.

Artikel 10 Ondertekening

10.1. Deze Overeenkomst staat open voor ondertekening vanaf 25 juni 1998.

10.2. Deze Overeenkomst blijft openstaan voor ondertekening tot aan de inwerkingtreding ervan.

Artikel 11 Inwerkingtreding

11.1. Deze Overeenkomst en de bijlagen, die daarvan integrerende delen vormen, treden in werking op de dertigste dag na de datum waarop ten minste vijf landen en/of organisaties voor regionale economische integratie overeenkomstig artikel 9 Overeenkomstsluitende Partijen zijn geworden. De Europese Gemeenschap, Japan en de Verenigde Staten van Amerika moeten tot dit minimumaantal van vijf behoren.

11.2. Indien echter niet binnen vijftien maanden na de in paragraaf 10.1 genoemde datum wordt voldaan aan paragraaf 11.1 van dit artikel, treden deze Overeenkomst en de bijlagen, die integrerende delen van de Overeenkomst vormen, in werking op de dertigste dag na de datum waarop ten minste acht landen en/of organisaties voor regionale economische integratie Overeenkomstsluitende Partij zijn geworden overeenkomstig artikel 9. Deze datum van inwerkingtreding moet minstens zestien maanden na de in paragraaf 10.1 genoemde datum vallen. Ten minste één van de bovengenoemde acht moet de Europese Gemeenschap, Japan of de Verenigde Staten van Amerika zijn.

11.3. Voor landen of organisaties voor regionale economische integratie, die na de inwerkingtreding van de Overeenkomst Overeenkomstsluitende Partij worden, treedt deze Overeenkomst in werking zestig dagen na de datum waarop dit land of deze organisatie voor regionale economische integratie zijn/haar akte van bekrachtiging, aanvaarding, goedkeuring of toetreding nederlegt.

Artikel 12 Opzegging van de overeenkomst

12.1. Een Overeenkomstsluitende Partij kan deze Overeenkomst opzeggen door middel van schriftelijke mededeling aan de Secretaris-Generaal.

12.2. De opzegging van deze Overeenkomst door een Overeenkomstsluitende Partij wordt van kracht één jaar na de datum waarop de Secretaris-Generaal de mededeling overeenkomstig paragraaf 12.1 van dit artikel heeft ontvangen.

Artikel 13 Wijziging van de overeenkomst

13.1. Een Partij kan wijzigingen van deze Overeenkomst en de bijlagen bij deze Overeenkomst voorstellen. De voorgestelde wijzigingen worden bij de Secretaris-Generaal ingediend, die ze doorzendt naar alle Overeenkomstsluitende Partijen.

13.2. Een overeenkomstig paragraaf 13.1 van dit artikel doorgezonden voorgestelde wijziging wordt door het Uitvoerend Comité op zijn eerstvolgende vergadering behandeld.

13.3. Indien er met eenparigheid van stemmen van de aanwezige en stemmende Overeenkomstsluitende Partijen vóór de wijziging wordt gestemd, wordt dit door het Uitvoerend Comité medegedeeld aan de Secretaris-Generaal, die vervolgens de wijziging toezendt aan alle Overeenkomstsluitende Partijen.

13.4. Een krachtens paragraaf 13.3 van dit artikel toegezonden wijziging wordt geacht door alle Partijen te zijn aanvaard, indien geen enkele Partij bezwaar maakt binnen zes maanden na de datum van toezending. Indien er geen bezwaar is gemaakt, treedt de wijziging voor alle Partijen in werking drie maanden na het verstrijken van de in deze paragraaf genoemde zes maanden.

13.5. Indien er tegen de voorgestelde wijziging bezwaar is gemaakt, deelt de Secretaris-Generaal dit zo spoedig mogelijk aan alle partijen mede. Indien er bezwaar is gemaakt, wordt de wijziging geacht niet te zijn aanvaard, en wordt zij op geen enkele wijze van kracht.

Artikel 14 Depositaris

De Secretaris-Generaal van de Verenigde Naties is depositaris van de Overeenkomst. Naast zijn andere functies als depositaris is het de taak van de Secretaris-Generaal om zo spoedig mogelijk de partijen in kennis te stellen van:

14.1. de opname of verwijdering van technische reglementen krachtens artikel 5;

14.2. de vastlegging of wijziging van mondiale technische reglementen krachtens artikel 6;

14.3. ontvangen mededelingen overeenkomstig artikel 7;

14.4. ondertekeningen, aanvaardingen en toetredingen overeenkomstig de artikelen 9 en 10;

14.5. ontvangen mededelingen overeenkomstig artikel 9;

14.6. de data waarop deze Overeenkomst voor de Overeenkomstsluitende Partijen van kracht wordt overeenkomstig artikel 11;

14.7. ontvangen mededelingen van opzegging van deze Overeenkomst overeenkomstig artikel 12;

14.8. de data van inwerkingtreding van eventuele wijzigingen van deze Overeenkomst overeenkomstig artikel 13;

14.9. ontvangen mededelingen overeenkomstig artikel 15 met betrekking tot grondgebieden.

Artikel 15 Uitbreiding van de overeenkomst tot grondgebieden

15.1. Deze Overeenkomst strekt zich uit tot het grondgebied of de grondgebieden van een Overeenkomstsluitende Partij, voor de internationale betrekkingen waarvan genoemde Overeenkomstsluitende Partij verantwoordelijk is, tenzij de Overeenkomstsluitende Partij vóór het van kracht worden van de Overeenkomst voor die Partij anders bepaalt.

15.2. Een Overeenkomstsluitende Partij kan deze Overeenkomst voor ieder van deze grondgebieden afzonderlijk opzeggen overeenkomstig artikel 12.

Artikel 16 Secretariaat

Het secretariaat van deze Overeenkomst wordt vervuld door de Uitvoerend Secretaris van de VN/ECE. De Uitvoerend Secretaris verricht de volgende secretariaatswerkzaamheden:

16.1. voorbereiding van de bijeenkomsten van het Uitvoerend Comité en de werkgroepen;

16.2. doorzending aan de Overeenkomstsluitende Partijen van rapporten en andere informatie die overeenkomstig de bepalingen van deze Overeenkomst zijn ontvangen; en

16.3. vervulling van de door het Uitvoerend Comité toegewezen functies.

Bijlage A

Definities

Voor de toepassing van deze Overeenkomst gelden de volgende definities:

1. Met betrekking tot de krachtens deze Overeenkomst opgestelde mondiale technische reglementen wordt onder „aanvaarden" verstaan de handeling waarbij een Overeenkomstsluitende Partij toestaat dat producten die aan een mondiaal technisch reglement voldoen op haar markt worden gebracht zonder dat het mondiaal technisch reglement in haar respectievelijke wetgeving en regelgeving wordt opgenomen.

2. Met betrekking tot de krachtens deze Overeenkomst ontwikkelde mondiale technische reglementen wordt met „opnemen" bedoeld de invoering van een mondiaal technisch reglement in de wetgeving en regelgeving van een Overeenkomstsluitende Partij.

3. Met betrekking tot de krachtens deze Overeenkomst ontwikkelde mondiale technische reglementen wordt met „toepassen" de handeling bedoeld waarbij een Overeenkomstsluitende Partij vanaf een bepaalde datum overeenstemming met een mondiaal technisch reglement verplicht stelt; met andere woorden, het op een bepaalde datum van kracht laten worden van het reglement binnen het rechtsgebied van de Overeenkomstsluitende Partij.

4. Met „artikel" wordt een artikel van deze Overeenkomst bedoeld.

5. Er is sprake van „eenparigheid van stemmen", wanneer bij een stemming over een bepaalde zaak geen enkele aanwezige en stemmende Overeenkomstsluitende Partij tegenstemt overeenkomstig paragraaf 7.2 van artikel 7 van bijlage B.

6. Met „Overeenkomstsluitende Partij" wordt bedoeld een land of een organisatie voor regionale economische integratie die partij is bij deze Overeenkomst.

7. Met „uitrustingsstukken en onderdelen die kunnen worden aangebracht en/of gebruikt op wielvoertuigen" worden uitrusting of onderdelen bedoeld met eigenschappen op het gebied van veiligheid, milieubescherming, energie-efficiëntie of diefstalbeveiliging. Tot deze uitrusting en onderdelen behoren onder meer uitlaatsystemen, banden, motoren, geluiddempende voorzieningen, tegen diefstal beveiligde alarminstallaties, signaalinrichtingen en kinderzitjes.

8. Met „vastgelegd mondiaal technisch reglement" wordt bedoeld een technisch reglement dat is vastgelegd in het Wereldregister overeenkomstig deze Overeenkomst.

9. Met „opgenomen technisch reglement" wordt bedoeld een nationaal of regionaal technisch reglement dat in het Compendium of Candidates is opgenomen overeenkomstig deze Overeenkomst.

10. Met „fabrikantenverklaring" wordt bedoeld de wettelijke eis van de Overeenkomstsluitende Partij dat een fabrikant van wielvoertuigen, uitrustingsstukken en onderdelen die kunnen worden aangebracht en/of gebruikt op wielvoertuigen moet verklaren dat ieder voertuiguitrustingsstuk of onderdeel dat de fabrikant in de handel brengt aan bepaalde technische eisen voldoet.

11. Met „organisatie voor regionale economische integratie" wordt bedoeld een door soevereine landen opgerichte en daaruit bestaande organisatie die bevoegd is met betrekking tot onder deze Overeenkomst vallende zaken, en die het gezag heeft om met betrekking tot die zaken besluiten te nemen die bindend zijn voor alle lidstaten.

12. Met „Secretaris-Generaal" wordt bedoeld de Secretaris-Generaal van de Verenigde Naties.

13. Met „doorzichtige procedures" wordt bedoeld procedures die tot doel hebben de bewustwording en de inspraak van het publiek in het wetgevingsproces te bevorderen in het kader van deze Overeenkomst. Zij omvatten publicatie van:

    • 1. notulen van bijeenkomsten van de werkgroepen en het Uitvoerend Comité; en

    • 2. werkdocumenten en slotdocumenten.

    • Zij voorzien ook in de gelegenheid om standpunten en argumenten naar voren te brengen op:

    • 1. bijeenkomsten van werkgroepen door middel van organisaties met een raadgevende status; en

    • 2. bijeenkomsten van werkgroepen en van het Uitvoerend Comité via voorafgaand overleg met vertegenwoordigers van de Overeenkomstsluitende Partijen.

14. Met „typegoedkeuring" wordt bedoeld de schriftelijke bevestiging door een Overeenkomstsluitende Partij (of een door een Overeenkomstsluitende Partij aangewezen bevoegde instantie) dat een voertuig en/of uitrustingsstuk en/of onderdeel dat kan worden aangebracht en/of gebruikt op een voertuig aan de bepaalde technische eisen voldoet, welke geldt als allereerste vereiste waaraan bij het in de handel brengen van het voertuig, het uitrustingsstuk of het onderdeel moet worden voldaan.

15. Met „VN/ECE-reglementen" wordt bedoeld de krachtens de Overeenkomst van 1958 aangenomen reglementen van de Economische Commissie voor Europa van de Verenigde Naties.

16. Met „werkgroep" wordt bedoeld een onder de ECE ressorterend technisch gespecialiseerd hulporgaan, dat tot taak heeft aanbevelingen op te stellen inzake de vaststelling van in het Wereldregister op te nemen geharmoniseerde of nieuwe mondiale technische reglementen, en wijzigingen te bestuderen van de in het Wereldregister opgenomen mondiale technische reglementen.

17. Met de „Overeenkomst van 1958" wordt bedoeld de Overeenkomst betreffende het aannemen van eenvormige technische eisen voor wielvoertuigen, uitrustingsstukken en onderdelen die kunnen worden aangebracht en/of gebruikt op wielvoertuigen en de voorwaarden voor wederzijdse erkenning van goedkeuringen verleend op basis van deze eisen.


Bijlage B

Samenstelling en huishoudelijk reglement van het Uitvoerend Comité

Artikel 1

De leden van het Uitvoerend Comité zijn uitsluitend Overeenkomstsluitende Partijen.

Artikel 2

Alle Overeenkomstsluitende Partijen zijn leden van het Uitvoerend Comité.

Artikel 3

3.1. Onverminderd het bepaalde in paragraaf 3.2 van dit artikel heeft iedere Overeenkomstsluitende Partij een stem.

3.2. Indien een organisatie voor regionale economische integratie en één of meer van haar lidstaten Overeenkomstsluitende Partijen zijn, heeft de organisatie voor economische integratie in zaken die onder haar bevoegdheid vallen het recht om te stemmen met een aantal stemmen dat gelijk is aan het aantal van haar lidstaten dat Overeenkomstsluitende Partij is. Een dergelijke organisatie maakt geen gebruik van haar stemrecht, wanneer één van haar lidstaten dit recht gebruikt, en omgekeerd.

Artikel 4

Om haar eigen stem te kunnen uitbrengen moet een Overeenkomstsluitende Partij aanwezig zijn. Een Overeenkomstsluitende Partij behoeft niet aanwezig te zijn, wanneer haar organisatie voor regionale economische integratie een stem uitbrengt.

Artikel 5

5.1. Voor een stemming is een quorum vereist van minstens de helft van alle Overeenkomstsluitende Partijen.

5.2. Bij de bepaling van een quorum krachtens dit artikel en bij de bepaling van het aantal Overeenkomstsluitende Partijen dat nodig is voor één derde van de Overeenkomstsluitende Partijen die aanwezig zijn en stemmen krachtens paragraaf 7.1 van artikel 7 van deze bijlage, worden een organisatie voor regionale economische integratie en haar lidstaten als één Overeenkomstsluitende Partij geteld.

Artikel 6

6.1. Het Uitvoerend Comité kiest op de eerste zitting in een kalenderjaar uit zijn leden een voorzitter en een vice-voorzitter. De voorzitter en de vice-voorzitter worden met tweederde meerderheid gekozen door alle aanwezige en stemmende Overeenkomstsluitende Partijen.

6.2. De voorzitter en de vice-voorzitter mogen niet meer dan twee jaar achtereen voor dezelfde Overeenkomstsluitende Partij geleverd worden. In geen enkel jaar mogen de voorzitter en de vice-voorzitter van dezelfde Overeenkomstsluitende Partij afkomstig zijn.

Artikel 7

7.1. Voor het opnemen van nationale of regionale voorschriften in het Compendium of Candidates is hetzij één derde van de aanwezige en stemmende Overeenkomstsluitende Partijen vereist, hetzij één derde van het totale aantal uitgebrachte stemmen, naar gelang van wat het meest bevorderlijk is voor een positief stemmingsresultaat. In beide gevallen dient de stem van de Europese Gemeenschap, Japan of de Verenigde Staten, indien zij Overeenkomstsluitende Partij zijn, tot dat derde deel te behoren.

7.2. Voor de vastlegging van een mondiaal technisch reglement in het Wereldregister, de wijziging van een vastgelegd mondiaal technisch reglement en de wijziging van deze Overeenkomst is eenparigheid van stemmen van de aanwezige en stemmende Overeenkomstsluitende Partijen vereist. Een aanwezige en stemmende Overeenkomstsluitende Partij die bezwaar maakt in een aangelegenheid waarin voor aanname eenparigheid van stemmen vereist is, dient binnen 60 dagen na de datum van de stemming een schriftelijke verklaring voor haar bezwaar bij de Secretaris-Generaal in. Indien genoemde Overeenkomstsluitende Partij verzuimt binnen die termijn een verklaring te geven, wordt zij geacht te hebben voorgestemd in de zaak waarover gestemd is. Als alle Overeenkomstsluitende Partijen die hebben tegengestemd nalaten een verklaring te geven, wordt de stemming beschouwd als een stemming waarbij alle aanwezige en stemmende personen met eenparigheid van stemmen voor de zaak hebben gestemd. In dat geval wordt de datum van de stemming beschouwd als de eerste dag na die periode van 60 dagen.

7.3. Alle overige zaken waarover een besluit moet worden genomen kunnen naar goeddunken van het Uitvoerend Comité worden beslist door middel van de stemprocedure van paragraaf 7.2 van dit artikel.

Artikel 8

Overeenkomstsluitende Partijen die zich van stemming onthouden worden beschouwd als niet-stemmend.

Artikel 9

De Uitvoerend Secretaris roept het Uitvoerend Comité bijeen, wanneer er een stemming vereist is krachtens artikel 5, 6 of 13 van deze Overeenkomst of, wanneer dit nodig is voor de uitvoering van de werkzaamheden in het kader van deze Overeenkomst.


D. PARLEMENT

De Overeenkomst behoeft ingevolge artikel 91 van de Grondwet de goedkeuring van de Staten-Generaal, alvorens het Koninkrijk aan de Overeenkomst kan worden gebonden.

E. BEKRACHTIGING

De volgende staten en organisatie hebben in overeenstemming met artikel 9, tweede lid, van de Overeenkomst een akte van bekrachtiging, aanvaarding of goedkeuring nedergelegd bij de Secretaris-Generaal van de Verenigde Naties:

F. TOETREDING

De volgende Staten hebben in overeenstemming met artikel 9, tweede lid, van de Overeenkomst een akte van toetreding nedergelegd bij de Secretaris-Generaal van de Verenigde Naties:

G. INWERKINGTREDING

De bepalingen van de Overeenkomst, met bijlagen, zijn ingevolge artikel 11, tweede lid, op 25 augustus 2000 in werking getreden.

Voor landen of organisaties voor regionale economische integratie, die na de inwerkingtreding van de Overeenkomst Overeenkomstsluitende Partij worden, treedt deze Overeenkomst in werking zestig dagen na de datum waarop dit land of deze organisatie voor regionale economische integratie zijn/haar akte van bekrachtiging, goedkeuring of toetreding nederlegt.

J. GEGEVENS

De Organisatie van de Verenigde Naties, naar welke Organisatie onder meer wordt verwezen in de preambule tot de onderhavige Overeenkomst, is opgericht bij het op 26 juni 1945 te San Francisco tot stand gekomen Handvest der Verenigde Naties. De Economische en Sociale Raad der Verenigde Naties, naar welke Raad wordt verwezen in artikel 2 van de onderhavige Overeenkomst, is ingesteld bij ditzelfde Handvest. Van dat Handvest zijn de gewijzigde Engelse en Franse tekst geplaatst in Trb. 1979, 37 en is de herziene vertaling geplaatst in Trb. 1987, 113. Zie ook, laatstelijk, Trb. 1998, 145.

De Economische Commissie van de Verenigde Naties voor Europa, naar welke Commissie onder meer wordt verwezen in de preambule tot de onderhavige Overeenkomst, is ingesteld door de Economische en Sociale Raad der Verenigde Naties op 28 maart 1947 bij resolutie 36 (IV). Voor de tekst van het mandaat van deze Commissie, naar welk mandaat wordt verwezen in artikel 2 van de onderhavige Overeenkomst, zie rubriek J van Trb. 1961, 140.

Van de op 20 maart 1958 te Genève tot stand gekomen Overeenkomst betreffende het aannemen van eenvormige technische eisen voor wielvoertuigen, uitrustingsstukken en onderdelen die kunnen worden aangebracht en/of gebruikt op wielvoertuigen en de voorwaarden voor wederzijdse erkenning van goedkeuringen verleend op basis van deze eisen, naar welke Overeenkomst onder meer in de preambule tot de onderhavige Overeenkomst wordt verwezen, zijn de, op 16 oktober 1995 herziene, Engelse en Franse tekst en de bijbehorende vertaling geplaatst in Trb. 1996, 151.

Van de op 12 april 1979 te Genève tot stand gekomen Overeenkomst inzake technische belemmeringen in het handelsverkeer, naar welke Overeenkomst wordt verwezen in de preambule tot de onderhavige Overeenkomst, zijn de Engelse en Franse tekst geplaatst in Trb. 1980, 19 en is de vertaling geplaatst in Trb. 1980, 127. Zie ook Trb. 1981, 153.

Van de op 15 april 1994 te Marrakesh tot stand gekomen Overeenkomst tot oprichting van de Wereldhandelsorganisatie, naar welke organisatie wordt verwezen in de preambule tot de onderhavige Overeenkomst, is de Engelse tekst geplaatst in Trb. 1994, 235 en de vertaling in Trb. 1995, 130.
