Op 28 augustus en 23 oktober 2000 zijn tussen de Nederlandse regering
en de regering van de Socialistische Republiek Vietnam nota's gewisseld met
betrekking tot een clausule inzake overname van eigen onderdanen, waarvan
de inhoud, voor zover van belang, als volgt luidt:

An Agreement regulating development cooperation between the government
of the Kingdom of the Netherlands and the Government of the Socialist Republic
of Vietnam is expected to be signed shortly. It is the present policy of the
Kingdom of the Netherlands to include in bilateral treaties a clause regarding
the readmission of the nationals of both States, unless the circumstances
allow to omit such a clause. In the case of the Agreement mentioned, such
a clause was omitted.
Instead, the Embassy refers to the fact that the Government of Vietnam,
in the Cooperation Agreement between the European Community and the Socialist
Republic of Vietnam signed on 17 July 1995, has recognized the responsibility
of all States, in accordance with basic international principles and practices,
to accept the return of those of its citizens who have left their country
for one reason or another. The Embassy, representing the Kingdom of the Netherlands
as a Member State of the European Community, reaffirms the obligation that
the Kingdom of the Netherlands and the Socialist Republic of Vietnam mutually
consent to readmit any of their nationals illegally present on the territory
of the other State, upon request by that State, and without further formalities
once such persons have been positively identified as such.
The Royal Netherlands Embassy would like to request the Socialist Republic
of Vietnam to reconfirm this obligation once again in writing to the Netherlands
Government.

The Government of the Socialist Republic of Viet Nam has always respected
and implemented strictly all the agreements which the Government of the Socialist
Republic of Viet Nam signed. The Ministry of Foreign Affairs reaffirms, one
more time, the Vietnamese Government's principle of readmitting its citizens
as mentioned in the Cooperation Agreement between the Socialist Republic of
Vietnam and the European Union signed on 17/7/1995 as follows:
«The Government of the Socialist Republic of Viet Nam states that
the repatriation of its citizens will be implemented on the basis of joint
agreements between Vietnam and the relevant countries in order to ensure the
principle of repatration in order and human dignity, in accordance with accepted
international practices and the Comprehensive Plan of Action (CPA) in 1989,
with the financial assistance of international community.»
