The Ministry of Foreign Affairs of the Kingdom of the Netherlands presents
its compliments to the International Criminal Tribunal for the former Yugoslavia
(hereinafter the International Tribunal) and has the honour to draw the attention
of the International Tribunal to the following.
Recalling that the Security Council acting under Chapter VII of the Charter
of the United Nations decided, by paragraph 1 of its resolution 808 (1993)
of 22 February 1993, inter alia ``that an international
tribunal shall be established for the prosecution of persons responsible for
serious violations of international humanitarian law committed in the territory
of the former Yugoslavia since 1991";
Noting that Article 13 of the Statute of the International Tribunal, which
was adopted on 25 May 1993, sets out the provisions relating to the qualifications
and election of the Judges;
Bearing in mind that on 29 July 1994 an Agreement has been concluded between
the Kingdom of the Netherlands and the United Nations concerning the Headquarters
of the International Tribunal for the Prosecution of Persons Responsible for
Serious Violations of International Humanitarian Law Committed in the Territory
of the Former Yugoslavia since 1991 (hereinafter the Headquarters Agreement),
which regulates matters arising from the establishment and necessary for the
proper functioning of the International Tribunal in the Netherlands;
Taking note of Article I, subparagraph (j), of the Headquarters Agreement
which defines ``the Judges" as ``the Judges of the [International] Tribunal
as elected by the General Assembly of the United Nations pursuant to Article
13 of the Statute";
Realising that on 30 November 2000, the UN Security Council adopted at
its 4240th meeting resolution 1329 (2000), by which the Security
Council has decided to increase the composition of the Chambers to allow for
two Judges from the International Tribunal for Rwanda to be assigned to the
Appeals Chamber and to serve as permanent judges of the International Tribunal
as well as to establish a pool of ad litem Judges in the International Tribunal
and to this end decided to amend, among other provisions, Article 13 and 14
of the Statute;
Therefore, the Ministry of Foreign Affairs of the Netherlands proposes
to come to the following agreement:
(1) Article I, subparagraph (j), of the Headquarters Agreement shall be
replaced by the following: ````the Judges" means the Judges of the International
Tribunal:
– as elected or appointed in accordance with Article 13bis of the Statute;
– as appointed in accordance with Article 13 ter, paragraph 2 of the Statute; or
– as assigned in accordance with Article 14, paragraph 4 of the
Statute."
If the above proposal is acceptable to the International Tribunal, the
Ministry has the honour to propose that this Note and the affirmative Note
in reply of the International Tribunal shall constitute an agreement between
the Kingdom of the Netherlands and the International Tribunal. The Agreement
shall enter into force one month after the date of receipt of the affirmative
reply of the International Tribunal.
The Ministry of Foreign Affairs of the Kingdom of the Netherlands avails
itself of this opportunity to renew to the International Criminal Tribunal
of the Former Yugoslavia the assurances of its highest consideration.

The International Criminal Tribunal for the former Yugoslavia (hereinafter
the International Tribunal) presents its compliments to the Ministry of Foreign
Affairs of the Kingdom of the Netherlands and has the honour to acknowledge
the receipt of the latter's Note Verbale no. DJZ/VE-697/01
of 20 July, which reads as follows:

The International Tribunal has further the honour to confirm that the
foregoing is acceptable to the United Nations, and that the Ministry's Note
and this reply shall constitute an agreement between the United Nations and
the Kingdom of the Netherlands on this matter. The Agreement shall enter into
force one month after the date of receipt of this affirmative reply.
The International Criminal Tribunal for the former Yugoslavia avails itself
of this opportunity to renew to the Ministry of Foreign Affairs of the Kingdom
of the Netherlands the assurances of its highest consideration.

D. PARLEMENT
Het in de nota's vervatte verdrag behoeft ingevolge artikel 7, onderdeel
a, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring
van de Staten-Generaal.
G. INWERKINGTREDING
De bepalingen van het in de nota's vervatte verdrag zijn ingevolge het
in de op één na laatste alinea van nota II gestelde op 20 augustus
2001 in werking getreden. Wat het Koninkrijk der Nederlanden betreft, geldt
het verdrag alleen voor Nederland.
J. GEGEVENS
Van het op 26 juni 1945 te San Francisco tot stand gekomen Handvest der
Verenigde Naties, naar welk Handvest onder meer in de tweede alinea van nota
Nr. I wordt verwezen, zijn de gewijzigde Engelse en Franse tekst geplaatst
in Trb. 1979, 37 en de herziene vertaling in Trb. 1987, 113. Zie ook, laatstelijk, Trb. 1998,
145.
De Engelse tekst van Resolutie 808 van de Veiligheidsraad van de Verenigde
Naties d.d. 12 februari 1993, naar welke Resolutie in de tweede alinea van
Nota I wordt verwezen, is afgedrukt in Trb. 1993, 168, blz. 2 e.v.
Het Statuut van het hieronder genoemde Internationaal Tribunaal is opgesteld
ingevolge paragraaf 2 van Resolutie 827 van de Veiligheidsraad van de Verenigde
Naties. De Engelse tekst van de Resolutie en van het Statuut is afgedrukt
in Trb. 1993, 168, blz. 4 e.v.
Van het op 29 juli 1994 te New York tot stand gekomen Verdrag tussen het
Koninkrijk der Nederlanden en de Verenigde Naties betreffende de zetel van
het Internationaal Tribunaal voor de vervolging van personen verantwoordelijk
voor ernstige schendingen van het internationaal humanitair recht op het grondgebied
van het voormalig Joegoslavië sedert 1991, naar welk Verdrag onder meer
in de vierde alinea van Nota Nr. I wordt verwezen, is de tekst geplaatst in Trb. 1994,

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring
en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald
dat het onderhavige verdrag zal zijn bekendgemaakt in Nederland op de dag
na de datum van uitgifte van dit Tractatenblad.
