Bij notawisseling tussen de Nederlandse en de Oekraiense Regering is op 22 oktober 1999 een overeenkomst als bedoeld in artikel 27, vierde lid, van het Verdrag tot stand gekomen betreffende de uitbreiding van het Verdrag tot de Nederlandse Antillen en Aruba. De tekst van de nota's luidt als volgt:

If this proposal is acceptable to the Ukrainian side, the Embassy has the honour further to propose that this note and the Ministry's affirmative reply shall constitute an arrangement as provided for in Article 2, paragraph 4, of the Convention, which shall enter into force on the first day of the third month following the date on which the Embassy receives the Ministry's reply.

Ingevolge artikel 28, eerste lid, van het onderhavige Verdrag is de op 9 oktober 1894 te Boekarest tot stand gekomen Overeenkomst tussen het Koninkrijk der Nederlanden en het Koninkrijk Roemenië tot regeling der wederzijdse uitlevering van misdadigers op 9 december 1997 buiten werking getreden.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat de in rubriek H afgedrukte overeenkomsten met Oekraïne en Moldavië zullen zijn bekendgemaakt op de dag na de datum van uitgifte van dit Tractatenblad.

Onder de volgende verklaringen en voorbehouden:

«Déclarations

Article 1

Le Gouvernement belge considère que la réserve formulée par le Portugal au sujet de l'article premier, alinéa c, n'est pas compatible avec l'objet de la Convention. Il comprend la réserve au sens que l'extradition ne sera refusée que si, conformément au droit de l'Etat requérant, la personne condamnée à perpétuité n'est pas susceptible d'être libérée après l'écoulement d'un certain temps suite à une procédure judiciaire ou administrative.

Article 14

La Belgique considère que la règle de la spécialité n'est pas applicable lorsque la personne réclamée par elle aura consenti expressément à être poursuivie et punie de quelque chef que ce soit et ce devant l'autorité judiciaire de l'Etat requis, si cette possibilité est prévue dans le droit de cet Etat. Si par contre l'extradition est demandée à la Belgique, celle-ci considère que, lorsque la personne à extrader a renoncé formellement aux formalités et garanties de l'extradition, la règle de la spécialité n'est plus applicable.

Article 15

La Belgique considère que l'exception prévue à l'article 15 est étendue, au casoù la personne qui a été remise à la Belgique a renoncé conformément au droit de la Partie requise à la spécialité de l'extradition.

Article 21

Le gouvernement belge n'accordera le transit sur son territoire qu'aux mêmes conditions que celles de l'extradition.

Article 23

Si la demande d'extradition et les documents à produire sont rédigés dans la langue de la Partie requérante et que cette langue n'est ni le néerlandais, ni le français, ni l'allemand, ils doivent être accompagnés d'une traduction en langue française.

Réserves

Article 1

La Belgique se réserve le droit de ne pas accorder l'extradition lorsque l'individu réclamé pourrait être soumis à un tribunal d'exception, ou si l'extradition est demandée en vue de l'exécution d'une peine prononcée par un tel tribunal.

L'extradition ne sera pas accordée lorsque la remise est susceptible d'avoir des conséquences d'une gravité exceptionnelle pour la personne réclamée, notamment en raison de son âge ou de son état de santé.

Article 18

L'obligation de la mise en liberté à l'expiration du délai de 30 jours prévue au paragraphe 4 de l'article 18 ne sera pas applicable dans le cas où l'individu réclamé aura introduit un recours contre la décision d'extradition ou concernant la légalité de sa détention.

Article 19

Le Gouvernement du Royaume de Belgique n'accordera l'extradition temporaire visée à l'article 19, paragraphe 2, que s'il s'agit d'une personne qui subit une peine sur son territoire et si des circonstances particulières l'exigent.

Article 28

En raison du régime particulier entre les pays du Benelux, le Gouvernement belge n'accepte pas les paragraphes 1 et 2 de l'article 28 en ce qui concerne ses rapports avec le Royaume des Pays-Bas et le Grand-Duché de Luxembourg.

Le Gouvernement belge se réserve la faculté de déroger à ces dispositions en ce qui concerne ses rapports avec les autres Etats Membres de la Communauté européenne.».

Onder de volgende verklaringen en het volgende voorbehoud:

«Déclarations

Concernant l'article 6, paragraphe 1.a: La Roumanie n'accordera pas l'extradition de ses citoyens et des personnes auxquelles a été accordé le droit d'asile en Roumanie.

Concernant l'article 6, paragraphe 1.b: Le terme <ressortissants>, au sens de la présente Convention, désigne les citoyens roumains ou les personnes auxquelles a été accordé le droit d'asile en Roumanie.

Concernant l'article 21, paragraphe 5: Des demandes de transit à travers le territoire de la Roumanie d'un citoyen roumain ou d'une personne à laquelle a été accordé le droit d'asile en Roumanie seront refusées.

Réserve

Concernant l'article 2, paragraphe 1: La Roumanie demandera et accordera l'extradition:

– en vue d'une poursuite pénale ou d'un jugement uniquement pour des faits dont l'accomplissement est puni par les lois de la Partie requérante et de la Partie requise d'une peine privative de liberté de plus de deux ans ou d'une peine plus sévère;

– en vue de l'exécution d'une condamnation à une peine privative de liberté uniquement supérieure à un an ou plus sévère.».

De Oostenrijkse Regering heeft naar aanleiding van bovenstaande verklaringen op 5 december 1997 het volgende verklaard:

«Le Gouvernement de l'Autriche déclare que la déclaration de la Roumanie relative à l'article 6, paragraphe 1 (a) et (b) et l'article 21, paragraphe 5, de la Convention est interprétée par l'Autriche de la façon que des personnes qui ont obtenu l'asile en Roumanie seront placées sur un pied d'égalité avec les ressortissants roumains seulement au cas d'une demande d'extradition ou de transit à travers le territoire de la Roumanie de l'Etat de persécution et, dans ce cas, que ces personnes ne seront ni extradées, ni transitées.

La déclaration de la Roumanie relative à l'article 6, paragraphe 1 (a) et (b) et l'article 21, paragraphe 5, n'est compatible avec l'objet et le but de la Convention qu'au cas où l'extradition ou le transit à travers le territoire de la Roumanie à un Etat tiers de personnes qui bénéficient de l'asile en Roumanie n'est pas refusée exclusivement au motif que ces personnes soient traitées en tant que ressortissants roumains.».

Onder de volgende voorbehouden en verklaringen:

«Article 1

La République de Moldova refusera l'extradition lorsque la personne réclamée doit être jugée, sur le territoire de la Partie requérante, par un tribunal d'exception (instituée pour une affaire déterminée), ou, lorsque l'extradition est demandée en vue de l'exécution d'un jugement ou d'une mesure de sûreté prononcée par une instance de même nature.

Article 3, paragraphe 3

La République de Moldova se réserve le droit, en fonction des circonstances, de déterminer si l'attentat à la vie d'un Chef d'Etat ou d'un membre de sa famille constitue ou non une infraction politique.

Article 6, paragraphe 1

Conformément à l'article 17, alinéa 3, de la Constitution de la République de Moldova, les citoyens de la République de Moldova ne peuvent être ni extradés, ni expulsés du pays.

Le terme <ressortissant>, au sens de l'article 6, paragraphe 1, lettre (b), vise toutes les personnes ayant la nationalité de la République de Moldova en conformité avec sa législation.

Article 7, paragraphe 2

La République de Moldova se réserve le droit de refuser l'extradition, dès lors qu'en vertu de l'article 7, paragraphe 2, la Partie requérante refusera l'extradition dans des cas analogues.

Article 9

1. La République de Moldova refusera l'extradition lorsqu'à l'égard de la personne réclamée, un jugement définitif a été prononcé par un Etat tiers pour le ou les faits à raison desquels l'extradition est demandée.

2. Par dérogation à l'article 9 (première phrase), la République de Moldova permettra l'extradition lorsque la Partie requérante prouvera que la survenue de circonstances nouvelles justifie un réexamen de l'affaire.

Article 16, paragraphe 2

La République de Moldova sollicite que toutes les demandes qui lui sont adressées en vertu de l'article 16, paragraphe 2, contiennent une brève description des faits mis à la charge de la personne réclamée y compris les indications essentielles permettant d'apprécier le caractère de l'infraction, conformément à la présente Convention.

Article 21

La République de Moldova se réserve le droit de ne permettre le transit que dans les conditions prévues pour l'extradition.

Article 23

La République de Moldova déclare que la demande d'extradition ainsi que les documents joints doivent être rédigés dans la langue moldave ou dans une des langues officielles du Conseil de l'Europe, ou traduits dans une de ces langues.».

“Article 1

Ukraine reserves the right to refuse extradition if the person whose extradition is requested cannot, on account of his/her state of health, be extradited without damage to his/her health.

Article 2, paragraph 1

Ukraine shall grant extradition only for offences which are punishable by imprisonment for a maximum period of not less than one year or by a more severe penalty.

Article 4

The extradition in respect of general criminal offences which are also military offences may only be granted provided that the person whose extradition is requested will not be subject to criminal prosecution in accordance with martial law.

Article 6, paragraph 1, subparagraphs a and b

Ukraine will not extradite citizens of Ukraine to another State. For the purposes of this Convention, any person is considered to be a citizen of Ukraine who, in accordance with the laws of Ukraine at the time when the decision to extradite is taken, is a citizen of Ukraine.

Article 21, paragraph 5

Ukraine shall allow transit through its territory of persons who are extradited on the same conditions as those on which extradition is granted.

Article 23

Requests for extradition and documents appended thereto shall be sent to Ukraine together with a translation into Ukrainian or into one of the official languages of the Council of Europe unless they are drawn up in those languages.".

Onder de volgende voorbehouden en verklaringen:

“1. Relating to paragraph 1 of Article 2 of the Convention, the Albanian Party has no minimum limits for the term of imprisonment for the effect of extradition. The Albanian Party considers this declaration as valid only in conditions of reciprocity.

2. Relating to paragraph 1, sub-paragraph a, of Article 6, the Albanian Party refuses the extradition of its nationals, unless otherwise provided in the international agreements to which Albania is a Contracting Party.

3. Relating to paragraph 1, sub-paragraph b, of Article 6, the Albanian Party includes in the term `nationals' the `persons with double nationality', in case either of them is Albanian.

4. Relating to paragraph 1 of Article 7, the Albanian Party does not allow the extradition of the persons who have committed offences either in the Albanian territory or outside it, when the offence has injured the interests of the State or of the nationals, unless it is otherwise agreed with the interested Party.

5. Relating to paragraph 2 of Article 19, the Albanian Party declares that when a person asked to be surrendered is serving a sentence for another offence, he or she, in the event of extradition, shall be permitted to serve the full sentence in the requesting country.

6. Relating to paragraph 4, sub-paragraph a, of Article 21, the Albanian Party declares that prior notification is not necessary in cases of transit by air that does not schedule a landing in Albanian territory.

The declarations contained in paragraphs 1, 4 and 5 are valid only in conditions of reciprocity.

7. Relating to paragraph 2 of Article 12, the Albanian Party presents the reservation that the request for extradition must be accompanied always by the original text, or authenticated copy of the applied law.".

Onder de volgende voorbehouden en verklaring:

“The Republic of Macedonia, with regard to Article 6 of the Convention, makes the following declaration:

Taking into account Article 4 of the Constitution of the Republic of Macedonia, which does not allow the extradition of the citizens of the Republic of Macedonia, the provisions of this Convention shall only apply to the persons which are not citizens of the Republic of Macedonia.

The Republic of Macedonia, with regard to the Articles 1, 12 and 18 of the Convention, makes the following reservations:

Reservation on Article 1:

The Republic of Macedonia shall not agree to surrender the person claimed, if this person is charged by an extraordinary court, or in cases where the surrender is requested for the purposes of executing a sentence, safety measure or correctional measure that was passed by such a court.

Reservation on Article 12:

Even in the cases where the final sentence or the arrest warrant are passed by the competent authorities in a country which is Party to this Convention, the Republic of Macedonia reserves the right to refuse the requested surrender, if an examination of the case in question shows that the said sentence or arrest warrant are manifestly ill-founded.

Reservation on Article 18:

In the event that the person claimed has not been taken over by the requesting Party, on the appointed date, the Republic of Macedonia reserves the right to annul the measure of restraint imposed on that person.".

De Regering van Hongarije heeft op 25 februari 1999 het bij de bekrachtiging gemaakte voorbehoud met betrekking tot artikel 6 gewijzigd. Het gewijzigde voorbehoud luidt als volgt:

“a. Notwithstanding the provisions of Article 6, paragraph 1.a, of the Peace Treaty concluded in Paris on 10 February 1947, Hungary will not grant extradition of its own nationals, except in the case where the person sought for extradition is also a citizen of an other State and has his permanent residence in a foreign State. Irrespective of his permanent residence and his incidental other citizenship, a Hungarian citizen may be transferred to another State, if the extradition of such a person to Hungary was granted under the condition that, following completion of the criminal proceedings or the execution of the sentence against him, he would be transferred back to that State for the purposes of fulfilling the request for extradition.

b. Hungary reserves the right to refuse extradition of persons settled definitively in Hungary.".

“In regard to Article 23 of the Convention, the Government of the State of Israel requests that the documents to be produced by the requesting Party be translated into English or Hebrew.".
