Protocol on the Authentic Six-Language Text of the Convention on International Civil Aviation (Chicago, 1944)

The undersigned Governments

Considering that the 31st Session of the Assembly, in Resolution A31–16, requested inter alia, the Council and the Secretary General to take the necessary measures to intensify the progressive use of the Chinese language in the International Civil Aviation Organization (ICAO) and to closely monitor these measures with the objective of achieving the utilization of the Chinese language in ICAO on the same level as the other languages in the Organization;

Considering that the English text of the Convention on International Civil Aviation (hereinafter called the Convention) was opened for signature at Chicago on 7 December 1944;

Considering that, pursuant to the Protocol signed at Buenos Aires on 24 September 1968 on the Authentic Trilingual Text of the Convention on International Civil Aviation done at Chicago, 7 December 1944, the text of the Convention was adopted in the French and Spanish languages and, together with the text of the Convention in the English language, constitutes the text equally authentic in the three languages as provided for in the final clause of the Convention;

Considering that a Protocol Relating to an Amendment to the Convention on International Civil Aviation and a Protocol on the Authentic Quadrilingual Text of the Convention on International Civil Aviation (Chicago, 1944) were adopted on 30 September 1977, providing for the authenticity of the text of the Convention and amendments thereto in the Russian language;

Considering that a Protocol Relating to an Amendment to the Convention on International Civil Aviation and a Protocol on the Authentic Quinquelingual Text of the Convention on International Civil Aviation (Chicago, 1944) were adopted on 29 September 1995, providing for the authenticity of the text of the Convention and amendments thereto in the Arabic language;

Considering accordingly, that it is appropriate to make the necessary provision for the text of the Convention to exist in the Chinese language;

Considering that in making such provision account must be taken of the existing amendments to the Convention in the English, Arabic, French, Russian and Spanish languages, the texts of which are equally authentic and that, according to Article 94(a) of the Convention, any amendment can come into force only in respect of any State which has ratified it;

Have agreed as follows:

Article I

The text of the Convention and of the amendments thereto in the Chinese language annexed to this Protocol, together with the text of the Convention and of the amendments thereto in the English, Arabic, French, Russian and Spanish languages, constitutes a text equally authentic in the six languages.

Article II

If a State party to this Protocol has ratified or in the future ratifies any amendment made to the Convention in accordance with Article 94(a) thereof, then the text of such amendment in the English, Arabic, Chinese, French, Russian and Spanish languages shall be deemed to refer to the text equally authentic in the six languages, which results from this Protocol.

Article III

1. The States members of the International Civil Aviation Organization may become parties to the present Protocol either by:

• a) signature without reservation as to acceptance, or

• b) signature with reservation as to acceptance followed by acceptance, or

• c) acceptance.

2. This Protocol shall remain open for signature at Montreal until 16 October 1998 and thereafter at Washington, D.C.

3. Acceptance shall be effected by the deposit of an instrument of acceptance with the Government of the United States of America.

4. Adherence to or ratification or approval of this Protocol shall be deemed to be acceptance thereof.

Article IV

1. This Protocol shall come into force on the thirtieth day after twelve States shall, in accordance with the provisions of Article III, have signed it without reservation as to acceptance or accepted it and after entry into force of the amendment to the final clause of the Convention adopted on 1 October 1998, which provides that the text of the Convention in the Chinese language is of equal authenticity.

2. As regards any State which shall subsequently become a party to this Protocol in accordance with Article III, the Protocol shall come into force on the date of its signature without reservation as to acceptance or of its acceptance.

Article V

Any adherence of a State to the Convention after this Protocol has entered into force shall be deemed to be acceptance of this Protocol.

Article VI

Acceptance by a State of this Protocol shall not be regarded as ratification by it of any amendment to the Convention.

Article VII

As soon as this Protocol comes into force, it shall be registered with the United Nations and with the International Civil Aviation Organization by the Government of the United States of America.

Article VIII

1. This Protocol shall remain in force so long as the Convention is in force.

2. This Protocol shall cease to be in force for a State only when that State ceases to be a party to the Convention.

Article IX

The Government of the United States of America shall give notice to all States members of the International Civil Aviation Organization and to the Organization itself:

• a) of any signature of this Protocol and the date thereof, with an indication whether the signature is with or without reservation as to acceptance;

• b) of the deposit of any instrument of acceptance and the date thereof;

• c) of the date on which this Protocol comes into force in accordance with the provisions of Article IV, paragraph 1.

Article X

This Protocol, drawn up in the English, Arabic, Chinese, French, Russian and Spanish languages, each text being equally authentic, shall be deposited in the archives of the Government of the United States of America, which shall transmit duly certified copies thereof to the Governments of the States members of the International Civil Aviation Organization.

IN WITNESS WHEREOF, the undersigned Plenipotentiaries, duly authorized, have signed this Protocol.

DONE at Montreal on the first day of October of the year one thousand nine hundred and ninety-eight.

Protocole concernant le texte authentique en six langues de la Convention relative à l'aviation civile internationale (Chicago, 1944)

Les Gouvernements soussignés

Considérant que l'Assemblée (31e session), par sa Résolution A3l-16, a demandé notamment au Conseil et au Secrétaire général de prendre les mesures nécessaires pour intensifier 1'emploi progressif de la langue chinoise à l'Organisation de l'aviation civile internationale (OACI) et de suivre attentivement ces mesures dans le but de s'assurer que l'emploi de la langue chinoise à l'OACI atteindra le même niveau que celui des autres langues de 1'Organisation;

Considérant que la Convention relative à l'aviation civile internationale (nommée ci-après «la Convention») a été ouverte à la signature à Chicago le 7 décembre 1944, dans un texte en langue anglaise;

Considérant que, en vertu du Protocole signé à Buenos Aires le 24 septembre 1968 concernant le texte authentique trilingue de la Convention faite à Chicago le 7 décembre 1944, le texte de cette convention a été adopté en langues française et espagnole et constitue, conjointement avec le texte en langue anglaise de la Convention, le texte faisant également foi dans ces trois langues tel qu'il est prévu dans la clause finale de la Convention;

Considérant qu'un Protocole concernant un amendement de la Convention relative à l'aviation civile internationale et un Protocole concernant le texte authentique quadrilingue de la Convention relative à l'aviation civile internationale (Chicago, 1944) ont été adoptés le 30 septembre 1977, attestant l'authenticité du texte en langue russe de la Convention et de ses amendements;

Considérant qu'un Protocole concernant un amendement de la Convention relative à l'aviation civile internationale et un Protocole concernant le texte authentique quinquélingue de la Convention relative à l'aviation civile internationale (Chicago, 1944) ont été adoptés le 29 septembre 1995, attestant l'authenticité du texte en langue arabe de la Convention et de ses amendements;

Considérant en conséquence qu'il convient de prendre les dispositions nécessaires pour qu'existe un texte de la Convention en langue chinoise;

Estimant que lors de l'adoption desdites dispositions il est nécessaire de tenir compte de l'existence d'amendements de la Convention en langues française, anglaise, arabe, espagnole et russe, ces textes faisant également foi et chacun de ces amendements ne pouvant, en vertu de l'article 94, alinéa a), de la Convention, entrer en vigueur qu'à l'égard des États qui l'ont ratifié;

Sont convenus de ce qui suit:

Article premier

Le texte en langue chinoise de la Convention et de ses amendements annexé au présent Protocole constitue, conjointement avec le texte en langues française, anglaise, arabe, espagnole et russe de la Convention et de ses amendements, un texte faisant également foi dans les six langues.

Article II

Lorsqu'un État Partie au présent Protocole a ratifié ou ratifie ultérieurement un amendement apporté à la Convention, conformément aux dispositions de l'article 94, alinéa a), de celle-ci, le texte en langues française, anglaise, arabe, chinoise, espagnole et russe de cet amendement est réputé se référer au texte faisant également foi dans les six langues qui résulte du présent Protocole.

Article III

1. Les États membres de l'Organisation de l'aviation civile internationale peuvent devenir parties au présent Protocole:

• a) soit en le signant, sans réserve d'acceptation;

• b) soit en le signant, sous réserve d'acceptation, suivie d'acceptation;

• c) soit en l'acceptant.

2. Le présent Protocole restera ouvert à la signature à Montréal jusqu'au 16 octobre 1998 et après cette date à Washington (D.C.).

3. L'acceptation est effectuée par le dépôt d'un instrument d'acceptation auprès du Gouvernement des États-Unis d'Amérique.

4. L'adhésion au présent Protocole, sa ratification ou son approbation est considérée comme acceptation du Protocole.

Article IV

1. Le présent Protocole entrera en vigueur le trentième jour après que douze États l'auront signé sans réserve d'acceptation ou accepté, conformément aux dispositions de l'article III, et après que l'amendement de la clause finale de la Convention adopté le ler octobre 1998, selon lequel le texte de la Convention en langue chinoise fait également foi, sera entré en vigueur.

2. En ce qui concerne tout État qui deviendra ultérieurement partie au présent Protocole, conformément aux dispositions de l'article III, le Protocole entrera en vigueur à la date de sa signature sans réserve d'acceptation ou à la date de son acceptation.

Article V

L'adhésion d'un État à la Convention après l'entrée en vigueur du présent Protocole vaut acceptation du présent Protocole.

Article VI

L'acceptation du présent Protocole par un État n'est pas considérée comme ratification par cet État d'un amendement quelconque de la Convention.

Article VII

Dès son entrée en vigueur, le présent Protocole sera enregistré par le Gouvernement des États-Unis d'Amérique auprès de l'Organisation des Nations Unies et auprès de l'Organisation de l'aviation civile internationale.

Article VIII

1. Le présent Protocole reste en vigueur aussi longtemps que la Convention est en vigueur.

2. Le présent Protocole cesse d'être en vigueur à l'égard d'un État, seulement lorsque cet État cesse d'être partie à la Convention.

Article IX

Le Gouvernement des États-Unis d'Amérique notifie à tous les États membres de l'Organisation de l'aviation civile internationale et à l'Organisation elle-même:

• a) toute signature du présent Protocole et la date de cette signature, en indiquant si la signature a été apposée sans ou sous réserve d'acceptation;

• b) le dépôt de tout instrument d'acceptation et la date de ce dépôt;

• c) la date à laquelle le présent Protocole est entré en vigueur, conformément aux dispositions de son article IV, paragraphe 1.

Article X

Le présent Protocole, rédigé dans les langues française, anglaise, arabe, chinoise, espagnole et russe, chaque texte faisant également foi, sera déposé aux archives du Gouvernement des États-Unis d'Amérique, qui en transmettra des copies dûment certifiées conformes aux gouvernements des États membres de l'Organisation de 1'aviation civile internationale.

EN FOI DE QUOI, les Plénipotentiaires soussignés, dûment autorisés, ont apposé leur signature au présent Protocole.

FAIT à Montréal, le premier octobre mil neuf cent quatre-vingt-dix-huit.

D. PARLEMENT

Het onderhavige Protocol behoeft ingevolge artikel 7, onderdeel b, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring der Staten-Generaal.

E. BEKRACHTIGING

De volgende Staat heeft in overeenstemming met artikel III, derde en vierde lid, het Protocol aanvaard:

G. INWERKINGTREDING

De bepalingen van het Protocol zullen ingevolge artikel IV, eerste lid, in werking treden op de dertigste dag nadat twaalf Staten in overeenstemming met de bepalingen van artikel III het Protocol hebben ondertekend zonder voorbehoud met betrekking tot aanvaarding of het hebben aanvaard en na inwerkingtreding van het in rubriek J hieronder ge- noemde Protocol van 1 oktober 1998 tot wijziging van het Verdrag inzake de internationale burgerluchtvaart.

J. GEGEVENS

Van het op 17 december 1944 te Chicago tot stand gekomen Verdrag inzake de internationale burgerluchtvaart is de Engelse tekst geplaatst inStb.  H 165 en de vertaling in Trb. 1973, 109; zie ook, laatstelijk, Trb. 1996, 32. In laatstgenoemd Tractatenblad is een overzicht van de wijzigingen en aanvullingen van het Verdrag opgenomen.

Van het Handvest van de Verenigde Naties – naar de Verenigde Naties wordt in artikel VII van het onderhavige Protocol verwezen – zijn de Engelse en Franse tekst, zoals gewijzigd, geplaatst in Trb. 1979, 37 en de vertaling, zoals gewijzigd, in Trb. 1987, 113; zie ook, laatstelijk, Trb. 1998, 145.

Van het op 24 september 1968 te Buenos Aires tot stand gekomen Protocol betreffende de authentieke tekst in drie talen van het op 7 december 1944 te Chicago tot stand gekomen Verdrag inzake de internationale burgerluchtvaart, naar welk Protocol in de preambule tot het onderhavige Protocol wordt verwezen, zijn de Engelse en Franse tekst geplaatst in Trb. 1970, 60; zie ook, laatstelijk, Trb. 1996, 39.

Van het op 30 september 1977 te Montreal tot stand gekomen Protocol houdende wijziging van het Verdrag inzake de internationale burgerluchtvaart, naar welk Protocol in de preambule tot het onderhavige Protocol wordt verwezen, zijn de Engelse en Franse tekst, alsmede de vertaling geplaatst in Trb. 1978, 124; zie ook Trb. 1996, 43.

Van het op 30 september 1977 te Montreal tot stand gekomen Protocol betreffende de authentieke tekst in vier talen van het op 7 december 1944 te Chicago tot stand gekomen Verdrag inzake de burgerluchtvaart, naar welk Protocol in de preambule tot het onderhavige Protocol wordt verwezen, zijn de Engelse en Franse tekst geplaatst in Trb. 1979, 87; zie ook Trb. 1996, 44.

Van het op 29 september 1995 te Montreal tot stand gekomen Protocol houdende wijziging van het Verdrag inzake de internationale burgerluchtvaart, naar welk Protocol in de preambule tot het onderhavige Protocol wordt verwezen, zijn de Engelse en Franse tekst geplaatst in Trb. 1996, 263.

Van het op 29 september 1995 te Montreal tot stand gekomen Protocol betreffende de authentieke tekst in vijf talen van het op 7 december 1944 te Chicago tot stand gekomen Verdrag inzake de internationale burgerluchtvaart, naar welk Protocol in de preambule tot het onderhavige Protocol wordt verwezen, zijn de Engelse en Franse tekst geplaatst in Trb. 1996, 262.

Van het op 1 oktober 1998 te Montreal tot stand gekomen Protocol tot wijziging van het op 17 december 1944 te Chicago tot stand gekomen Verdrag inzake de internationale burgerluchtvaart, naar welk Protocol wordt verwezen in artikel IV, eerste lid, van het onderhavige Protocol, zijn de Engelse en Franse tekst geplaatst in Trb. 1999, 47.
