Protocol relating to an amendment to the Convention on International Civil Aviation

Signed at Montreal on 1 October 1998

The Assembly of the International Civil Aviation Organization

Having met in its Thirty-second Session at Montreal on 22 September 1998,

Having noted that it is the general desire of Contracting States to take action to ensure that the Convention on International Civil Aviation done at Chicago on 7 December 1944 is available as the authentic Chinese text,

Having considered it necessary to amend the said Convention, for the purpose aforesaid,

1. Approves, in accordance with the provisions of Article 94(a) of the Convention aforesaid, the following proposed amendment which is to replace the present text of the final paragraph of the said Convention:

“Done at Chicago the seventh day of December 1944 in the English language. The texts of this Convention drawn up in the English, Arabic, Chinese, French, Russian and Spanish languages are of equal authenticity. These texts shall be deposited in the archives of the Government of the United States of America, and certified copies shall be transmitted by that Government to the Governments of all the States which may sign or adhere to this Convention. This Convention shall be open for signature at Washington, D.C.",

2. Specifies, pursuant to the provisions of the said Article 94(a) of the said Convention, one hundred and twenty-four as the number of Contracting States upon whose ratification the proposed amendment aforesaid shall come into force, and

3. Resolves that the Secretary General of the International Civil Aviation Organization draw up a Protocol in the English, Arabic, Chinese, French, Russian and Spanish languages each of which shall be of equal authenticity embodying the proposed amendment above mentioned and the matter hereinafter appearing.

Consequently, pursuant to the aforesaid action of the Assembly,

This Protocol has been drawn up by the Secretary General of the Organization.

The Protocol shall be open to ratification by any State which has ratified or adhered to the said Convention on International Civil Aviation.

The instruments of ratification shall be deposited with the International Civil Aviation Organization.

The Protocol shall come into force in respect of the States which have ratified it on the date on which the one hundred and twenty-fourth instrument of ratification is so deposited.

The Secretary General shall immediately notify all Contracting States of the date of deposit of each ratification of the Protocol.

The Secretary General shall immediately notify all States parties to the said Convention of the date on which the Protocol comes into force.

With respect to any Contracting State ratifying the Protocol after the date aforesaid, the Protocol shall come into force upon deposit of its instrument of ratification with the International Civil Aviation Organization.

IN WITNESS WHEREOF the President of the aforesaid Thirty-second Session of the Assembly and the Secretary General of the Organization, being authorised thereto by the Assembly, sign this Protocol.

DONE at Montreal on the first day of October of the year one thousand nine hundred and ninety-eight, in a single document in the English, Arabic, Chinese, French, Russian, and Spanish languages, each of which shall be of equal authenticity. This Protocol shall remain deposited in the archives of the International Civil Aviation Organization, and certified copies thereof shall be transmitted by the Secretary General of the Organization to all States parties to the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944.

Protocole concernant un amendement de la Convention relative à l'aviation civile internationale

Signé à Montréal le 1er octobre 1998

L'assemblée de l'organisation de l'aviation civile internationale,

S'étant réunie, lors de sa trente-deuxième session à Montréal, le 22 septembre 1998,

Ayant noté que les États contractants ont manifesté le désir général que des mesures soient prises pour garantir qu'un texte authentique en langue chinoise de la Convention relative à l'aviation civile internationale faite à Chicago le 7 décembre 1944 sera disponible,

Ayant jugé nécessaire d'amender ladite Convention, aux fins précitées,

1. Approuve, conformément aux dispositions de l'article 94, alinéa a), de ladite Convention, l'amendement ci-après, visant à remplacer le texte actuel du dernier paragraphe de la Convention par le texte ci-après:

«Fait à Chicago, le septième jour du mois de décembre 1944, en langue anglaise. Les textes de la présente Convention rédigés dans les langues française, anglaise, arabe, chinoise, espagnole et russe font également foi. Ces textes seront déposés aux archives du Gouvernement des États-Unis d'Amérique et des copies certifiées conformes seront transmises par ce gouvernement aux gouvernements de tous les États qui signeront la présente Convention ou y adhéreront. La présente Convention sera ouverte à la signature à Washington (D.C.).»

2. Fixe, conformément aux dispositions dudit article 94, alinéa a), de ladite Convention, à cent vingt-quatre le nombre d'États contractants dont la ratification dudit amendement proposé est nécessaire pour que ledit amendement entre en vigueur.

3. Décide que le Secrétaire général de l'Organisation de l'aviation civile internationale établira un protocole dans les langues française, anglaise, arabe, chinoise, espagnole et russe, chaque texte faisant également foi, incorporant l'amendement proposé précité et les éléments ci-après.

En conséquence, conformément à la décision ci-dessus de l'Assemblée,

Le présent Protocole a été établi par le Secrétaire général de l'Organisation.

Le Protocole sera ouvert à la ratification de tout État qui aura ratifié ladite Convention relative à l'aviation civile internationale ou y aura adhéré.

Les instruments de ratification seront déposés auprès de l'Organisation de l'aviation civile internationale.

Le Protocole entrera en vigueur à l'égard des États qui l'auront ratifié à la date à laquelle le cent vingt-quatrième instrument de ratification aura été déposé.

Le Secrétaire général avisera immédiatement tous les États contractants de la date de dépôt de chaque ratification du Protocole.

Le Secrétaire général avisera immédiatement tous les États parties à ladite Convention de la date à laquelle le Protocole entrera en vigueur.

À l'égard de tout État contractant qui ratifiera le Protocole après ladite date, le Protocole entrera en vigueur à la date du dépôt de son instrument de ratification auprès de l'Organisation de l'aviation civile internationale.

EN FOI DE QUOI, le Président de la trente-deuxième session de l'Assemblée et le Secrétaire général de l'Organisation, dûment autorisés à cet effet par l'Assemblée, apposent leur signature au présent Protocole.

FAIT à Montréal le premier octobre mil neuf cent quatre-vingt-dix-huit, en un seul document dans les langues française, anglaise, arabe, chinoise, espagnole et russe, chacun des textes faisant également foi. Le présent Protocole sera déposé dans les archives de 1'Organisation de l'aviation civile internationale et des copies certifiées conformes seront transmises par le Secrétaire général de l'Organisation à tous les États parties à la Convention relative à l'aviation civile internationale faite à Chicago le sept décembre 1944.

Het Protocol behoeft ingevolge artikel 7, onderdeel b, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring der Staten-Generaal.

E. BEKRACHTIGING

In overeenstemming met het in het Protocol terzake gestelde heeft de volgende Staat een akte van bekrachtiging nedergelegd bij de Internationale Burgerluchtvaartorganisatie:

J. GEGEVENS

Van het op 7 december 1944 te Chicago tot stand gekomen Verdrag inzake de internationale burgerluchtvaart, tot wijziging van welk Verdrag het onderhavige Protocol strekt, is de Engelse tekst bij Koninklijk besluit van 3 juni 1947 bekendgemaakt in Stb. H 165 en is de vertaling, bijgewerkt tot en met het Protocol van 21 juni 1961, geplaatst in Trb. 1973, 109; zie ook, laatstelijk, Trb. 1996, 32.

Op 1 oktober 1998 is te Montreal eveneens tot stand gekomen het Protocol betreffende de authentieke tekst in zes talen van het Verdrag inzake de Internationale Burgerluchtvaartorganisatie. De Engelse en Franse tekst van het Protocol zijn geplaatst in Trb. 1999, 48.
