De in de brieven vervatte overeenkomst wordt in de verhouding het Koninkrijk der Nederlanden (Nederland) – Kroatië vanaf 15 november 1999 voorlopig toegepast ingevolge het gestelde in de in rubriek J hieronder afgedrukte nota.

De Nederlandse Ambassade te Zagreb heeft op 26 oktober 1999 een nota gericht aan het Kroatische Ministerie van Buitenlandse Zaken inzake de voorlopige toepassing van de in de brieven vervatte overeenkomst. De materiële inhoud van de nota luidt als volgt:

“.................. and has the honour to inform the Ministry of Foreign Affairs of the Republic of Croatia that the Agreement concerning the abolition of the visa requirements between the Benelux States and the Republic of Croatia, which was concluded by exchange of Notes at Zagreb on 11 June 1999, will be provisionally applied as from 15 November 1999 by the Netherlands authorities.

As regards this provisional application the Netherlands authorities stipulate as a condition that the Agreement between the Benelux States and the Republic of Croatia on the readmission of persons in breach of the regulations, done at Zagreb on 11 June 1999, be also provisionally applied in the relation between the Kingdom of the Netherlands and the Republic of Croatia, so that a juridical basis exists for readmission of their subjects in case of breach of the regulations.

If the Croatian authorities agree to this condition the Agreement on the readmission of persons in breach of the regulations shall also be provisionally applied as from 15 November 1999 by the Netherlands authorities.

De regering van Kroatië heeft op 10 november 1999 met de voorlopige toepassing van de beide overeenkomsten ingestemd.

Van de op 11 juni 1999 te Zagreb tot stand gekomen Overeenkomst tussen het Koninkrijk der Nederlanden, het Koninkrijk België en het Groothertogdom Luxemburg, enerzijds, en de Republiek Kroatië, anderzijds, betreffende de overname van onregelmatig binnengekomen of verblijvende personen, naar welke Overeenkomst in bovenstaande nota wordt verwezen, zijn de Nederlandse en Franse tekst geplaatst in Trb. 1999, 140; zie ook Trb. 1999, 192.
