Voor het op 26 juni 1945 te San Francisco tot stand gekomen Statuut van het Internationale Gerechtshof zie ook, laatstelijk, Trb. 1997, 106.

Op 8 en 25 juni 1999 zijn te 's-Gravenhage tussen de Nederlandse regering en de Internationale Dienst voor nationaal landbouwkundig onderzoek (ISNAR) nota's houdende een verdrag tot wijziging van de Overeenkomst gewisseld.

De tekst van de nota's luidt als volgt:

The Ministry of Foreign Affairs of the Kingdom of the Netherlands presents its compliments to the International Service for National Agricultural Research (hereinafter ISNAR) and has the honour to submit a proposal for amendment of the Agreement between the Kingdom of the Netherlands and the International Service for National Agricultural Research concerning the headquarters of ISNAR of 2 June 1980 (hereinafter referred to as “the Agreement"), as follows:

To Article 5, paragraph 1 shall be added a new subparagraph (e):

“e) in the event of an enforcement of an arbitration award pronounced by the Administrative Tribunal of the International Labour Organisation of the United Nations."

After Article 12 of the Agreement a new Article 12 bis shall be inserted, which shall read as follows:

“Article 12 bis Director General

“The Director General and the Deputy Director General, when performing the functions of the Director General shall enjoy within and with respect to the Kingdom of the Netherlands, the privileges, exemptions and facilities granted in accordance with the Vienna Convention on Diplomatic Relations, of 18 April 1961, to heads of diplomatic missions."

Article 13, paragraph 2 shall be replaced by a new paragraph 2, as follows:

“2. The Government shall issue to the Staff Members of ISNAR and non-Netherlands members of their families forming part of their households an identity card bearing the photograph of the holder. This card shall serve to identify the holder in relation to all authorities of the Kingdom of the Netherlands."

The text of Article 15 of the Agreement shall become paragraph 1 of article 15. A new paragraph 2 shall be added after paragraph 1, which shall read as follows:

“2. The provisions of paragraph 1 of this Article shall apply mutatis mutandis to partners and dependent children, who are forming part of the households of the persons referred to in paragraph 1 of this Article, unless they are employed otherwise than by ISNAR or self-employed in the Netherlands or unless they receive Netherlands social security benefit."

After Article 15 of the Agreement, a new Article 15 bis shall be inserted, which shall read as follows:

“Article 15 bis Employment

1. Persons who have been recognised by the Government as

  • a) partners of Staff Members of ISNAR, or

  • b) dependent children of Staff Members of ISNAR

    and who are forming part of the households of Staff Members, shall be authorised to engage in gainful employment for the duration of the employment of the said Staff Members.

2. Persons who obtain employment under paragraph 1 of this Article shall have no immunity from criminal, civil and administrative jurisdiction with respect to matters arising in the course of or in connection with such employment, provided that measures of execution are taken without infringing the inviolability of their person or of their residence.

3. Employment referred to in paragraph 1 of this Article shall be in accordance with Dutch legislation."

After Article 15 bis of the Agreement, a new Article 15 ter shall be inserted, which shall read as follows:

“Article 15 ter ISNAR provident fund

“A provident fund established by or conducted under the authority of ISNAR shall enjoy legal capacity in the Kingdom of the Netherlands and shall enjoy the same exemptions, privileges and immunities as ISNAR itself."

If the foregoing proposal is acceptable to ISNAR, the Ministry has the honour to propose that this Note and the affirmative reply to it shall together constitute an agreement between the Kingdom of the Netherlands and ISNAR, which shall enter into force with retroactive effect as from 1 January 1999, on the date of the reply of ISNAR.

The Ministry of Foreign Affairs avails itself of this opportunity to renew to the International Service for National Agricultural Research the assurance of its highest consideration.

The International Service for National Agricultural Research (ISNAR) presents its compliments to the Ministry of Foreign Affairs of the Kingdom of the Netherlands and has the honor to acknowledge receipt of the Note No. DJZ/VE-629/99 of the Ministry of 8 June 1999, which reads as follows:

In reply, ISNAR has the honor to inform the Ministry that the above proposal is acceptable to ISNAR, and therefore agrees that the Note of the Ministry, together with this reply, shall constitute an agreement between ISNAR and the Kingdom of the Netherlands, which shall enter into force retroactively from 1 January 1999.

The International Service for National Agricultural Research avails itself of this opportunity to renew to the Ministry the assurances of its highest consideration.

De bepalingen van het in de nota's vervatte verdrag zijn ingevolge het in de voorlaatste alinea van nota Nr. I gestelde op 25 juni 1999 in werking getreden, met terugwerkende kracht vanaf 1 januari 1999.

Wat het Koninkrijk der Nederlanden betreft, geldt het verdrag alleen voor Nederland.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat het onderhavige verdrag zal zijn bekendgemaakt in Nederland op de dag na die der uitgifte van dit Tractatenblad.
