Acuerdo entre el Reino de los Países Bajos y la Asociacion de Estados del Caribe que define los terminos de la participacion de Aruba como Miembro Asociado

El Reino de los Países Bajos, a título de Aruba y la Asociación de Estados del Caribe,

Considerando que el Artículo IV, párrafo 2, del Convenio Constitutivo de la Asociación de Estados del Caribe, en adelante denominado «Convenio», establece que el Consejo de Ministros de la Asociación de Estados del Caribe concluirá acuerdos con los Miembros Asociados;

Considerando que Aruba figura entre los Estados, Países y Territorios listados en el Anexo II del Convenio;

Teniendo en cuenta las disposiciones pertinentes de la Constitución del Reino de los Países Bajos, que permiten que Aruba pueda obtener la calidad de Miembro Asociado de la Asociación de Estados del Caribe;

Deseando promover la cooperación regional entre los Estados Miembros y Miembros Asociados de la Asociación con el objetivo de fortalecer, utilizar y desarrollar las capacidades colectivas de la región del Caribe para lograr el avance sostenido en lo económico, social, cultural, científico y tecnológico;

Deseando promover la consulta regional, la cooperación y la acción concertada en el turismo, la integración económica y otras áreas comerciales relacionadas, así como el transporte, entre otros asuntos;

Considerando que el Reino de los Países Bajos, a título de Aruba, firmó el Convenio el 11 de diciembre de 1998, en la Cuarta Reunión Ordinaria del Consejo de Ministros, efectuada en Bridgetown, Barbados;

Han acordado lo siguiente:

Artículo 1

Para la ejecución del presente Acuerdo:

1. El término «Acuerdo» se refiere al Acuerdo entre el Reino de los Países Bajos y la Asociación de Estados del Caribe, en el que se definen las modalidades de la participación de Aruba como Miembro Asociado.

2. La definición de los términos empleados en este Acuerdo es la que figura en el Artículo l del Convenio.

Artículo 2

Aruba, de acuerdo con los Artículos IV y IX del Convenio y según las mismas condiciones y términos definidos para los Estados Miembros, tendrá el derecho, como Miembro Asociado, a participar en las discusiones y a votar en las reuniones del Consejo de Ministros en los asuntos que la afectan directamente y que estén dentro de su competencia constitucional.

Artículo 3

Aruba, de conformidad con el Artículo IV, párrafo 2 del Convenio, el presente Acuerdo de relaciones y otros acuerdos aprobados por el Consejo de Ministros, bajo los mismos términos y condiciones de los Estados Miembros, tendrá el derecho a participar, como Miembro Asociado, en las reuniones de los Comités Especiales, en aquellos programas, planes y proyectos en los que se requiera su participación, que caigan dentro de su autonomía y que las afecten directamente. Aruba podrá presentar proyectos e iniciativas para promover la cooperación regional.

Artículo 4

Aruba contribuirá en un 1.5% del presupuesto anual de la Asociación, el cual será aprobado por consenso de los delegados presentes en el Consejo de Ministros, de conformidad con el Artículo XII, párrafo 2 del Convenio.

Artículo 5

Los derechos y obligaciones que resulten del presente Acuerdo serán del cumplimiento exclusivo del Gobierno de Aruba.

Artículo 6

Este Acuerdo entrará en vigor a partir de la fecha en que el Reino de los Países Bajos, en nombre del Gobierno de Aruba, notifique a la Asociación la culminación de los procedimientos constitucionales correspondientes. Esta notificación no podrá ser hecha hasta tanto el Reino de los Países Bajos haya depositado su instrumento de adhesión al Convenio ante el Gobierno de la República de Colombia.

HECHO en Santo Domingo de Guzmán, República Dominicana, el 26 de marzo de 1999, en tres copias en idioma Inglés, Francés y Español, igualmente válidas. Se firma en 3 ejemplares, uno para cada parte, el ter- cero será depositado ante el Gobierno de la República de Colombia como Estado depositario del Convenio Constitutivo de la Asociación de Estados del Caribe.

Agreement between the Kingdom of the Netherlands and the Association of Caribbean States defining the modalities of participation of Aruba as an Associate Member

The Kingdom of the Netherlands, in respect of Aruba and the Association of the Caribbean States,

Whereas Article IV, paragraph 2 of the Convention establishing the Association of the Caribbean States, henceforth called the “Convention", creates the possibility that the Ministerial Council of the Association of Caribbean States shall conclude relationship agreements with Associate Members;

Considering that Aruba is included in the States, Countries and Territories listed in Annex II of the Convention;

Bearing in mind the relevant provisions of the Charter of the Kingdom of the Netherlands, which permit Aruba to obtain Associated Membership of the Association of Caribbean States;

Wishing to promote regional co-operation among the Member States and Associate Members of the Association in order to harness, utilise and develop the collective capabilities of the Caribbean region to achieve sustained economic, social, cultural, scientific and technological advances;

Wishing to enhance regional consultation, co-operation and concerted action regarding tourism, economic integration and other trade-related topics, and transport among other matters;

Considering that the Kingdom of the Netherlands, in respect of Aruba, signed the Convention on December 11th, 1998 at the Fourth Ordinary Meeting of the Ministerial Council held in Bridgetown, Barbados;

Have agreed as follows:

Article 1

For the purpose of this Agreement:

1. The term “Agreement" means the Agreement between the Kingdom of the Netherlands and the Association of Caribbean States defining the modalities of participation of Aruba as an Associate Member;

2. The definitions used in this Agreement shall be the same as those set forth in Article I of the Convention.

Article 2

Aruba, in accordance with Articles IV and IX of the Convention, under the same conditions and modalities as Member States, shall have the right to intervene as an Associate Member in discussions and vote at meetings of the Ministerial Council, on those matters which belong to its constitutional competence and which affect it directly.

Article 3

Aruba, in accordance with article IV, paragraph 2 of the Convention, this Agreement and other agreements as approved by the Ministerial Council, under the same conditions and the same modalities as Member States, shall have the right to participate as an Associate Member in meetings of the Special Committees in which programmes, plans and projects are being studied and decided upon, which require its participation and fall within its autonomous authority and which affect it directly. Aruba may present projects and initiatives promoting regional co-operation.

Article 4

Aruba shall contribute 1.5% of the Annual Budget of the Association of Caribbean States, which in accordance with Article XII, paragraph 2 of the Convention shall be approved by the Ministerial Council by consensus of the delegates present.

Article 5

The rights and obligations resulting from the present Agreement shall be exclusively binding upon the Government Aruba.

Article 6

This Agreement shall come into force on the date on which the Kingdom of the Netherlands, on behalf of the Government of Aruba, shall have notified the Association of the completion of the relevant constitutional procedures. This notification cannot be made until the Kingdom of the Netherlands has deposited its instrument of adhesion to the Convention with the Government of the Republic of Colombia.

DONE at Santo Domingo, the Dominican Republic on March 26th, 1999 in three copies in the English, French and Spanish languages, each text being equally authentic, one for each Party, the third to be depos- ited with the Government of the Republic of Colombia as depositary State of the Convention establishing the Association of Caribbean States.

D. PARLEMENT

Het Verdrag behoeft ingevolge artikel 91 van de Grondwet de goedkeuring der Staten-Generaal, alvorens het Koninkrijk aan het Verdrag kan worden gebonden.

G. INWERKINGTREDING

De bepalingen van het Verdrag zullen ingevolge artikel 6 in werking treden op de datum, waarop het Koninkrijk der Nederlanden namens de regering van Aruba de Associatie van Caraïbische Staten meedeelt dat de desbetreffende constitutionele procedures zijn voltooid.
