Subject: Request to the Government of the Netherlands to host an ESTRO/IAEA Training Course on Principles and Practice of Radiotherapy Treatment Planning, Rotterdam, 15 – 19 February 1998

Sir,

I have the honour to refer to the IAEA's 1998 technical co-operation programme within which includes a Training Course on Principles and Practice of Radiotherapy Treatment Planning to be given in co-operation with the European Society for Therapeutic Radiology and Oncology (ESTRO) at the Dr. Daniel Den Hoed Kliniek in Rotterdam, Netherlands, from 15 to 19 February 1998. Informal agreement about the IAEA's and ESTRO's respective contributions has already been reached with ESTRO (see attached draft agreement which is now in the process of being signed by the two parties).1

As the above-indicated training course will be held on Dutch territory I hereby wish to beg your Government's consent to ESTRO and the IAEA holding this course in Rotterdam. This consent would not imply any financial commitments for the Government of the Netherlands but I would request you to confirm your Government's agreement with the following arrangements which are customary for all the IAEA's training courses:

Privileges and Immunities

1. The Host Government will accord to the Agency, its property, funds and assets, and to the officials of the Agency and the participants officially designated to attend the course in their official capacities, and to members of the immediate families of such persons, the privileges and immunities contained in the Agreement on the Privileges and Immunities of the International Atomic Energy Agency which was accepted by the Host Government on 29 August 1963.

Visas

2. The Host Government will accord to the officials of the Agency, to the Agency recruited lecturers every facility necessary for the performance of their functions in connection with the course, and to the participants selected by the Agency every facility to attend the training course, including entering, remaining in and leaving the Netherlands. The Host Government will issue any necessary visas as expeditiously as possible, and where the legislation of the Netherlands permits, free of charge. The Government, however, reserves the right to deny, irrespective of nationality, visas to individual participants for national security reasons. Annex A contains the list of Member States to be invited to participate.

3. The Agency will inform the Host Government promptly of all persons officially designated to attend the course. The Agency will also advise such persons to apply for visas, if necessary, in good time before the opening date of the course, and the Host Government is expected to issue such visas promptly so as to allow participants to attend the course.

Customs

4. The Host Government will facilitate customs formalities for the officials of the Agency, the lecturers recruited by the Agency and the course participants selected by the Agency on entering and leaving the Netherlands as well as for the training materials and publications being provided by the Agency.

Security

5. The Host Government will take whatever steps may be reasonable to ensure security on the premises in which the training course takes place and to ensure the safety of the lecturers, instructors, officials of the Agency and participants while on the premises of the course.

I am sending copy of this letter to Ms. Zdravka Dimitrova, ESTRO Office, Brussels, who has so far been our principal contact regarding this course.

I express to you the Agency's deep appreciation of your Government's co-operation.

I have the honour to inform you that my Government is prepared to host the meeting in question. My Government considers your letter and my reply as an agreement between the Kingdom of the Netherlands and the International Atomic Energy Agency, which shall enter into force on the date of receipt of this reply and shall remain in force for the duration of the meeting and for such additional period as is necessary for its winding up, the total duration of this agreement, however, not to exceed one year.

D. PARLEMENT

Het in de brieven vervatte verdrag behoeft ingevolge artikel 7, letter c, van de Rijkswet goedkeuring en bekendmaking verdragen, niet de goedkeuring der Staten-Generaal, alvorens in werking te kunnen treden.

G. INWERKINGTREDING

De bepalingen van het in de brieven vervatte verdrag zijn ingevolge het in de voorlaatste alinea van brief Nr. II gestelde op 4 februari 1998 in werking getreden.

Wat het Koninkrijk der Nederlanden betreft, geldt het verdrag alleen voor Nederland.

J. GEGEVENS

Van het op 26 oktober 1956 te New York tot stand gekomen Statuut van de Internationale Organisatie voor Atoomenergie (IAEA) zijn tekst en vertaling geplaatst in Trb. 1957, 50; zie ook, laatstelijk, Trb. 1990, 51.

Van de op 1 juli 1959 te Wenen tot stand gekomen Overeenkomst inzake de voorrechten en immuniteiten van de Internationale Organisatie voor Atoomenergie, naar welke Overeenkomst in de brieven wordt verwezen, is de tekst geplaatst in Trb. 1965, 49; zie ook Trb. 1971, 57.

In overeenstemming met artikel 19, tweede lid, van de Rijkswet goedkeuring en bekendmaking verdragen heeft de Minister van Buitenlandse Zaken bepaald dat de onderhavige Overeenkomst zal zijn bekendgemaakt op de dag na die der uitgifte van dit Tractatenblad.
