Roemenië heeft op 28 april 19951 en Tsjechië op 1 mei 19952 bij de Secretaris-Generaal van de Verenigde Naties bezwaar gemaakt tegen de wijziging.

Wijziging van juni 1997

In overeenstemming met artikel 59, eerste en tweede lid, van de Overeenkomst heeft de Commissie van beheer op haar drieëntwintigste zitting gehouden te Genève op 26 en 27 juni 1997 de volgende wijziging van de artikelen 6, 38, 42, 58, 59 en 60 aangenomen. De Engelse en de Franse tekst1 van de wijziging luiden als volgt:

Amendment proposals to the TIR Convention, 1975 adopted by the Administrative Committee for the TIR Convention, 1975 on 27 June 1997

Article 6, paragraph 1

Modify paragraph 1 as follows:

“1. Each Contracting Party may authorize associations to issue TIR Carnets, either directly or through corresponding associations, and to act as guarantors, as long as the minimum conditions and requirements, as laid down in Annex 9, Part I, are complied with. The authorization shall be revoked if the minimum conditions and requirements contained in Annex 9, Part I are no longer fulfilled."

Article 6, new paragraphs 3 to 5

Add the following new paragraphs:

“3. An association shall issue TIR Carnets only to persons, whose access to the TIR procedure has not been refused by the competent authorities of Contracting Parties in which the person is resident or established.

4. Authorization for access to the TIR procedure shall be granted only to persons who fulfil the minimum conditions and requirements laid down in Annex 9, Part II to this Convention. Without prejudice to article 38, the authorization shall be revoked if the fulfilment of these criteria is no longer ensured.

5. Authorization for access to the TIR procedure shall be granted according to the procedure laid down in Annex 9, Part II to this Convention."

Article 38, paragraph 2

Modify paragraph 2 as follows:

“2. This exclusion shall be notified within one week to the competent authorities of the Contracting Party on whose territory the person concerned is established or resident, to the association(s) in the country or Customs territory where the offence has been committed and to the TIR Executive Board."

Article 42 bis

Add the following new article:

«The competent authorities, in close cooperation with the associations, shall take all necessary measures to ensure the proper use of TIR Carnets. To this effect they may take appropriate national and international control measures. National control measures taken in this context by the competent authorities shall be communicated immediately to the TIR Executive Board which will examine their conformity with the provisions of the Convention. International control measures shall be adopted by the Administrative Committee.»

New article 58 bis

Add the following new article 58 bis:

“Article 58 bis Administrative Committee

An Administrative Committee composed of all the Contracting Parties shall be established. Its composition, functions and rules of procedure are set out in Annex 8."

New article 58 ter

Add the following new article 58 ter:

“Article 58 ter TIR Executive Board

The Administrative Committee shall establish a TIR Executive Board as a subsidiary body which will, on its behalf, fulfil the tasks entrusted to it by the Convention and by the Committee. Its composition functions and rules of procedure are set out in Annex 8."

Article 59

Modify the first sentence of article 59, paragraph 2 as follows:

«2. Any proposed amendment to this Convention shall be considered by the Administrative Committee ....»

Article 60

Modify the end of the heading “... 6 and 7" to read as follows: “... 6, 7, 8 and 9".

Modify the beginning of the article “1. Any proposed amendment to Annexes 1, 2, 3, 4, 5, 6 and 7 ..." to read as follows: “1. Any proposed amendment to Annexes 1, 2, 3, 4, 5, 6, 7, 8 and 9 ...".


De vertaling van de wijziging van de artikelen 6, 38, 42, 58, 59 en 60 luidt als volgt:

Wijziging Overeenkomst

Voorgestelde wijzigingen van de TIR-Overeenkomst, 1975 aangenomen door de Commissie van beheer van de TIR-Overeenkomst, 1975 op 27 juni 1997Artikel 6, eerste lid

Wijzig het eerste lid als volgt:

„1. Iedere Overeenkomstsluitende Partij kan aan organisaties de bevoegdheid verlenen om, hetzij rechtstreeks, hetzij door tussenkomst van soortgelijke organisaties, carnets TIR af te geven, alsmede om zich garant te stellen, zolang wordt voldaan aan de in Bijlage 9, deel I, neergelegde minimumvoorwaarden en -eisen. De bevoegdverklaring wordt ingetrokken, indien niet meer wordt voldaan aan de in Bijlage 9, deel I, genoemde minimumvoorwaarden en -eisen."

Artikel 6, nieuwe leden 3 tot en met 5

Voeg de volgende nieuwe leden toe:

„3. Een organisatie geeft carnets TIR uitsluitend af aan personen wier toelating tot de TIR-regeling niet is geweigerd door de bevoegde autoriteiten van de Overeenkomstsluitende Partijen op het grondgebied waarvan de desbetreffende personen zijn gevestigd of wonen.

4. De bevoegdheid tot toelating tot de TIR-regeling wordt uitsluitend verleend aan personen die voldoen aan de in Bijlage 9, deel II, bij deze Overeenkomst, neergelegde minimumvoorwaarden en -eisen. Onverminderd het bepaalde in artikel 38 wordt de bevoegdverklaring ingetrokken, indien niet langer wordt gewaarborgd dat aan deze criteria wordt voldaan.

5. De bevoegdheid tot toelating tot de TIR-regeling wordt verleend overeenkomstig de in Bijlage 9, deel II, bij deze Overeenkomst, neergelegde procedure."

Artikel 38, tweede lid

Wijzig het tweede lid als volgt:

„2. Van deze uitsluiting wordt binnen een week mededeling gedaan aan de bevoegde autoriteiten van de Overeenkomstsluitende Partij op het grondgebied waarvan de desbetreffende persoon is gevestigd of woont, aan de organisatie(s) in het land of douanegebied waar de inbreuk is gepleegd en aan het TIR Uitvoerend Comité."

Artikel 42 bis

Voeg het volgende nieuwe artikel toe:

„De bevoegde autoriteiten nemen in nauwe samenwerking met de organisaties alle noodzakelijke maatregelen ter verzekering van het correcte gebruik van de carnets TIR. Hiertoe kunnen zij passende nationale en internationale controlemaatregelen nemen. De in dit verband door de bevoegde autoriteiten genomen nationale controlemaatregelen worden onverwijld ter kennis gebracht van het TIR Uitvoerend Comité, die zal toetsen of zij in overeenstemming zijn met de bepalingen van de Overeenkomst. De internationale controlemaatregelen worden aangenomen door de Commissie van beheer."

Nieuw artikel 58 bis

Voeg het volgende nieuwe artikel 58 bis toe:

„Artikel 58 bis Commissie van beheer

Er wordt een Commissie van beheer ingesteld die is samengesteld uit alle Overeenkomstsluitende Partijen. De samenstelling, de taken en het reglement van orde van de Commissie van beheer worden uiteengezet in bijlage 8."

Nieuw artikel 58 ter

Voeg het volgende nieuwe artikel 58 ter toe:

„Artikel 58 ter TIR Uitvoerend Comité

De Commissie van beheer stelt een TIR Uitvoerend Comité in als ondergeschikt orgaan dat namens haar de taken zal uitvoeren die haar door de Overeenkomst en door de Commissie van beheer worden opgedragen. De samenstelling, de taken en het reglement van orde van het TIR Uitvoerend Comité worden uiteengezet in bijlage 8."

Artikel 59

Wijzig de eerste zin van artikel 59, tweede lid, als volgt:

„2. Iedere op deze Overeenkomst voorgestelde wijziging wordt onderzocht door de Commissie van beheer ...."

Artikel 60

Wijzig het einde van het opschrift „... 6 en 7" als volgt: „... 6, 7, 8 en 9".

Wijzig het begin van het artikel „1. Iedere op de bijlagen 1, 2, 3, 4, 5, 6 en 7 voorgestelde wijziging ..." als volgt: „1. Iedere op de bijlagen 1, 2, 3, 4, 5, 6, 7, 8 en 9 voorgestelde wijziging ...".


De wijziging van de artikelen 6, 38, 42, 58, 59 en 60 behoeft ingevolge artikel 91 van de Grondwet de goedkeuring van de Staten-Generaal, alvorens het Koninkrijk de wijziging kan aanvaarden.

Wijzigingen van de Bijlagen

In overeenstemming met artikel 59, eerste en tweede lid, van de Overeenkomst heeft de Commissie van beheer op haar drieëntwintigste zitting gehouden te Genève op 26 en 27 juni 1997 de volgende wijzigingen op de Bijlagen 6 en 8 respectievelijk een nieuwe Bijlage 9 bij de Overeenkomst aangenomen. De Engelse en de Franse tekst1 van deze wijzigingen luiden als volgt:

Annex 6, explanatory note 0.38.2

Add a new explanatory note to annex 8, article 13, paragraph 1 to read as follows:

“8.13.1-1 Financial arrangements

Following an initial period of two years, the Contracting Parties to the Convention envisaged the operation of the TIR Executive Board and the TIR secretariat to be financed through the Regular Budget of the United Nations. This does not preclude a prolongation of the initial financing arrangement should financing from the United Nations or alternative sources not be forthcoming."Annex 6, new explanatory note 8.13.1-2

Add a second explanatory not to annex 8, article 13, paragraph 1 to read as follows:

“8.13.1-2 Operation of the TIR Executive Board

The work of the members of the TIR Executive Board will be financed by their respective Governments."

Annex 6, new explanatory note 9.I.1 (a)

Add a new explanatory note to new Annex 9, Part I, paragraph 1 (a) to read as follows:

“9.I.1a) Established association

The provisions in annex 9, Part I, paragraph 1a) cover organizations involved in the international trade of goods, including chambers of commerce."

Annex 6, new explanatory note 9.II.3

Add a new explanatory note to new Annex 9, Part II, paragraph 3 to read as follows:

“9.II.3 Authorization committee

It is recommended to establish national authorization committees comprising representatives of the competent authorities, national associations and other organizations concerned."

Modify the heading of Annex 8 to read as follows:

Annex 8, new article 1 bis

Add the following new article 1 bis

“Annex 8, article 1 bis

1. The Committee shall consider any proposed amendment to the Convention in accordance with article 59, paragraphs 1 and 2.

2. The Committee shall monitor the application of the Convention and shall examine any measure taken by Contracting Parties, associations and international organizations under the Convention and their conformity therewith.

3. The Committee, through the TIR Executive Board, shall supervise and provide support in the application of the Convention at the national and international levels."

Add a new sub-heading before annex 8, new article 9 to read as follows:

“COMPOSITION, FUNCTIONS AND RULES OF PROCEDURE OF THE TIR EXECUTIVE BOARD"Annex 8, new articles 9 to 12

Add the following new articles to annex 8:

“Article 9

1. The TIR Executive Board established by the Administrative Committee in accordance with article 58 ter, shall be composed of nine members, each from different Contracting Parties to the Convention. The TIR Secretary will attend the sessions of the Board.

2. The members of the TIR Executive Board shall be elected by the Administrative Committee by a majority of those present and voting. The term of office of each member of the TIR Executive Board shall be two years. The members of the TIR Executive Board may be re-elected. The Terms of Reference for the TIR Executive Board shall be established by the Administrative Committee.

Article 10

The TIR Executive Board shall:

  • a) supervise the application of the Convention, including the operation of the guarantee system, and fulfil the functions entrusted to it by the Administrative Committee;

  • b) supervise the centralized printing and distribution to the associations of TIR Carnets which may be performed by an agreed international organization as referred to in article 6;

  • c) coordinate and foster the exchange of intelligence and other information among competent authorities of Contracting Parties;

  • d) coordinate and foster the exchange of information between competent authorities of Contracting Parties, associations and international organizations;

  • e) facilitate the settlement of disputes between Contracting Parties, associations, insurance companies and international organizations without prejudice to article 57 on the settlement of disputes;

  • f) support the training of personnel of Customs authorities and other interested parties concerned with the TIR procedure;

  • g) maintain a central record for the dissemination to Contracting Parties of information to be provided by the international organizations as referred to in article 6, on all rules and procedures prescribed for the issue of TIR Carnets by associations, as far as they relate to the minimum conditions and requirements laid down in annex 9;

  • h) monitor the price of TIR Carnets.

Article 11

1. A session of the Board shall be convened by the TIR Secretary at the request of the Administrative Committee or by at least three members of the Board.

2. The Board shall strive to take decisions by consensus. If no consensus can be reached, decisions shall be put to vote and shall be taken by a majority of those present and voting. A quorum of five members is required for the purposes of taking decisions. The TIR Secretary shall have no vote.

3. The Board shall elect a Chairman and shall adopt any additional rules of procedure.

4. The Board shall report on its activities, including the submission of audited accounts, to the Administrative Committee. The Board will be represented in the Administrative Committee by its Chairman.

5. The Board shall consider any information and queries transmitted to it by the Administrative Committee, Contracting Parties, the TIR Secretary, national associations and international organizations referred to in article 6 of the Convention. These international organizations shall have the right to attend the sessions of the TIR Executive Board as observers unless its Chairman decided otherwise. If necessary, any other organization may attend the sessions of the Board as observer at the invitation of the Chairman.

Article 12

The TIR Secretary shall be a member of the secretariat of the United Nations Economic Commission for Europe and shall execute the decisions of the TIR Executive Board within the Terms of Reference of the Board. The TIR Secretary will be assisted by a TIR secretariat, the size of which shall be determined by the Administrative Committee.

Article 13

1. The operation of the TIR Executive Board and the TIR Secretariat shall be financed, until such time as alternative sources of funding are obtained, through a levy on each TIR Carnet distributed by the international organization as referred to in article 6.

2. The amount of the levy and the procedure for its collection shall be determined by the Administrative Committee following consultations with the international organization as referred to in article 6. Any proposed changes to the levy shall be authorized by the Administrative Committee."

New Annex 9

Add the following new annex 9 to the Convention:

“Annex 9

ACCESS TO THE TIR PROCEDURES

Part I

AUTHORIZATION FOR ASSOCIATIONS TO ISSUE TIR CARNETS

Minimum conditions and requirements

1. The minimum conditions and requirements to be complied with by associations in order to be authorized by Contracting Parties to issue TIR Carnets and act as guarantor in accordance with article 6 of the Convention are:

  • a) Proven existence for at least one year as an established association representing the interests of the transport sector.

  • b) Proof of sound financial standing and organizational capabilities enabling it to fulfil its obligations under the Convention.

  • c) Proven knowledge of its staff in the proper application of the Convention.

  • d) Absence of serious or repeated offences against Customs or tax legislation.

  • e) Establishment of a written agreement or any other legal instrument between the association and the competent authorities of the Contracting Party in which it is established. A certified copy of the written agreement or any other legal instrument together, if necessary, with a certified translation into English, French or Russian, shall be deposited with the TIR Executive Board. Any changes to the written agreement or any other legal instrument shall be immediately brought to the attention of the TIR Executive Board.

  • f) An undertaking in the written agreement or any other legal instrument under (e), that the association:

    • (i) shall comply with the obligations laid down in article 8 of the Convention;

    • (ii) shall accept the maximum sum per TIR Carnet determined by the Contracting Party which may be claimed from the association in accordance with article 8, paragraph 3 of the Convention;

    • iii) shall verify continuously and, in particular, before requesting authorization for access of persons to the TIR procedure, the fulfilment of the minimum conditions and requirements by such persons as laid down in Part II of this annex;

    • (iv) shall provide its guarantee for all liabilities incurred in the country in which it is established in connection with operations under cover of TIR Carnets issued by itself and by foreign associations affiliated to the same international organization as that to which it is itself affiliated;

    • (v) shall cover its liabilities to the satisfaction of the competent authorities of the Contracting Parties in which it is established with an insurance company, pool of insurers or financial institution. The insurance or financial guarantee contract(s) shall cover the totality of its liabilities in connection with operations under cover of TIR Carnets issued by itself and by foreign associations affiliated to the same international organization as that to which it is itself affiliated.

      The time to give notice for the termination of the insurance or financial guarantee contract(s) shall be not less than the time to give notice for the termination of the written agreement or any other legal instrument under (e). A certified copy of the insurance or financial guarantee contract(s) as well as all subsequent modifications thereto shall be deposited with the TIR Executive Board, including a certified translation, if necessary, into English, French or Russian;

    • (vi) shall allow the competent authorities to verify all records and accounts kept relating to the administration of the TIR procedure;

    • (vii) shall accept a procedure for settling efficiently disputes arising from the improper or fraudulent use of TIR Carnets;

    • (viii) shall agree that any serious or repeated non-compliance with the present minimum conditions and requirements shall lead to the authorization to issue TIR Carnets being revoked;

    • (ix) shall comply strictly with the decisions of the competent authorities of the Contracting Party in which it is established concerning the exclusion of persons in line with article 38 of the Convention and Part II of this annex;

    • (x) shall agree to implement faithfully all decisions adopted by the Administrative Committee and the TIR Executive Board in as much as the competent authorities of Contracting Parties in which the association is established have accepted them.

2. Contracting Parties in which the association in established shall revoke the authorization to issue TIR Carnets in case of serious or repeated non-compliance with these minimum conditions and requirements.

3. Authorization of an association under the terms set out above shall be without prejudice to that association's responsibilities and liabilities under the Convention.

4. The minimum conditions and requirements laid down below are without prejudice to additional conditions and requirements Contracting Parties may wish to prescribe.

Part II

AUTHORIZATION FOR NATURAL AND LEGAL PERSONS TO UTILIZE TIR CARNETS

Minimum conditions and requirements

1. The minimum conditions and requirements to be complied with by persons wishing to have access to the TIR procedure are:

  • a) Proven experience or, at least, capability to engage in regular international transport (holder of a licence for carrying out international transport, etc.).

  • b) Sound financial standing.

  • c) Proven knowledge in the application of the TIR Convention.

  • d) Absence of serious or repeated offences against Customs or tax legalisation.

  • e) An undertaking in a written declaration of commitment to the association that the person:

    • (i) will comply with all Customs formalities required under the Convention at the Customs offices of departure, en route and of destination;

    • (ii) will pay the sums due, mentioned in article 8, paragraphs 1 and 2 of the Convention, if requested to do so by the competent authorities in line with article 8, paragraph 7 of the Convention;

    • (iii) will, as far as national legislation permits, allow associations to verify information on the above minimum conditions and requirements.

2. Additional and more restrictive conditions and requirements for access to the TIR procedure may be introduced by the competent authorities of Contracting Parties and by the associations themselves unless the competent authorities decide otherwise.

Procedure

3. Contracting Parties will decide, in line with national legislation, the procedures to be followed for access to the TIR procedure on the basis of the minimum conditions and requirements set forth in paragraphs 1 and 2.

4. The competent authorities shall transmit within one week from the date of authorization or withdrawal of authorization to use TIR Carnets, the particulars of each person to the TIR Executive Board in conformity with the specimen authorization attached (MAF).

5. The association shall transmit annually an updated list as per 31 December of all authorized persons as well as of persons whose authorization has been withdrawn. This list shall be transmitted one week following the 31 December to the competent authorities. The competent authorities shall forward a copy thereof to the TIR Executive Board.

6. The authorization for access to the TIR procedure does not constitute in itself a right to obtain TIR Carnets from the associations.

7. Authorization of a person to utilize TIR Carnets under the minimum conditions and requirements set out above, shall be without prejudice to that person's responsibilities and liabilities under the Convention.

Propositions d'amendement à la Convention TIR de 1975 adoptées par le Comité de gestion de la Convention TIR de 1975 le 27 juin 1997Article 6, paragraphe 1

Modifier le paragraphe 1 comme suit:

«1. Aussi longtemps que les conditions et prescriptions minimales stipulées dans la première partie de l'annexe 9 sont respectées, chaque Partie contractante peut habiliter des associations à délivrer les carnets TIR, soit directement, soit par l'intermédiaire d'associations correspondantes, et à se porter caution. «Article 9

1. La Commission de contrôle TIR, créée par le Comité de gestion conformément à l'article 58 ter, est composée de neuf membres de Parties contractantes à la Convention différentes. Le Secrétaire de la Convention TIR participe aux sessions de la Commission.

2. Les membres de la Commission de contrôle TIR sont élus par le Comité de gestion à la majorité des membres présents et votants. Le mandat de chaque membre de la Commission de contrôle TIR est de deux ans. Les membres de la Commission de contrôle TIR sont rééligibles. Le mandat de la Commission de contrôle TIR doit être établi par le Comité de gestion.

Article 10

La Commission de contrôle TIR:

  • a) supervise l'application de la Convention, y compris le fonctionnement du système de garantie, et exerce les fonctions qui lui sont confiées par le Comité de gestion;

  • b) supervise l'impression et la délivrance centralisées des carnets TIR aux associations, fonction qui peut être exécutée par une organisation internationale agréée à laquelle il est fait référence dans l'article 6;

  • c) coordonne et encourage l'échange de renseignements confidentiels et autres informations entre les autorités compétentes des Parties contractantes;

  • d) coordonne et encourage l'échange de renseignements entre les autorités compétentes des Parties contractantes, les associations et les organisations internationales;

  • e) facilite le règlement des différends entre les Parties contractantes, les associations, les compagnies d'assurance et les organisations internationales sans préjudice de l'article 57 sur le règlement des différends;

  • f) appuie la formation du personnel des autorités douanières et des autres parties intéressées, concernées par le régime TIR;

  • g) tient un registre central en vue de la diffusion, aux Parties contractantes, des renseignements que fourniront les organisations internationales auxquelles il est fait référence dans l'article 6 sur tous les règlements et procédures prescrits pour la délivrance des carnets TIR par des associations, dans la mesure où ils concernent les conditions et prescriptions minimales établies dans l'annexe 9;

  • h) surveille le prix des carnets TIR.

Article 11

1. Le Secrétaire de la Convention TIR convoque une session de la commission à la demande du Comité de gestion ou à celle d'au moins trois membres de la Commission.

2. La Commission s'efforce de prendre les décisions par consensus. Faute de consensus, elles sont mises aux voix et adoptées à la majorité des suffrages exprimés par les membres présents et votants. Aux fins de la prise de décisions, le quorum est de cinq membres. Le Secrétaire de la Convention TIR ne prend pas part au vote.

3. La Commission élit un président et adopte toute autre disposition relative au règlement intérieur.

4. Au moins une fois par an ou à la demande du Comité de gestion, la commission fait rapport sur ses activités au Comité de gestion, auquel elle présente également des comptes vérifiés. La Commission est représentée au Comité de gestion par son président.

5. La Commission examine toute information et toute question qui lui sont transmises par le Comité de gestion, les Parties contractantes, le Secrétaire de la Convention TIR, les associations nationales et les organisations internationales auxquelles il est fait référence dans l'article 6 de la Convention. Ces organisations internationales ont le droit de participer aux sessions de la Commission de contrôle TIR en qualité d'observateurs, à moins que le Président n'en décide autrement. Si nécessaire, toute autre organisation peut, à l'invitation du Président, participer en qualité d'observateur aux sessions de la Commission.

Article 12

Le Secrétaire de la Convention TIR est un membre du secrétariat de la Commission économique des Nations Unies pour l'Europe. Il exécute les décisions de la Commission de contrôle TIR dans le cadre du mandat de la Commission. Le Sécretaire de la Convention TIR est assisté d'un secrétariat TIR dont la taille est déterminée par le Comité de gestion.

Article 13

1. En attendant que d'autres sources de financement soient obtenues, le fonctionnement de la Commission de contrôle TIR et le secrétariat TIR sont financés par un droit prélevé sur chaque TIR distribué par l'organisation internationale à laquelle il est fait référence dans l'article 6.

2. Le montant et les modalités de recouvrement de ce droit sont déterminés par le Comité de gestion à la suite de consultations avec l'organisation internationale à laquelle il est fait référence dans l'article 6. Toute proposition tendant à modifier ce droit doit être approuvée par le Comité de gestion.»Nouvelle Annexe 9

«Annexe 9

ACCES AU REGIME TIR

Première partie

HABILITATION DES ASSOCIATIONS A DELIVRER DES CARNETS TIR

Conditions et prescriptions minimales

1. Pour être habilitée par les Parties contractantes à délivrer des carnets TIR et à se porter caution selon l'article 6 de la Convention, une association devra satisfaire aux conditions et prescriptions minimales ci-après:

  • a) Preuve qu'elle opère officiellement en tant qu'organisation représentative des intérêts du secteur des transports depuis au moins un an.

  • b) Preuve de la solidité de sa situation financière et de l'existence des moyens logistiques lui permettant de remplir les obligations qui lui incombent au titre de la Convention.

  • c) Preuve que son personnel possède les connaissances pour appliquer la Convention comme il convient.

  • d) Absence d'infractions graves ou répétées à l'encontre de la législation douanière ou fiscale.

  • e) Etablissement d'un accord écrit ou de tout autre instrument juridique entre elle et les autorités compétentes de la Partie contractante sur le territoire de laquelle elle est établie. Une copie certifiée conforme de l'accord écrit ou de tout autre instrument juridique avec, le cas échéant, une traduction certifiée exacte, en anglais, français ou russe, sera déposée auprès de la Commission de contrôle TIR. Toute modification de cet accord écrit ou de tout autre instrument juridique sera immédiatement portée à l'attention de la Commission de contrôle TIR.

  • f) Un engagement, dans l'accord écrit ou tout autre instrument juridique visé à l'alinéa e) ci-dessus, que l'association:

    • (i) respectera les obligations stipulées à l'article 8 de la Convention;

    • (ii) acceptera le montant maximum par carnet TIR, déterminé par la Partie contractante, que l'on peut exiger d'elle conformément au paragraphe 3 de l'article 8 de la Convention;

    • iii) vérifiera continûment et, en particulier, avant de demander que des personnes soient habilitées à accéder au régime TIR, le respect par ces personnes des conditions et prescriptions minimales stipulées dans la deuxième partie de la présente annexe;

    • (iv) accordera sa garantie à toutes les responsabilités encourues, dans le pays sur le territoire duquel elle est établie, à l'occasion des opérations effectuées sous couvert des carnets TIR qu'elle a elle- même délivrés ou qui l'auront été par des associations étrangères affiliées à l'organisation internationale à laquelle elle est elle-même affiliée;

    • (v) couvrira ses responsabilités à la satisfaction des autorités compétentes des Parties contractantes sur le territoire desquelles elle est établie auprès d'une compagnie d'assurance, d'un groupe d'assureurs ou d'une institution financière. Le(s) contrat(s) d'assurance ou de garantie financière couvrira (couvriront) la totalité de ses responsabilités en rapport avec les opérations effectuées sous couvert des carnets TIR qu'elle a elle-même délivrés ou qui l'auront été par des associations étrangères affiliées à la même organisation internationale que celle à laquelle elle est elle-même affiliée. Les délais de notification de l'annulation des contrats d'assurance ou de garantie financière ne seront pas inférieurs à ceux de la notification d'annulation de l'accord écrit ou de tout autre instrument juridique visé à l'alinéa e). Une copie certifiée conforme du (des) contrat(s) d'assurance ou de garantie financière ainsi que de tous les avenants ultérieurs à ces documents sera déposée auprès de la Commission de contrôle TIR ainsi qu'une traduction certifiée exacte, la cas échéant, en anglais, français ou russe.

    • (vi) permettra aux autorités compétentes de vérifier tous les dossiers et les comptes tenus quant à l'administration du régime TIR;

    • (vii) acceptera une procédure pour le règlement efficient des différends liés à l'utilisation indue ou frauduleuse des carnets TIR;

    • (viii) acceptera que tout manquement grave ou répété aux présentes conditions et prescriptions minimales entraîne la révocation de l'habilitation à émettre des carnets TIR;

    • (ix) respectera strictement les décisions des autorités compétentes de la Partie contractante sur le territoire de laquelle elle est établie en ce qui concerne l'exclusion de personnes conformément à l'article 38 de la Convention et à la deuxième partie de la présente annexe;

    • (x) acceptera d'appliquer scrupuleusement toutes les décisions adoptées par le Comité de gestion et la Commission de contrôle TIR, dans la mesure où les autorités compétentes des Parties contractantes sur le territoire desquelles elle est établie les auront acceptées.

2. Les Parties Contractantes sur le territoire desquelles l'association est établie révoqueront l'habilitation à émettre des carnets TIR en cas de manquement grave ou répété aux présentes conditions et prescriptions minimales.

3. L'habilitation d'une association dans les conditions énoncées ci-dessus ne préjugera pas les responsabilités et engagements incombant à cette association en vertu de la Convention.

4. Les conditions et prescriptions minimales stipulées ci-après ne préjugent pas les conditions et prescriptions supplémentaires que les Parties contractantes souhaiteraient éventuellement prescrire.

Deuxième partie

HABILITATION DES PERSONNES PHYSIQUES ET MORALES A UTILISER DES CARNETS TIR

Conditions et prescriptions minimales

1. Les personnes souhaitant avoir accès au régime TIR sont tenues de satisfaire les conditions et prescriptions minimales ci-après:

  • a) Expérience démontrée ou, au moins, aptitude à effectuer régulièrement des transports internationaux (titulaire d'un permis de transports internationaux, etc.).

  • b) Situation financière saine.

  • c) Connaissance démontrée en matière d'application de la Convention TIR.

  • d) Absence d'infractions graves ou répétées à l'encontre de la législation douanière ou fiscale.

  • e) Engagement écrit envers l'association, selon lequel la personne:

    • (i) respectera toutes les formalités douanières exigées au titre de la Convention aux bureaux de douane de départ, de passage et de destination;

    • (ii) paiera les sommes dues, visées aux paragraphes 1 et 2 de l'article 8 de la Convention, si les autorités compétentes l'exigent, conformément au paragraphe 7 de l'article 8 de la Convention;

    • (iii) dans la mesure où la législation nationale le permet, autorisera les associations à vérifier les informations relatives aux conditions et prescriptions minimales susmentionnées.

2. Les autorités compétentes des Parties contractantes et les associations elles-mêmes peuvent introduire des conditions et des prescriptions supplémentaires et plus restrictives pour l'accès au régime TIR, à moins que les autorités compétentes n'en décident autrement.

Procédure

3. Les Parties contractantes décideront, conformément à la législation nationale, des procédures à suivre pour accéder au régime TIR sur la base des conditions et prescriptions minimales énoncées aux paragraphes 1 et 2.

4. Conformément à la formule type d'habilitation jointe (FTH), les autorités compétentes transmettent à la Commission de contrôle TIR, sous une semaine à compter de la date d'habilitation ou de retrait de l'habilitation à utiliser des Carnets TIR, les précisions voulues sur chaque personne.

5. L'association transmet chaque année une liste mise à jour au 31 décembre de toutes les personnes habilitées ainsi que de celles dont l'habilitation a été retirée. La liste est transmise aux autorités compétentes une semaine après le 31 décembre. Les autorités compétentes en communiquent une copie à la Commission de contrôle TIR.

6. L'autorisation d'accéder au régime TIR ne constitue pas en soi un droit d'obtenir des carnets TIR auprès des associations.

7. L'habilitation d'une personne à utiliser les carnets TIR conformément aux conditions et prescriptions minimales énoncées ci-dessus ne préjuge pas des responsabilités et engagements de cette personne en vertu de la Convention.

1. Het ingevolge artikel 58 ter door de Commissie van Beheer in het leven geroepen TIR Uitvoerend Comité bestaat uit negen leden van verschillende Overeenkomstsluitende Partijen. De Secretaris van de TIR-Overeenkomst woont de zittingen van de Controlecommissie bij.

2. De leden van het TIR Uitvoerend Comité worden gekozen met een meerderheid van stemmen van de aanwezige leden van de Commissie van Beheer die hun stem uitbrengen. De ambtstermijn van elk van de leden van het TIR Uitvoerend Comité is twee jaar. De leden van het TIR Uitvoerend Comité zijn herkiesbaar. Het mandaat van het TIR Uitvoerend Comité wordt opgesteld door de Commissie van Beheer.

Artikel 10

Het TIR Uitvoerend Comité:

  • a. houdt toezicht op de toepassing van de Overeenkomst, met inbegrip van het functioneren van het garantstellingssysteem, en verricht de taken die haar door de Commissie van Beheer worden toevertrouwd;

  • b. houdt toezicht op het centraal drukken en de centrale afgifte van carnets TIR aan organisaties; deze taak kan worden uitgevoerd door een in artikel 6 bedoelde erkende internationale organisatie.

  • c. coördineert en bevordert de uitwisseling van vertrouwelijke gegevens en andere informatie tussen de bevoegde autoriteiten van de Overeenkomstsluitende Partijen.

  • d. coördineert en bevordert de uitwisseling van gegevens tussen de bevoegde autoriteiten van de Overeenkomstsluitende Partijen, de organisaties en de internationale organisaties;

  • e. vergemakkelijkt de beslechting van geschillen tussen de Overeenkomstsluitende Partijen, de organisaties, de verzekeringsmaatschappijen en de internationale organisaties, onverminderd het in artikel 57 ten aanzien van de regeling van geschillen bepaalde;

  • f. ondersteunt de opleiding van het personeel van de douaneautoriteiten en de andere betrokken partijen bij de TIR-regeling;

  • g. houdt een centraal register bij voor de verspreiding, aan de Overeenkomstsluitende Partijen, van de gegevens die door de in artikel 6 bedoelde internationale organisaties worden verschaft betreffende alle door de organisaties voorgeschreven regels en procedures voor de afgifte van carnets TIR, voor zover deze betrekking hebben op de in bijlage 9 bedoelde minimumvoorwaarden en -eisen;

  • h. houdt toezicht op de prijs van de carnets TIR.

Artikel 11

1. De Secretaris van de TIR-Overeenkomst roept op verzoek van de Commissie van Beheer of van ten minste drie leden van het TIR Uitvoerend Comité een zitting van het TIR Uitvoerend Comité bijeen.

2. Het TIR Uitvoerend Comité stelt alles in het werk om beslissingen bij consensus te nemen. Indien geen consensus kan worden bereikt, wordt over de beslissingen gestemd en worden deze aangenomen met een meerderheid van de aanwezige leden die hun stem uitbrengen. Voor het nemen van beslissingen is het quorum vijf leden. De Secretaris van de TIR-Overeenkomst heeft geen stem.

3. Het TIR Uitvoerend Comité kiest een voorzitter en kan aanvullingen op het reglement van orde aannemen.

4. Ten minste eenmaal per jaar of op verzoek van de Commissie van Beheer brengt het TIR Uitvoerend Comité over zijn activiteiten verslag uit aan de Commissie van Beheer, aan wie hij eveneens een gecontroleerde jaarrekening voorlegt. Het TIR Uitvoerend Comité wordt in de Commissie van Beheer vertegenwoordigd door zijn voorzitter.

5. Het TIR Uitvoerend Comité bestudeert alle informatie en alle vragen die haar worden toegezonden door de Commissie van Beheer, de Overeenkomstsluitende Partijen, de Secretaris van de TIR-Overeenkomst, de nationale organisaties en de in artikel 6 van de Overeenkomst bedoelde internationale organisaties. Deze internationale organisaties hebben het recht om de zittingen van het TIR Uitvoerend Comité bij te wonen als waarnemer, tenzij de Voorzitter anders bepaalt. Indien nodig kan elke andere organisatie, op uitnodiging van de Voorzitter, als waarnemer de zittingen van het TIR Uitvoerend Comité bijwonen.

Artikel 12

De Secretaris van de TIR-Overeenkomst is lid van het secretariaat van de Economische Commissie voor Europa van de Verenigde Naties. Hij geeft uitvoering aan de besluiten van het TIR Uitvoerend Comité in het kader van het mandaat van het TIR Uitvoerend Comité. De Secretaris van de TIR-Overeenkomst wordt bijgestaan door een TIR-Secretariaat waarvan de omvang door de Commissie van Beheer wordt vastgesteld.

Artikel 13

1. In afwachting van de verkrijging van andere financieringsbronnen worden de activiteiten van het TIR Uitvoerend Comité en van het TIR-Secretariaat gefinancierd uit een heffing op elk carnet TIR dat door de in artikel 6 bedoelde internationale organisatie wordt afgegeven.

2. Het bedrag van de heffing en de procedure voor de inning daarvan worden door de Commissie van Beheer vastgelegd na overleg met de in artikel 6 bedoelde internationale organisatie. Elk voorstel tot wijziging van deze heffing behoeft de goedkeuring van de Commissie van Beheer."

„Bijlage 9

TOEGANG TOT DE TIR-REGELING

Deel I

BEVOEGDVERKLARING VAN DE ORGANISATIES TOT HET AFGEVEN VAN CARNETS TIR

Minimumvoorwaarden en -eisen

1. Teneinde door de Overeenkomstsluitende Partijen bevoegd te worden verklaard tot de afgifte van carnets TIR en zich garant te stellen overeenkomstig artikel 6 van de Overeenkomst, moet een organisatie voldoen aan de hieronder genoemde minimumvoorwaarden en -eisen:

  • a. Aantonen dat zij gedurende ten minste een jaar officieel werkzaam is als organisatie die de belangen van de vervoerssector behartigt.

  • b. Aantonen dat haar financiële situatie solide is en dat zij over de organisatorische middelen beschikt die haar in staat stellen aan de verplichtingen te voldoen die ingevolge deze Overeenkomst op haar rusten.

  • c. Aantonen dat haar personeel over de nodige kennis beschikt om deze Overeenkomst naar behoren toe te passen.

  • d. Geen ernstige of herhaalde overtredingen van de douane- of belastingwetten hebben begaan.

  • e. Opstelling van een schriftelijke overeenkomst of van elk ander juridisch instrument tussen haar en de bevoegde autoriteiten van de Overeenkomstsluitende Partij op het grondgebied waarvan zij is gevestigd. Een voor eensluidend gewaarmerkt afschrift van de schriftelijke overeenkomst of van elk ander juridisch instrument, indien van toepassing voorzien van een gewaarmerkte vertaling in het Engels, Frans of Russisch, dient te worden neergelegd bij het TIR Uitvoerend Comité. Elke wijziging van deze schriftelijke overeenkomst of van elk ander juridisch instrument dient onmiddellijk onder de aandacht te worden gebracht van het TIR Uitvoerend Comité.

  • f. Een verbintenis, in de schriftelijke overeenkomst of in elk ander onder e bedoeld juridisch instrument, dat de organisatie:

    • i. de in artikel 8 van de Overeenkomst vastgelegde verplichtingen zal nakomen;

    • ii. het door de Overeenkomstsluitende Partij bepaalde maximumbedrag per carnet TIR dat men van haar kan eisen overeenkomstig artikel 8, derde lid, van de Overeenkomst, zal aanvaarden;

    • iii. zorg draagt voor de permanente verificatie van de naleving van de in deel II van deze Bijlage bedoelde minimumvoorwaarden en -eisen door personen, in het bijzonder voorafgaand aan de aanvraag om deze personen bevoegd te verklaren toe te treden tot de TIR-regeling;

    • iv. zich garant stelt voor alle mogelijke aanspraken in het land op het grondgebied waarvan zij is gevestigd, ten aanzien van activiteiten die plaatsvinden onder dekking van carnets TIR die zij zelf heeft afgegeven of die zijn afgegeven door buitenlandse organisaties die zijn aangesloten bij de internationale organisatie waarbij zij zelf is aangesloten;

    • v. haar aansprakelijkheid naar tevredenheid van de bevoegde autoriteiten van de Overeenkomstsluitende Partijen op het grondgebied waarvan zij is gevestigd, afdekt bij een verzekeringsmaatschappij, bij een groep van verzekeraars of bij een financiële instelling. Het verzekeringscontract of de verzekeringscontracten of de financiële zekerheden dienen de totale aanspraken te dekken die verband houden met activiteiten die worden verricht onder dekking van carnets TIR die zij zelf heeft afgegeven of die zijn afgegeven door buitenlandse organisaties die zijn aangesloten bij dezelfde internationale organisatie waarbij zij zelf is aangesloten;

      De termijn voor de betekening van de opzegging van de verzekeringscontracten of financiële zekerheden is niet korter dan die van de betekening van de opzegging van de schriftelijke overeenkomst of van elk ander onder e bedoeld juridisch instrument. Een voor eensluidend gewaarmerkt afschrift van het verzekeringscontract of de verzekeringscontracten of van de financiële zekerheden alsmede alle latere wijzigingen hiervan, worden neergelegd bij het TIR Uitvoerend Comité, indien nodig samen met een gewaarmerkte vertaling in het Engels, Frans of Russisch;

    • vi. de bevoegde autoriteiten in staat stelt alle stukken en rekeningen te controleren die betrekking hebben op de administratie van de TIR-regeling;

    • vii. een procedure aanvaardt voor de doeltreffende beslechting van geschillen die voortkomen uit het onjuiste of frauduleuze gebruik van carnets TIR;

    • viii. aanvaardt dat elke ernstige of herhaalde schending van deze minimumvoorwaarden en -eisen leidt tot de intrekking van de bevoegdverklaring tot het afgeven van carnets TIR;

    • ix. de beslissingen van de bevoegde autoriteiten van de Overeenkomstsluitende Partij op het grondgebied waarvan zij is gevestigd met betrekking tot de uitsluiting van personen overeenkomstig het bepaalde in artikel 38 van de Overeenkomst en overeenkomstig deel II van deze Bijlage, strikt naleeft;

    • x. ermee instemt alle door de Commissie van Beheer en het TIR Uitvoerend Comité aangenomen besluiten nauwgezet uit te voeren, voor zover de bevoegde autoriteiten van de Overeenkomstsluitende Partijen op het grondgebied waarvan zij is gevestigd deze hebben aanvaard.

2. De Overeenkomstsluitende Partijen op het grondgebied waarvan de organisatie is gevestigd, trekken de bevoegdheid om carnets TIR af te geven in bij ernstige of herhaalde schending van de minimumvoorwaarden en -eisen.

3. De bevoegdverklaring van een organisatie onder de hierboven genoemde voorwaarden doet geen afbreuk aan de verantwoordelijkheden en verplichtingen die deze organisatie heeft op grond van de Overeenkomst.

4. De hieronder genoemde minimumvoorwaarden en -eisen doen geen afbreuk aan de door de Overeenkomstsluitende Partijen mogelijk voor te schrijven aanvullende voorwaarden en eisen.

Deel II

BEVOEGDVERKLARING VAN NATUURLIJKE PERSONEN EN RECHTSPERSONEN TOT HET GEBRUIK VAN CARNETS TIR

Minimumvoorwaarden en -eisen

1. De personen die toegang wensen te verkrijgen tot de TIR-regeling, dienen te voldoen aan de volgende minimumvoorwaarden en -eisen:

  • a. Aantoonbare ervaring met of, ten minste, geschiktheid voor het regelmatig verrichten van internationaal vervoer (houder van een vergunning voor internationaal vervoer, enzovoort).

  • b. Gezonde financiële situatie.

  • c. Aantoonbare kennis op het gebied van de toepassing van de TIR-Overeenkomst.

  • d. Geen ernstige of herhaalde overtredingen van de douane- of belastingwetten.

  • e. Een schriftelijke verbintenis ten opzichte van de organisatie, dat de persoon:

    • i. alle ingevolge de Overeenkomst verlangde douaneformaliteiten vervult bij de douanekantoren van vertrek, doorgang en bestemming;

    • ii. de ingevolge artikel 8, eerste en tweede lid, van de Overeenkomst, verschuldigde bedragen betaalt, indien de bevoegde autoriteiten dit eisen, overeenkomstig artikel 8, zevende lid, van de Overeenkomst;

    • iii. voor zover de nationale wetgeving dit toelaat, de organisaties toestaat de gegevens met betrekking tot de hierboven genoemde minimumvoorwaarden en -eisen te verifiëren.

2. De bevoegde autoriteiten van de Overeenkomstsluitende Partijen en de organisaties zelf kunnen aanvullende en meer beperkende voorwaarden en eisen invoeren voor de toegang tot de TIR-regeling, tenzij de bevoegde autoriteiten anders bepalen.

Procedure

3. De Overeenkomstsluitende Partijen besluiten, in overeenstemming met de nationale wetgeving, welke procedures moeten worden gevolgd om toegang te verkrijgen tot de TIR-regeling op basis van de in het eerste en tweede lid bedoelde minimumvoorwaarden en -eisen.

4. Overeenkomstig het standaardmodel van het bevoegdverklaringsformulier (SBF) doen de bevoegde autoriteiten binnen een week, te rekenen vanaf de datum van bevoegdverklaring of van de intrekking van de bevoegdverklaring om carnets TIR te gebruiken, de van iedere persoon verlangde gegevens aan het TIR Uitvoerend Comité toekomen.

5. De organisatie verstuurt elk jaar een tot en met 31 december bijgewerkte lijst van alle bevoegd verklaarde personen alsmede van de personen wier bevoegdverklaring is ingetrokken. Deze lijst wordt een week na 31 december aan de bevoegde autoriteiten gezonden. De bevoegde autoriteiten doen hiervan een afschrift toekomen aan het TIR Uitvoerend Comité.

6. De bevoegdverklaring om toe te treden tot de TIR-regeling houdt op zichzelf geen recht in op de verkrijging van carnets TIR bij de organisaties.

7. De bevoegdverklaring van een persoon om carnets TIR te gebruiken in overeenstemming met de hierboven bedoelde minimumvoorwaarden en -eisen laat de verantwoordelijkheden en verplichtingen die krachtens de Overeenkomst op deze persoon rusten, onverlet.

Ten aanzien van elke persoon voor wie door de erkende organisatie een aanvraag tot bevoegdverklaring wordt ingediend, dienen ten minste de volgende gegevens aan de bevoegde autoriteiten te worden verschaft:

– Individueel en uniek identificatienummer (ID-nummer) dat aan de persoon wordt toegekend door de zich garant stellende organisatie (in samenwerking met de internationale organisatie waarbij zij is aangesloten).

– De naam- en adresgegevens van de persoon of personen of van de onderneming (voor commerciële organisaties eveneens de namen van de verantwoordelijke bestuurders opgeven).

– Contactpunt (natuurlijke persoon die bevoegd is aan de douane-autoriteiten en aan de organisaties inlichtingen te verschaffen betreffende de TIR-regeling) met volledige vermelding van de telefoonnummers, faxnummers en e-mailadressen.

– Handelsregistratienummer of vergunningsnummer internationaal vervoer of anderszins (indien beschikbaar).

– (Indien van toepassing) Eerdere intrekking van de bevoegdverklaring, met inbegrip van de datum, de duur en de aard van deze intrekking.


De wijziging van bijlage 6 behoeft ingevolge artikel 7, onderdeel f, van de Rijkswet goedkeuring en bekendmaking verdragen niet de goedkeuring van de Staten-Generaal.

De wijziging van bijlage 8 en de nieuwe bijlage 9 behoeven ingevolge artikel 91 van de Grondwet de goedkeuring van de Staten-Generaal, alvorens het Koninkrijk de wijziging en de bijlage kan aanvaarden.
