Het in de brieven vervatte administratief akkoord is ingevolge het gestelde in de in rubriek I hieronder afgedrukte brieven op 1 januari 1997 buiten werking getreden.

I. OPZEGGING

Het in de brieven vervatte administratief akkoord is opgezegd per 1 januari 1997 bij de volgende briefwisseling:

I have the honour to refer to the exchange of letters of 8 and 28 January 1976 and of 18 July and 18 October 1983 between the competent authorities of the United Kingdom of Great Britain and Northern Ireland and Gibraltar and of the Netherlands regarding Article 70(3) of Regulation 1408/71.

The 1976 agreement provided for the waiving of reimbursement of the costs of unemployment benefits paid in accordance with Article 69(1) of Regulation 1408/71.

The 1983 agreement provided for the exclusion from this waiver agreement of self-employed people moving between the Netherlands and Gibraltar.

Having reviewed the 1976 agreement insofar as it refers to the waiving of the costs of unemployment benefits provided in accordance with Article 69 of the said Regulation 1408/71, the competent authorities of the United Kingdom of Great Britain and Norhern Ireland and of Gibraltar wish to advise the competent authority of the Netherlands that they would like to revise the present arrangements insofar as they relate to the waiver of such costs.

I have the honour to advise you that it is proposed that reimbursement of the cost of unemployment benefits provided in accordance with the provisions of Article 69(1) of Regulation 1408/71 should be effected in all cases in accordance with Article 70(1) and (2) of Regulation 1408/71 and 97(1) of Regulation 574/72. This change is to be operative from 1 January 1997. However, where the period of three months under Article 69(1)(c) starts before, and ends on or after, 1 January 1997, the institutions concerned will waive the costs of providing these benefits for the whole of that period.

If the foregoing is acceptable to the competent authorities of The Netherlands, I have the honour to propose that this letter together with your reply to that effect will place on record the understanding of the competent authorities on this matter.

Sir,

In your letter of 17 December 1996 you refer to the exchange of letters of January 1976 between the competent authorities of the United Kingdom of Great Britain and Norhern Ireland and of Gibraltar, and of The Netherlands.

You propose that, from the 1 January 1997, reimbursement of the cost of unemployment benefits provided in accordance with the provisions of Article 69(1) of Regulation 1408/71 should be effected in accordance with Article 70(1) and (2) of Regulation 1408/71 and Article 97/1 of Regulation 574/72. However, where the three months' period under Article 69(1)(c) starts, before, and ends on or after 1 January 1997, the institutions concerned will waive the costs of providing these benefits for the whole of that period.

I have the honour to confirm the foregoing accords with the understanding of the competent authority of the Netherlands and that your letter together with my reply to that effect be regarded as placing on record the understanding of the competent authorites in this matter.
